The aim of this paper is to provide some insights for a normative theory of corporate political activities. Such a theory aims to provide theoretical tools to investigate the legitimacy of corporate political involvement and allows us to determine which political activities and relations with government regulators are appropriate or inappropriate, permissible or impermissible, obligatory or forbidden for corporations. After having explored what I call the “normative presumption of legitimacy” of CPAs, this paper identifies three different plausible strategies to criticize (...) and object to corporate political involvement: the “egalitarian” strategy, the “corporate citizenship” strategy, and the “market failures” strategy. It constitutes an attempt to develop the market failures approach to reflect on CPAs. My main claim is that within such an account, the idea that corporations have a license to operate considerably limits their right to engage in political activities. (shrink)

ABSTRACT: What kinds of markets, market regulations, and business organizations are compatible with contemporary egalitarian theories of justice? This article argues that any thoughtful answer to this question will have to draw on recent developments in political philosophy that are concerned not only with the equality of the distribution of core goods but also with the requirements for equality of status, voice, and so on, in the relations between individuals and within organizations. The dominance of theories of distributive justice in (...) egalitarian political philosophy since Rawls may have contributed, on the one hand, to the oft-recognized gulf between these theories and their theorists and, on the other, to discussions of corporate governance and business ethics. The main purpose of this article is to introduce business ethicists to some of the less-familiar features of recent relational theories of justice and equality, and to suggest that some of these notions may help bridge the gap between business ethics and political philosophy more generally. Studying the funny trends within historically marginalized populations has historically been used as a means of making them seem nonthreatening to dominant cultures. Scholars, furthermore, have often applied dominant-culture contexts toward reading minority artifacts without taking the time to understand the premises for other cultures’ funny enthymemes. This paper proposes two solutions to the dilemma of recognizing the importance of representing marginalized populations’ humor in the scholarly canon but also studying those funny artifacts with a mind toward ethics, using Native (...) This article seeks to offer a socially and politically situated analysis of the disenchantment produced by sociological research categorised as critical. It offers a step-by-step comparison of how a study on voluntary work (that produced disenchantment for some, truism for others) was received. It also gives weight to the fact that a research process can also lead to the politicisation of research. The article sheds light on two arguments for the autonomy of engagement that lies at the heart of the (...) critique of a critique: one concerning the autonomy of the actors’ “citizen engagement” and of their relation to work, and the other concerning the autonomy of the researcher’s work and its “commitments”, generally presented as “research neutrality”. This reflexive attention to the effects of the research investigation not only on others but also on the author of the research ultimately questions the social and political scope of the “conception of hostile worlds” inscribed in the “doctrine of separated spheres” of work and commitment that, in the present case, concerns both the object and the practice of research. What, if anything, is wrong with high executive compensation? Is the common “lay reaction” of indignation and moral outrage justified? In this paper, my main goal is to articulate in a more systematic and philosophical manner the egalitarian responses to these questions. In order to do so, I suggest that we take some insights from recent debates on two versions of egalitarianism: a distributive one, according to which no one should be worse off than others because of unfair distributions of (...) goods and resources, especially ones based on matters of luck or arbitrary factors, and a relational one, which maintains that egalitarian justice requires members of a society to relate to one another as equals. Drawing on recent attempts to highlight the tricky nature of managerial authority, I argue that high inequalities in pay are not simply a distributional matter but should also be analyzed through a relational lens. I also attempt to show that relational egalitarians are well-equipped to question the now dominant “incentives” view of CEO compensation. (shrink)

Clinical trials emerged in rapid succession as the COVID-19 pandemic created an unprecedented need for life-saving therapies. Fair and equitable subject selection in clinical trials offering investigational therapies ought to be an urgent moral concern. Subject selection determines the distribution of risks and benefits, and impacts the applicability of the study results for the larger population. While Research Ethics Committees monitor fair subject selection within each trial, no standard oversight exists for subject selection across multiple trials for the same disease. (...) Drawing on the experience of multiple clinical trials at a single academic medical centre in the USA, we posit that concurrent COVID-19 trials are liable to unfair and inequitable subject selection on account of scientific uncertainty, lack of transparency, scarcity and, lastly, structural barriers to equity compounded by implicit bias. To address the critical gap in the current literature and international regulation, we propose new ethical guidelines for research design and conduct that bolsters fair and equitable subject selection. Although the proposed guidelines are tailored to the research design and protocol of concurrent trials in the COVID-19 pandemic, they may have broader relevance to single COVID-19 trials. (shrink)

Petre died shortly after completing this short biography, and the text begins with a note on her life by James A. Walker. According to Holmes, it represents a good representation of Sill's belief about the continuity of the human soul. This was the subject of the extended conversations presented in this work. Sill's nature was deeply spiritual, highly intellectual and bordered on the mystical. He possessed one of the most brilliant and well-trained minds Holmes had ever known. The nature of poetic truth, and of the belief claimed by poetry, has become for many thinkers a question of keener interest through the discussions of Dr. I. A. Richards. In a recent article in this Journal,1 Dr. Helen Wodehouse has expressed her own view, elicited in relation to that of Dr. Richards, concerning truth in poetry. She urges that “a great poem seems sometimes centrally to be showing us the full measure and nature of some aspect of the actual (...) world.” Our response involves essentially an element of belief in something revealed as rooted in reality, laying necessity upon the poet; even though that belief may not attach to all that the poet accepted as fact, and though we may be unable to formulate in reflective terms the nature of the truth discerned. In 2017, Steven Gimbel published Isn’t That Clever: A Philosophical Account of Humor and Comedy. This book proposes, among other vastly interesting notions, a definition of humor that eschews audience reactions in favor of focusing exclusively on the craft and intention of the responsible comedian. This article intends to provoke that definition and show why humorous performances cannot be crafted without an audience-centric mindset, proving Gimbel’s notion problematic at best. To poke this definition, I draw on the American Folk Humor (...) tradition and compare its historic roots with modern tourist attractions that on the surface appear to channel its spirit. These include the Hoop-Dee-Doo Revue dinner show at Walt Disney World and The Brewery Follies at Virginia City, Montana. After showcasing the differences between these modern performances and the tradition they pretend to espouse, I conclude that Gimbel’s theory cannot account for the evolution of a funny genre. Décrire adéquatement la signification d’un terme, ou d’un énoncé, suppose souvent de faire appel au co-texte ou au contexte. Le linguiste doit alors recourir à des corpus authentiques et proposer des procédures de contextualisation. Une telle démarche, que l’on peut à bon droit qualifier d’étique, est loin d’être suffisante. Elle ne tient pas compte des stratégies de contextualisation et de recontextualisation des discours par les locuteurs eux-mêmes, sans aucun doute liées à l’existence d’une compétence métalinguistique et métapragmatique. La contextualisation est (...) donc aussi un problème émique. Dans le cadre d’une enquête ethnographique au sein d’une troupe de théâtre, incluant l’observation et l’enregistrement audiovisuel des différentes activités des comédiens, on s’est intéressé aux phases de travail théâtral – lecture à la table et répétitions – pendant lesquelles les participants se confrontent à des textes qui leur posent des difficultés d’interprétation. Face à des énoncés dont la signification ne fait pas nécessairement problème, mais dont le sens en contexte peut sembler problématique, les comédiens et les metteurs en scène sont amenés à devoir recontextualiser. Nous étudierons ces pratiques de contextualisation, leur émergence – soit parce que les participants l’exigent, soit parce que les locuteurs eux-mêmes en éprouvent la nécessité pour parvenir à une pertinence communicative plus forte – en en soulignant la dimension collective. The contemporary books of Cassius Dio's Roman History are known for their anecdotal quality and lack of interpretive sophistication. This paper aims to recuperate another layer of meaning for Dio's anecdotes by examining episodes in his contemporary books that feature masquerades and impersonation. It suggests that these themes owe their prominence to political conditions in Dio's lifetime, particularly the revival, after a hundred-year lapse, of usurpation and damnatio memoriae, practices that rendered personal identity problematic. The central claim is that narratives (...) in Dio's last books use masquerades and impersonation to explore paradoxes of personal identity and signification, issues made salient by abrupt changes of social status at the highest levels of imperial society. Despite the rapid adoption of technology in human resource departments, there is little empirical work that examines the potential challenges of algorithmic decision-making in the recruitment process. In this paper, we take the perspective of job applicants and examine how they perceive the use of algorithms in selection and recruitment. Across four studies on Amazon Mechanical Turk, we show that people in the role of a job applicant perceive algorithm-driven recruitment processes as less fair compared to human only or algorithm-assisted (...) human processes. This effect persists regardless of whether the outcome is favorable to the applicant or not. A potential mechanism underlying algorithm resistance is the belief that algorithms will not be able to recognize their uniqueness as a candidate. Although the use of algorithms has several benefits for organizations such as improved efficiency and bias reduction, our results highlight a potential cost of using them to screen potential employees during recruitment. Mon objectif dans cet article est de mieux cerner les contours d’une conception institutionnelle de la corruption. Je tenterai de contribuer à ce programme de recherches sur la corruption institutionnelle d’une double façon. Premièrement, j’essaierai de clarifier le concept de « corruption institutionnelle » en mettant en lumière quatre de ses principales caractéristiques et certains de ses avantages. Deuxièmement, je tenterai d’exposer trois problèmes auxquels sont confrontés ses partisans : les problèmes de la portée, du faux-diagnostic et de l’essentialisme. Malgré (...) la sympathie que j’ai pour cette approche, j’espère montrer qu’elle recèle certains points problématiques. Background In June 2016, the Parliament of Canada passed federal legislation allowing eligible adults to request Medical Assistance in Dying (MAID). Since its implementation, there likely exists a degree of hesitancy among some healthcare providers due to the law being inconsistent with personal beliefs and values. It is imperative to explore how nurses in Quebec experience the shift from accompanying palliative clients through “a natural death” to participating in “a premeditated death.” Research question/aim/objectives This study aims to explore how Quebec (...) nurses personally and professionally face the new practice of MAID and their role evolution. Research design A grounded theory design was used. Participants and research context We recruited 37 nurses who participated in or coordinated at least one MAID. Semi-structured interviews and focus groups were conducted and audiotaped. Data collection and analysis followed Strauss and Corbin steps. Ethical considerations Ethics approval was received from the investigator’s affiliated University. Participants were informed regarding the research goal, signed a written consent, and were assigned pseudonyms. Findings/results Results show that nurses experienced the wide range of paradoxe during MAID centering around the following eight elements: 1) confrontation abouth death, 2) choice, 3) time of death, 4) emotional load, 5) new Bill, 6) relationship with the person, 7) communication skills, and 8) healthcare setting. The shifting of views and values in this new role is presented by the contradiction of opposites. Conclusions A better understanding of the paradox experienced by nurses involved with MAID paves the way for the development of interventions. (shrink)

This paper investigates sun‑dried mudbrick architecture in the Minoan Palace at Malia on the north coast of Crete (Greece), excavated and studied by the French School at Athens since the beginning of the 20th century. Macroscopic study of the standing architectural remains is combined with geochemical (pXRF and XRD) and petrographic analyses of a selection of mudbrick samples in order to explore patterns and variations in bricklaying, mudbrick recipes, manufacturing practices and mudbrick performance throughout the Pre‑, Proto‑ and Neopalatial periods (...) (2450-1430 BCE). The microscopic composition of the mudbricks highlights the consistent procurement of local raw materials, despite marked differences in macroscopic composition related to varying manufacturing processes that impacted mudbrick performance. This diversity is important enough to indicate the completion of the Neopalatial building project by separate teams of builders, whose skills seem to have varied markedly. The participation in the Neopalatial building project of specialised mudbrick ‘master’ builders is attested but the workforce was also drawn from the site’s inhabitants who had the requisite knowledge to produce standing, though significantly less‑well performing, mudbrick walls. Une série de blocs en calcaire cristallin gris noir et gréseux gris ont été découverts remployés sous la forme d’éléments architectoniques divers (bases de colonnes, seuils, marches ou linteaux par exemple) au sein du palais néopalatial de Malia. Leur observation détaillée a permis de déterminer qu’ils provenaient d’une assise de nivellement dans la façade Ouest du palais détruit à la fin de la période protopalatiale. Les matériaux utilisés et le soin apporté au façonnage des blocs illustrent la qualité du projet (...) architectural. Leur restitution au sein du palais protopalatial de Malia met également en évidence le parallèle avec les façades Ouest des palais de Knossos et Phaistos, et suggère l’existence d’une communauté de pratiques architecturales entre les différents palais crétois au Protopalatial. Est envisagée ici la pauvreté du corpus funéraire néopalatial (1650/ 1640 -1440/ 1430), en même temps que les différents facteurs, naturels et culturels, susceptibles d’en être la cause. On suggère l’exposition des corps ou leur dépôt sommaire dans des cavités naturelles, dans le prolongement de pratiques crétoises anciennes, à l’origine de leur rareté dans le paysage archéologique au Néopalatial. La sphère palatiale semble désormais offrir un cadre rituel plus adapté aux besoins de la population et participe au désintérêt pour des (...) cadres funéraires monumentaux caractéristiques des époques pré-et protopalatiale. Parallèlement à la pauvreté du corpus, les pratiques funéraires néanmoins identifiées sont explorées. On met en exergue la diversité des cadres funéraires, leur contenu matériel et les pratiques rituelles dont ils faisaient l’objet. (shrink)

The development of in vitro fertilisation (IVF) as a treatment for human infertilty was among the most controversial medical achievements of the modern era. In Ireland, the fate and status of supranumary (non-transferred) embryos derived from IVF brings challenges both for clinical practice and public health policy because there is no judicial or legislative framework in place to address the medical, scientific, or ethical uncertainties. Complex legal issues exist regarding informed consent and ownership of embryos, particularly the use of non-transferred (...) embryos if a couple separates or divorces. But since case law is only beginning to emerge from outside Ireland and because legislation on IVF and human embryo status is entirely absent here, this matter is poised to raise contractual, constitutional and property law issues at the highest level. Our analysis examines this medico-legal challenge in an Irish context, and summarises key decisions on this issue rendered from other jurisdictions. The contractual issues raised by the Roche case regarding informed consent and the implications the initial judgment may have for future disputes over embryos are also discussed. Our research also considers a putative Constitutional 'right to procreate' and the implications EU law may have for an Irish case concerning the fate of frozen embryos. Since current Medical Council guidelines are insufficient to ensure appropriate regulation of the advanced reproductive technologies in Ireland, the report of the Commission on Assisted Human Reproduction is most likely to influence embryo custody disputes. Public policy requires the establishment and implementation of a more comprehensive legislative framework within which assisted reproductive medical services are offered. (shrink)
