This article explores the role of constitutional thought in Latour’s work on cosmopolitics. It will study his non-modern proposal in the Politics of Nature (2004) and argue for a constitutional rather than political understanding. To address criticisms of being too metaphysical or unpractical, we will work out the notion of a “constitutional ecology of practices” to highlight how different practices such as politics, science, organization, but also law, all contribute to the design of the stage and processes for composing a (...) common world. Special focus will here be placed on the role of “epigrams”: practical models for ordering contributions of different practices or modes in hierarchical relationships. This renders them identifiable, mobilizable, and contestable as cross-cutting models for shaping mutual relations in concrete collaborative settings. The case of the legal regulation of robots will be presented as an example of a cosmopolitical attempt to introduce non-human entities in the common collective. We will here observe the role that epigrams play in framing, ordering and contesting the epistemic contributions of the various practices involved in this innovation ecology. This case will be used to discuss Latour’s proposals and to study non-modern constitutionalism in action. (shrink)

The tendency in intellectual property law to commodify information embedded in software and profiles could counteract this shift to transparency and control. These rights obstruct the access and contestation of the design of the code that impacts one’s personhood. This article is an analytic register of recent European efforts in the making of ‘autonomous’ robots to address what is imagined as Europe’s societal challenges. The paper describes how an emerging techno-epistemic network stretches across industry, science, policy and law to legitimize and enact a robotics innovation agenda. Roadmap is the main metaphor and organizing tool in working across the disciplines and sectors, and in aligning these heterogeneous actors with a machine-centric vision along a path to make way for ‘new (...) kinds’ of robots. We describe what happens as this industry-dominated project docks in a public–private partnership with pan-European institutions and a legislative initiative on robolaw. Emphasizing the co-production of robotics and European innovation politics, we observe how well-known uncertainties and scholarly debates about machine capabilities and human–machine configurations, are unexpectedly played out in legal scholarship and institutions as a controversy and a significant problem for human-centered legal frameworks. European robotics are indeed driving an increase in speculative ethics and a new-found weight of possible futures in legislative practice. (shrink)

Previous research has yielded inconsistent findings concerning the relationship between envy and schadenfreude. Three studies examined whether the distinction between benign and malicious envy can resolve this inconsistency. We found that malicious envy is related to schadenfreude, while benign envy is not. This result held both in the Netherlands where benign and malicious envy are indicated by separate words (Study 1: Sample A, N = 139; Sample B, N = 150), and in the USA where a single word is used (...) to denote both types (Study 2, N = 180; Study 3, N = 349). Moreover, the effect of malicious envy on schadenfreude was independent of other antecedents of schadenfreude (such as feelings of inferiority, disliking the target person, anger, and perceived deservedness). These findings improve our understanding of the antecedents of schadenfreude and help reconcile seemingly contradictory findings on the relationship between envy and schadenfreude. (shrink)

Smith and van Dijk explore the relationship between the emotions schadenfreude and gluckschmerz, and why people experience these emotions. Their perspective is valuable and adds to a better understanding of how people respond to the fortunes of others. In this manuscript I try to further these ideas by arguing that schadenfreude and gluckschmerz are best seen as signals that indicate that a balance in how we would want the world to be is restored or violated.

The history of ideology and its definition continues to occupy scholars across a range of disciplines. Contrary to the vast volume of earlier work on ideology however, this books provides a challenging new theory of ideology, one that is capable of explaining not only the internal structures of ideologies, but also how ideologies function in society. Radical empiricists at the turn of the twentieth century described organisms as experiencing the relations they maintain with their surroundings prior to any analytic separation from their environment. They notably avoided separating perception of the material environment from social life. This perspective on perceptual experience was to prove the inspiration for Gibson’s ecological approach to perceptual psychology. Gibson provided a theory of how the direct perception of the organism-environment relation is possible. Central to his account was the notion of a (...) medium for direct perception. However Gibson provided two mutually inconsistent accounts of the medium leading to problems for his radical empiricism. We develop an account of the medium that does justice to ecological psychology’s radical empiricist roots. To complement this account of the medium we detail a usage-based account of information. Together they allow us to propose a novel radical empiricist view of direct perception. We then return to the notion of medium and expand it to include sociomaterial practices. We show how direct perception happens in the midst of social life, and is made possible by an active achieving and maintaining of a pragmatic relation with the environment. (shrink)

Research on work values shows that respectful leadership is highly desired by employees. On the applied side, however, the extant research does not offer many insights as to which concrete leadership behaviors are perceived by employees as indications of respectful leadership. Thus, to offer such insights, we collected and content analyzed employees’ narrations of encounters with respectful leadership (N1 = 426). The coding process resulted in 19 categories of respectful leadership spanning 149 leadership behaviors. Furthermore, to also harness this comprehensive (...) repertoire for quantitative organizational research, we undertook two more studies (N2a = 228; N2b = 412) to empirically derive a feasible item-based measurement of respectful leadership and assess its psychometric qualities. In these studies, we additionally investigated the relationships between respectful leadership as assessed with this new measurement and employees’ vertical and contextual followership as assessed via subordinates’ identification with their leaders, their appraisal respect for their leaders, their feeling of self-determination, and their job satisfaction. A common adage runs that, given a theory manifesting symmetries, the syntax of that theory should be modified in order to construct a new theory, from which symmetry-variant structure of the original theory has been excised. Call this strategy for explicating the underlying ontology of symmetry-related models reduction. Recently, Dewar has proposed an alternative to reduction as a means of articulating the ontology of symmetry-related models—what he calls sophistication, in which the semantics of the original theory is modified, and symmetry-related (...) models of that theory are treated as if they are isomorphic. In this paper, we undertake a critical evaluation of sophistication about symmetries—we find the programme underdeveloped in a number of regards. In addition, we clarify the interplay between sophistication about symmetries, and a separate debate to which Dewar has contributed—viz., that between interpretational versus motivational approaches to symmetry transformations. We provide an ethical evaluation of the debate on managing diversity within teams and organizations between equality and business case scholars. Our core assertion is that equality and business case perspectives on diversity from an ethical reading appear stuck as they are based on two different moral perspectives that are difficult to reconcile with each other. More specifically, we point out how the arguments of equality scholars correspond with moral reasoning grounded in deontology, whereas the foundations of the business case (...) perspective are crafted by utilitarian arguments. We show that the problems associated with each diversity perspective correspond with the traditional concerns with the two moral perspectives. To resolve this stalemate position, we argue that the equality versus business case debate needs to be approached from a third, less well-known moral perspective (i.e. virtue ethics). We posit that a focus on virtues can enhance equality by reducing prejudice and illustrate this by applying it to the HRM domains of recruitment and selection and of performance management. Subsequently, we argue that values are key to aligning virtues with each other and with corporate strategy, delineate our values and virtues perspective on diversity, and argue why and how it can enhance organizational performance. In this article the relevance of a sociocognitive approach to discourse is shown by presenting a new theory of context, defined as subjective participants’ constructs of communicative situations, and made explicit in terms of mental models - context models - in Episodic Memory. Through a ‘contextual analysis’ of a fragment of one of the ‘Iraq’ speeches by Tony Blair in the British House of Commons, it is shown how such context models control and explain many political aspects of interaction that (...) cannot be accounted for in autonomous approaches to text and talk. Context models thus provide an explicit theory of relevance and the situational appropriateness of discourse, and hence also a basis for theories of style. (shrink)

How does metaphysical necessity relate to the modal force often associated with natural laws? Fine argues that natural necessity can neither be obtained from metaphysical necessity via forms of restriction nor of relativization — and therefore pleads for modal pluralism concerning natural and metaphysical necessity. Wolff, 898–906, 2013) aims at providing illustrative examples in support of applying Fine’s view to the laws of nature with specific recourse to the laws of physics: On the one hand, Wolff takes it that equations (...) of motion can count as examples of physical laws that are only naturally but not metaphysically necessary. On the other hand, Wolff argues that a certain conservation law obtainable via Noether’s second theorem is an instance of a metaphysically necessary physical law. I show how Wolff’s example for a putatively metaphysically necessary conservation law fails but argue that so-called topological currents can nevertheless count as metaphysically necessary conservation laws carrying physical content. Theorizing about perception is often motivated by a belief that without a way of ensuring that our perceptual experience correctly reflects the external world we cannot be sure that we perceive the world at all. Historically, coming up with a way of securing such epistemic contact has been a foundational issue in psychology. Recent ecological and enactive approaches challenge the requirement for perception to attain epistemic contact. This article aims to explicate this pragmatic starting point and the new direction of (...) inquiry that this opens up for psychology. It does so by detailing the development of James J. Gibson’s ecological psychology. Securing epistemic contact has been a leitmotiv in Gibson’s early work, but subsequent developments in Gibson’s works can teach us what it takes to adopt a pragmatic approach to psychology. We propose a reading of the developments in Gibson’s original works that shows that, since perception is a mode of acting, perception aims for pragmatic contact before allowing for epistemic contact. Amplifying these pragmatist lines of thought in Gibson’s works we end by considering situations where an individual is adapted to the intricacies of specific social practices. These situations show how pragmatic contact can also afford attaining epistemic contact. (shrink)

The debate on the ‘right to know’ has simmered on for over 30 years. New examples where a right to be informed is contrasted to a right to be kept in ignorance occasionally surface and spark disagreement on the extent to which patients and research subjects have a right to be self-determining concerning the health related information they receive. Up until now, however, this debate has been unsatisfactory with regard to the question what type of rights—if any—are in play here (...) and to what extent they can provide a normative basis for informed consent. This paper provides an analysis of informed consent in the context of ‘epistemic interventions’: interventions which involve the communication of information. First, I offer an analysis of the concept of a ‘right not to know’ in the context of consent to epistemic interventions. I argue that the scope of the consent is determined by the extent to which this intervention can be seen as an infringement of the private sphere. After that I show how this analysis affects the scope and standards of informed consent. (shrink)

Neil Tennant’s core logic is a type of bilateralist natural deduction system based on proofs and refutations. We present a proof system for propositional core logic, explain its connections to bilateralism, and explore the possibility of using it as a type theory, in the same kind of way intuitionistic logic is often used as a type theory. Our proof system is not Tennant’s own, but it is very closely related, and determines the same consequence relation. The difference, however, matters for (...) our purposes, and we discuss this. We then turn to the question of strong normalization, showing that although Tennant’s proof system for core logic is not strongly normalizing, our modified system is. (shrink)

We discuss the status of gravitational radiation in Newtonian theories. In order to do so, we consider various options for interpreting the Poisson equation as encoding propagating solutions, reflect on the extent to which limit considerations from general relativity can shed light on the Poisson equation’s conceptual status, and discuss various senses in which the Poisson equation counts as a dynamical equation.

A ‘bonus culture’ among financial traders has been blamed for the excessive risk-taking in the run-up to the latest financial crisis. I show that when individuals are more social gain seeking than social loss averse, social comparison predicts more risk-taking as well as a preference for negatively correlated gambles. Testing these two joint propositions in a laboratory experiment, I find that preference for positively or negatively correlated outcomes is highly correlated with risk-taking in a social risky investment task. While only (...) a third of subjects prefer negatively correlated outcomes in a peer comparison setting, in line with relatively stronger social gain seeking, those subjects invest on average 50 % more in a risky gamble in their peer comparison setting than a reference group that made the same decision in an isolated individual setting. Subjects with a preference for positively correlated outcomes, in line with relatively stronger social loss aversion, do not show a higher propensity to invest in a risky gamble compared to the individual reference group. We address the differences between schadenfreude and happiness and those between gluckschmerz and anger. We argue that these emotions are largely elicited by distinct interactions of appraisals that trigger distinct emotional responses. Moreover, we discuss both schadenfreude and gluckschmerz in relation to the emotional lexicon of several languages and conclude that these emotions help us to better understand human behaviour.

This paper explores the notion of hospitality and faith in Derrida and Kierkegaard. The aim is to trace the topological core of existence in relation to an ongoing debate in contemporary continental philosophy of religion about khôra. The paper shows how khôral traces are at work in Kierkegaard’s thinking in relation to the topological proximity of love. The claim is, that Kierkegaard emphasizes, not a hostility but a vulnerability of what I coin khôral love – the vibrating space between the (...) anonymous and the amorous, call and response. The unknown X of the khôral becomes the topos of existence – the “stepping out”, the “you are here (X)”. A “you” called forth by the commandment of love or the visitation of the stranger. (shrink)

Imagination is often considered the pinnacle of representational cognition. Looking at the concrete details of imagining in context, this paper aims to contribute to the emerging literature that is challenging this representational view by offering a relational and radically situated alternative. On the basis of observing architects in the process of making an architectural art installation, we show how to consider imagination not as de-contextualized achievement by an individual but as an opening up to larger-scale “affordances,” i.e. the unfolding possibilities (...) for action. We show how the architects coordinate the enactment of multiple affordances across different timescales, from small-scale affordances of picking up a mobile phone to the large-scale affordance of making the installation that takes months to unfold. These affordances get co-determined as they are jointly enacted. It is within this determining process that imagination too finds its place. On our view it is the indeterminacy of multiple affordances unfolding in action simultaneously that can be experienced as imaginative. The indeterminate character of this coordinative process allows activities to widen and open up, letting new possibilities for action enter into them. (shrink)

Despite an attempt to break with the hierarchical picture in traditional emergentist thought, non-standard accounts of emergence are often still committed to a premise that ontology is prior to epistemology. This paper aims to topple this last remnant of the traditional hierarchy by explicating a pragmatic view of emergence based on John Dewey’s work. Dewey argued that the traditional notion of ontology is premised on a view of existence as complete. Through a discussion of Dewey’s work it is argued that (...) this premise results in a process of reification that unduly excludes from ontology many precarious and indeterminate aspects involved both in everyday life and in philosophic and scientific inquiry. Building on a recent explication of transformational emergence the paper proposes a diachronic and non-hierarchical account of emergence, called pragmatic emergence. According to that account the relation between ontology and epistemology is a temporally reciprocal one. This means that ontological and epistemological features co-determine each other over time. Determinacy and continuity become historical features of a multitude of unfinished processes that we view from within. (shrink)

This paper aims to provide a starting point for a non-representational approach to language. It will do so by undoing some of the reifying tendencies that are at the heart of the ontology of scientific psychology. Although non-representational theories are beginning to emerge, they remain committed to giving explanations in terms of ontological structures that are independent of human activity. If they maintain this commitment it is unlikely that they will displace representationalism in domains such as language. By following some (...) of Wittgenstein’s remarks on language, I explain the phenomenon of reification by carefully considering the formative, situational flow of language—thus without invoking representations. In this way, the paper sketches a direction of approach for a non-representational theory of language, undercutting the most important assumptions that justify an explanatory ontology devoid of human activity. Background: Empathy is a contested concept in the field of care ethics. According to its proponents, empathy is a unique way to connect with others, to understand what is at stake for them, and to help guide moral deliberation. According to its critics, empathy is biased, inaccurate or a form of projection that does not truly grasp and respect the otherness of the other, and that may be distorted by prejudices. Objectives: We aim to contribute to a better understanding of (...) the significance of empathy in care ethics by reviewing both the functions and limitations of empathy in this field. Research design: Drawing on literature from care ethics and closely related fields, we identify the relevant functions and limitations of empathy from the relational, epistemic, normative, and political perspectives. These perspectives are drawn from four main characteristics of care ethics, which serve as a concise framework for understanding the significance of empathy. Participants and research context: This article is written as part of an empirical and theoretical research project that aims to better understand the functions and limitations of empathy in care practices, from the perspective of care ethics. Ethical considerations: We try to do justice to both the appraisal and critique of empathy in the care ethics literature. Findings: Our findings stress that the relationship between care ethics and empathy is complicated and rife with opposing views. Therefore, we conclude that care ethics is not an ethics of empathy. Discussion and conclusion: Based on our findings, we formulate pathways that may guide the further analysis of empathy in care practices and care ethics. (shrink)
