This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. The postmodern age, in its critic to the modern period, demands the recovery of some losses. At the time of fast changes as it happens in the Renaissance, the Humanism originates a fruitful debate. According to the authors protagonists, the controversy became a dialogue plenty of common questions to which we find in the contemporary discussion. The reflection (...) on the thought of one of the most representative and well-known authors, Comenio, it serves to think on the encounter of traditions in Philosophy of Education. Posverdad ha sido recientemente definida como la manipulación deliberada de una realidad con el fin de influir en la opinión pública y en actitudes sociales. Al mismo tiempo, esta idea se ha asimilado, en variadas ocasiones, a discursos postmetafísicos como el de Richard Rorty. Este artículo pretende esclarecer la concepción de verdad de Richard Rorty y abordar la errónea asociación de su pensamiento posmoderno con el surgimiento de la posverdad en el ámbito político contemporáneo. Aunque se ha vinculado la posverdad (...) con la filosofía de autores posmodernos contemporáneos como Rorty, es importante señalar que esta asociación carece de fundamento. Rorty no abordó directamente el concepto de posverdad en su obra, y aunque su enfoque posmoderno sobre la contingencia del lenguaje y la construcción social de la realidad puede tener implicaciones en la esfera política, no es adecuado reducir su filosofía a un respaldo teórico de la posverdad. Attention-deficit hyperactivity disorder is one of the most common neurodevelopmental disorders in children and adolescents. People who have this disorder are characterized by presenting difficulties in the processes of sustained attention, being very active, and having poor control of their impulses. Despite the high prevalence of this disorder and the existence of various tests used for its diagnosis, few data are available regarding the usefulness and diagnostic validity of these tools. Given the difficulties that these subjects present in executive functions, (...) the aim of this study was to evaluate whether the Neuropsychological Assessment of Executive Functions battery for Children allows to establish specific profiles of executive performance for people with attention-deficit hyperactivity disorder. The sample was made up of 197 participants of both sexes, aged between 6 and 12 years age. A nonexperimental design was followed, using a comparative descriptive study method. The results indicated that the scales of phonological fluency, color path, rings, and interference are the most associated with the diagnosis of ADHD, providing data on inhibition, mental flexibility, sustained and selective attention, planning, verbal fluency, and working memory, among others. The practical implication of these results is in line with providing support in the clinical diagnosis that is carried out in children’s mental health units. In addition, the ENFEN tool can be valued as a suitable psychometric instrument in the psychoeducational field, helping professionals in a school environment to be more aware of the areas of cognitive development in which a student diagnosed with ADHD will have more difficulties and, in doing so, providing more adjusted and effective psychopedagogical measures when it comes to supporting students in their adaptation to the school environment. En este artículo se revisan los avances, los desafíos y las particularidades de la ciencia abierta en la investigación cualitativa. En particular se analiza la apertura de datos porque tiene menor avance en comparación con la publicación en repositorios y revistas de acceso libre. Se revisan los criterios de validez en la investigación cualitativa en ciencias sociales, para identificar algunos elementos que fomenten la apertura de datos, ya que, mientras se plantee como una vía para replicar resultados de investigación, tendrá (...) poco eco en la comunidad que practica la investigación cualitativa. Sin embargo, el artículo muestra que el compartir datos puede fortalecer las estrategias de verificación cualitativa y preservar el conocimiento, las experiencias, las historias y los contextos cotidianos de las personas participantes. ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. The aim of this study was to assess the predictive capacity of some of the most relevant cognitive skills pertaining to the academic field as measured by the Spanish Primary School Aptitude Test Battery. This psychometric tool was applied to all students who were enrolled in the final year of Early Childhood Education in the public schools of the province of Alicante and a follow-up of their academic progress was carried out when they completed Primary Education. The results obtained show (...) that medium-high and high scores in Verbal Aptitude and Numerical Aptitude tests in Early Childhood Education, can predict academic success at the end of Primary Education in instrumental subjects such as: Language and Mathematics. We have determined the importance of developing pedagogical programs that stimulate the development of these skills during Early Childhood Education, while implementing support strategies during Primary Education, for those students who present underdeveloped aptitudes in these areas. In this way, school difficulties would be prevented in the instrumental subjects that provide access to other academic areas. (shrink)

La democracia hizo que los sentados a la mesa fuésemos más. Que pudiéramos tener mejores productos y más cocineros. Que el sabor no tuviese que pedir permiso para poder viajar. Que los aromas no fuesen detenidos por alcabalas ni en aduanas. Con la libertad se come mejor. La posibilidad de escoger se agranda hasta volverse casi infinita. La presencia de la democracia, y también su ausencia y restricciones, se observan no sólo en la calle y en la prensa sino también (...) y mejor en la mesa cotidiana. La libertad se olfatea, se bebe y se mastica. La democracia en la mesa tiene también su precio. Los malos, el engaño y la especulación forman parte del proceso. Saber escoger implica saber vivir. Table and FreedomDemocracy increased the number of those sitting at the table. It made possible for us to have better products and more cooks; for flavor not to ask for permission to be able to travel around; for aromas not to be detained by checkpoints or customs. With freedom one eats better. The possibility to choose grows larger, ultimately becoming almost infinite. The presence of democracy, and also its absence and restrictions, can be noticed not also in the street and the press, but also, and in a better fashion, at the ordinary table. Freedom can be smelled, drunk and chewed. Democracy at the table also has its price. The delinquents, deceit and speculation are part of the process. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

En este sentido, haremos referencia al papel integrador que tuvo el ejército romano durante buena parte de la historia (...) del Imperio Romano, y señalaremos los principales hechos que condujeron al final de dicho papel; esbozando también las desastrosas consecuencias que tuvo este hecho para el futuro del Imperio, especialmente del Occidental. In it we will emphasize the role of the barbarians who fought with the Romans, since the barbarización of the Roman army is one of the points of reference in the investigations about the decay and fall of the Roman Empire. In this sense, we will refer to the role played by the Roman army in the integration of foreigners during a large part of the history of the Roman Empire. In addition, we will point out the main events that led to the end of this integrating role; we will also indicate the disastrous consequences this fact had for the future of the Empire, especially for the Western part. En su escrito autobiográfico, Trotsky las orquídeas silvestres, Rorty describe su trayectoria filosófica y presenta su alternativa a Platón como pensada desde su más pronta juventud. Sin embargo, como vamos a mostrar, el proyecto central de acabar con la imagen única de Platón no es algo que esté pensado ni se dé desde un principio en sus obras. Defendemos que, pese a lo que (...) el propio Rorty indicó en sus escritos, encontramos indicios de que no es hasta la década de los noventa que Rorty piensa en elaborar una nueva relación alternativa al léxico último de Platón. ABSTRACT The article examines the origin of the rortyan project to destroy Plato's unique image. In his autobiographical writing, Trotsky the Wild Orchids, Rorty describes his philosophical journey and presents his alternative to Plato as thought out from his earliest youth. However, as we will show, the central project of ending Plato's unique image is not something that is thought out or given from the beginning in his works. We argue that, despite what Rorty himself indicated in his writings, we find indications that it is not until the 1990s that Rorty thinks of elaborating a new alternative relationship to Plato's last lexicon. I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. Este artigo analisa a projeção continental do México revolucionário no pós 1917 a partir do caso brasileiro. Após a eclosão da Revolução Russa, o modelo bolchevique passou a rivalizar indiretamente com o protagonismo que o México revolucionário pretendia exercer no cenário latino-americano. Assim, a ideia de um “autoctonismo continental” passou a ser enfatizada na propaganda mexicana como elemento que faria da Revolução Mexicana um modelo mais apropriado de transformação social para os países latino-americanos. Discutimos neste artigo os aspectos tomados pela (...) propaganda mexicana e algumas apropriações da experiência revolucionária do México por parte dos brasileiros, com destaque para o caso dos socialistas. In this paper we analyse utterances that, without explicitly constituting hate speech, nevertheless convey a hateful message. For example, in the headline “Iraqi Refugee is convicted in Germany of raping and murdering teenage girl”, the presence of “Iraqi refugee” does not seem arbitrary. To the contrary, it is responsible for inviting a racist inference against Iraqi refugees. We defend that these inferences cannot be described as slurs, ethnic or social terms used as insults, dogwhistles or conversational implicatures. Rather, we propose (...) that these inferences are insinuations, specifically provocative insinuations, as no conversational response seems effective at blocking them. (shrink)

This article argues the philosophical concerns and foundational challenges raised by a for-profit model of education. The for-profit model is governed by a business paradigm, without reference to the context in which it is found. The authors explore primary ethical questions and challenges presented by this model. As such, they present potential solutions to the growing problem in higher education as a corporate entity. The authors introduce a potential model for analysis of the issues and suggest an interventional technique with (...) concrete directions for change. Universities are on the threshold of a transformation which can no longer be isolated from wider society. This environment awakened the critical task of blending corporate success with educational integrity. (shrink)

M. J. Dewar argues that in Georg. 1.511–4 Virgil may have been drawing a disquieting parallel between Orestes, evoked through an imitation of Aeschylus , and Octavian, present a few lines above . Pausanias probably supports this suggestion; he shows that the link Octavian-Orestes existed quite early and in a sense favourable to Octavian, even though it may soon have been used in a negative sense by anti-Caesarian propaganda on account of the dark side of the myth. In front of (...) the temple of Hera in Argos there was still visible in the second century a statue representing Orestes, but identified by the inscription as Augustus. Certainly this parallel Augustus-Orestes was not proposed-and preserved - with polemical purpose in a famous sanctuary and in the Augustan age. Given the resemblance between history and myth and the moral weight of the famous myth itself, it is unlikely that we have to do with the mere re-use of any old statue. (shrink)

We explore a particular type of propagandistic message, which we call “provocative insinuation”. For example: ‘Iraqi refugee is convicted in Germany of raping and murdering teenage girl’. Although this sentence seems to merely report a fact, it also conveys a potentially hateful message about Iraqi refugees. We look at the argumentative roles that these utterances play in public discourse. Specifically, we argue that they implicitly address the question of the integration of refugees and migrants, and in fact aim to tilt (...) the audience against these groups by strongly inviting hearers to make generalisations based on “striking” properties. We examine different strategies to counteract the conveyed hateful message. (shrink)

This article aims to clarify the relationship between the Truth and Justification in the philosophies of Jürgen Habermas and Richard Rorty from their discussions. The thesis that I advocate is that the relationship between Truth and Justification depends on the Ontological and Epistemological assumptions that each maintains and is not a matter of conditions of speech as stated by Habermas.

It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

This paper summarizes three major approaches to the problem of business ethics. Comparisons and contrasts are drawn between the moralistic approach of Berhman, the social contract theory of Nash, and a comprehensive systems approach as articulated by Elbing. In the final section, some attempt is made to indicate how these models may be implemented into managerial policy decision making process by the use of group work and ascending communication. Some consideration of using organizational structure to implement ethical concerns is indicated.

El presente trabajo reconstruye algunas de las tesis centrales de la familia realista-liberal de la democracia en relación con los liderazgos políticos y la participación política de la ciudadanía en sus dos fases de pensamiento: desde el elitismo hacia la poliarquía. Posteriormente se formulan algunas de las críticas que los teóricos deliberativos le realizan a este modelo en relación con el carácter minimalista de la participación y sus dificultades para combatir posibles poderes exógenos a la política. En este sentido, se (...) presentan tres pilares del modelo deliberativo para superar esta aparente debilidad del modelo realista-liberal y generar autonomía política o, al menos, combatir su heteronomía a través de: 1) la transformación de preferencias, 2) el ejercicio de una razón comunicativa, y 3) una fundamentación epistémica de las creencias morales.
