HUME'S DEBT TO KANT Various commentators on Hume's work have argued that his examination of our causal reasoning is not fundamentally at odds with the claims made by Kant in his supposed "answer to Hume". One way of making the connection, suggested by Wolff for example, is to emphasize the ways in which Humean epistemology depends upon a theory of mental activity. If this activity itself can (...) only be understood in terms of built-in "propensities" of the mind, these dispositions can be interpreted as psychological descriptions of a mind operating in accordance with something quite like Kantian categories. Another way of arguing for this compatibility between Hume and Kant is to bring out central principles (e.g., relating to causation ) which Hume's account depends upon, but which are such that they cannot be given an experiential foundation. Lewis White Beck has offered such a Kantianization of Hume, arguing that beneath the surface of the official Empiricist Hume (and just outside Hume's view of what he was doing) there is a commitment to principles that have 2 an a priori status in his theory. If Beck is right about this, we might speak with tongue only partially in cheek, of Hume's debt to Kant, for the Kantian categories could be taken as the systematic working out of the underpinnings of Hume's theory. In this paper I shall consider this problem only insofar as it relates to causal reasoning. I focus on Professor Wilson's defense of the Empiricist Hume, in which it is denied that our causal reasoning rests upon a priori principles. The principles in question are that (1) Every event has some cause, and (2) That like causes have like effects, and like effects like causes. Wilson argues that these are both empirical generalizations within an account that is both plausible and Humean. I shall 60. argue briefly that, contrary to Wilson's claim, the Humean account of causation makes the second of these an a priori truth because it is analytic. The first is certainly not an analytic truth, but it could not have been derived from experience, at least as Hume depicts our experience. It thus seems to be a claim that is functioning as synthetic and a priori in Hume's account of our beliefs. Except in the general way that this phrase implies, this paper is not really about Kant, who will barely be mentioned again. In my discussion of Wilson's argument I will not deal with the formalizations which he has introduced, but will attempt to capture the main lines of argument in more or less ordinary language. In proceeding thus, I am siding with Hume in siding with the vulgar. Having listed the eight rules of causal judgment which are under discussion here, Hume says Here is all the LOGIC I think proper to employ in my reasoning; and perhaps even this was not very necessary, but might have been supply 'd by the natural principles of our understanding. Our scholastic headpieces and logicians shew no such superiority above the mere vulgar in their reason and ability, as to give us an inclination to imitate them in delivering a long system of rules and precepts to direct our judgment, in philosophy. The basic problem is whether or not Hume's explanation of our causal reasoning depends upon the assumption that all events have causes, and depends upon it in a way that makes this assumption a priori. Beck (and Wolff) have argued that this is the case, and hence that Hume is much closer to Kant than is commonly supposed. This Wilson denies. The argument revolves around the cases in which we fail to observe the causes we have come to associate with certain effects (or, in principle, vice versa) so that the conjunction of events is not "constant". The Humean account of what happens in such circumstances is that the imagination supplies the deficiency; we feign unobserved events to 4 fill the gap. Corey W. Dyck presents a new account of Kant's criticism of the rational investigation of the soul in his monumental Critique of Pure Reason, in light of its eighteenth-century German context. When characterizing the rational psychology that is Kant's target in the Paralogisms of Pure Reason chapter of the Critique commentators typically only refer to an approach to, and an account of, the soul found principally in the thought of Descartes and Leibniz. But Dyck argues that to do so is (...) to overlook the distinctive rational psychology developed by Christian Wolff, which emphasized the empirical foundation of any rational cognition of the soul, and which was widely influential among eighteenth-century German philosophers, including Kant. In this book, Dyck reveals how the received conception of the aim and results of Kant's Paralogisms must be revised in light of a proper understanding of the rational psychology that is the most proximate target of Kant's attack. In particular, he contends that Kant's criticism hinges upon exposing the illusory basis of the rational psychologist's claims inasmuch as he falls prey to the appearance of the soul as being given in inner experience. Moreover, Dyck demonstrates that significant light can be shed on Kant's discussion of the soul's substantiality, simplicity, personality, and existence by considering the Paralogisms in this historical context. Bare particularism is a constituent ontology according to which substances—concrete, particular objects like people, tables, and tomatoes—are complex entities constituted by their properties and their bare particulars. Yet, aside from this description, much about bare particularism is fundamentally unclear. In this paper, I attempt to clarify this muddle by elucidating the key metaphysical commitments underpinning any plausible formulation of the position. So the aim here is primarily catechismal rather than evangelical—I don’t intend to convert anyone to bare particularism, but, by (...) looking at a series of questions, to instead specify what, if one is a bare particularist, one is committed to. Along the way, I address three major objections: a classic objection about whether bare particulars have properties, a new objection raised by Bailey, and an understanding objection that questions some of the position’s resources. The scope and severity of the opioid epidemic in the United States has prompted significant legislative intrusion into the patient-physician relationship. These proscriptive regulatory regimes mirror earlier legislation in other politically-charged domains like abortion and gun regulation. We draw on lessons from those contexts to argue that states should consider integrating their responses to the epidemic with existing medical regulatory structures, making physicians partners rather than adversaries in addressing this public health crisis.

While many people outside India find the images, sounds, and practices of Indian performing arts compelling and endeavor to incorporate them into the "global" repertoire, few are aware of the central role of religious belief and practice in Indian aesthetics. Completing the trilogy that includes Darsan: Seeing the Divine and Mantra: Hearing the Divine in India and America, this volume focuses on how rasa has been applied in a range of Indian performance traditions. "Rasa" is taste, essence, flavor. How is (...) it possible that a word used to describe a delicious masala can also be used to critique a Bharata Natyam performance? Rasa expresses the primary goals of performing arts in India in all the major literary, philosophical, and aesthetic texts, and it provides the cornerstone of the oral traditions of transmission. It is also essential to the study and production of sculpture, architecture, and painting. Yet its primary referent is cuisine. This book articulates the religious sensibility underlying the traditional performing arts as well as other applications of rasa and examines the relationships between the arts and religion in India today. Although some doctors celebrated when the Court of Appeal overturned Hadiza Bawa-Garba’s erasure from the medical register, it is argued here that in many ways the ruling is by no means good news for the medical profession. Doctors’ interests are served by transparent professional tribunals but the Court of Appeal’s approach to the GMC Sanctions Guidance risks increasing opacity in decision-making. Close attention to systemic factors in the criminal trial protects doctors yet the Court of Appeal states that the structural (...) circumstances surrounding Bawa-Garba’s failings were only of peripheral relevance to her conviction. Public confidence in the profession is undermined when convicted doctors return to work because the public de facto do not understand the nuance of gross negligence manslaughter law. Rather than changing the law to make the regulator more lenient towards doctors, it would be better to ensure that doctors are only convicted of gross negligence manslaughter when their conduct is so serious that they ought to be struck off. The emergence of the European Union citizenship agenda has mainly taken place along the evolution of mobility rights, with the goal of creating a pan-European labor market. Mobility undermines the nationally embedded notion of industrial citizenship. Industrial citizenship protects workers’ rights and secures their participation in national political systems. The Europeanization of labor markets severs the relationship between state, territory and citizen on which industrial citizenship has been built, undermining worker collectivism and access to representation. This is legitimated in terms (...) of building market-citizenship, i.e., enabling mobile workers as market actors. However, the way mobility is regulated in the EU has the purpose and effect of weakening collective labor institutions, which also undermines workers’ ability to act as autonomous market actors. The same factors which undermine the industrial citizenship of mobile workers also prevent them from being effective free market agents: i.e., they can neither negotiate nor enforce individual contracts effectively in the face of systematic employer fraud and wage theft. The “Arendtian dilemma” of the “right to have rights” — a dilemma that derives from the claim that rights depend on the existence of a political community, which until now is the territorially exclusive nation-state, rather than universal personhood — emerges as industrial citizenship is internationalized. By disembeddeding workers from host-country industrial relations systems, EU regulation provides the social context in which workers’ rights become alienable. (shrink)

Do free will beliefs influence moral judgments? Answers to this question from theoretical and empirical perspectives are controversial. This study attempted to replicate past research and offer theoretical insights by analyzing World Values Survey data from residents of 46 countries (n = 65,111 persons). Corroborating experimental findings, free will beliefs predicted intolerance of unethical behaviors and support for severe criminal punishment. Further, the link between free will beliefs and intolerance of unethical behavior was moderated by variations in countries’ institutional integrity, (...) defined as the degree to which countries had accountable, corruption-free public sectors. Free will beliefs predicted intolerance of unethical behaviors for residents of countries with high and moderate institutional integrity, but this correlation was not seen for countries with low institutional integrity. Free will beliefs predicted support for criminal punishment regardless of countries’ institutional integrity. Results were robust across different operationalizations of institutional integrity and with or without statistical control variables. (shrink)

The challenge of orphans and vulnerable children has become central to the response of many organisations today. The number of OVC throughout northern Nigeria is growing as a result of the Boko Haram pandemic. Mostly, this is caused by the death of parents who have been killed by the insurgents. It has been estimated that by 2015, 200 000 children under the age of 18 had been orphaned by the Boko Haram insurgents. As the number of OVC is growing, it (...) is becoming more and more difficult for their communities to address all their needs, including their need for positive role models and mentors. This article discusses the role that mentoring can play in the development of OVC affected by violence in northern Nigeria, specifically those in internally displaced person camps. This article argued that one approach to improve the holistic care of OVC in IDP camps in northern Nigeria is through the use of mentors. (shrink)

Many studies have shown that women are more likely than men to be living kidney donors, and the discrepancy is particularly marked in heterosexual couples: wives are more likely than husbands to donate a kidney to their spouse. This ‘ Gender Kidney Donation Gap’ can be understood in terms of Carol Gilligan’s claims about gender differences in ethical decision-making style, making it appropriate to analyse responses to this imbalance using an ethic of care. This article centres the vast majority of (...) living donors, those who donate in the context of a significant pre-existing relationship. A cost-neutral approach is unfair on donors who make society richer and healthier by helping a loved one. However, models of kidney sale fail to offer an acceptable alternative, either (a) compelling donors to sell into a pool where they do not know the recipient or (b) allowing affluent individuals unfair access to kidneys. Drawing on surrogacy law in England and Wales, a model of compensation is proposed that includes a range of non-financial benefits. This option celebrates donation and expresses gratitude to all donors while avoiding the pitfalls of the marketplace, with an emphasis on fair treatment of donors. Nevertheless, if more generous treatment led to a 10% increase in directed donation, then it would be equivalent to doubling ‘altruistic’ stranger donations. As long as the Gender Kidney Donation Gap persists, the best response is to minimise the discomfort and disruption caused to donors by their profound act of kindness. (shrink)

In Embryo: A Defense of Human Life (Doubleday, 2008), Robert P. George and Christopher Tollefsen argue that human embryo-destructive experimentation is morally wrong and should not be supported with state funds. I argue that their arguments fail.

Although one can argue that they do not represent a radical departure from existing practices, protocols for reverse triage certainly step beyond what is ordinarily done in medicine and healthcare. Nevertheless, there seems to be some degree of moral concern regarding the ethical legitimacy of practicing reverse triage in the context of a pandemic. Such concern can be taken as a reflection of the moral antipathy some exhibit towards current practices of withdrawing treatment—that is, when withdrawal of treatment is arguably (...) in the best interests of patients—and a rejection of the purported normative insignificance of withholding and withdrawing. Given that the relevance of the psychological attitudes of some healthcare professionals to the moral assessment of withdrawing and withholding treatment continues to be debated, it would seem that some thought should be given to the introduction and implementation of reverse triage decisions in response to a pandemic. This brief paper will consider if provision should be made for healthcare professionals to conscientiously refuse to participate in reverse triage. (shrink)

The nursing community in the United States polarized in September 2020 between Dawn Wooten's whistleblowing about forced hysterectomies at an immigration center in Georgia and the American Nurses Association's refusal to endorse a presidential candidate despite the Trump administration's mounting failures to address the public health crisis posed by the COVID‐19 pandemic. This reveals a need for more attention to political aspects of health outcome inequities. As advocates for health equity, nurses can join in recent scholarship and activism concerning the (...) political determinants of health. In this paper, we examine recent work on the political determinants of health with an aim to add two things. First, we seek to build further on the notion of “political” determinants of health by distinguishing policy and governance structures from dynamics of politicization through appeal to critical disabilities studies. Second, we seek to apply this further nuanced approach to challenge rhetorical uses of “vulnerable populations,” where this phrase serves to misrecognize systemic institutionalized forces that actively exploit and marginalize people and groups. By refocusing attention to political systems organized around and perpetuating inequitable health outcomes, nurses and other health care professionals—as well as those whom they serve—can concentrate their effort and power to act on political determinants of health in bringing about more equitable health outcomes. This paper focuses on the practice of injecting patients who are dying with a relatively high dose of sedatives in response to a catastrophic event that will shortly precipitate death, something that we term ‘crisis sedation.’ We first present a confabulated case that illustrates the kind of events we have in mind, before offering a more detailed account of the practice. We then comment on some of the ethical issues that crisis sedation might raise. We identify the primary value of (...) crisis sedation as allowing healthcare professionals to provide some degree of reassurance to patients, their families and the professionals who are caring for them. Next we focus on the issue of informed consent. Finally, we ask whether continuous deep sedation might be preferable to crisis sedation in scenarios where potential catastrophic events can be anticipated. (shrink)

In this article, I probe the extent of Kierkegaard's skepticism and irrationalism by examining the nature and limits of his “objective” and “approximate” knowledge. I argue that, for Kierkegaard, certain objective knowledge of contingent being is impossible and “approximate” knowledge of the same is funded by the volitional passion of belief. But, while Kierkegaard endorses severe epistemic restrictions, he rejects wholesale skepticism, allowing for genuine “approximate” knowledge of mind-independent reality. However, I further argue that we cannot ignore his criticisms of (...) such knowledge because of its intrinsic dangers, and because epistemic limitations are crucial in developing religious selfhood before God. In October 1862, the Duke of Argyll published an article in the Edinburgh Review entitled “The Supernatural.” In it, Argyll argued that contrary to the prevailing assumption, miracles were “natural” rather than “supernatural” acts of God. This reconceptualization was a response to the controversial publication Essays and Reviews (1860), which challenged orthodox Biblical doctrine. Argyll's characterization of a miracle was not novel; a number of early modern Newtonian thinkers had advanced the same argument for similar reasons. New in this nineteenth-century (...) reconceptualization, however, were (1) the recent geological, physical, and evolutionary developments and (2) the introduction of German higher criticism. Argyll and the neo-Newtonians thus attempted to construct a philosophico-theological alternative, which would constitute a middle-position between the traditional acceptance and liberal rejection of miracles. I argue finally that 21st-century debates on divine action in fact exist as part of a longer historical tradition that dates back to Augustine. (shrink)

Despite significant progress in the legalization and decriminalization of abortion in Australia over the past decade or more recent research and government reports have made it clear that problems with the provision of services remain. This essay examines such issues and sets forth the view that such issues can and should be seen as (bio)ethical concerns. Whilst conscientious objection—the right to opt-out of provision on the basis of clear ethical reservations—is a legally and morally permissible stance that healthcare professionals can (...) adopt, this does not mean those working in healthcare can simply elect not to be providers absent a clear ethical rationale. Furthermore, simple non-provision would seem to contravene the basic tenants of medical professionalism as well as the oft raised claims of the healthcare professions to put the needs of patients first. Recognizing that much of the progress that has been made over the past three decades can be attributed to the efforts of dedicated healthcare professionals who have dedicated their careers to meeting the profession’s collective responsibilities in this area of women’s health and reproductive healthcare, this paper frames the matter as a collective ethical lapse on the part of healthcare professionals, the healthcare professions and those involved in the management of healthcare institutions. Whilst also acknowledging that a range of complex factors have led to the present situation, that a variety of steps need to be taken to ensure the proper delivery of services that are comprehensive, and that there has been an absence of critical commentary and analysis of this topic by bioethicists, I conclude that there is a need to (re)assess the provision of abortion in Australia at all levels of service delivery and for the healthcare professions and healthcare professionals to take lead in doing so. That this ought to be done is clearly implied by the healthcare profession’s longstanding commitment to prioritizing the needs of patient over their own interests. (shrink)
