Liberalism’s concern with human freedom seems related to contractual freedom and thus contract law. There are, however, many strands of liberal thought and which of them best justifies contract is a difficult question. In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller offer a vision of contract based on autonomy. Drawing on the work of Joseph Raz, they argue that extending autonomy should be the law’s primary concern, which requires that we extend the range of contractual choices available. (...) While there is much to admire in their work, I argue that autonomy as conceived by Dagan and Heller cannot justify contract law. First, there are reasons to doubt the coherence of autonomy as an ideal. Second, given the pluralism of liberal societies, which, for example, often include substantial numbers of religious believers who reject core assumptions of autonomy theory, it is doubtful that such a theory can legitimate contract law. A more modest version of liberalism concerned primarily with protection against cruelty and providing a modus vivendi in pluralistic societies is more tenable. Such a vision of liberalism yields a more modest vision of contract law. Rather than making it into another means of realizing the dream of a more autonomous self, it is enough that contract law facilitates commerce and the marketplace. Markets in turn can serve an important — albeit limited — role in sustaining the peaceful cooperation and coexistence toward which a more realistic liberalism should aim. (shrink)

Hope. The very word became world-changing in 2008, as we saw a man who many considered to be an unlikely presidential candidate ride to victory on his message of hope. Indeed, hope--which, perhaps to some, once seemed a soft, somewhat wishy-washy quality--is being redefined by millions as a powerful, dynamic force in a world that demands the heart-felt commitment of its inhabitants in order to even survive. In the twenty-first century, the need for hope--for the intention, commitment, and action that (...) hope inspires--is more compelling and crucial than ever before as we collectively navigate such unforeseen challenges as a global pandemic that has effectively stopped the busyness of life as we have known it. Fortunately, history offers us a treasury of hope, through the words of those who have passed before us, and through events that have proven that hope can and will prevail. What we need is portable evidence of that, a handy inspirational resource that can remind us of the power of hope and the changes that hope can effect. Hope is a topic that people of both sexes, all ages, all races, and all faith traditions not only find of interest but also feed upon; and hope--particularly now, since it has been branded into our consciousness internationally with President Obama's iconic summoning of it--will continue to be a subject area that is actively explored and embraced. While there are a number of anthologies available which address hope (all of them more narrow in scope, falling within the Christian-publishing or recovery category), no book--until now--has attempted to provide an inclusive collection that provides 365 inspirational readings referencing actual historical events that have been a result of, and a source of, hope. In this paper, we study the union axiom of ZFC. After a brief introduction, we sketch a proof of the folklore result that union is independent of the other axioms of ZFC. In the third section, we prove some results in the theory T:= ZFC minus union. Finally, we show that the consistency of T plus the existence of an inaccessible cardinal proves the consistency of ZFC.

This article revisits Oman's idea that an intuitive felt knowledge of the divine underlies the articulate knowledge found in faith and theology. Such feeling, Oman claims, is analogous to ordinary perception and gives rise to the attempt to evaluate, understand, and respond to the divine. PurposeWithin a larger mandate of reviewing the key global trends concerning consumer protection in the electronic commerce (e-commerce) literature, this study aims to study the legal framework concerning e-commerce and consumer protection in the Sultanate of Oman and to analyse the current regulations concerning e-commerce and consumer protection.Design/methodology/approachThis study followed the normative legal research approach and resorted to the desk research process to facilitate content analysis of literature containing consumer protection legislation and regulatory provisions in Oman in particular (...) and the rest of the world in general.FindingsThe study reveals that consumer protection initiatives in Oman are well entrenched for offline transactions, but are relatively new and limited for e-commerce. In spite of the promulgation of consumer protection laws, electronic transaction law and cybercrime law, consumer protection measures for e-commerce in Oman do not address a large number of the global concerns necessary to build consumer confidence and trust in the online environment.Research limitations/implicationsThere is a dearth of information concerning Oman on this topic in the extant literature. The research also witnessed the lack of empirical data on the issue of consumer protection and e-commerce in Oman that offer a detailed database of consumer complaints and associated outcomes.Practical implicationsThe mechanism of consumer protection in electronic transactions is not robust in many countries. Because of the lack of comprehensive and robust legislation, consumers remain vulnerable in the online contractual purchase process. Moving beyond the fragmented legislation, many countries are currently mulling an all-comprehensive e-commerce law, implications of this paper will help the policymakers in identifying the focus areas.Social implicationsConsumer protection is a burning global issue in this era of consumerism. It is important to build consumer trust, transparency and integrity of transactions to reduce the risk and uncertainties of purchase.Originality/valueConsumer protection studies conducted in the context of Oman, hitherto, deal more with data protection and dispute resolution mechanisms, and less with legal provisions, regulations and consumer confidence. The study shares newer insights based on a systematic review of legal and business databases. It is the first study of its kind in the context of Oman and the Middle East in general. (shrink)

Genetic research presents ethical challenges to the achievement of valid informed consent, especially in developing countries with areas of low literacy. During the last several years, a number of genetic research proposals involving Omani nationals were submitted to the Department of Research and Studies, Ministry of Health, Oman.The objective of this paper is to report on the results of an internal quality assurance initiative to determine the extent of the information being provided in genetic research informed consent forms. In (...) order to achieve this, we developed checklists to assess the inclusion of basic elements of informed consent as well as elements related to the collection and future storage of biological samples. Three of the authors independently evaluated and reached consensus on seven informed consent forms that were available for review.Of the seven consent forms, four had less than half of the basic elements of informed consent. None contained any information regarding whether genetic information relevant to health would be disclosed, whether participants may share in commercial products, the extent of confidentiality protections, and the inclusion of additional consent forms for future storage and use of tissue samples. Information regarding genetic risks and withdrawal of samples were rarely mentioned (1/7), whereas limits on future use of samples were mentioned in 3 of 7 consent forms.Ultimately, consent forms are not likely to address key issues regarding genetic research that have been recommended by research ethics guidelines. We recommend enhanced educational efforts to increase awareness, on the part of researchers, of information that should be included in consent forms. (shrink)

Humanism built Western civilization as we know it today. Its achievements include the liberation of the individual, democracy, universal rights, and widespread prosperity and comfort. Its ambassadors are the heroes of modern culture—Erasmus, Holbein, Shakespeare, Velázquez, Descartes, Kant, Freud. Those who sought to contain humanism’s pride within a frame of higher truth—Luther, Calvin, Poussin, Kierkegaard—could barely interrupt its torrential progress. Those who sought to reform humanism’s tenets from within—Marx, Darwin, and Nietzsche—were tested by the success of their own prophecies. So (...) runs the approved view. It is not shared by John Carroll. Instead, Carroll articulates a disruptive and compelling alternative narrative of the course of Western civilization since the Renaissance and the Reformation contrived to unleash reason, will, and a superhuman man on the world. The West’s five-hundred-year experiment with humanism has failed, he maintains in this bracing study of humanism’s rise to preeminence and its headlong tumble into contradiction, because humans ultimately need some kind of contact with a higher, or metaphysical, order beyond the confines of their time-bound, mundane selves. And if this wasn’t entirely clear before September 11, 2001, Carroll concludes, it surely is now. His provocative and brilliant arguments will challenge received wisdom on every side. (shrink)

This article describes the meaning of incest in contemporary popular culture. The author explores how feminism and changes in systems of kinship and sexuality have affected present-day discourse on incest, comparing the significance of blood relations and notions of abuse in constructing incest. The author analyzes media commentaries on two contemporary incestuous events that generated publicity: Kathryn Harrison’s memoir of a sexual affair with her biological father and Woody Allen’s relationship with Soon-Yi Previn. The author explores how commentators framed incest (...) as morally objectionable in reaction to these two cases. She argues that blood ties are prevalent, but are becoming less relevant to discussions of incest in popular culture, and that feminist constructions of incest as an exploitation of power relations have been powerful enough for individuals to apply this framework even when adults are involved. This essay discusses the semiotic scaffolding of modern science, the roots of which lie in the Protestant Reformation and the latter’s repudiation of the “semiotics of nature” upon which medieval theology depended. Taking the fourteenth-century battles between realism and nominalism as the semiotic scaffolding of the Reformation which was subsequently built on nominalist principles, and the Reformation as what made possible the development of early modern science, this essay argues that nominalism, Protestantism, and early modern science were all infected by (...) the gnostic influences which had always accompanied Christianity from the start. Indicating that forms of creative discovery, in the arts, humanities and sciences, are closer to poetic forms than they are to the Baconian model which informed modern science, the essay goes on to link the latter gnostic-influenced metaphysics, motivated by a Reformation anxiety about sin and error, to the development of the modern “megamachine” as described by Lewis Mumford in The Myth of the Machine volumes 1 and 2. Finally the essay suggests that semiotically revivified life sciences might be capable of resolving some of the systemic and ecological problems which Mumford identifies. (shrink)

This study contributes to the limited literature on VAT’s impact on student populations by assessing the financial strain on university students in Oman. The research provides novel insights into policymaking, suggesting VAT exemptions for essential educational goods and proposing financial literacy programs for mitigating the adverse effects of VAT which employs chi-square tests and regression analysis to quantify the financial effects of VAT on students' purchasing behavior, revealing that VAT negatively impacts purchasing power with a statistically significant p-value (< (...) 0.05). The findings highlight substantial financial strain on students, particularly those in lower-income brackets, prompting policy recommendations for VAT exemptions on essential educational goods and the inclusion of financial literacy programs aimed at helping students mitigate the tax's adverse effects. This study evaluates the financial implications of the Value Added Tax (VAT) introduced in Oman in 2021, focusing on its impact on consumer behavior among university students at A’sharqiyah University. Utilizing a quantitative methodology, including chi-square tests and regression analysis, and a sample of 53 students, the research investigates the effects of VAT on purchasing power and consumption patterns. The findings demonstrate a significant disruption to students' financial capacity, with the majority reporting challenges in affording essential educational materials. By contributing to the limited body of literature on VAT’s effects on low-income populations, this study provides valuable insights into how students rationalize their consumption and cope with increased financial strain. Policy recommendations include VAT exemptions for educational goods and the implementation of comprehensive financial literacy programs to help vulnerable groups manage the tax's adverse effects. BackgroundA different ethos with respect to the perception of medical ethics prevails in societies in transition such as those in the Arabian Peninsula, which makes it difficult to apply international principles of bioethics in medical practice. This study aimed to develop and psychometrically test an instrument that measures physicians’ awareness of bioethics and medical law and their attitudes towards the practice of medical ethics. Additionally, it examined physician correlates influencing the awareness of bioethics.MethodsFollowing a rigorous review of relevant literature by (...) a panel of experts, a 13-item instrument, the Omani physicians’ bioethics and medical law awareness (OBMLA) questionnaire was developed with the aim of assessing physicians’ awareness of bioethics and medical law. The study tool’s construct validity and internal consistency reliability were examined by exploratory factor analysis (EFA) and Cronbach’s alpha. In a cross-sectional study, the questionnaire was distributed among a random sample of 200 physicians at a tertiary hospital in Muscat, Oman. Participant characteristics that may influence awareness of bioethics and medical law were explored.ResultsThe EFA of the OBMLA questionnaire resulted in three well-loading factors: (1) Physicians’ bioethics practice subscale (2) incentive related bioethics subscale and (3) medical law awareness subscale. Internal consistency reliability ranged between Cronbach’s α: 0.73–0.8. Of the total 200 participants, 52% reported that teaching medical ethics during medical school was inadequate. The overall mean (standard deviation, SD) of the bioethics awareness score and Omani medical law awareness were 27.6 (3.5) and 10.1 (2.1) respectively. The majority of physicians (73%) reported that they frequently encountered ethical dilemmas in their practice and 24.5% endorsed the view that unethical decisions tended to occur in their practice.ConclusionThe study provides an insight into the practice of bioethics, and the awareness of bioethics and medical law among physicians in a teaching hospital in Oman. The OBMLA questionnaire appears to be a valid and reliable tool to assess a physician’s awareness of bioethics and medical law. In this preliminary study, it appears that participants have suboptimal scores on the indices which measure practice and awareness of bioethics and medical law. (shrink)

Errors have been the concern of providers and consumers of health care services. However, consumers' perception of medical errors in developing countries is rarely explored. The aim of this study is to assess community members' perceptions about medical errors and to analyse the factors affecting this perception in one Middle East country, Oman.

Purpose Whereas integration of big data in “e-Oman” – the e-government face of Oman – is a significant prospect, this paper aims to underscore the challenges of privacy concerns in effecting such integration. Design/methodology/approach Providing a brief description about the concepts of e-government and big data, the paper follows a discussion on “e-Oman”. While drawing a framework for integration of big data in “e-Oman”, the paper throws light on the privacy concerns in effecting such an integration (...) following a qualitative approach. Findings Integration of big data in “e-Oman” is fraught with ethical challenges in terms of privacy issues which have social implications. Practical implications While the pros of integration of big data in “e-Oman” are noteworthy, technical and administrative constraints vis-à-vis the cons of such integration need to be taken care of. It may be underlined that there is a trade-off between the norms of transparency and privacy of individuals versus the deployment of big data in “e-Oman” for effective real-time problem-solving. Social implications Technical and administrative infrastructure needs to be robust for countering challenges of cybercrimes. Furthermore, confidentiality and privacy of individuals may be at stake; the government needs to tackle these issues. Originality/value Integration of big data in “e-Oman” needs to be probed, and this paper seeks to fill this gap. Second, the paper underscores that it is important that ethical norms are being accounted for while effecting this integration. (shrink)

Investigations of large scale industrial accidents generally take one of two alternative approaches to identifying the cause or causes of those destructive events. The first is legal analysis, which focuses on the mechanical failure or human error that immediately preceded the accident. The second is socio-technical reasoning, which centers on the complexities of the interlocking technological and organizational systems that brought about the accident. Both are retrospective, and provide little insight into the means of avoiding industrial accidents in the future. (...) This article looks at six levels of managerial responsibility within a firm, and suggests specific changes at all levels that should logically help in the prevention or mitigation of these high impactllow probability events.
