Philosophers of criminal punishment widely agree that criminal punishment should be “proportional” to the “seriousness” of the offense. But this apparent consensus is only superficial, masking significant dissensus below the surface. Proposed proportionality principles differ on several distinct dimensions, including: regarding which offense or offender properties determine offense “seriousness” and thus constitute a proportionality relatum; regarding whether punishment is objectionably disproportionate only when excessively severe, or also when excessively lenient; and regarding whether the principle can deliver absolute judgments, or only (...) comparative ones. This essay proposes that these differences cannot be successfully adjudicated, and one candidate proportionality principle preferred over its rivals, in the abstract; a proportionality principle only makes sense as an integrated part of a more complete justificatory theory of criminal punishment. It then sketches a proportionality principle that best fits the responsibility-constrained pluralist theories of criminal punishment that currently predominate. The proportionality principle it favors provides that punishments should not be disproportionately severe, in noncomparative terms, relative to an agent’s culpability in relation to their wrongdoing. ABSTRACT The Swedish case bears out Lewin's contention, in Self-Interest and Public Interest in Western Politics, that public spiritedness is much more important than is suggested by public-choice theories positing the universal dominance of self-interestedness. However, in Sweden we find that public spiritedness on the part of the public—as evidenced, for example, in sociotropic voting—was cultivated by political institutions, policies, and rhetoric that transformed a divided, conflictual society into one in which the “public interest” was both coherent and desirable. In (...) turn, this cultivation was the result of decisions by politicians that were, in the most simplistic sense, self-interested, because they secured the politicians’ election and re-election. But the goal of election and re-election was to create a just society. In short, the politicians, too, were public spirited. (shrink)

This article discusses an interdisciplinary and community-engaged public health law course that was developed as part of The Future of Public Health Law Education faculty fellowship program. Law and public health students worked collaboratively to assist a local health department in preparing for the law-related aspects of Public Health Accreditation Board review.

On January 22, 2002, California Governor Gray Davis released the state's long-anticipated, proposed regulations establishing hospital nurse-to-patient ratio requirements. The Safe Staffing Law mandating minimum ratios was enacted in October 1999 in response to legislators concerns that [q]uality of patient care is jeopardized because of staffing changes implemented in response to managed care. While the law was scheduled to take effect by January 1, 2002, conflict within the medical community regarding appropriate ratios slowed down the rulemaking process. Lawmakers now anticipate (...) that the rule will be implemented by January 2003. Approximately 5,000 new nurses will need to be hired for California's hospitals to come into compliance with the proposed regulation. (shrink)

Merleau-Ponty and Buddhism explores a new mode of philosophizing through a comparative study of Maurice Merleau-Ponty's phenomenology and philosophies of major Buddhist thinkers including Nagarjuna, Chinul, Dogen, Shinran, and Nishida Kitaro. The book offers an intercultural philosophy in which opposites intermingle in a chiasmic relationship, and which brings new understanding regarding the self and the self's relation with others in a globalized and multicultural world.

Few subjects have provoked more speculation or scholarly inquiry than the relationship between creativity and madness—or, in the case of Jason Thompson, the link between memoir writing and depression. Plato theorized that the poet’s madness is divinely inspired, and two thousand years later Sigmund Freud (1928/1961) admitted that “Before the problem of the creative artist analysis must, alas lay down its arms” (p. 177)—a cautionary injunction he then disregards. The strong sensorimotor account of perception gives self-induced movements two constitutive roles in explaining visual consciousness. The first says that self-induced movements are vehicles of visual awareness, and for this reason consciousness ‘does not happen in the brain only’. The second says that the phenomenal nature of visual experiences is consists in the action-directing content of vision. In response I suggest, first, that the sense in which visual awareness is active should be explained by appeal to the role of attention (...) in visual consciousness, rather than self-induced movements; and second, that the sense in which perceptual consciousness does not happen in the brain only should be explained by appeal to the relational nature of perceptual consciousness, appeal to which also shows why links with action cannot exhaust phenomenal content. Using a multimethod approach, this article examines the link between class and masculinities by comparing the way two groups—professional men and working-class men —practice fatherhood. First, the authors show that these two groups practice different types of masculinity as they engage in different kinds of fatherhood. Physicians emphasize “public fatherhood,” which entails attendance at public events but little involvement in the daily care of their children. In contrast, EMTs are not only involved in their children's public events but also emphasize (...) “private fatherhood,” which entails involvement in their daily care. Second, the authors suggest that these differing types of involvement can be explained by the contrasting employment conditions of each group as well the gender order of their families, especially the divergent labor market positions of spouses and the division of parenting. The authors conclude by arguing that these working-class fathers are “undoing gender” while professional fathers reproduce the conventional gender order. (shrink)

Naomi Scheman argues that the concerns of philosophy emerge not from the universal human condition but from conditions of privilege. Her books represents a powerful challenge to the notion that gender makes no difference in the construction of philosophical reasoning. At the same time, it criticizes the narrow focus of most feminist theorizing and calls for a more inclusive form of inquiry.

Unlike nearly all studies of Berkeley, this book looks at the full range of his work and links it with his life--focusing in particular on his religious thought. Deepening understanding without abandoning hope, Zack shows why it is more important to consider black rights than white privilege as we move forward through today's culture of inequality.

Most professionally-qualifying youth work programmes in the UK are secular programmes in mainstream universities. Current UK National Occupational Standards require youth workers to ‘Explore the concept of values and beliefs with young people’. Faith organisations form the largest sector of the UK youth work field and all youth workers need to be equipped to work inclusively with diverse communities. This research explored, through a semi-structured survey sent to programme leaders, the coverage of religion, faith and spirituality in youth work training (...) courses in England. We found tensions in how religion, faith and spirituality are incorporated into programmes and how programme leaders think youth workers should engage with it in their practice. Where explicit content on religion, faith and spirituality is incorporated into training programmes, it tends to focus on controversial issues such as radicalisation. The survey revealed a lack of consensus across programme leaders as to how the NOS relating to values and beliefs should be interpreted and whether their graduates are being sufficiently equipped to work with diverse religious communities. The research exposes a need for more explicit recognition of the place of religion, faith and spirituality in youth work and in the curricula of secular training programmes. (shrink)

It’s widely accepted that we have most reason to accept theories that best fulfill the following naturalistically respectable criteria: internal consistency, consistency with the facts, and exemplification of the theoretical virtues. It’s also widely accepted that metaphysical theories are necessarily true. I argue that if you accept the aforementioned criteria, you have most reason to reject that metaphysical theories are necessarily true. By applying the criteria to worlds that are all prima facie possible, I show that contingent local matters of (...) particular fact partly determine which theory of composition we should accept at a world. For instance, I argue that when we apply the criteria to our world, we should accept Mereological Nihilism. Furthermore, even if you think that the worlds I mention, such as gunky worlds, are impossible, you should still reject the brute principle that metaphysical theories are necessarily true. Instead, you should only accept that a theory of composition is necessarily true if contingent local matters of particular fact at possible worlds cannot tell in favor of one theory of composition over another. The U.S. scientific community has long led the world in research on such areas as public health, environmental science, and issues affecting quality of life. These scientists have produced landmark studies on the dangers of DDT, tobacco smoke, acid rain, and global warming. But at the same time, a small yet potent subset of this community leads the world in vehement denial of these dangers. -/- Merchants of Doubt tells the story of how a loose-knit group of high-level scientists and (...) scientific advisers, with deep connections in politics and industry, ran effective campaigns to mislead the public and deny well-established scientific knowledge over four decades. Remarkably, the same individuals surface repeatedly-some of the same figures who have claimed that the science of global warming is "not settled" denied the truth of studies linking smoking to lung cancer, coal smoke to acid rain, and CFCs to the ozone hole. "Doubt is our product," wrote one tobacco executive. These "experts" supplied it. -/- Naomi Oreskes and Erik M. Conway, historians of science, roll back the rug on this dark corner of the American scientific community, showing how ideology and corporate interests, aided by a too-compliant media, have skewed public understanding of some of the most pressing issues of our era. ExcerptIn the immediate aftermath of the Hamas attacks on October 7, and then again during the spring, coordinated protests have spread through colleges and universities. The rapidity with which normal functioning was disrupted and the helplessness of administrators, on poignant display in the congressional hearing, point to fundamental weaknesses in higher education. I doubt that there can be a return to a pre-October 7 normalcy. Public dismay with universities was already pronounced before the protests, and the campus chaos has triggered (...) memories of the lawlessness of the George Floyd riots. What’s wrong with higher ed? Can it be saved with a program of ambitious reforms? Or do we need new structures? In the wake of October 7, universities are due for major changes, one way or another, by themselves or by Congress. A very different set of institutions may emerge. (shrink)
