To address the rising concern that algorithmic decision-making may reinforce discriminatory biases, researchers have proposed many notions of fairness and corresponding mathematical formalizations. Each of these notions is often presented as a one-size-fits-all, absolute condition; however, in reality, the practical and ethical trade-offs are unavoidable and more complex. We introduce a new approach that considers fairness—not as a binary, absolute mathematical condition—but rather, as a relational notion in comparison to alternative decisionmaking processes. Using US mortgage lending as an example use (...) case, we discuss the ethical foundations of each definition of fairness and demonstrate that our proposed methodology more closely captures the ethical trade-offs of the decision-maker, as well as forcing a more explicit representation of which values and objectives are prioritised. An increasing number of financial services (FS) companies are adopting solutions driven by artificial intelligence (AI) to gain operational efficiencies, derive strategic insights, and improve customer engagement. However, the rate of adoption has been low, in part due to the apprehension around its complexity and self-learning capability, which makes auditability a challenge in a highly regulated industry. There is limited literature on how FS companies can implement the governance and controls specific to AI-driven solutions. AI auditing cannot be performed in (...) a vacuum; the risks are not confined to the algorithm itself, but rather permeates the entire organization. Using the risk of unfairness as an example, this paper will introduce the overarching governance strategy and control framework to address the practical challenges in mitigating risks AI introduces. There is growing concern that decision-making informed by machine learning (ML) algorithms may unfairly discriminate based on personal demographic attributes, such as race and gender. Scholars have responded by introducing numerous mathematical definitions of fairness to test the algorithm, many of which are in conflict with one another. However, these reductionist representations of fairness often bear little resemblance to real-life fairness considerations, which in practice are highly contextual. Moreover, fairness metrics tend to be implemented in narrow and targeted toolkits that (...) are difficult to integrate into an algorithm’s broader ethical assessment. In this paper, we derive lessons from ethical philosophy and welfare economics as they relate to the contextual factors relevant for fairness. In particular we highlight the debate around acceptability of particular inequalities and the inextricable links between fairness, welfare and autonomy. We propose Key Ethics Indicators (KEIs) as a way towards providing a more holistic understanding of whether or not an algorithm is aligned to the decision-maker’s ethical values. (shrink)

The fact that Internet companies may record our personal data and track our online behavior for commercial or political purpose has emphasized aspects related to online privacy. This has also led to the development of search engines that promise no tracking and privacy. Search engines also have a major role in spreading low-quality health information such as that of anti-vaccine websites. This study investigates the relationship between search engines’ approach to privacy and the scientific quality of the information they return. (...) We analyzed the first 30 webpages returned searching “vaccines autism” in English, Spanish, Italian, and French. The results show that not only “alternative” search engines but also other commercial engines often return more anti-vaccine pages (10–53%) than Google (0%). Some localized versions of Google, however, returned more anti-vaccine webpages (up to 10%) than Google. Health information returned by search engines has an impact on public health and, specifically, in the acceptance of vaccines. The issue of information quality when seeking information for making health-related decisions also impact the ethical aspect represented by the right to an informed consent. Our study suggests that designing a search engine that is privacy savvy and avoids issues with filter bubbles that can result from user-tracking is necessary but insufficient; instead, mechanisms should be developed to test search engines from the perspective of information quality (particularly for health-related webpages) before they can be deemed trustworthy providers of public health information. No bosque sagrado das Eumênides, situado em uma colina no distrito ateniense de Colono, Édipo se prepara para enfrentar seu destino final. Nesse processo, ele se utiliza dos princípios da tecnologia de si, conceito categorizado por Michel Foucault, e da epiméleia heautoû, termo cunhado por Platão em seu Primeiro Alcibíades. A peça Édipo em Colono (c 406 a.C.), última obra de Sófocles, redime o protagonista de suas transgressões e, por meio de sua transformação, antevê a futura supremacia de Atenas. Conforme (...) observado por James Porter (2006), o interesse de Foucault pela cultura antiga é motivado pela busca dos mecanismos que possibilitam o pleno controle e a disciplina de si. Para Foucault, especialmente em sua obra A Hermenêutica do Sujeito (2002), o auge dessa cultura ocorreu durante o período helenístico até os séculos I e II da Era Comum, juntamente com o período socrático-platônico, que representou uma espécie de pré-história do cuidado de si. Por meio de um movimento de tessera, é possivel identificar aspectos da cultura de si na tragédia sofocleana, seja na preparação ritualística de Édipo para a morte, na argumentação em prol de sua inocência, ou na manifestação do Coro no quarto Estásimo, que preconiza a ascese e o comedimento. O presente artigo tem como objetivo examinar a recepção de Foucault aos clássicos e demonstrar como seus conceitos se manifestam na tragédia selecionada. Trata-se de uma pesquisa bibliográfica, que se utiliza da metodologia genealógica para investigar as tensões nas relações entre sujeito e discurso. Inicialmente, o artigo contextualiza a cultura de si e, em seguida, apresenta informações a respeito da relação entre Sófocles e o culto aos heróis. Em sua terceira seção, examina trechos da peça, relacionando-os com o cuidado de si. Na quarta seção, é discutida a cultura de si no Primeiro Alcibíades de Platão e, na quinta seção, verifica-se a abordagem foucaultiana da mesma. Nas considerações finais, argumenta-se que são identificais aspectos da cultura de si sob a perspectiva foucaultiana na peça Édipo em Colono. (shrink)

Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in (...) Vegas stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

A escola de ensino de tempo integral tem assumido paulatinamente o lugar de referência para um novo modelo de educação pública nacional. Ancorada no desenvolvimento de competências, habilidades, conhecimentos específicos, atitudes e qualidades pessoais, elementos constitutivos do capital humano, ela tem fornecido aos estudantes uma formação cuja centralidade está no Projeto de Vida e na empresa si mesmo, a fim de responder as demandas de economias virtualizadas, que por sua vez, estão baseadas na competitividade e concorrência, condicionadas pelo forte processo (...) de financeirização do neoliberalismo. Partindo da análise de leis e documentos oficiais este artigo buscou conhecer e problematizar a operacionalização de novos dispositivos pela racionalidade neoliberal na formação de subjetividades no modelo de política pública educacional implantado em Pernambuco através Programa de Educação Integral (PEI) nas Escolas de Referência em ensino médio (EREMs), avaliando sua contribuição para formação de capital humano instrumentalizado pela lógica concorrencial e mão de obra precarizada. Utilizando-se dos conceitos da racionalidade neoliberal de Pierre Dardot e Christian Laval e de biopolítica de Michel Foucault, constatou-se que a implementação e execução do PEI operou uma ressignificação do Ensino Médio com o objetivo de formação de uma subjetividade específica, adaptada a flexibilidade produtiva da economia do conhecimento. Compreendeu-se que o Programa de Educação Integral produz uma escola utilitarista por essência, moldada conforme as diretrizes de padronização de sistemas de ensinos para países emergentes, determinadas por organizações internacionais como OCDE e Banco Mundial, atendendo a ordem global que diferencia países ricos e pobres. Conclui-se que apesar do discurso de inovação e modernidade o novo modelo de escola pública de ensino médio de tempo integral é um dispositivo biopolítico para forjar subjetividades dóceis. Ela é uma tecnologia de controle da governamentalidade neoliberal para formação de um capital humano precarizado e cidadanias fragilizadas. (shrink)

The ethical concept of Informed Consent provides individuals with the right and the opportunity to approve of events that will occur regarding his or her own person. In medicine, informed consent is obtained for treatment and for research participation. However, under some circumstances, prospective informed consent cannot be obtained because of the devastating clinical condition of the patient. In emergency circumstances, treatment is never withheld if obtaining informed consent from a critically ill person is not possible or if a delay (...) while seeking surrogates would further endanger life. In emergency research circumstances, waiving informed consent for study participation is fraught with additional ethical considerations. This article will review a presentation given at the June 2, 2006 conference entitled “The Ethics of Research in Emergency Medicine”. (shrink)

Building on contemporary research in embodied cognition, enactivism, and the extended mind, this book explores how social institutions in contemporary neoliberal nation-states systematically affect our thoughts, feelings, and agency. Human beings are, necessarily, social animals who create and belong to social institutions. But social institutions take on a life of their own, and literally shape the minds of all those who belong to them, for better or worse, usually without their being self-consciously aware of it. Indeed, in contemporary neoliberal societies, (...) it is generally for the worse. In The Mind-Body Politic, Michelle Maiese and Robert Hanna work out a new critique of contemporary social institutions by deploying the special standpoint of the philosophy of mind—in particular, the special standpoint of the philosophy of what they call essentially embodied minds—and make a set of concrete, positive proposals for radically changing both these social institutions and also our essentially embodied lives for the better. Researchers have emphasized the value of authenticity, but not much is known about what makes a person authentic in the eyes of others. Our research takes an interpersonal perspective to examine the determinants of followers’ perceptions of leader authenticity. Building on social identity theory, we propose that two fundamental self-identifications–a leader’s sense of uniqueness and sense of belongingness–interact to influence followers’ perceptions of a leader’s authenticity via perceptions of a leader’s self-concept consistency. In a field study conducted among leader–follower dyads (...) and in a controlled laboratory experiment, we find that when a leader feels a low sense of belongingness, there is a positive relationship between a leader’s sense of uniqueness and perceptions of leader authenticity. When a leader feels a low sense of uniqueness, there is a positive relationship between a leader’s sense of belongingness and perceptions of leader authenticity. This is because followers perceive this leader as having high self-concept consistency. (shrink)

Awe has been defined as an emotional response to perceptually vast stimuli that overwhelm current mental structures, yet facilitate attempts at accommodation. Four studies are presented showing the information-focused nature of awe elicitors, documenting the self-diminishing effects of awe experience, and exploring the effects of awe on the content of the self-concept. Study 1 documented the information-focused, asocial nature of awe elicitors in participant narratives. Study 2 contrasted the stimulus-focused, self-diminishing nature of appraisals and feelings associated with a prototypical awe (...) experience with the self-focused appraisals and feelings associated with pride. Study 3 found that dispositional awe-proneness, but not dispositional joy or pride, was associated with low Need for Cognitive Closure, and also documented a relationship between dispositional awe and increased emphasis on membership in “universal” categories in participants’ self-concepts. Study 4 replicated the self-concept finding from Study 3 using experimentally elicited awe. Implications for future work on awe are discussed. (shrink)

Background: The ability to consent promotes children’s access to health services. Healthcare providers should assess and arrive at a clinical judgement about the child’s maturity and mental capacity to obtain valid consent. Research objective: The objective of the study was to determine practices employed by South African healthcare providers to obtain consent for treatment from children. Research design: A qualitative, explorative, descriptive research design was used and the study was contextual. Participants and research context: In all, 24 healthcare providers (professional (...) nurses and medical practitioners) were purposively sampled from a hospital and primary health clinics. Semi-structured interviews were used. Ethical consideration: Ethical approval was obtained from the Institutional Review Board and gatekeepers. Written informed consent was obtained from each participant. Findings: Healthcare providers’ current practices in obtaining consent from children revealed inconsistency in implementation as well as the yardstick used to determine children’s mental capacity. Building trust with children, sharing information and assessment were interlinked in obtaining consent. Discussion: The inconsistent practice has implications for children’s access to healthcare services. Conclusion: Inconsistent practices in the implementation of consent laws have the potential to violate children’s rights to bodily and psychological integrity, access to health services and having their opinions heard and be taken into consideration. Through uncovering the current perceptions and practices and a literature review, guidelines intended for use by the Department of Health could be developed. (shrink)

This rich and varied collection of essays addresses some of the most fundamental human questions through the lenses of philosophy, literature, religion, politics, and theology. Peter Augustine Lawler and Dale McConkey have fashioned an interdisciplinary consideration of such perennial and enduring issues as the relationship between nature and history, nature and grace, reason and revelation, classical philosophy and Christianity, modernity and postmodernity, repentance and self-limitation, and philosophy and politics.

Although the testimony of mental health experts in custody cases is supposed to be scientific and objective, the experts' testimony in the Mary Beth Whitehead case was imbued with prevailing middle-class biases about good mothers and good parenting. Close review of the experts' reports fails to substantiate many of their assessments and recommendations and demonstrates instead a consistent bias in favor of the Sterns and against Mary Beth Whitehead.

Digital sovereignty, and the question of who ultimately controls AI seems, at first glance, to be an issue that concerns only specialists, politicians and corporate entities. And yet the fight for who will win digital sovereignty has far-reaching societal implications. Drawing on five case studies, the paper argues that digital sovereignty affects everyone, whether digital users or not, and makes the case for a hybrid system of control which has the potential to offer full democratic legitimacy as well as innovative (...) flexibility. In an earlier paper I argued that J.G. Fichte (rather than Kant or Hegel or some amalgam) was the primary historical model for the ethical standpoint described in Kierkegaard’s Either/Or II . There I offered a list of reasons for thinking that Hegel was less important than some believed and that Kierkegaard addressed Kantianism largely in its Fichtean form. In the interim I have discovered another reason to add to that list: as it happens, there was a quite general consensus (...) among philosophers in the 1830s, ’40s and ’50s not just that Fichte’s ethics was Kantian ethics in its most perfect form, but even that it was the best example available of normative ethics on a philosophical (rather than a religious) foundation. So Kierkegaard’s use of Fichte as a foil was the perfectly obvious choice in the context. That is a curious fact, given the complete obscurity of Fichte’s ethics today, and one whose interest should not be confined to Kierkegaard scholars. (shrink)

Who is Lucrezia, the mysterious woman at the center of Machiavelli’s comic play Mandragola? And why is she deemed “fit to govern a kingdom”? This article revisits these questions with attention to Mandragola’s sophisticated, and often irreverent, allusions to Roman source materials. While scholars have long recognized that Mandragola draws on Roman history and drama, its sustained engagement with Lucretian and Ovidian poetry has gone largely unnoticed. In what follows, I trace these allusions and show how Machiavelli uses them to (...) bring into view the fertility of erotic desire. Mandragola is replete with Lucretian phrases and imagery, but a close examination of these references indicates they are made playfully, and even satirically, in the style of Ovid’s Ars amatoria, a didactic elegy on the art of seduction that develops a mixed assessment of Epicurean teachings. Like Ovid, Machiavelli embraces the hedonism that motivates Epicureanism—but without accepting that happiness requires distancing ourselves from illusion. This departure allows both Ovid and Machiavelli to reassess the status of erotic desire. For Lucretius, erotic desire must be handled with extreme caution lest it entangle the mind in ruinous false beliefs and destroy the possibility of theoretical wisdom. Machiavelli, following Ovid, recommends a different course, in which happiness is achieved through the deliberate manipulation of erotic fantasy. For Machiavelli, staging erotic fantasies is an essential part of statecraft. (shrink)

In this article, Peter and Rowland explore the role of implicit statistical learning in syntactic development. It is often accepted that the processes observed in classic implicit learning or statistical learning experiments play an important role in the acquisition of natural language syntax. As Peter and Rowland point out, however, the results from neither research strand can be used to fully explain how children's syntax becomes adult‐like. They propose to address this shortcoming by using the structural priming paradigm.

As a central organizing institution in society, marriage presents an idealized package for sociosexual relations that reproduces and intertwines gender power dynamics and heterosexual desire. This package is sustained, in part, by the ideology of romantic love—a set of beliefs that constructs only a particular configuration of sexual and gender practices as natural, normal, and right. Drawing on interviews with 45 people, this study examines how people negotiate marital relationships that do not fit into this normative configuration— mixed-orientation marriages. Participants' (...) resolutions to these situations, whether they divorced or created asexual or sexual nonmonogamous marriages, were heavily shaped by their belief in the ideology of romantic love, illustrating how heteronormative relations can be held in place by normalizing ideologies. Violence in psychiatric clinics has been a consistent problem since the birth of modern psychiatry. In this paper, I examine current efforts to understand and reduce both violence and coercive responses to violence in psychiatry, arguing that these efforts are destined to fall short. By and large, scholarship on psychiatric violence reduction has focused on identifying discrete factors that are statistically associated with violence, such as patient demographics and clinical qualities, in an effort to quantify risk and predict violent acts (...) before they happen. Using the work of Horkheimer and Adorno, I characterize the theoretical orientation of such efforts as identity thinking. I then argue that these approaches lead to epistemic imperceptiveness and a subtle form of conceptual restraint on patients. I suggest a reorientation in psychiatric research, away from identity thinking and toward a more productive and just approach to the problem of violence in psychiatric clinics. (shrink)

When a physician employment relationship terminates, the physician–patient relationship may also be terminated by enforcement of a covenant not to compete, which typically forces the physician to leave the geographic area for a period of time. This gives rise to several ethical dilemmas. The public interest is compromised when enforcement of these covenants contributes to the shortage of physicians in the community, and individual patients are harmed when their physicians are no longer available. The authors undertook a unique study to (...) explore physician perspectives concerning the ethics of banning a physician from practice and the impact of the ban on both the physician and the physician’s patients. The results identified harmful effects that have not been raised in prior scholarly articles or reported court opinions. After reviewing the legal background of covenants not to compete, this paper presents the results of that study and concludes that resorting to the legal system for enforcement of covenants not to compete is not always the ethical course of action. In this paper we reflect upon our multi-year reading group as a site of decolonial feminist praxis that motivates reading in a different register from how we were trained to read as academics in the humanities. In collaborative study we willingly open ourselves to change, to being worked on by one another and by the texts we read. Our reading together has initiated the undoing of settler colonial academic subjectivity and the co-creation of new forms of scholarly subjectivity grounded in (...) relations of care, openness to transformation, and a growing commitment to epistemic justice. In giving an account of our group history and process we reflect on our complicities with settler-colonialism in the university and consider the ways that reading together has cultivated our capacities to listen to counter-narratives, formulate institutional and self critique, and engage in epistemic reparations. Synesthetes can be distinguished from nonsynesthetes on a variety of experimental tasks because their concurrent synesthetic experiences can affect task performance if these experiences match or conflict with some aspect of the stimulus. Here, we tested grapheme‐color synesthetes and nonsynesthetic control participants using a novel perceptual similarity task to assess whether synesthetes’ concurrent color experiences influence perceived grapheme similarity. Participants iteratively arranged graphemes and, separately, their associated synesthetic colors in a display, such that similar items were placed close together and (...) dissimilar items further apart. The resulting relative inter‐item distances were used to calculate the pair‐wise (dis)similarity between items in the set, and thence to create separate perceptual representational dissimilarity matrices (RDMs) for graphemes and colors, on an individual basis. On the assumption that synesthetes’ similarity judgments for graphemes would be influenced by their concurrent color experiences, we predicted that grapheme and color RDMs would be more strongly correlated for synesthetes than nonsynesthetes. We found that the mean grapheme‐color RDM correlation was indeed significantly higher in synesthetes than nonsynesthetes; in addition, synesthetes’ grapheme‐color RDM correlations were more likely to be individually statistically significant, even after correction for multiple tests, than those of nonsynesthetes. Importantly, synesthetes’ grapheme‐color RDM correlations scaled with the consistency of their grapheme‐color associations as measured by their Synesthesia Battery (SB) scores. By contrast, the relationship between SB scores and grapheme‐color RDM correlations for nonsynesthetes was not significant. Thus, dissimilarity analysis quantitatively distinguished synesthetes from nonsynesthetes, in a way that meaningfully reflects a key aspect of synesthetic experience. (shrink)

Joan Didion uses Biblical analogues in her novel Play It As It Lays (1970) to recount the American western myth she learned in her youth, “the story that the wilderness was and is redemptive” (“Thinking about Western Thinking” 14). Her use of scriptural analogues helps us to understand the moral themes in this novel. Situating her novel in America’s most disappointing frontier —Hollywood, Didion uses the Biblical metaphor of the desert to relate a tale of moral chaos illustrated by failed (...) marriages, sexual adultery, forsaken children, and suicide. In Didion’s scriptural analogues, we see, in this Hollywood story, a contemporary wilderness riven by spiritual despair and moral devastation, but a wilderness that can lead to deliverance. (shrink)

This paper considers some of the curatorial devices used in exhibitions at the South End Museum in Gqeberha. The South End Museum, which opened on 3 March 2001, is modelled in several respects on the District Six Museum in Cape Town: it, too, is an urban-based, self-defined 'community museum' constituted around the histories of the apartheid Group Areas Act and the implementation of forced removals. Like many post-1994 museums in South Africa, the South End Museum relies on photographs for their (...) displays, whilst also making use of maps, a mural and reenactment. The paper considers the ways in which these different displays touch, recall, reflect and activate one another. Keeping in mind that the notion of 'community' in South Africa bears the burden of being raced by its apartheid and colonial pasts, and abiding by the spectrality that is constitutive of the image, the paper grapples with the haunted space of 'community museums' in the Eastern Cape. While the South End Museum deploys some of the same curatorial devices as the District Six Museum, and deals with related histories of forced removal, South End, it is argued, brings the relation between race, indigeneity and 'ruin' within 'community museums' into fleeting focus. Organizations interested in food alterity, security, and justice are often governed as 501(c)(3) nonprofits. As such, they are required to fulfill missions beyond profit maximization. This study focuses on the role of nonprofits in the agrifood system. Looking at nonprofit farms as both farms and as nonprofits, we seek to understand whether nonprofit organizations, as an alternative mode of governance, creates the possibility of an alternative economic practice, set apart from the conventional food system. We constructed a national database of (...) nonprofit farms and the characteristics of the counties in which they are located. Our findings indicate that nonprofit farms tend not to be in the places with the most need of the services provided, which we argue is due to the structure of nonprofit governance, namely that nonprofits, while not profit-maximizing, are dependent on external resources, particularly donations. While they do operate as an alternative economic practice, their nonprofit mode of governance renders them unable to repair the failures of the current food system. Nevertheless, these farms do contribute to their local communities, both in terms of meeting their mission and as members of a broader local food system infrastructure. This is true whether or not these farms specifically state that food system transformation is part of their mission. (shrink)
