Political corruption imposes substantial costs on shareholders in the U.S. Yet, we understand little about the basic factors that exacerbate or mitigate the value consequences of political corruption. Using federal corruption convictions data, we find that firm-level economic rents and monitoring mechanisms moderate the negative relation between corruption and firm value. The value consequences of political corruption are exacerbated for firms operating in low-rent product markets and mitigated for firms subject to external monitoring by state governments or monitoring induced by (...) disclosure transparency. Our results should inform managers and policymakers of the tradeoffs imposed on firms operating in politically corrupt districts. (shrink)

A categorical, higher dimensional algebra and generalized topos framework for Łukasiewicz–Moisil Algebraic–Logic models of non-linear dynamics in complex functional genomes and cell interactomes is proposed. Łukasiewicz–Moisil Algebraic–Logic models of neural, genetic and neoplastic cell networks, as well as signaling pathways in cells are formulated in terms of non-linear dynamic systems with n-state components that allow for the generalization of previous logical models of both genetic activities and neural networks. An algebraic formulation of variable ‘next-state functions’ is extended to a Łukasiewicz–Moisil (...) Topos with an n-valued Łukasiewicz–Moisil Algebraic Logic subobject classifier description that represents non-random and non-linear network activities as well as their transformations in developmental processes and carcinogenesis. The unification of the theories of organismic sets, molecular sets and Robert Rosen’s (M,R)-systems is also considered here in terms of natural transformations of organismal structures which generate higher dimensional algebras based on consistent axioms, thus avoiding well known logical paradoxes occurring with sets. Quantum bionetworks, such as quantum neural nets and quantum genetic networks, are also discussed and their underlying, non-commutative quantum logics are considered in the context of an emerging Quantum Relational Biology. This paper reviews the literature concerning the neural correlates of the self, the relationship between self and memory and the profile of memory impairments in Alzheimer’s disease and explores the relationship between the preservation of the self and anosognosia in this condition. It concludes that a potential explanation for anosognosia in AD is a lack of updating of personal information due to the memory impairments characteristic of this disease. A categorical ontology of space and time is presented for emergent biosystems, super-complex dynamics, evolution and human consciousness. Relational structures of organisms and the human mind are naturally represented in non-abelian categories and higher dimensional algebra. The ascent of man and other organisms through adaptation, evolution and social co-evolution is viewed in categorical terms as variable biogroupoid representations of evolving species. The unifying theme of local-to-global approaches to organismic development, evolution and human consciousness leads to novel patterns of relations that (...) emerge in super- and ultra- complex systems in terms of colimits of biogroupoids, and more generally, as compositions of local procedures to be defined in terms of locally Lie groupoids. Solutions to such local-to-global problems in highly complex systems with ‘broken symmetry’ may be found with the help of generalized van Kampen theorems in algebraic topology such as the Higher Homotopy van Kampen theorem (HHvKT). Primordial organism structures are predicted from the simplest metabolic-repair systems extended to self-replication through autocatalytic reactions. The intrinsic dynamic ‘asymmetry’ of genetic networks in organismic development and evolution is investigated in terms of categories of many-valued, Łukasiewicz–Moisil logic algebras and then compared with those obtained for (non-commutative) quantum logics. The claim is defended in this essay that human consciousness is unique and should be viewed as an ultra-complex, global process of processes. The emergence of consciousness and its existence seem dependent upon an extremely complex structural and functional unit with an asymmetric network topology and connectivities—the human brain—that developed through societal co-evolution, elaborate language/symbolic communication and ‘virtual’, higher dimensional, non-commutative processes involving separate space and time perceptions. Philosophical theories of the mind are approached from the theory of levels and ultra-complexity viewpoints which throw new light on previous representational hypotheses and proposed semantic models in cognitive science. Anticipatory systems and complex causality at the top levels of reality are also discussed in the context of the ontological theory of levels with its complex/entangled/intertwined ramifications in psychology, sociology and ecology. The presence of strange attractors in modern society dynamics gives rise to very serious concerns for the future of mankind and the continued persistence of a multi-stable biosphere. A paradigm shift towards non-commutative, or non-Abelian, theories of highly complex dynamics is suggested to unfold now in physics, mathematics, life and cognitive sciences, thus leading to the realizations of higher dimensional algebras in neurosciences and psychology, as well as in human genomics, bioinformatics and interactomics. The ACA shifted U.S. health policy from centering on principles of actuarial fairness toward social solidarity. Yet four legal fixtures of the health care system have prevented the achievement of social solidarity: federalism, fiscal pluralism, privatization, and individualism. Future reforms must confront these fixtures to realize social solidarity in health care, American-style.

Out-of-network air ambulance bills are a pernicious and financially devastating type of surprise medical bill. Courts have broadly interpreted the Airline Deregulation Act to preempt most state attempts to regulate air ambulance billing abuses, so a federal solution is ultimately needed. However, in the absence of a federal fix, states have experimented with a variety of approaches that may survive preemption and provide some protections for their citizens.

I Propose to re-explore here some aspects of a very shop-worn question: ‘Was Hobbes in any sense an atheist?’ Three centuries ago, Hobbes's personal security in part depended on the way his contemporaries answered this question; today, the validity of several current accounts of his philosophy are similarly bound up with it. These accounts vary extraordinarily, all the way from Polin's confident assertion that ‘ pour qui sait lire entre les lignes, … c'est ľatheísme qui triomphe implicitement ’, to Taylor's (...) equally firm belief that ‘a certain kind of theism is necessary to make [Hobbes's] theory work.’ 1 And now the latest of the Taylorians, Prof. Howard Warrender, has published his book The Political Philosophy of Hobbes , in which Hobbes's statements regarding the place of God are again treated as an essential part of his theory; and the charge explicitly made, that there are no sound grounds for regarding them as ‘the product of confusion or pretence on Hobbes's part’. In a recent judgment1 the Court of Protection was highly critical of health professionals for continuing to provide clinically-assisted nutrition and hydration in the face of disagreement about the patient’s best interests, without seeking to resolve the issue. This hearing had been set up specifically to consider whether GU’s dignity had been properly protected, and if not why not, given concerns raised by the Official Solicitor about what she considered to be “a complete abrogation of responsibility to consider properly or (...) at all, and to determine whether it was in GU’s best interests and therefore lawful to continue to give him an invasive medical treatment, CANH.” In April 2014, at 63 years old and living in Thailand, GU sustained severe injuries after suffering from an electrocution accident. He sustained a cardiorespiratory arrest with a significant delay before cardiopulmonary resuscitation was started and was unconscious and unresponsive. In September 2014 he was transferred to the UK. In August 2018, GU’s brother made a request for a best interests decision concerning the continuation of CANH. The family met to discuss this and all except GU’s son, agreed that continuing CANH was not in GU’s best interests. In view of the fact that there was not unanimity among the family, a decision was made that CANH should continue. Commenting on this decision, Mr Justice Hayden said ‘the apparent assumption that in the face of family disagreement ‘ therefore will continue to be cared for by nursing staff ” is a troubling non sequitur’ and stressed that ‘family dissent to a medical consensus should never stand in the way of an incapacitated patients’ best interests being properly identified’. It is unclear whether someone’s responsibility for developing a disease or maintaining his or her health should affect what healthcare he or she receives. While this dispute continues, we suggest that, if responsibility is to play a role in healthcare, the concept must be rethought in order to reflect the sense in which many health-related behaviours occur repeatedly over time and are the product of more than one agent. Most philosophical accounts of responsibility are synchronic and individualistic; we indicate here (...) what paying more attention to the diachronic and dyadic aspects of responsibility might involve and what implications this could have for assessments of responsibility for health-related behaviour. Antievolution arguments of Christian and Hindu creationists often critique Darwin's metaphor of the geological record as an ill‐preserved book of life, while highlighting the problem of anomalous fossils. For instance, Bible‐based young‐Earth creationists point to anomalous humanlike prints alongside authenticated dinosaur tracks to argue for the creation of all life some few thousand years ago. But Vedic‐based ancient‐hominid creationists view the same sort of evidence as indicating the existence of all species, including the hominids, billions of years ago. I examine (...) the roots of this Hindu Vedic creationism and its recent elaboration among scientifically minded members of the International Society for Krishna Consciousness (ISKCON). Similarities in the methods and rhetorical strategies of the two creationist groups are considered, as well as the underlying motives that have brought together such otherwise disparate religious worldviews. End-of-life decision making is fraught with ethical challenges. Withholding or withdrawing life support therapy is widely considered ethical in patients with high treatment burden, poor premorbid status, or significant projected disability even when such treatment is not ?futile.? Whether such withdrawal of therapy in the aftermath of attempted suicide is ethical is not well established in the literature. We provide a clinical vignette and propose criteria under which such withdrawal would be ethical. We suggest that it is appropriate to withdraw (...) life support, regardless of the cause of the critical illness or disability, when the following criteria are met: (1) Surrogates request withdrawal of care and the adequacy of surrogates is confirmed, (2) an external reasonability standard is met, (3) passage of time, perhaps 72 hours, to allow certainty regarding the patient's wishes, and (4) psychiatric morbidity should be considered as grounds for withdrawal only in truly treatment-refractory cases. Fundamentally, we believe the question to ask is, ?If this were not an attempted suicide, would a request to withdraw care be reasonable?? We believe that under these circumstances, such withdrawal of life support, even in an individual who has attempted suicide, does not constitute physician assistance with suicide and is distinct from physician aid-in-dying in several important respects. This paper argues that there exists a collective epistemic state of ‘Broad Medical Uncertainty’ regarding the effectiveness of many medical interventions. We outline the features of BMU, and describe some of the main contributing factors. These include flaws in medical research methodologies, bias in publication practices, financial and other conflicts of interest, and features of how evidence is translated into practice. These result in a significant degree of uncertainty regarding the effectiveness of many medical treatments and unduly optimistic beliefs about (...) the benefit/harm profiles of such treatments. We argue for an ethical presumption in favour of openness regarding BMU as part of a ‘Corrective Response’. We then consider some objections to this position, including concerns that public honesty about flaws in medical research could undermine trust in healthcare institutions. We suggest that, as it stands, the Anti-Corrective Response is unconvincing. (shrink)

This paper aims to provide an analysis of the metatextual function of one of the most well-known elements of Martial's Epigrams, the ‘lion and hare’ cycle from Book 1. This cycle, in which a hare is held precariously but safely in the jaws of a lion, has historically been read as representing the relationship between Domitian and poet. This paper aims to expand on this reading of the cycle while considering a largely unexplored point of view: the metatexual function of (...) this cycle within Martial's larger epigrammatic project. I identify three major ways in which the cycle supports Martial's larger interests in exploring poetic anxieties and defending the genre of epigrammatic poetry. First of all, by figuring the lion and the hare as, respectively, the emperor and the poet, Martial presents and performs an exemplum modelling clemency in the reception of lascivious poetry. Second, as a sexual metaphor that points to the anxiety and insecurity of both predator and prey, the cycle anticipates a broader concern of the Epigrams: the instability of Roman hierarchical relations and the difficulty of maintaining balance within such relationships. Third, Martial's continued use of hare imagery in the later books of the Epigrams, both in culinary and in hunting contexts, suggests the continued consumption and enjoyment of the genre of epigram, particularly outside of the imperial city. This new edition of Hegel's Lectures on the History of Philosophy sets forth clearly, for the first time for the English reader, what Hegel actually said.
