The notion of Leitkultur has been used in German immigration debates to capture the idea that our living arrangements ought to be shaped by shared cultural identity. Leitkultur contrasts with a multiculturalism that sees multiple cultures side-by-side on equal terms. We should replace Leitkultur with Orientierungskultur, a notionwhose introduction is overdue. German philosophy, especially Kant, has bestowed an intellectual meaning upon an originally geographical notion that is already ubiquitous, making ‘Orientierungskultur’ a natural construct. That notion allows us to say there (...) is an inevitably amorphous but recognizable German culture whose prominence in public life provides a grounding for many and prevents them from feeling alienated from the society they helped build; at the same time, for some domains of public life not participating in default behavior is not merely tolerated but acknowledged as a genuine alternative. This essay reconstructs the place of utopia in realist political theory, by examining the ways in which the literary genre of critical utopias can productively unsettle ongoing discussions about “how to do political theory.” I start by analyzing two prominent accounts of the relationship between realism and utopia: “real utopia” (Erik Olin Wright et al.) and “dystopic liberalism” (Judith Shklar et al.). Elaborating on Raymond Geuss’s recent reflections, the essay then claims that an engagement with literature can shift the focus (...) of these accounts. Utopian fiction, I maintain, is useful for comprehending what is (thus enhancing our understanding of the world) and for contemplating what might be (thus nurturing the hope for a better future). Ursula K. Le Guin’s novel The Dispossessed deploys this double function in an exemplary fashion: through her dynamic and open-ended portrayal of an Anarchist community, Le Guin succeeds in imagining a utopia that negates the status quo, without striving to construct a perfect society. The book’s radical, yet ambiguous, narrative hence reveals a strategy for locating utopia within realist political theory that moves beyond the positions dominating the current debate. Reading The Dispossessed ultimately demonstrates that realism without utopia is status quo–affirming, while utopia without realism is wishful thinking. (shrink)

The article investigates Giorgio Agamben’s turn to, and radicalization of, Foucault’s concept of governmentality, which Agamben argues constitutes a ’decisive point’ in the Homo sacer-series. The article shows that in the investigation of the Trinitarian oikonomia, Agamben finds the point of intersection between the ‘totalizing procedures’ of the state and ‘individualizing techniques’ of biopolitics thereby disclosing the ‘zone of indistinction’ between sovereignty and government and politics and economy, which constitutes power in the West. Furthermore, the article argues that Agamben shows (...) how the economy is not something distinct from politics, encroaching on its logic, but rather how the governmental paradigm of the West constitutes the continual administration of the given, the continual and perpetual government of the economy and thereby of the existing economic and political power-relations. In legal academia it is highly controversial how to ‘be original’ in legal research. This article will try to maintain an attitude of tolerance in not promoting or discrediting one particular methodology. Instead, it will identify four different ways of ‘being original’. Perhaps the most common approach is to deal with ‘micro-legal questions’. Many legal academics also pursue research in ‘macro-legal questions’. Less common but growing is the importance of ‘scientific legal research’ and research in ‘non-legal topics’.

ion and Ideation - The Semantics of chemical and biological fundamental concepts. The methods of abstraction and ideation are indispensable tools to introduce new concepts in a scientific terminology. The latter is paradigmatically introduced within the 'protophysical program' whereas abstraction is commonly applied in logics and mathematics. The application within the reconstruction of chemistry and biology causes several problems. Ideation appears to be inadequate whereas the application of abstraction necessitates a critical and minute examination of the corresponding equivalence relations. These (...) problems are solved by the introduction of the method of materially-synthetic abstraction which is exemplified by the introduction of the chemical concept of 'substance' and the biological concept of 'hereditary factor'. In one of his brilliant essays, Gilbert Keith Chesterton—famous English author of the early twentieth century and master of paradoxical reasoning in his intellectual battle for the truth of Christianity1—outlines the fascinating story of a very strange adventurer. Having completely lost orientation after a long, stormy journey, this adventurer reaches the safe shores of his homeland, proudly believing to have discovered a yet-unknown country. Even stranger and more fantastic is his constant astonishment in rediscovering exactly those places, people, and things (...) that had actually always been part of his everyday life. We find problems with Vaesen's treatment of the primatological research, in particular his analysis of foresight, function representation, and social intelligence. We argue that his criticism of research on foresight in great apes is misguided. His claim that primates do not attach functions to particular objects is also problematic. Finally, his analysis of theory of mind neglects many distinctions.

It is known that Kierkegaard’s relation to politics was problematic and marked by a somewhat reactionary stance. The nature of this problematic relation, however, will be shown to lie in the tension between his double skepticism of the order of establishment [det Bestående] on the one hand, and the political associations of his age on the other. In this tension he is immersed, trembling between Scylla and Charybdis. On the one hand Kierkegaard is hesitant to support the progressive political movements (...) of the time due to his skepticism about the principle of association in the socio-psychological climate of leveling and envy. On the other hand, his dubious support of the order of the establishment, in particular the Church and Bishop Mynster, becomes increasingly problematic. The importance of 1848 is crucial in this regard since this year marks the decisive turn in Kierkegaard’s authorship. Using the letters to Kolderup-Rosenvinge in the wake of the cataclysmic events of 1848 as my point of departure, I wish to elucidate the pathway towards what Kierkegaard himself understands as his Socratic mission. Mathias Frisch provides the first sustained philosophical discussion of conceptual problems in classical particle-field theories. Part of the book focuses on the problem of a satisfactory equation of motion for charged particles interacting with electromagnetic fields. As Frisch shows, the standard equation of motion results in a mathematically inconsistent theory, yet there is no fully consistent and conceptually unproblematic alternative theory. Frisch describes in detail how the search for a fundamental equation of motion is partly driven by pragmatic considerations (...) (like simplicity and mathematical tractability) that can override the aim for full consistency. The book also offers a comprehensive review and criticism of both the physical and philosophical literature on the temporal asymmetry exhibited by electromagnetic radiation fields, including Einstein's discussion of the asymmetry and Wheeler and Feynman's influential absorber theory of radiation. Frisch argues that attempts to derive the asymmetry from thermodynamic or cosmological considerations fail and proposes that we should understand the asymmetry as due to a fundamental causal constraint. The book's overarching philosophical thesis is that standard philosophical accounts that strictly identify scientific theories with a mathematical formalism and a mapping function specifying the theory's ontology are inadequate, since they permit neither inconsistent yet genuinely successful theories nor thick causal notions to be part of fundamental physics. Zusammenfassung Mit Beginn der Spielzeit 2013/14 traten alle Maßnahmen des UEFA Financial Fair Play-Konzeptes in Kraft. Vornehmliches Ziel dieses regulatorischen Eingriffs ist es, der wachsenden Verschuldungs­rate auf Seiten der europäischen Vereine sowie der zunehmenden Abhängigkeit von Investoren entgegenzusteuern. Um die Effektivität und Effizienz solcher Maßnahmen zu erhöhen, ist ein tief­gehendes Verständnis der institutionellen Rahmenbedingungen unabdingbar. Vor diesem Hinter­grund beschreibt und interpretiert der konzeptionelle Artikel das Verhältnis zwischen der UEFA und den Klubs mit Hilfe eines institutionenökonomischen Instrumentariums. Aus verfügungsrecht­licher Sicht wird (...) eine Verschiebung der Eigentums- und Machtverhältnisse zu Ungunsten der UEFA skizziert. Weiter zeigt sich, dass die Beziehung zwischen dem Dachverband und den Vereinen in vielen Aspekten einer klassischen Principal-Agent-Dyade entspricht. Die vorliegende Analyse baut diesbezüglich auf einer vorherigen Fallstudie von Schubert auf und entwickelt dessen Modell weiter. Die von der UEFA im Rahmen von Financial Fair Play verfolgte Strategie wird evaluiert, um daraus theoriebasiert handlungsleitende Gestaltungsempfehlungen zur Steigerung der Wirksamkeit des regulatorischen Eingriffs abzuleiten. In What Is Philosophy? we find philosophy devised as that power of thinking and creating which, in a division of labour with science and art, creates the concept. This division of labour points to the free interplay of Reason, Understanding and Imagination in Kant's Critique of Judgement and enables us to affirm, without obliterating the differences in kind, the non-hierarchical relationship between the three forms of thought that is asserted by Deleuze and Guattari. However, as powers of thinking and creating, (...) philosophy, science and art do not inscribe themselves in a transcendental subject. Rather, Deleuze and Guattari conceive of them, following Spinoza's ‘creating nature’, as powers that express themselves in an attribute in which every thinking subject participates. (shrink)

Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

The associative theory of creativity states that creativity is associated with differences in the structure of semantic memory, whereas the executive theory of creativity emphasises the role of top-down control for creative thought. For a powerful test of these accounts, individual semantic memory structure was modelled with a novel method based on semantic relatedness judgements and different criteria for network filtering were compared. The executive account was supported by a correlation between creative ability and broad retrieval ability. The associative account (...) was independently supported, when network filtering was based on a relatedness threshold, but not when it was based on a fixed edge number or on the analysis of weighted networks. In the former case, creative ability was associated with shorter average path lengths and higher clustering of the network, suggesting that the semantic networks of creative people show higher small-worldness. One of the core tenets of cognitive metaphor theory is the claim that metaphors ground abstract knowledge in concrete, first-hand experience. In this paper, I argue that this grounding hypothesis contains some problematic conceptual ambiguities and, under many reasonable interpretations, empirical difficulties. I present evidence that there are foundational obstacles to defining a coherent and cognitively valid concept of “metaphor” and “concrete meaning,” and some general problems with singling out certain domains of experience as more immediate than others. I conclude (...) from these considerations that whatever the facts are about the comprehension of individual metaphors, the available evidence is incompatible with the notion of an underlying conceptual structure organized according to the immediacy of experience. Phillips argues that blindsight is due to response criterion artefacts under degraded conscious vision. His view provides alternative explanations for some studies, but may not work well when one considers several key findings in conjunction. Empirically, not all criterion effects are decidedly non-perceptual. Awareness is not completely abolished for some stimuli, in some patients. But in other cases, it was clearly impaired relative to the corresponding visual sensitivity. This relative dissociation is what makes blindsight so important and interesting.

We argue that the two temporal cognition systems are conceptually too confined to be helpful in understanding the evolution of temporal cognition. In fact, we doubt there are two systems. In relation to this, we question that the authors did not describe the results of our planning study on ravens correctly, as this is of consequence to their theory.

Deepfakes are a new form of synthetic media that broke upon the world in 2017. Bringing photoshopping to video, deepfakes replace people in existing videos with someone else’s likeness. Currently most of their reach is limited to pornography, and they are also used to discredit people. However, deepfake technology has many epistemic promises and perils, which concern how we fare as knowers. Our goal is to help set an agenda around these matters, to make sure this technology can help realize (...) epistemic rights and epistemic justice and unleash human creativity, rather than inflict epistemic wrongs of any sort. Our project is exploratory in nature, and we do not aim to offer conclusive answers at this early stage. There is a need to remain vigilant to make sure the downsides do not outweigh the upsides, and that will be a tall order. (shrink)

Much has been written on the role of causal notions and causal reasoning in the so-called 'special sciences' and in common sense. But does causal reasoning also play a role in physics? Mathias Frisch argues that, contrary to what influential philosophical arguments purport to show, the answer is yes. Time-asymmetric causal structures are as integral a part of the representational toolkit of physics as a theory's dynamical equations. Frisch develops his argument partly through a critique of anti-causal arguments and (...) partly through a detailed examination of actual examples of causal notions in physics, including causal principles invoked in linear response theory and in representations of radiation phenomena. Offering a new perspective on the nature of scientific theories and causal reasoning, this book will be of interest to professional philosophers, graduate students, and anyone interested in the role of causal thinking in science.
