The present book is a sequel to Ephraim Chamiel's two previous works The Middle Way and The Dual Truth-studies dedicated to the "middle" trend in modern Jewish thought, that is, those positions that sought to combine tradition and modernity, and offered a variety of approaches for contending with the tension between science and revelation and between reason and religion. The present book explores contemporary Jewish thinkers who have adopted one of these integrated approaches-namely the dialectical approach. Some of these thinkers (...) maintain that the aforementioned tension-the rift within human consciousness between intellect and emotion, mind and heart-can be mended. Others, however, think that the dialectic between the two poles of this tension is inherently irresolvable, a view reminiscent of the medieval "dual truth" approach. Some thinkers are unclear on this point, and those who study them debate whether or not they successfully resolved the tension and offered a means of reconciliation. The author also offers his views on these debates. This book explores the dialectical approaches of Rav Kook, Rav Soloveitchik, Rabbi Abraham Joshua Heschel, Samuel Hugo Bergman, Leo Strauss, Ernst Simon, Emil Fackenheim, Rabbi Mordechai Breuer, his uncle Isaac Breuer, Tamar Ross, Rabbi Shagar, Moshe Meir, Micah Goodman and Elchanan Shilo. It also discusses the interpretations of these thinkers offered by scholars such as Michael Rosenak, Avinoam Rosenak, Eliezer Schweid, Aviezer Ravitzky, Avi Sagi, Binyamin Ish-Shalom, Ehud Luz, Dov Schwartz, Rabbi Yuval Cherlow, Lawrence Kaplan, and Haim Rechnitzer. The author questions some of these approaches and offers ideas of his own. This study concludes that many scholars bore witness to the dialectical tension between reason and revelation; only some believed that a solution was possible. That being said, and despite the paradoxical nature of the dual truth approach (which maintains that two contradictory truths exist and we must live with both of them in this world until a utopian future or the advent of the Messiah), increasing numbers of thinkers today are accepting it. In doing so, they are eschewing delusional and apologetic views such as the identicality and compartmental approaches that maintain that tensions and contradictions are unacceptable. (shrink)

In this essay, Mordechai Gordon interprets Martin Buber's ideas on dialogue, presence, and especially his notion of embracing in an attempt to shed some light on Buber's understanding of listening. Gordon argues that in order to understand Buber's conception of listening, one needs to examine this concept in the context of his philosophy of dialogue. More specifically, his contention is that closely examining Buber's notion of embracing the other is critical to making sense of his conception of listening. Gordon's (...) analysis suggests that, in Buber's model, listening involves a kind of active attentiveness to another's words or actions, engaging them as though they are directed specifically at us. Gordon's discussion of dialogue and listening also indicates that the relation between speaking and listening is one of reciprocity and mutual dependence and that listening plays an essential role in initiating many dialogues by creating a space in which two people can embrace each other as complete individuals. This essay analyzes the educational significance of the metaphysical novel, that is, how it can be used to educate ourselves and our students. Mordechai Gordon begins by describing the nature of the metaphysical novel while contrasting it to “pure” philosophy and theory building. Gordon also situates Beauvoir’s insights in the broader context of the ongoing conversation on philosophy and literature. In the next part, he examines Beauvoir’s philosophy of lived experience and compare her philosophical approach to more traditional phenomenological (...) theories. From the analysis of Beauvoir’s philosophy of lived experience, Gordon turns to explore the role that ambiguity, contingency, and complexity play in helping us make sense of people’s lives while drawing on examples from several metaphysical novels to illustrate these notions. Uncertainty about the actual orientation of the measurement device has been claimed to open a loophole for hidden variable models of quantum mechanics. In this paper I describe the statistics of inaccurate spin measurements by unsharp spin observables. A no‐go theorem for hidden variable models of the inaccurate measurement statistics follows: There is a finite set of directions for which not all results of inaccurate spin measurements can be predetermined in a non‐contextual way. In contrast to an earlier theorem ( (...) class='Hi'>Breuer 2002) this result does not rely on the assigment of approximate truth values, and it holds under weaker assumptions on the measurement inaccuracy. This unmodalizable primal facts host a core of protocontingency that accounts for the factual contingency not only of the categories of experience, but of the world, the ego and of finite beings: Understood as processes or subjected to qualitative changes in their essential structures, their mode of being is characterized by an essential openness. In her article “Die Irrealität des Kunstwerkes,” first published in 1938, Hedwig Conrad-Martius delves into the question of the artistic representation of the real reality of the world, which basically concerns the classical distinction between art and nature. It is in this context that Conrad-Martius rejects idealism and the concomitant assumption that an artwork imitates the “living reality” of Nature. She clearly distinguishes between the task of phenomenology and that of art: while phenomenology should surpass the sphere of mere sensuous (...) appearances and inquire into the “real reality” (wirkliche Wirklichkeit) of the world, phenomenological aesthetics should conversely deal with the expressive character of appearances and assume their inherent “irreality” (Irrealität), such that phenomenological ontology and aesthetics involve distinctive ontological realms that vary according to the subject-matter. However, while she clearly distances herself from Husserl’s phenomenology in her search for the consciousness-independent facticity of the world, she concurs with him in her eidetic enquiries and in the assertion of the creative potential of art, which lies in the creation of a new, even “irreal,” world. For this purpose, I will explore confluences and divergences between their respective conceptions. (shrink)

It is shown that it is impossible for an observer to distinguish all present states of a system in which he or she is contained, irrespective of whether this system is a classical or a quantum mechanical one and irrespective of whether the time evolution is deterministic or stochastic. As a corollary, this implies that it is impossible for an observer to measure the EPR-correlations between himself or herself and an outside system. Proportionality in Action presents an empirical and comparative exploration of the proportionality doctrine, based on detailed accounts of the application of the framework by apex courts in six jurisdictions: Germany, Canada, South Africa, Israel, Poland and India. The analysis of each country is written and contextualized by a constitutional scholar from the relevant jurisdiction. Each country analysis draws upon a large sample of case law and employs a mixed methodological approach: an expansive coding scheme allows for quantitative analysis providing comparable (...) and quantifiable measurements, which is enriched by qualitative analysis that engages with the substance of the decisions and captures nuance, contextualizing the data and providing it with meaning. The book concludes with a comparative chapter that synthesizes some of the most interesting findings. The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. The Calvinist view that man is predestined to be among the elect or the damned has profoundly influenced not only our views of criminals and deviants, but also the theoretical basis of correctional methods and psychotherapeutic techniques. This paper investigates whether managerial rhetoric in the Management Discussion and Analysis section of 10-K filings can help gauge the level of managerial opportunism in a firm. We find that the use of trust-related words is connected to inefficient investment decisions and poor operating performance. Furthermore, firms making more frequent use of trust-related words are subject to less monitoring by institutional investors or analysts. Their accounting also relies more heavily on discretionary accruals. Carl Schmitt verfügt heute über eine so breite und stets wachsende internationale Leserschaft wie kein anderer deutscher Staatsrechtslehrer des vergangenen Jahrhunderts. Sein Werk wird dabei freilich meist isoliert betrachtet und allenfalls auf den staatsrechtlichen Kontext bezogen. Im Mittelpunkt dieses Buches steht dagegen der politische Intellektuelle, der weit über die Grenzen seines Faches hinauswirkte. Besondere Aufmerksamkeit gilt dabei den Anfangs- und den Endjahren der Weimarer Republik. Während Schmitt in München Strategien zur Zähmung der Revolution entwickelte, setzte er sich in seinen Berliner (...) Jahren für eine autoritäre Transformation der Verfassung ein, die neben der äußersten Linken auch die äußerste Rechte von der Macht fernhalten sollte. Das geschah nicht nur in der Form der verfassungsrechtlichen Expertise für Regierungskreise, sondern auch durch publizistische Interventionen, bei denen der in Bonn gebildete Schülerkreis Schmitts eine tragende Rolle spielte. Zeitschriften wie Der Ring und das Deutsche Volkstum standen in der Endkrise der Weimarer Republik zeitweise vollständig unter dem Einfluß Schmittscher Ideen, und auch im breiteren Umfeld waren sie präsent, etwa in den Organen der Bündischen Jugend oder in der vielgelesenen Tat. Selbst Kritiker Schmitts konnten sich diesem Einfluß nicht entziehen, wie am Beispiel Otto Kirchheimers, Franz Neumanns, Ernst Fraenkels, Waldemar Gurians und anderer gezeigt wird. This article inquires firstly into the descriptive and affective function of images as examples and exemplars in both Cassirer’s and Husserl’s conceptions of perception and aesthetics in order to disclose their respective relationship to reality, that is, mimesis. In view of the correlation between symbolic comportment and symbolic forms at Cassirer, it will secondly show that the ensuing hermeneutical circle can be overcome by taking recourse on Husserl’s genetic analyses on passive sense constitution. It will thus set the basis for (...) a “hermeneutics of expression” that should, thirdly, shed light on the possibility of establishing an aesthetical knowledge. For this purpose, it will disclose an excess of sensuous expression that is determined by a pre-categorial limit-concept within the process of sense-formation. This inquiry shows that, while images as examples are characterized by their ideal arbitrariness, aesthetic images as singular and categorially determined exemplars can be understood as the affective expression of reality. Inspired by Camus’ portrayal of Sisyphus, this essay examines the act of teaching as an absurd profession, one that faces numerous obstacles and challenges and continually falls short of its intended goals. I begin my analysis by demonstrating that Camus’ understanding of the absurd was heavily influenced by Nietzsche’s conception of nihilism. I argue that for Camus the sense of absurdity comes from the conflict between humans’ longing for order and meaning and the disorder and meaninglessness that we experience in (...) our daily lives. Next, I show that Camus’ understanding of absurdity can help us make sense of the recent wave of educational reform. More fundamentally, I argue that that the existential conditions of schooling that many teachers have to negotiate daily are themselves absurd in Camus’ sense of the term. In the last part of this article, I take a close look at how a number of teachers are attempting to resist and even rebel against the new educational mandates. (shrink)

This paper enquires into a paradigmatic change concerning the concept of motion: from a phenomenological conception of motion understood as a continuous and finite process of translation, to a physical conception of motion as rectilinear, uniform and continuous, that is, as an inertial state that if unhindered, can extend infinitely – the former held by Aristotle, the latter by Koyré, a shift that is evidenced by their contrasting treatment of Zeno’s paradoxes. I argue that both ontologies of motion can be (...) understood in phenomenological terms: Motion is accomplished by the real itself. However, while Aristotle’s continuous motion as actualization of the form of a given body involves its formal determination and constitution of sense, Koyré’s conceives of motion and rest as kinds of being and motion itself as exemplifcation of the mathematization of nature that Husserl described in the Crisis. Taken together, these changes presuppose a transformation of metaphysical and epistemic frameworks. (shrink)

This paper deals with the problem of the origin of sense and meaning. For Husserl, the determination of the ideal identity of something new can only take place retroactively in the totality of the preceding series by stepping back towards the original foundation of sense. In this regard, J. Derrida questions the ideality of the same as presence and the possibility of retrieving any arché of sense in his writings Speech and Phenomena and Edmund Husserl’s Origin of Geometry. Phenomenology is (...) not oblivious to these difficulties, as results from a closer reading of the correlation between idealities and sensory experience: It will show that there are at least four interrelated gaps in the Husserlian phenomenology which testify the difficulty in grasping a retraceable arché of sense. First, the gap between the ideality of sense and its representation. Second, the gap between sensory and categorial intuitions, whereby both exceed one another. Third, the gap between the ideality of sense and the sense which exceeds our expectations. Fourth, the gap between the experience of the new that overcomes us and its apprehension by consciousness. Hence, there is a fundamental gap between the conceptual idealities and the essential indeterminacy of our phenomenological sensory experience, which is correlative to an excess of one in respect to the other. In this sense, Derrida’s concepts of « différance » and “invention” allow us to conceive of this self-givenness of sense as the expression of its constant self-renewal. This expression takes the form of a trace, which, neither present nor absent, suspends meaning and full presence, leaving the narrative “open” for the reinvention of sense. (shrink)

Abstract:This essay explores with the help of the discipline of philosophy of education the educational implications of the practice of canceling individuals or ideas. In particular, it investigates what gets lost or undermined when we cancel various opinions, words, and practices. To advance my argument, I first introduce some basic definitions while analyzing the problem with the notion of cancel culture. Then, I briefly review various historical examples of canceling going back to Socrates. The next part of this paper presents (...) some of the philosophical arguments against canceling and restricting speech made by John Stuart Mill. After presenting Mill’s contentions in favor of liberty of expression, I revisit John Dewey’s conception of democratic association in order to show that the practice of canceling people and ideas is antithetical to Dewey’s dynamic view of democracy. Based on the insights of Mill and Dewey, in the final part I attempt to make an educational case against the practice of canceling. (shrink)

SummaryEdmund Chilmead (1610–54), a little-known scholar and musician, was the author of a possibly unique testimony to the interest among English natural philosophers in the nature of sound and philosophical music theory during the years following the publication of Francis Bacon's Sylva Sylvarum (1626). Chilmead's ‘An Examination … of the Naturall History’ is a manuscript treatise which takes the form of twenty ‘Quaeres’ on the second and third centuries of experiments of the Sylva which are concerned with the nature of (...) sound. In the treatise, Chilmead reveals his familiarity with the developments in the field of musical acoustics made by the French natural philosopher Marin Mersenne (1588–1648) and his circle.The paper falls into two complementary sections. In the first, Feingold gives an account of Chilmead's life and career (which has hitherto never been fully documented) in order to place him in the context of the intellectual and social milieu of Oxford and London during this period. ABSTRACT The current article deals with the correlation between virtual and physical reality as they concern the body. The thesis of this article is that the lived body transposed into virtual reality becomes a body without organs in Deleuze’s terms, i.e. the lived body, a sensitive field of sensorial events immersed in a lived space, becomes a virtual body made up of intensities, of pure forces or magnitudes within a vector space, thereby losing its affective qualities. Furthermore, lived and virtual (...) bodies build up a correlation bridged not by intentionality, as phenomenology would maintain, but by sensation. Virtuality is thus characterised by both the loss of corporeality and the simulation of the lifeworld. But how can the split between the real and the virtual body be bridged? On the one hand, in Deleuze’s conception of sensation, real and virtual collapse into one another so that the real world ‘resonates’ with its virtual double. On the other hand, Merleau-Ponty’s concept of form relates both realities in terms of a correlation of signification between the physical and the existential realms. With recourse to the notion of structure or form, I will argue that the phenomenal and the virtual do not represent different modes of being, but are bound by a correlation ruled by sensation as a system of intensive forces. ABSTRACT When Henry Macomber published his census of owners of the first edition of the Principia in 1953, he believed the edition to be small, ‘perhaps not more than 250 copies’, an estimate that still enjoys currency. Lower estimates of the size of the first edition of the Principia were based partly on assessments regarding an inhospitable market for highly technical mathematical books, and partly on the presumption that the vaunted incomprehensibility of the Principia would have militated against a sizeable (...) edition. Our preliminary census more than doubles the number of identified copies, to 387—suggesting a much larger print run than commonly assumed – as well as encourages us to believe that there existed a wider, and competent, readership of the Principia from the start. The long-standing assumption regarding the recondite nature of Newton's science as presented in the Principia, together with claims concerning the scarcity of the book, brought many scholars to assume that Newton's masterpiece exerted little influence before the 1730s. The new empirical evidence presented in our census enables a reassessment of the early diffusion of the Principia in Europe which, in turn, would necessitate a major refinement of our understanding of the contribution of Newtonianism to Enlightenment science. More specifically, he explores the kind of humor that makes fun of oneself and how it can affect educational encounters. Gordon begins his analysis by discussing the nature and purpose of humor in general, while distinguishing it from laughter and amusement. In the next part of the essay, he (...) takes a close look at the characteristics and benefits of the type of humor that we use when we make fun of ourselves. He then turns his attention to exploring the relation between laughing at ourselves, self‐transcendence, and a number of moral virtues. This paper aims to pay tribute to Figal’s comprehensive and innovative analysis of the artwork and beauty, while challenging both his realist position on the immediacy of meaning and his monist stance that reduces sublimity to beauty. To enquire into the origin of aesthetic feelings and sense, and thus, to break the hermeneutic circle, we first trace the origin of this reduction to the reception of Burke’s concept of the sublime by Mendelssohn and Kant. We then recur to Husserl and (...) Dufrenne to trace the origin of the sense of the feeling of sublimity in the realm of affectivity or sensuousness. This genesis takes place in passive experience, where we identify an excess of sensuous sense over categorial meaning that is constitutive of the affective sense that our bodily sensations give to hyletic material. It is argued that this sensuous excess evokes a sublime experience in the phenomenological sense, involving an affective and disruptive bodily experience and an endless process of sense formation. Affective or sensuous sense is thus an event that irreversibly affects the bodily surface. To elucidate this phenomenon, we draw on the theoretical framework of Breton and Bataille, positing it as a form-transgressive ‘convulsive’ sublime, which we then illustrate in the architectural works of Tschumi and Eisenman. In short, we have retrieved the origin of aesthetic experience and redefined the feeling of the sublime as a phenomenological ‘convulsive’ sublimity. (shrink)

But Thomas Mann's understanding of this concept does not at all coincide with the definition established by Armin Mohler, mainly in that it is not Nietzschean. Nor do the ties with the George circle furnish grounds for assigning Mann to the 'Conservative Revol ution', any more than to the 'aesthetic fundamentalism' which was cul tivated there. Moreover, it can be (...) shown that Mann's political views differ significantly from the 'new nationalism' propagated in the circle around Arthur Moeller van den Bruck, and that they have more affini ties to old liberalism than to a 'Conservative Revolution'. This essay analyzes the tensions that the rise of “Nordic racism” associated with Hans F. K. Günther triggered within the völkisch movement in the 1920s. Using the examples of the “Deutschbund,” the völkisch wing of the German youth movement “Bündische Jugend” and the German Aristocrats' Association “Deutsche Adelsgenossenschaft,” this essay shows that the reception of the Nordic idea was partially based on misunderstandings and distortions but was also met with open disagreement.

I will discuss two opposed conceptions of the nature of the self and indicate the shortcomings of each approach, in order to go on to show something about self-involvement and singularity that is often overlooked. The two opposed conceptions deal with the self in different ways because they also deal differently with the relation between consciousness and the self as such. In the first conception, this relation remains external: reflection is not of the same order as the self and, conversely, (...) the self is something that always falls outside of reflection, something against which a position can be occupied and a (critical) distance taken. Here, the self is an object whose nature does not in the least affect the nature of reflection. To the contrary, the ego must explicitly identify with that object if there is to be any trace of a connection with it at all. I will refer to this position as that of individualism. (shrink)

It is shown that for an inside observer it is impossible to distinguish all states in which a system was at some past time. This holds for classical and quantum systems, but an assumption of determinism is essential in the proof.

Acts of violence develop in relation to place and involve the violation of its very limits. Every significant place is a scene of history, its limits embrace presence and sense. As such, it is the life-worldly home of memory. In this article, I will retrieve the bodily affective dimension of the phenomenon of place memory in instances of public commemoration. Drawing on different philosophical horizons like those of mainly Heidegger, Husserl, Merleau-Ponty, Derrida, Adorno, Ricoeur and Bataille, I’ll contrast their different (...) perspectives on the question of the intertwining of violence, place and memory and refer them to the narrative work of memorials. Insofar violence has been traditionally represented and thereby obliterated by architecture, we may ask how should genocide, as the unspeakable and ungraspable be expressed? I’ll suggest that it can only be attained by the suspension of meaning and presence: A narrative of bodily affections, of pathos, suffering and excess that accounts for what in itself remains beyond expression. General results about restrictions on measurements from inside are applied to quantum mechanics. They imply subjective decoherence: For an apparatus it is not possible to determine whether the joint system consisting of itself and the observed system is in a statistical state with or without interference terms; it is possible that the apparatus systematically mistakes the real pure state of the joint system for the decohered state.
