Herbert Spencer is one of the most distinguished representatives of Nineteenth-Century liberalism. Originality of his doctrine is based on combined concepts of social evolutionism with postulates of conservative liberalism. Ethics of an individual were the conceptual point of his philosophical reflection. Thus he believed that a free market economy is the economic foundation of ethical and material development of every individual. Material development may be summarized as achieving ever improving results of performed actions. According to Spencer, the free market critically (...) assesses the quality of goods through increasing demand for goods of better quality. In this manner effective producers develop, because they achieve greater gain from their work. Moral development of an individual is in turn focused on continuous self-improvement. Through developing his skills a man increases the quality of actions carried out by him or of objects that he creates. The “law of equal freedom” – also described by Spencer – is in direct connection with the aforementioned issues. This rule states that every man has the right to do anything, as long as his actions do not infringe upon the freedom of another man which is defined in exactly the same manner. Thus the law of equal freedom can be characterized as a negative freedom if juxtaposed with relations that occur between individuals themselves or between individuals and the state. Combining of ethical and economic topics leads to the presentation of inhibitions that, according to Spencer, should be placed upon the activity of the State in the field of economy. Spencer believed that the State should not interfere with the economy, since all individuals should be granted full freedom of participating in comply with their own interests. (shrink)

The article presents so-called “derivational” theory of legal interpretation and analyzes its basic assumptions. The derivational theory of legal interpretation is still little known outside of Poland. The article is divided into two parts. The first part is presenting the normative model of legal interpretation according to the derivational theory. In the second part, the basic assumptions and features of the theory are analysed in context of some other approaches to legal interpretation. The author argues that there are two levels (...) of the derivational theory: local and universal. The local level of theory is related to the fact that it was designed for Polish legal system and legal culture. However, beyond its local features, the derivational theory is presenting strong theoretical framework and some significant universal ideas about legal interpretation. This creates universal level that can be called the “hard core” of the theory. The author characterizes the elements of this hard core, and in particular the most important element: the idea that the legal interpretation consists in the reconstruction of legal norms from legal provisions. In this study, we reconcile conflicting findings from the extant literature on the impact of tax system parameters on tax noncompliance. We argue that social norms play a role of heuristics facilitating tax payers’ response to the instrumental incentives posed by the systemic parameters, such as tax rate and penalties for evasion, and thus moderate the effect of those parameters on willingness to evade taxes. Relying on a unique survey experiment conducted in fourteen countries of Central-Eastern Europe, we demonstrate two (...) types of a conditioning effect of norms. First, the impact of tax rates on respondents’ propensity for tax evasion is moderated by the perceived norms of the society at large. In particular, an increasing tax rate lowers the probability of evasion as long as one views “most others” as honest taxpayers, which highlights the importance of equitability concerns for tax compliance decisions. In contrast, the impact of punishment is moderated by the perceived norms of one’s immediate reference group. Strong subjective compliance norms tend to effectively replace penalties as a mechanism discouraging tax evasion, suggesting that the deterrent effect of a penalty can be entirely suppressed when subjective norms are strong. These findings have important implications for the understanding of tax compliance decisions under different formal and informal regimes. (shrink)

W niniejszym artykule podjęto próbę rewizji list poloników sporządzonych na podstawie rejestru _Navis peregrinorum _(1561–1695). Początki polskich badań nad tymi wykazami sięgają drugiej połowy XIX wieku. Spisy sporządzali polscy franciszkanie posługujący w Kustodii Ziemi Świętej oraz podróżnicy goszczący w Jerozolimie. Do czasu przeprowadzonej w roku 2019 kwerendy liczba Polaków odnotowanych w księdze wahała się od 29 do 65 nazwisk. Powody tej rozbieżności należy tłumaczyć tym, że pierwsi badacze księgi kierowali się rozmaitymi, nie zawsze precyzyjnymi kryteriami przy określaniu „polskości” pątnika, takimi (...) jak: wyznanie, słowiańskie brzmienie nazwiska oraz towarzysząca temu adnotacja „Polacco/Polacca” w _Navis peregrinorum_. Dane pątników zostały zniekształcone również przez włoskich mnichów, którzy podczas dokonywania wpisu do księgi latynizowali je. Każdy z badaczy próbował zidentyfikować tożsamość pielgrzyma, stąd pojawiło się wiele różnych wersji nazwisk peregrynantów. Do tej pory udało się ustalić personalia tylko niektórych z nich. (shrink)

This paper explores the psychometric properties of the Polish adaptation of the MBI-SS questionnaire, which measures academic burnout in students. The factorial structure of the tool was examined, and its validity was evaluated using a sample from Polish state universities (N=935). Findings suggest that the MBI-SS possesses strong psychometric parameters. Data supports the tool's 3-factor structure and internal consistency. However, there are reservations regarding one item (MBI_6). Consequently, the 15- item version of the MBI-SS is recommended as a suitable tool (...) for assessing burnout in Polish students. Certainly principles of criminal liability may be understood as rules or norms outlining orders or prohibitions and standing out among other norms with their weight, for legal culture, legal doctrine, etc. In such a classic approach they are norms defining basic rights and obligations in the applicable criminal law. However, is it the only possible and cognitively interesting meaning of the word “principle” in jurisprudence? From the semiotic point of view, they can occur in three forms: special-kind norms, teleological directives, (...) rules which constitute valid performance of conventional activities. In an extra-directival sense these principles may be understood as models-descriptions of shaping the system of criminal law. From a theoretical and practical point of view principles addressed to the legislator are extremely weighty—they can be called rules constructing the system of criminal liability. Background: Nurses face ethical issues and experience moral distress in their everyday work. A nursing ethics champion program was developed at a hospital in the United States. Methods: As part of a quality improvement project, pre- and post-training surveys were developed to assess whether the program was feasible and sustainable, enhanced nurse confidence in recognizing and addressing ethical issues and moral distress, and increased nurse knowledge of institutional resources for addressing the same. Qualitative and quantitative analyses were performed. Results: Thirteen (...) nurses from both the critical care and medical/surgical settings participated in the program. The program proved feasible. Attrition after the educational sessions raised concerns about sustainability. Survey results suggest an association between participating in the program’s educational sessions and increased nurse confidence in recognizing and addressing ethical issues and moral distress, as well as identifying institutional resources that can assist nurses with the same. Discussion: Opportunities for future nursing ethics champion programs include increasing the interactivity and duration of educational sessions, making programs multidisciplinary, and creating materials for nurses to more easily share with colleagues. It would be valuable for future research to measure the impact of nursing ethics champion programs on nursing turnover. Implications: A nursing ethics champion program has the potential to help nurses feel better equipped to navigate ethical issues and moral distress in their everyday work. (shrink)

Background: Pre-licensure ethics nursing education does not adequately prepare and instill confidence in nurses to address ethical issues, and yet ethics education provides nurses with greater confidence to take moral action, which can mitigate the negative effects of moral distress. Objectives: To assess the feasibility and acceptability of a nursing ethics education program that included simulated case-based ethics competencies as a form of evaluation. The program aimed at building nurses’ ethical knowledge and confidence to respond to ethical challenges in practice. (...) Research design: A prospective, longitudinal, correlational, single-cohort feasibility study using an investigator-developed survey and intervention field data. Participants and research context: Registered nurses were recruited from an academic quaternary-care medical center and 9 small- to mid-sized regional hospitals within one health system in the Midwest United States. Ethical considerations: IRB approval was obtained. Participants could complete the educational program regardless of research process participation. Findings: Of 20 participants, 19 (95%) provided post-program surveys and 18 completed competencies. Median (IQR) scores with quartiles for scheduling, timing, and length of sessions were all 10.0 [9.0, 10.0], and participants perceived that the content was interesting, increased knowledge and confidence in ethics, increased skills in providing ethical care, and would recommend the program to colleagues. Of factors, an increase in ethics knowledge had the highest “always agree” (17, 89.5%) response. Most participants reported that ethics competencies were appropriate 9.0 [9.0, 10.0] and sufficiently challenging 10.0 [9.0, 10.0]. Discussion: The education program developed nurses’ ethics knowledge and confidence. The single-cohort feasibility design provided early-stage intervention outcomes; however, a larger randomized controlled trial would substantiate program value. Conclusion: This novel ethics education program was highly feasible and acceptable to hospital-based nurses who reported increased knowledge and confidence in providing ethical care. Simulated case-based ethics competencies were an appropriate evaluation method. (shrink)
