“No one has advanced a just and logical reason why reward for service to the public should be extended to the inventor of a mechanical toy and denied to the genius whose patience, foresight, and effort have given a valuable new [discovery] to mankind” . The law around the world permits the granting of patents for drugs, medical devices, and cosmetic treatment of the human body. At the same time, patentability for a method of treatment of the same body is (...) denied in some countries on various public policy grounds. Is there any logical justification for this distinction? Are methods of medical treatment not as vital to the health or even to the life of a patient as drugs or medical devices? Why is a cosmetic result patentable and a curative result not? (shrink)

Sounds are audible, and sound sources are audible. What is the audible relation between audible sounds and audible sources? Common talk and philosophy suggest three candidates. The first is that sounds audibly are properties instantiated by their sources. I argue that sounds are audible individuals and thus are not audibly instantiated by audible sources. The second is that sounds audibly are effects of their sources. I argue that auditory experience presents no compelling evidence that sounds audibly are causally related to (...) audible sources. Aberrant consumer behaviour costs firms millions of pounds a year, and the Internet has provided young techno-literate consumers with a new medium to exploit businesses. This paper addresses Internet related ethics and describes the ways in which young consumers misdemean on the Internet and their attitudes towards these. Using a sample of 219 generation Y consumers, the study identified 24 aberrant behaviours which grouped into five factors; illegal, questionable activities, hacking related, human Internet trade and downloading. Those perceived as least (...) wrong were; "Downloading movie and music files from the Internet for free". The consequences of these behaviours have implications for educators, consumer policy and marketers. (shrink)

My concern is this paper is to consider the nature of obsessive thoughts with the aim of getting a clearer idea about the extent to which they are rightly identified as passive or as active. The nature of obsessive thoughts is of independent interest, but my concern with the question is also rooted in a general concern to map the extent of mental activity, and to defend the importance and centrality of a view of self-knowledge that appeals to agency. I (...) hold that much of our mental lives is active, and that the distinctive knowledge we have of our own minds is in many cases best explained by appealing to agency. Along with many others, I take knowledge of our actions and activities to be distinctive. We know our actions and activities in a way that we do not know anything else, and in a way that is distinctively and essentially self-conscious. (shrink)

Anaxarchus accompanied Pyrrho on Alexander the Great’s expedition to India and was known as “the Happy Man” because of his impassivity and contentment. Our sources on his philosophy are limited and largely consist of anecdotes about his interactions with Pyrrho and Alexander, but they allow us to reconstruct a distinctive ethical position. It overlaps with several disparate ethical traditions but is not merely a hodge-podge; it hangs together as a unified whole. Like Pyrrho, he asserts that things are indifferent in (...) value and that realizing this indifference leads to contentment. But this doctrine of indifference is rooted in Democritean atomism. And in his pursuit of pleasure and dismissiveness of conventional standards of what is just, noble, and pious, Anaxarchus is closer to fifth century thinkers such as Aristippus, Antiphon, and Critias. The development of a professional code of ethics should provide an explanation of the professional values and principals that guide a body of persons engaged in an important role in society. Most professions find ethical standards of conduct are necessary to codify acceptable behavior to develop public trust, reliability, and consistency in their performance. The proposed AMS Code of Ethics for Marketing Educators is the first step in developing communication, debate, and hopefully, agreement about the social responsibility of the marekting (...) discipline. It is important to note that the AMS code was not developed to punish wrongdoers but to provide a positive guide to help marketing educators understand how their actions may be viewed by society. Recent theorizing about the nature of the cognitive impairment in autism suggests that autistic individuals display abnormally weak central coherence, the capacity to integrate information in order to make sense of one’s environment. Our article shows the relevance of computational models of coherence to the understanding of weak central coherence. Using a theory of coherence as constraint satisfaction, we show how weak coherence can be simulated ina a connectionist network that has unusually high inhibition compared to excitation. This essay asks what it is about the practice of trade that grounds duties of justice between states as trade partners. The answer advanced is that such duties are grounded in the dependence that trade generates. The essay puts forward four conditions that a plausible account of grounding in trade must meet: it must admit of degrees, explain the distinctly international character of trade justice, ground both procedural and distributive duties, and it must be a necessary feature of all trade (...) relationships which generate duties of justice. A dependence account of grounding meets all four conditions, and does so in an intuitively compelling way. While other accounts of what grounds duties of trade justice can meet some of the conditions, none can meet all of them. Relative to rival candidates, then, the dependence account provides a firmer foundation for the ongoing attempts to develop a comprehensive theory of trade justice. (shrink)

Moral principles or the rules of conduct are based in the society. If the purpose of ethics in research is to take into consideration the needs and the rights of the experimental subject, his social milieu must then largely determine the ethical considerations of a projected study. The inability to comprehend such rights may often be due to ignorance, disease and his societal values. Blood letting, biopsy and post-mortem examinations may so conflict with local beliefs that so called 'consent' to (...) these is much more than a surrender of the rights of the individual. It is difficult to conform with the highest principles of ethics in research in any uniform society. It is more so when the many variables are further complicated by cultural demands and social taboos. The best custodians of ethical standards must relate intimately with the norms of the local population. (shrink)

It is widely believed that philosophical pessimism is committed to fatalism about the sufferings that characterize the human condition, and that it encourages resignation and withdrawal from the political realm in response. This paper offers an explanation for and argument against this perception by distinguishing two functions that pessimism can serve. Pessimism’s skeptical mode suggests that fundamental cross-cultural constraints on the human condition bar us from the good life (however defined). These constraints are often represented as immune to political amelioration, (...) leading to the perception that pessimism is intrinsically fatalistic and resigned. Yet pessimism’s critical function emphasizes the political, economic, and cultural contingency of many sources of suffering and crisis while exhorting us to reject and reimagine the social forces that actively harm our capacity to flourish. It also offers an internal critique of skeptical pessimism’s tendency to naturalize and depoliticize the sources of our sufferings. These sometimes contradictory skeptical and critical tendencies should both be grouped under the pessimist banner, and we should see pessimism’s critical mode as especially valuable to political critique. -/- . This paper examines a lasting tension in pragmatism between broadly functionalist outlooks on meaning and a primacy placed on what can be revealed by direct experiential or practical encounters. Both the inferentialist and experiential emphases can be traced back to Peirce’s original pragmatic maxim. Here the tension is examined first in William James’s insightful views on intentionality and experience, followed by a diagnosis of the problem as it has arisen in neo­pragmatist debates concerning the nature of perceptual knowledge in Rorty (...) and Brandom and their critics. In the end the paper sketches the general form of a resolution of the tension that is consistent with both of these core emphases in the pragmatist tradition. (shrink)

This paper attempts to locate modern Zen and psychoanalysis in terms of contemporary philosophy of mind, particularly in view of dominant theories of cognitivism that see the mind as informational and material, with meaning being mere information in disguise. Psychoanalysis and modern Zen hold to the contrary view that the mind is “semantic,” not “syntactic,” and that the meanings we have in our heads are not reducible to the physical informational processes from which they have emerged. Meaning, as non-reducible, is (...) infinite and uncaused. However, the structure of meaning entails a split between a knower and what is known. This split creates problems in the mind which can be confronted through more, not less, engagement with the meanings in our minds, until we are self-aware and, perhaps, self-identical, with the mechanisms of consciousness that produce the meanings in our head. Such self-awareness is seen as being self-liberating rather than self-reducing. (shrink)

The logic of soku-hi is presented as an articulation of a post-Kantian view of reality that embraces the truths of science with the assumption of the transcendental subject. As such, soku-hi represents the philosophical posture of both the secular Zen of the Kyoto School and the new materialists of contemporary continental philosophy. It describes how material reality is not all even though there is nothing else.

Kinship and friendship are key human relationships. Increasingly, data suggest that people are not less altruistic toward friends than close kin. Some accounts suggest that psychologically we do not distinguish between them; countering this is evidence that kinship provides a unique explanatory factor. Using the Implicit Association Test, we examined how people implicitly think about close friends versus close kin in three contexts. In Experiment 1, we examined generic attitudinal dispositions toward friends and family. In Experiment 2, attitude similarity as (...) a marker of family and friends was examined, and in Experiments 3 and 4, strength of in-group membership for family and friends was examined. Findings show that differences exist in implicit cognitive associations toward family and friends. There is some evidence that people hold more positive general dispositions toward friends, associate attitude similarity more with friends, consider family as more representative of the in-group than friends, but see friends as more in-group than distant kin. At the end of the last section we anticipated the concluding page of the argument, where Plato makes the soul imperishable, as well as not-dead, and where he describes finally the soul's withdrawal at the approach of death. For the conclusion that the soul never admits death, and is in that sense was probably in Plato's eyes the heart of the argument. The final page, we shall argue, will have seemed to Plato in some ways less important, and even something (...) of an embarrassment. (shrink)

Open peer commentary on the article “Never Mind the Gap: Neurophenomenology, Radical Enactivism, and the Hard Problem of Consciousness” by Michael D. Kirchhoff & Daniel D. Hutto. Upshot: We agree with Kirchhoff and Hutto that phenomeno-physical identities have to be motivated to approach the hard problem of consciousness. We propose that REC will do a better job in motivating these identities if intentionality and phenomenality are considered inseparable. We suggest that the notion of dispositional flexibility motivates these phenomeno-intentional identities and (...) opens up a practical avenue for neurophenomenology. (shrink)
