Researchers, when engaging with Māori communities, are in a process of relationship building and this process can be guided by the principles of the Treaty of Waitangi, partnership, participation and protection. The main concerns for many indigenous peoples in research revolve around respect for their indigenous rights, control over research processes and reciprocity within research relationships to ensure that equitable benefits are realised within indigenous groups. Māori have identified similar issues and these concerns can be aligned with the principles of (...) the Treaty of Waitangi. The relevance of the Treaty of Waitangi to research ethics is discussed and this paper suggests a revised interpretation of the treaty principles to incorporate the range of ethical issues that Māori have expressed as important. Whakapapa is the foundation of traditional Māori social structure and it perpetuates a value base that locates people through their relationships to the physical and spiritual worlds. As part of a new envirogenomics research programme, researchers at the Institute of Environmental Science and Research (ESR) are developing a study with an iwi (tribe) to identify combinations of genetic and environmental factors that may contribute to current health status. A major objective of this study is to utilise whakapapa (genealogical information) to (...) explore patterns of genetic variation unique to the iwi and to correlate these with potential disease or ill health. Genetic testing and screening raises numerous ethical issues, particularly when indigenous peoples are the subjects. This paper will outline ESR’s strategy for addressing indigenous concerns about genetic testing and how whakapapa forms an integral part of the envirogenomics research programme. (shrink)

He explores non-theistic reasons in the first chapter and theistic ones towards the end; in the intervening sections he inquires into a variety of puzzles in the metaphysics of material objects that are either generated by the hypothesis of hyperspace or else informed by it, with discussions of receptacles, boundaries, contact, occupation, and superluminal motion. In recent years, the value-freeness of science has come under extensive critique. Early objectors to the notion of value-free science can be found in Rudner and Churchman, later objections occur in Leach and Gaa, and more recent critics are Kitcher, Douglas, and Elliott. The goal of this paper is to examine and critique two arguments opposed to the notion of a value-free science. The first argument, the uncertainty argument, cites the endemic uncertainty of science and concludes that values are needed (...) to give direction to scientific investigation. Hud Hudson shows that apparently irreconcilable conflicts between science and religion often turn out to be misdescribed battles about negotiable philosophical assumptions. He defends an original Hypertime Hypothesis which reconciles the Christian doctrines of The Fall and Original Sin with reigning scientific orthodoxy.

Secession and the civil war that followed are often regarded as having exclusively structural determinants, expressed in political cleavages. From this point of view, these events are explained, variously, by the rise of abolitionism in the North or sectionalism in the Union or some cultural attribute of the South. This focus gets us part of the way in understanding the events that led to secession, the creation of a Southern Confederacy, and civil war, but this interpretation says too little about (...) precisely how these events and processes played out. Secession occurred in time, sequentially and dynamically, with one state leading and other states following. This article offers a processual specification of the conditions of Southern secession and the creation of a Southern Confederacy. It does so by focusing on mobilization within the vanguard state, South Carolina, and the consequences of this activity for other Southern states. (shrink)

Hud Hudson presents an innovative view of the metaphysics of human persons according to which human persons are material objects but not human organisms. In developing his account, he formulates and defends a unique collection of positions on parthood, persistence, vagueness, composition, identity, and various puzzles of material constitution. The author also applies his materialist metaphysics to issues in ethics and in the philosophy of religion. He examines the implications for ethics of his metaphysical views for standard arguments addressing (...) the moral permissibility of our treatment of human persons and their parts, fetuses and infants, the irreversibly comatose, and corpses. He argues that his metaphysics provides the best foundation in the philosophy of religion for the Christian doctrine of the resurrection of the body. Hudson addresses a broad range of metaphysical issues, but among his most strikingly original contributions are his defense of the "Partist" view and his argument for the compatibility of Christianity with a materialistic theory of human persons. In Seeing Things, Robert Hudson assesses a common way of arguing about observation reports called "robustness reasoning." Robustness reasoning claims that an observation report is more likely to be true if the report is produced by multiple, independent sources. Seeing Things argues that robustness reasoning lacks the special value it is often claimed to have. Hudson exposes key flaws in various popular philosophical defenses of robustness reasoning. This philosophical critique of robustness is extended by recounting five episodes in (...) the history of science (from experimental microbiology, atomic theory, astrophysics, and astronomy) where robustness reasoning is — or could be claimed to have been — used. Hudson goes on to show that none of these episodes do in fact exhibit robustness reasoning. In this way, the significance of robustness reasoning is rebutted on both philosophical and historical grounds. But the book does more than critique robustness reasoning. It also develops a better defense of the informative value of observation reports. The book concludes by relating insights into the failure of robustness reasoning to a popular approach to scientific realism called "(theoretical) preservationism." Hudson argues that those who defend this approach to realism commit similar errors to those who advocate robustness reasoning. In turn, a new form of realism is formulated and defended. Called "methodological preservationism," it recognizes the fundamental value of naked-eye observation to scientists — and the rest of us. (shrink)

It challenges the widely-held view that language is an innate mental module with its own special internal organization. In an important 2006 paper, Nishi Shah defends ‘evidentialism’, the position that only evidence for a proposition’s truth constitutes a reason to believe this proposition. In opposition to Shah, Anthony Robert Booth, Andrew Reisner and Asbjørn Steglich-Petersen argue that things other than evidence of truth, so-called non-evidential or ‘pragmatic’ reasons, constitute reasons to believe a proposition. I argue that we can effectively respond to Shah’s pragmatist critics if, following Shah, we are careful to distinguish the evaluation of the reasons for (...) a belief from the process of actually forming a belief and allowing it to influence action. Drawing this distinction is assisted if we utilize Rudolf Carnap’s probabilistic interpretation of what it means to be disposed to believe a claim. (shrink)

I want to put forward a certain view of the logical foundation of religious belief. It is, in a sentence, the view that religious belief is constituted by the concept of god. This view will be discussed under three headings. First, I shall explain as clearly as I can what I mean by it. Secondly, I shall indicate what seem to me to be interesting parallels, both with regard to universes of discourse in general and to religious belief in particular, (...) between my idea of a constitutive concept and Wittgenstein's ideas of a fundamental proposition and a religious ‘picture’. Thirdly, I shall try to substantiate the view I take of the logical foundation of religious belief by rebutting three conceivable objections to it: namely, that it rests on an illegitimate craving for generality, that it is at variance with common usage, and that it consigns religious belief to an intellectual ghetto. Psychiatric inpatients with capacity may be treated paternalistically under the Mental Health Act 1983. This violates bodily autonomy and causes potentially significant harm to health and moral status, both of which may be long-lasting. I suggest that such harms may extend to killing moral persons through the impact of psychotropic drugs on psychological connectedness. Unsurprisingly, existing legislation is overwhelmingly disliked by psychiatric inpatients, the majority of whom have capacity. I present four arguments for involuntary treatment: individual safety, public safety, authentic (...) wishes and protection of autonomy. I explore these through a case study: a patient with schizophrenia admitted to a psychiatric hospital under the Mental Health Act 1983 after an episode of self-poisoning. Through its discussion of preventative detention, the public safety argument articulates the (un)ethical underpinnings of the current position in English law. Ultimately, none of the four arguments are cogent—all fail to justify the current legal discrimination faced by psychiatric inpatients. I conclude against any use of involuntary treatment in psychiatric inpatients with capacity, endorsing the fusion approach where only psychiatric patients lacking capacity may be treated involuntarily.
