DESCARTES IS USUALLY CREDITED WITH THE INAUGURATION of modern philosophy. This inauguration consists in a mathematical-mechanical understanding of physics and a concern with human self-consciousness. The Passions of the Soul treats, however, fleetingly, that being which can be regarded as both an object of the mathematical physicist and of the speculative philosopher—“de toute la nature de l’homme.” The peculiarity, if not uniqueness, of this subject, who is discontinuous with the rest of nature, implies that Descartes’ words in the preface—“mon dessein (...) n’a pas est d’expliquer les Passions en Orateur, ny mesme en Philosophe moral, mais seulement en Physicien”—cannot be wholly accurate, if only because man is not simply a physical being in the Cartesian sense. Cartesian physics does away with the final cause an explanation in physics: yet the final cause, the end, is fundamental to any discussion of desire, which is essentially futural, that is, goal directed or purposive. And it is only by virtue of desire that any action results from the passions of the soul. It is thus not simply efficient causation that regulates the activity of man taken as a whole: Descartes speaks of “le machine de nostre corps” but not of “la machine qui est l’homme.”. (shrink)

This paper wants to explore three challenges to these charges: Measures in PHC (...) are aimed to protect, restore or promote ‘deep autonomy’, Measures in PHC are directed at the public and, as such, they do show respect for autonomy, and Some measures in PHC can be justified on grounds of justice and need not be defended as cases of ‘justified paternalism’. Wrongful life claims have always been controversial. Courts in England,1 the USA,2 and Australia3 have generally refused to accept them. However, are wrongful life claims becoming more commonly accepted in continental Europe? After the widely discussed Perruche case in France ,4 and a judgment of a Brussels tribunal in July 2002 that has passed almost unnoticed, the Court of Appeal of The Hague, the Netherlands, in a lengthy and motivated judgment of 26 March 2003, awarded moral damages to a child (...) born with a severe chromosomal disease.5 This judgment differs from the Perruche and Brussels judgments in that both of the latter failed to show to what extent the negligence towards the mother can at the same time be a negligence towards the unborn child. The Court of Appeal of The Hague did at least attempt to explain this.According to the Court of Appeal the midwife looking after the mother had a legal obligation not only towards the pregnant woman but also towards her fetus. This obligation can be derived from the medical treatment contract concluded between, on one hand, the employer of the midwife, the Leiden University Medical Centre, and on the other hand, the parents of the child. This article seeks to explore and analyze the relationship between autonomy and trust, and to show how these findings could be relevant to medical ethics. First, I will argue that the way in which so-called “relational autonomy theories” tie the notions of autonomy and trust together is not entirely satisfying Then, I will introduce the so-called Encapsulated Interest Account as developed by Russell Hardin. This will bring out the importance of the reasons for trust. What good reasons do we have (...) for trusting someone? I will criticize Hardin’s business model as insufficiently robust, especially in the context of health care, and then turn to another source of trust, namely, love. It may seem that trust-through-love is much better suited for the vulnerability that is often involved in health care, but I will also show that it has its own deficiencies. Good health care should therefore pay attention to both models of trust, and I will offer some tentative remarks on how to do this. (shrink)

Bioethics has been in existence now for more than twenty years. Much has changed, however, since Van Rensselaer Potter2 first used the term bioethics in 1971. For Potter, bioethics was an applied science with its roots in the biological sciences and its orientation towards the betterment of human life. Today the concept is used in a different context. It has become the name given to the ethical research that has become necessary in light of the new possibilities created by revolutionary (...) developments in medical science. Generally speaking, bioethics is concerned with the beginning and the end of life. In a certain sense, however, this is merely a de facto definition which does not possess a great deal of internal logical consistency.If we attempt to reconstruct the incredibly rapid evolution of bioethics we quickly realize how the times were truly ripe for this new discipline to begin to mature. In a very short space of time bioethics was taken seriously in just about every University and medical centre the world over. There is no part of the world which has not organised a colloquium or developed a study programme or created a Centre for Biomedical Ethics. Yet this advance is hardly surprising if we consider the fact that there have been revolutionary developments in themedical world in the 1960’s which have made it necessary to engage in serious ethical reflection on the borderline questions of human life.From the start, bioethicists have concerned themselves primarily with ethical problems related to reproductive technology such as in vitro fertilization, medically assisted fertilization with donor gametes, pregnancy termination, and the status of the embryo. More recently, however, questions concerning the end of life have entered the bioethicist’s field of interest, e.g. ethical questions related to euthanasia and the problems surrounding the artificial nutrition and hydration of persistently vegetative patients. In the meantime, of course, bioethics has broadened its field of interest beyond questions related to the beginning and end of life. Serious ethical and juridical reflection has resulted from the problems surrounding organ transplantation, transplantation of brain tissue, and the problem of AIDS.With the many recent developments in genetics, the first applications of gene therapy, and the world-wide human genome research project bioethics is assured an exciting future. It is clear that the issues which grab the bioethicist’s attention are rather disparate. Moreover, we are now beginning to realize that a whole gamut of specific questions cannot be addressed unless the broader context of the ethics of health care in general is taken into account. Such a realization has led to something of a new movement within the bioethical sphere which is interested in widening the notion of ‘medical ethics’ or ‘ethics of health’.The purpose of this article is to help familiarize the reader with the world of bioethics. Such a task is both simple and complex; bioethics has become a house with many rooms, a house, furthermore, which is being constantly renovated and rebuilt. By way of introduction, we shall take an investigative and evaluative stroll through the broad landscape bioethics has traced in the first twenty years of its existence. (shrink)

Are causal explanations (e.g., “she switched careers because of the COVID pandemic”) treated differently from the corresponding claims that one factor caused another (e.g., “the COVID pandemic caused her to switch careers”)? We examined whether explanatory and causal claims diverge in their responsiveness to two different types of information: covariation strength and mechanism information. We report five experiments with 1,730 participants total, showing that compared to judgments of causal strength, explanatory judgments tend to bemoresensitive to mechanism andlesssensitive to covariation – (...) even though explanatory judgments respond to both types of information. We also report exploratory comparisons to judgments of understanding, and discuss implications of our findings for theories of explanation, understanding, and causal attribution. As a response to Gooskens’ article , this paper offers some further comments on the ethics of violent or immoral video games. After arguing that the appeal of such games actually presupposes an awareness of moral transgression, it considers the desensitization thesis, the argument from catharsis, and the relevance of human flourishing.Although this brief analysis does not provide any clear-cut answer to the question of whether or not such games ought to be frowned upon, it does reveal some possible sources (...) of discomfort. The main task of Cognitive Science is to construct concepts and models that would be superordinate to knowledge in the various particular cognitive sciences. In particular, one major objective is to formulate a hypergeneral description of representations that could encompass all descriptions given in subordinate domains.A first basic distinction is between natural and rational representations, i.e. given mental entities and representations that are governed by prescriptive rules coming from logical or scientific thought. In addition, representations must be described in respect (...) to several sources of variability, which are tentatively listed here.Description of natural representations is based on a distinction between taken representations, which are mental events, and type representations, which are lasting structures registered in memory. The connection between them can be modelled through the concept of activation.One advantage of activation models is their large compatibilty, not only with experimental evidence in cognitive psychology, but also with facts and hypotheses in neurosciences, and programming modes or requirements in artificial intelligence. Comprehension of natural language is a highly representative domain in this respect, which exemplifies the power of these concepts. (shrink)

De Nys offers a philosophy of religion grounded within the phenomenological tradition as a way to understand religious life. Focusing on the key concepts of sacred transcendence, religious discourse, and radical self-transcendence, De Nys contends that a phenomenological view of religion allows considerable diversity in regard to the possibility of religious truth. Phenomenology also helps to account for the dizzying variety of religious expressions and religious lifeways. (...) Der "Verfransungsprozess" der Künste, von dem Adorno gesprochen hat schlägt sich in Christian Grünys Buch in einer Verflechtung ihrer theoretischen Ausarbeitungen nieder.Eher als ein linearer Argumentationsgang ergibt sich dabei insgesamt eine Konstellation von Problemfeldern, die sich gegenseitig beleuchten und teilweise aufeinander aufbauen. Diese Konstellation versucht, das Wie der Musik auf möglichst reiche Weise zu konturieren. Die Begriffe, vermittels derer diese Konstellation aufgebaut und erläutert wird - Differenz, Resonanz, Geste und Rhythmus, Raum und Zeit, Materialität -, sind nur teilweise genuin musikalisch. (...) Sie sind Begriffe einer philosophischen Ästhetik, die dennoch nicht auf die Musik angewandt, sondern an und mit ihr entwickelt wird. Philosophische Konstellationen zur Musik sind sie insofern, als sie dem Anspruch nach weniger über die Musik sprechen als sich zu ihr stellen, sich auf ihre Bewegung einlassen und so einen Zusammenhang produzieren, der etwas an ihr aufscheinen zu lassen versucht, was sonst nicht sichtbar würde. Dabei sind an verschiedenen Stellen philosophische Diskussionen zu führen. Wenn es dabei ein Motiv gibt, das sich durch den gesamten Text zieht, so ist es das einer Differenz, die sich nie zu fixen Entgegensetzungen verfestigt. So bedeutsam die Unterscheidungen sind, die an den unterschiedlichen Stellen vorgenommen oder von der Tradition übernommen werden, so wichtig sind die Übergänge zwischen ihren Polen. In response to Ruud ter Meulen’s contribution, it is argued that, although the relationship between these concepts is both tight and complex, solidarity should be carefully distinguished from justice. Although ter Meulen wants to defend a normative conception of solidarity, the relation to its descriptive component is not always very clear. As a normative concept it should not collapse into that of justice; and as a descriptive notion it is obviously defective. In order to successfully navigate between these unhappy alternatives, (...) ter Meulen rightfully turns to critical theory. But then it is still not entirely clear how the normative considerations that ter Meulen wants to defend follow from this promising framework. (shrink)

In this paper I argue that Isaiah Berlin’s theory of freedom should not be interpreted in a reductive sense. The distinction between negative and positive freedom, as different concepts and possibly conflicting values, truly holds (thereby excluding reductive interpretations that claim there is only one concept of freedom). Moreover, Berlin’s theory as a whole leaves room for both a comprehensive liberalism which advocates autonomy, critical reflection and personal judgement, as well as a liberalism of fear which defends a minimal level (...) of decency and modesty aims at a modus vivendi. I think Berlin’s liberalism is one of hope and fear. (shrink)

The Belgian health care system has a few features that may havecontributed to the rising costs of health care: patients' freechoice of physicians, large clinical freedom of physicians, essentiallya fee-for-service remuneration for medical specialists in which the feesare agreed between insurance funds and physicians. The increased medicalconsumption and costs have prompted the state and insurance companies totake measures that limit the professional autonomy of the physicians.Access to medical education, free until 1997, is now restricted. Themedical profession is organized in the (...) Order of Physicians that hasestablished a code of professional ethics that has moral but not legalforce. So far, there is no special legislation for thepatient–physician relationship, though laws on specific issueslike organ transplantation contain duties for physicians. In recentyears a debate is taking place on patients' rights, of which informedconsent is central and gaining importance in medico-legal publications.An analysis of (ethical and legal) regulations concerning thewithholding or withdrawal of treatment by physicians demonstrate thatthe profession still enjoys a large clinical autonomy, though duediscussion with the patient has become more explicitly required. Therespect for professional autonomy is not primarily due to any formalpower that the Order of Physicians would have, but is rather grounded inthe generally high quality of the patient–physician relationshipthat in ethical terms is considered essentially as a confidencerelationship rather than a contractual relationship.
