In this essay, I look at some extraordinary actors who never got their due—actors who had distinguished careers, but never won an Academy Award for acting. I review the work of: Joseph Cotten; Orson Welles; Edward G. Robinson; Cary Grant; James Mason; Richard Burton; Claude Rains; Alan Ladd: Robert Mitchum; and Fred MacMurray. In each case, I explore the actor’s best work, what made his acting outstanding, and offer possible explanations why he was not so honored.

A prominent way of justifying civil disobedience is to postulate a pro tanto duty to obey the law and to argue that the considerations that ground this duty sometimes justify forms of civil disobedience. However, this view entails that certain kinds of uncivil disobedience are also justified. Thus, either a) civil disobedience is never justified or b) uncivil disobedience is sometimes justified. Since a) is implausible, we should accept b). I respond to the objection that this ignores the fact that (...) civil disobedience enjoys a special normative status on account of instantiating certain special features: nonviolence, publicity, the acceptance of legal consequences, and conscientiousness. I then show that my view is superior to two rivals: the view that we should expand the notion of civility and that civil disobedience, expansively construed, is uniquely appropriate; and the view that uncivil disobedience is justifiable in but only in unfavorable conditions. Social movements often impose nontrivial costs on others against their wills. Civil disobedience is no exception. How can social movements in general, and civil disobedience in particular, be justifiable despite this apparent wrong-making feature? We examine an intuitively plausible account—it is fair that everyone should bear the burdens of tackling injustice. We extend this fairness-based argument for civil disobedience to defend some acts of uncivil disobedience. Focusing on uncivil environmental activism—such as ecotage (sabotage with the aim of protecting the environment)—we (...) argue that some acts of uncivil disobedience can be morally superior to their civil counterparts, when and because such acts target people who are responsible for environmental threats. Indeed, insofar as some acts of uncivil disobedience can more accurately target responsible people, they can better satisfy the demands of fairness compared to their civil counterparts. Why did nineteenth‐century German historians and physicists habitually warn against vices that they believed philosophers in particular embodied: speculation, absence of common sense, and excessive systematizing? Drawing on a rich array of sources, this article interprets this vice‐charging as a rhetorical practice aimed at delineating empirical research from Naturphilosophie and Geschichtsphilosophie as practiced in the heyday of German Idealism. The strawman of “the philosopher” as invoked by historians and physicists served as a negative model for strongly empiricist scholars committed to (...) virtues like precision, thoroughness, and conscientiousness. In their historical narratives, historians and physicists consistently depicted philosophy either as a relic from the past or as a phase that they had virtuously left behind. This boundary work was central to the self‐positioning of both history and physics, which makes clear that the persona of the philosopher mattered not only to philosophers but also to scholars in adjacent disciplines. Ten years after Mill's famous defence of civil freedoms, On Liberty, Richard Wagner declaimed:I'll put up with everything—police, soldiers, muzzling of the press, limits on parliament… Freedom of the spiriti is the only thing for men to be proud of and which raises them above (...) animals. In this paper we study the expressive power and definability for modal languages interpreted on topological spaces. We provide topological analogues of the van Benthem characterization theorem and the Goldblatt–Thomason definability theorem in terms of the well-established first-order topological language.

The current model of technology assessment treats ethics itself as just another problem‐solving technology. Ethics should resist this model to play a more critical role in technology assessment by better understanding the complex relationship between society, medicine, and technology—and by recasting how problems are defined.

In this study, we investigate whether firms recognised as superior sustainability performers respond differently to climate change regulatory, physical and other risks/opportunities and examine whether such differences predict sustainability performance in subsequent years. Further, we seek to gain insights from climate change programs and strategies of both superior and inferior sustainability performers. Adopting mixed methods, we use a merged sample from the Top500 world’s largest firms and the Global 100 Most Sustainable Corporations. Our quantitative analyses show that greater awareness of (...) physical and other climate change opportunities is what sets superior performers apart, and that superior future sustainability performance is related to a firm’s stated awareness of these two types of opportunities. Qualitative content analysis of narrative disclosures confirm that superior performers provide more detailed description of climate change strategies that go beyond managing climate change risks. Our study contributes to the limited amount of research highlighting the value of proactively seeking opportunities rather than merely focussing on risk management. (shrink)

In the essay On Liberty , Mill put forward his famous principle that society may only interfere with those actions of an individual which concern others and not with actions which merely concern himself. The validity of this principle depends on there being a distinction between self-regarding and other-regarding actions. But the concept of self-regarding actions has been severely criticised on the ground that all actions affect others in some way and are therefore other-regarding. The notion of self-regarding actions appears (...) to be completely discredited. Very recently, however, there has been some dissatisfaction with the traditional debunking of Mill on this score. Two serious and important attempts to reinterpret the principle were made by Mr J. C. Rees in an article entitled ‘A Re-Reading of Mill on Liberty’, and by Mr Alan Ryan in two brief but extremely useful contributions. My aim is to discuss these reinterpretations of Mill, and on the basis of this, build up what I think is the correct account of Mill's notion of self-regarding actions. (shrink)

This paper gives a selective overview of studies in 'medical ethnomethodology'. It starts with the 1967 contributions by Garfinkel and Sudnow, which focus on medical action as accountable Then it discusses the many CA-inspired studies of doctor-patient inter-action published during the 1980s. Finally, it points to scattered studies that suggest several ways in which this latter approach can be deepened and enlarged. In this way, it formulates the contours of a program for ethnomethodological studies in the medical field.

The member states of the United Nations Educational, Scientific and Cultural Organization (UNESCO) decided in 2002 that ethics is one of the five priority areas of the organization. This article describes three categories of past and current activities in the ethics of science and technology, in particular bioethics. The first category is the global standard setting with the Universal Declaration on Bioethics and Human Rights as the most recently adopted normative instrument. The second category focuses on capacity building in order (...) to enable member states to apply the provisions of the declarations, through, for example, the establishment of national bioethics committees, the introduction of ethics teaching programs, and drafting of legislation and guidelines. The final category of activities is awareness raising through publications, events, and conferences. The challenges and difficulties UNESCO may face in its various activities are highlighted. The identity of indiscernibles is false. Robert Adams and others have argued that if the identity of indiscernibles is false, then primitive thisness must be admitted as a fundamental feature of the world (i.e. haecceitism is true). Moreover, it has been suggested that if haecceitism is true, then essentialism is false - that accounting for individuation by means of haecceities precludes a thing's having essential qualitative properties. I will argue that this suggestion is misguided. In so doing, I will be (...) defending what Adams has labeled 'moderate haecceitism'.After working through some preliminary issues, I will attempt (in section I) to motivate haecceitism. I will begin by reviewing Adams' arguments against the doctrine of the identity of indiscernibles. Next, I will examine altemative accounts of individuation which concede the falsity of that doctrine. I will reject these accounts and conclude that primitive thisness has an essential role to play in any satisfying account of individuation. In section II, I will surface the alleged tension between haecceitism and essentialism. In section III, I will suggest that Adams' moderate haecceitism avoids the tension surfaced in section II. Finally, in section IV, I will raise a difficulty for Adams' view and suggest a different understanding of the nature of haecceities. I will argue that the alleged tension between haecceitism and essentialism rests on a conflation of the metaphysical problem of individuation either with the epistemological problem which goes by the same name or with problems involving the unity of a thing. I will conclude with a few brief comments about the significance of moderate haecceitism for modal epistemology. (shrink)

The current COVID-19 pandemic has reactivated ancient metaphors but also initiated a new vocabulary: social distancing, lockdown, self-isolation, and sheltering in place. Terminology is not ethically neutral but reflects prevailing value systems. I will argue that there are two metaphorical vocabularies at work: an authoritarian one and a liberal one. Missing is an ecological vocabulary. It has been known for a long time that emerging infectious diseases are associated with the destruction of functioning ecosystems and biodiversity. Ebola and avian influenza (...) viruses have been significant warnings. Obviously, this pandemic will not be the last one. As the planet is our common home, the major metaphor to explore is sheltering at this home. (shrink)

Lachlan Umbers defends democracy against Jason’s Brennan’s competence objection, by showing that voting even incompetently does not violate the rights of others, as the risk imposed is negligible, and furthermore lower than other permissible actions, e.g. driving. I show there are costs in taking this line of argument. Accepting it would make arguing for the duty to vote more difficult in two ways: since voting incompetently is permissible, and not voting imposes less risk than not voting, then not voting is (...) permissible; in terms of fairness, voting incompetently is worse than not voting, if voting incompetently is permissible, then there cannot be a fairness-based duty to vote. The Global Ethics Observatory, launched by the United Nations Educational, Scientific, and Cultural Organization in December 2005, is a system of databases in the ethics of science and technology. It presents data on experts in ethics, on institutions and on teaching programmes in ethics. It has a global coverage and will be available in six major languages. Its aim is to facilitate the establishment of ethical infrastructures and international cooperation all around the world.

Teachers´ attitudes toward their students have been associated with differential teachers´ expectations and, in turn, with students´ educational pathways. Theories of social cognition can explain the link between attitudes and behavior. In this regard, the distinction between implicit and explicit attitudes is worth to be considered, whereby implicit attitudes are automatically activated when the attitude object is present and guide automatic behavior. In contrast, explicit attitudes infer deliberation and reflection, hence affecting controlled behavior. As teachers often are required to act (...) immediately in situations that do not allow for thoughtful reflection due to time restraints, teachers´ implicit attitudes concerning different student groups with shared characteristics, such as gender or ethnicity, may be especially important when considering teachers´ behavior in relation to students´ educational pathways. This notion is reflected by an increased interest in adopting implicit methodology in the educational domain. Over the last 10 years, several studies have been conducted in different countries, involving in- and preservice teachers and investigating their attitudes toward different student groups. Estimates of effects have varied and may be affected by sampling bias. To systematically review and integrate data from different studies, this meta-analysis focuses on teachers´ implicit attitudes. Following the systematic search of the database and initial screening, 43 articles were identified from which 22, describing 34 studies, were retained for the meta-analysis after further inspection. First analyses revealed an estimated average effect size of 0.56 for implicit attitudes in favor of non-marginalized groups. As there was a large extent of heterogeneity between studies, several moderator variables, were investigated. Results showed that the employed implicit measure and stimulus materials as well as the student target group affected the effect sizes. Low or non-significant relationships were reported between implicit and explicit attitudes. Findings are discussed in terms of theory and future research. (shrink)

The transmission of a product or idea from one culture or point of origin to another and the maintenance of control outside the new locality has been referred to as the distribution and maintenance of “nothing.” This perspective has been used to describe the global marketplace and the influence of large multinational corporations on the politics and cultures of host countries. This paper uses this concept, but within a much smaller context. Using the sensitizing concept of a “disjoint constitution,” we (...) interviewed health inspectors and apple cider producers in Michigan to determine if the implementation of the Hazard Analysis and Critical Control Points (HACCP) program designed to ensure food safety was characterized by a power differential that would favor the inspectors. In addition, a larger survey of processors and an internet survey of apple cider consumers was conducted to supplement this data. It was found that HACCP had characteristics of both “nothing” and “something” and that better communication is needed between these groups to move it further along toward the something end of the continuum. Since the founding of the University of Limburg (1974), in The Netherlands, an innovative medical curriculum has been guided by educational principles of problem-orientation, continuous assessment, student initiative and attitude development. The teaching of medical ethics was built into the preclinical curriculum from the start. However, the clinical years remained largely unaffected, and only recently has an effort been made to extend the educational philosophy to this more or less traditional part of medical education. Within this context, an experiment of (...) clinical ethics teaching was introduced in the Obstetrics and Gynaecology (Ob/Gyn) clerkships. The objectives, methods and results of this experimental programme are described in this paper. The success of the teaching is based on three features of the programme: 1) its student-centred approach; 2) the programme is designed in a way similar to regular patient conferences; 3) the programme is taught by a team consisting of both clinician and ethicist. Before starting a longitudinal programme of ethics teaching during the clinical years, it proved very helpful to experiment with a well designed and evaluated pilot programme. (shrink)

This article is a systematic repudiation of Joseph Hamburger's thesis in his book John Stuart Mill on Liberty And Control . Hamburger maintains that Mill wanted to promote the `moral regeneration of mankind' by eroding Christian belief and replacing it with a religion of humanity. He argues that Mill's defense of liberty must be seen in this context, although Mill himself tried to conceal some of his views. Mill in fact permitted interference even in the area of self-regarding conduct. He (...) was against interference by public opinion, but not against interference by superior persons. Mill valued freedom because it enabled superior persons to promote the desired progress toward the religion of humanity. But this article argues that Hamburger fails to distinguish between legitimate and illegitimate forms of interference, a distinction that is central to Mill's case for liberty. Superior persons are not allowed to coerce others from engaging in non-harmful but `miserable' conduct. The progress that Mill envisaged was to be achieved within the framework of freedom for all. This paper provides several examples of how modal logic can be used in studying the XML document navigation language XPath. More specifically, we derive complete axiomatizations, computational complexity and expressive power results for XPath fragments from known results for corresponding logics. A secondary aim of the paper is to introduce XPath in a way that makes it accessible to an audience of modal logicians.

As palliative care develops across many of the countries of Europe, we find that it continues to raise important ethical challenges. Palliative care practice requires ethical sensitivity and understanding. At the same time the very existence of palliative care calls for ethical explanation. Ethics and palliative care meet over some vital issues: 'the good death', sedation at the end of life, requests for euthanasia, futile treatment, and the role of research. Yet palliative care appears uncertain about its goals and there (...) is evidence that its ethical underpinnings are changing. Likewise, the moral problems of palliative care are only partly served by the four 'principles' of modern bioethics. This innovative book, with contributions by clinicians, ethicists, philosophers and social scientists, provides the first ever picture of palliative care ethics in the European context. It will be of interest to those involved in the delivery and management of palliative care services, as well as to students and researchers. (shrink)

This essay explores three questions: What are the salient features of Hobbes's concept of prudence? Prudence for Hobbes is a capacity to predict the future rooted in experience. Second, can 'Hobbesian individuals' have significantly different capacities for prudence? Challenging a common view, asserted even by Hobbes himself, I contend that Hobbes's own conception of prudence yields significant variation across individuals' capacities for prudence. Finally, what is the role of prudence in Hobbes's political thought? A consequence of the significant variation among (...) individuals is that prudence plays a much more consequential role in Hobbes's political philosophy than is often appreciated. (shrink)

Objective To assess whether the frequency of end-of-life decisions for children under 1 year of age in the Netherlands has changed since ultrasound examination around 20 weeks of gestation became routine in 2007 and after a legal provision for deliberately ending the life of a newborn was set up that same year. Methodology This was a recurrent nationwide cross-sectional study in the Netherlands. In 2010, a sample of death certificates from children under 1 year of age was derived from the (...) central death registry. All 223 deaths that occurred in a 4-month study period were included. Physicians who had reported a non-sudden death (n=206) were sent a questionnaire on the end-of-life decisions made. 160 questionnaires were returned (response 78%). Findings In 2010, 63% of all deaths of children under 1 year of age were preceded by an end-of-life decision—a percentage comparable to other times when this study was conducted (1995, 2001, 2005). These end-of-life decisions were mainly decisions to withdraw or withhold potentially life-sustaining treatment. In 2010, the percentage of cases in which drugs were administered with the explicit intention to hasten death was 1%, while in 1995 and 2001, this was 9% and in 2005, this was 8%. Discussion and conclusion There has been a reduction of infant deaths that followed administration of drugs with the explicit intention to hasten death. One explanation for this reduction relates to the introduction of routine ultrasound examination around 20 weeks of gestation. In addition, the introduction of legal criteria and a review process for deliberately ending the life of a newborn may have left Dutch physicians with less room to hasten death. (shrink)

Sher's notion of deserved punishment has unacceptable implications. It does not justify punishing some serious wrongdoers, who are unwilling to commit lesser wrongs, more severely than minor offenders. It requires victim-inflicted punishments which repeat the wrongdoings, with the roles reversed. But if Sher moves away from such victim-inflicted punishments, then his theory should treat wrongdoers like tort-feasors who have to pay monetary compensations to their victims.
