This article is an examination of the Augsburg physician Ieremias Martius’s Catalogus bibliothecae of 1572, which may well by the first printed sales catalogue of a library. The author claims it to be the product of careful selection, covering the whole field of medicine and containing both rare and recent medical books. The catalogue is placed here in the context of Martius’s career, and his contacts in the European medical world. An account is given of the bibliographical resources available to (...) him, before the contents themselves are anatomised. His interest in various fields is revealed here: medieval practical medicine, medical humanism, anatomy, Hippocratism, medical observationes and letter collections, gynecology, astrological medicine, balneology, botany, and the literature of medical secrets. Martius’s eclecticism and open-mindedness is revealed further through a comparison of his library with five other contemporary book collections of doctors. (shrink)

Nancy MacLean’s book, Democracy in Chains, raised questions about James M. Buchanan’s commitment to democracy. This paper investigates the relationship of classical liberalism in general and of Buchanan in particular to democratic theory. Contrary to the simplistic classical liberal juxtaposition of “coercion vs. consent,” there have been from Antiquity onwards voluntary contractarian defenses of non-democratic government and even slavery—all little noticed by classical liberal scholars who prefer to think of democracy as just “government by the consent of the (...) governed” and slavery as being inherently coercive. Historically, democratic theory had to go beyond that simplistic notion of democracy to develop a critique of consent-based non-democratic government, e.g., the Hobbesian pactum subjectionis. That critique was based firstly on the distinction between contracts or constitutions of alienation (translatio) versus delegation (concessio). Then the contracts of alienation were ruled out based on the theory of inalienable rights that descends from the Reformation doctrine of inalienability of conscience down through the Enlightenment to modern times in the abolitionist and democratic movements. While he developed no theory of inalienability, the mature Buchanan explicitly allowed only a constitution of delegation, contrary to many modern classical liberals or libertarians who consider the choice between consent-based democratic or non-democratic governments (e.g., private cities or shareholder states) to be a pragmatic one. But Buchanan seems to not even realize that his at-most-delegation dictum would also rule out the employer-employee or human rental contract which is a contract of alienation “within the scope of the employment.”. This paper, inspired by Duke University historian Nancy MacLean’s extraordinary book Democracy in Chains: The Deep History of the Radical Right’s Stealth Plan for America (2017), elaborates the carefully calibrated, multifaceted plan by a billionaire-funded facet of the radical right, deeply disturbed by the fact that so many students have critical views of capitalism, to transform American universities. Its multi-pronged strategy involves the following three steps: (1) Reconfigure the financial superstructure of higher education. Cut public funding for higher (...) education and fill the gap with strategic donor giving. (2) Purge and Recruit: remove left-leaning faculty, develop a counter-intelligentsia of libertarian faculty, and foster the creation of libertarian student organizations on campus. (3) Undermine the general public’s respect for and trust in our colleges and universities by manufacturing controversies that attract widespread attention. This paper examines each of these in detail, with particular attention given to the myriad of privately funded institutional “think tanks” involved in the process. (shrink)

This paper addresses the just distribution of vaccines against the SARS-CoV-2 virus and sets forth an ethical framework that prioritises frontline and essential workers, people at high risk of severe disease or death, and people at high risk of infection. Section I makes the case that vaccine distribution should occur at a global level in order to accelerate development and fair, efficient vaccine allocation. Section II puts forth ethical values to guide vaccine distribution including helping people with the greatest need, (...) reducing health disparity, saving the most lives and promoting narrow social utility. It also responds to objections which claim that earlier years have more value than later years. Is age discrimination ethically objectionable? One puzzle is that we sometimes assume that the target of both age discrimination and ageism must be older people, yet in poorer nations, older people are generally shown more respect. This article explores the ethical question. It looks first at ethical arguments favoring age discrimination toward younger people in low‐income, less industrialized countries of the global South, using sub‐Saharan Africa as an illustration. It contrasts these with arguments favoring age discrimination toward older people in (...) high‐income, more industrialized countries of the global North, particularly the United States and United Kingdom. Finally, it considers what role, if any, differences in life expectancy, infant and child mortality, and prospects for healthy lives should play in the moral embrace of a particular view by a community. This paper argues that even when simple analogue models picture parallel worlds, they generally still serve as isolating tools. But there are serious obstacles that often stop them isolating in just the right way. These are obstacles that face any model that functions as a thought-experiment but they are especially pressing for economic models because of the paucity of economic principles. Because of the paucity of basic principles, economic models are rich in structural assumptions. Without these no interesting conclusions can (...) be drawn. This, however, makes trouble when it comes to exporting conclusions from the model to the world. One uncontroversial constraint on induction from special cases is to beware of extending conclusions to situations that we know are different in relevant respects. In the case of economic models it is clear by inspection that the unrealistic structural assumptions of the model are intensely relevant to the conclusion. Any inductive leap to a real situation seems a bad bet. (shrink)

Opponents of ceteris paribus laws are apt to complain that the laws are vague and untestable. Indeed, claims to this effect are made by Earman, Roberts and Smith in this volume. I argue that these kinds of claims rely on too narrow a view about what kinds of concepts we can and do regularly use in successful sciences and on too optimistic a view about the extent of application of even our most successful non-ceteris paribus laws. When it comes to (...) testing, we test ceteris paribus laws in exactly the same way that we test laws without the ceteris paribus antecedent. But at least when the ceteris paribus antecedent is there we have an explicit acknowledgment of important procedures we must take in the design of the experiments — i.e., procedures to control for “all interferences” even those we cannot identify under the concepts of any known theory. Health care reform to provide long-term care supportive services for growing numbers of older Americans presents ethical, cultural, and political challenges. This paper draws lessons from Japan, the world’s oldest nation, to develop an ethical argument in support of enacting public long-term care in the U.S. Despite cultural and political challenges, the paper shows that the ethical case for reform is strong, with broad ethical support from a range of ethical perspectives.

Christian parables have retained their force well beyond the sphere of religion; indeed, they share with much of modern literature their status as a form of address: "Who hath ears to hear, let him hear." There is no message without there first being--or, more subtly, without there also being in the message itself--an address to a capacity or an aptitude for listening. This is not an exhortation of the kind "Pay attention!" Rather, it is a warning: if you do not (...) understand, the message will go away.The scene in the Gospel of John in which the newly risen Christ enjoins the Magdalene, "Noli me tangere," a key moment in the general parable made up of his life, is a particularly good example of this sudden appearance in which a vanishing plays itself out. Resurrected, he speaks, makes an appeal, and leaves."Do not touch me." Beyond the Christ story, this everyday phrase says something important about touching in general. It points to the place where touching must not touch in order to carry out its touch (its art, its tact, its grace). The title essay of this volume is both a contribution to Nancy's project of a "deconstruction of Christianity" and an exemplum of his remarkable writings on art, in analyses of "Noli me tangere" paintings by such painters as Rembrandt, Dürer, Titian, Pontormo, Bronzino, and Correggio. It is also in tacit dialogue with Jacques Derrida's monumental tribute to Nancy's work in Le toucher--Jean-Luc Nancy.For the English-language edition, Nancy has added an unpublished essay on the Magdalene and the English translation of "In Heaven and on the Earth," a remarkable lecture he gave in a series designed to address children between six and twelve years of age. One of the enduring questions in the study of religion is how to define the object of our study. I would like to offer a definition, as an opening move in any discussion of religion, not because I think definitions settle anything by themselves, but because very different definitions of religion are at stake in contemporary debates in the academy, particularly in the hyphenated areas such as science and religion, or religion and politics, or religion and gender studies, and I (...) think it is important to see how they are related. In situations where experience shows that a particular intervention will not benefit a patient, common sense seems to suggest that the intervention should not be used. Yet it is precisely in these situations that a peculiar ethic begins to operate, an ethic that Eddy calls “the criterion of potential benefit.” According to this ethic, “a treatment is appropriate if it might have some benefit.” Thus, the various maxims learned in medical school instruct physicians that “‘an error of commission is to (...) be preferred to an error of omission,’ or ‘when in doubt, cut it out’ or ‘if but one patient is helped, then the treatment is worthwhile.’”. Adoration is the second volume of the Deconstruction of Christianity, following Dis-Enclosure. The first volume attempted to demonstrate why it is necessary to open reason up not to a religious dimension but to one transcending reason as we have been accustomed to understanding it; the term "adoration" attempts to name the gesture of this dis-enclosed reason. -/- Adoration causes us to receive ignorance as truth: not a feigned ignorance, perhaps not even a "nonknowledge," nothing that would attempt to justify the (...) negative again, but the simple, naked truth that there is nothing in the place of God, because there is no place for God. The outside of the world opens us in the midst of the world, and there is no first or final place. Each one of us is at once the first and the last. Each one, each name. And our ignorance is made worse by the fact that we do not know whether we ought to name this common and singular property of all names. We must remain in this suspense, hesitating between and stammering in various possible languages, ultimately learning to speak anew. -/- In this book, Jean-Luc Nancy goes beyond his earlier historical and philosophical thought and tries to think-or at least crack open a little to thinking-a stance or bearing that might be suitable to the retreat of God that results from the self-deconstruction of Christianity. Over thirty years after Maurice Blanchot writes The Unavowable Community--a book outlining a critical response to Jean-Luc Nancy's early proposal for thinking an "inoperative community"--The Disavowed Community offers a close reading of Blanchot's text.

The argument of this article is that, philosophically, there are but three broad conceptual models that Western thought employs in thinking about the meaning of God. At the level of greatest generality, these are the models known as classical theism, pantheism, and panentheism. The essay surveys and updates these three conceptual models in light of recent writings, finds more flaws in classical theism and panentheism than in pantheism, and suggests a feminist response to each.

Siraisi Hunter College In Renaissance medical practice rhetoric had an ambiguous reputation. Many authors warned physicians against use of persuasion or repeated some version of the truism that patients are cured not by eloquence but by medicines. On the other hand, physicians were also reminded that by (...) speaking well they helped patients to have confidence in their advice and to understand directions, which in turn facilitated cure.1 Yet some aspects of medical culture of the period between 1450 and 1600 seem profoundly attentive to rhetoric, at least as regards the use of language, performative elements, and the influence of these features in ancient models (most notably Galen himself).2 One area in which rhetoric had an unambiguous, acknowledged, and essential place was in the medical orations pronounced at university ceremonies. A sample follows: Pursuit of all these different things by study, investigation of obscurities with ingenuity, conquest of difficulties with industry, and—after penetrating into the very fibers of the earth and searching everywhere into the arcana of the whole of nature and from all herbs, fruits, trees, animals, gems, and even poisons—inquiry after remedies and the proper way to use them for all the ills of human life from so many authors, so many disciplines, and even from the very stars: these things, I say, [End Page 191] have uncovered so many hidden cures, been attained with such arduous powers of the mind, completed with so much effort of memory, offer so many things necessary for the health of the entire human race in common, that does not indeed [the entire enterprise of medicine] seem to have been superhuman and really in a certain way divine?3This nicely exuberant example of Renaissance medical rhetoric exemplifies the genre in several respects. The oration to which it belongs was originally delivered to an academic faculty of medicine by a physician; it shows the impact in medical settings of the revival of epideictic rhetoric, and its author drew on learned sources and commonplaces about medicine that belonged to a store of broadly humanistic erudition, shared both in and outside the medical profession. In fact the only truly distinctive feature of this passage is its author. It comes from Erasmus's Encomium medicinae, which he wrote in 1499 for a friend—a physician named Gysbertus—to deliver to the medical faculty of the University of Paris.4If Gysbertus was exceptionally fortunate in his ghost, many other surviving medical orations are internal products of medical faculties, the work of university masters or students of medicine. But whoever their authors, orations delivered in or written for an academic medical setting offer some telling illustrations both of the way in which certain kinds of humanistic interests and requirements came to penetrate medical learning and of the reaction of humanistic rhetoric to medicine. "Medical humanism" is usually understood to encompass both the core enterprise of intensive philological study, editing, and translation of Greek medical texts—never the occupation of more than a handful of hellenist scholars—and also the reception and scientific influence of the fruits of their labors among a wider medical audience. But Renaissance medicine was also a humanistic discipline in a much broader and more inclusive sense; that is, it both fostered and provided ample scope for the development among learned physicians of interests characteristic of humanistic culture in general: rhetoric, history, biography, fascination with remote peoples and places, and antiquarianism. This paper uses a materialist feminist discourse analysis to examine how women’s movement organizations, liberal Democrats, and conservative Republican legislators shaped the Violence Against Women Act and the consequences for intersectional and carceral feminism. Drawing on qualitative analysis of Congressional hearings, published feminist and conservative discussion of VAWA, and accounts of feminist mobilization around VAWA, I first show how a multi-issue coalition led by feminists shaped VAWA. Second, I show how discourses of crime intermixed with feminism into a polysemic gendered (...) crime frame that facilitated cross-ideological support. Third, I show how, in contrast, intersectional issues that activists understood as central to violence against women were discursively and structurally separated from gendered crime in Congress. Although a multi-issue movement coalition advocated for expansions in VAWA dealing with immigrants, unmarried partners, same-sex partners, transgender people, and Native Americans, these issues were understood in Congress through more controversial single-issue discourses and often considered in administratively separate Congressional committees. Fourth, I show how VAWA’s outcomes played out in terms of carceral and intersectional feminist goals. (shrink)
