Recent arbitration and human rights boards of inquiry cases involving discrimination against pregnant employees are reviewed. A comparison is made between remedies available under each procedure. It is suggested that the human resource managers review their policies and procedures relevant to this issue to ensure that they do not have the effect or intent of discriminating against pregnant employees.

This conceptual paper draws on cognitive theory and attribution theory to develop a process model of managerial dissonance and responsibility attribution after harm-doing. Although extant harm-doing literature assumes managerial backing for such decisions, this study suggests that there will, at times, be acts of organizationally mandated harm-doing that managers believe are unnecessary. In these cases, it is proposed that managers will experience dissonance from enacting the harm-doing event, resulting in the externalization of responsibility to either the organization or the harm-doing (...) target. This paper examines the challenges faced by the manager through each phase of the dissonance resolution process and possible outcomes of the process. This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

Current focus in the health care ethics literature on the character of the practitioner has a reputable pedigree. Rather than offer a staple diet of Aristotelian ethics in the undergraduate curricula, perhaps instead one should follow Murdoch's suggestion and help the practitioner to develop vision and moral imagination, because this has a practical rather than a theoretical aim. The imaginative capacity of the practitioner plays an important part in both the quality of the nurse's role enactment and the moral strategies (...) which the nurse uses. It also plays a central part in the practitioner's ability to communicate with a patient and in the type of person which the practitioner becomes. Can the moral imagination be stimulated and nurtured? Some philosophers and literary critics argue that not only is this possible, but that literature is the means of doing so. If this is the case then a place should be made for literature in already crowded health care curricula. (shrink)

Critics who use historical evidence to challenge scientific realism have deployed a perfectly natural argumentative strategy that has created a profoundly misguided conception of what would be required to vindicate that challenge. I argue that the question fundamentally in dispute in such debates is neither whether particular terms in contemporary scientific theories will be treated as referential nor whether particular existential commitments will be held true by future scientific communities, but whether the future of science will exhibit the same broad (...) pattern of repeated, profound, and unpredictable changes in theoretical orthodoxy that such historicist critics argue characterizes its past. This paper suggests that a consideration of health care practice is a necessary step in gaining insight into the appropriate composition of an ethics course for students in the health care professional. Health care practice, if it responds to the needs of society, is dynamic in nature. In the current climate of change in the health service, the author sug gests that the nursing profession needs to become more proactive in analysing and attempting to determine the future shape of nursing. (...) To protect patient care the nursing profession needs to have its eyes open to the ethical dimensions of changes in role and practice. The author argues that, in attempting to ensure that the education to which nursing students are exposed is of relevance, it is necessary to introduce an element of the ideal into the ethics component of their professional education. From early on in their profes sional development students should be aware of the scope and standards of practice, and the type of role enactment to which the profession requires them to aspire. Increasing European co-operation must take place in many areas, including medical ethics. Against the background of common cultural norms and pluralistic variation within political traditions, religion and lifestyles, Europe will have to converge towards unity within the field of medical ethics. This article examines how such convergence might develop with respect to four major areas: European research ethics committees, democratic health systems, the human genome project and rules for stopping futile treatments.

Open peer commentary on the article “Exploration of the Functional Properties of Interaction: Computer Models and Pointers for Theory” by Etienne B. Roesch, Matthew Spencer, Slawomir J. Nasuto, Thomas Tanay & J. Mark Bishop. Upshot: Artificial life computer simulations hold the potential for demonstrating the kinds of bottom-up, cooperative, self-organizing processes that underlie the self-construction of observer-actors. This is a worthwhile, if limited, attempt to use such simulations to address this set of core constructivist concerns. Although we concur with much (...) of the philosophical perspective in the target article, we take issue with some of the implied positions related to dynamical systems, sensorimotor contingency theory, and neural information processing. Ideally, we would like to see computational approaches more directly address adaptive, constructive processes and mechanisms operant in minds and brains. This would entail using tasks that are more relevant to the psychology of human and animal learning than performing digit sums or sorts. It also could involve relating the dynamics of agents more explicitly to ensembles of communicating neural assemblies. (shrink)

The essay briefly review the intellectual bonds between Alchourrón and Bulygin and Italian legal thought. Alchourrón and Bulygin’s seminal work is widely read in Italy; and by now is considered essential groundwork by a growing generation of young legal scholars.

This dialogue is on the nature of thought and thinking. The five disputants are Socrates, an imaginary neuroscientist from California, an Oxford don from the 1950s, a Scottish post-doctoral student, and John Locke. The discussion takes place in Elysium in the late afternoon. They examine the idea that thinking is an activity of the mind or the brain, whether the medium of thought consists of words or ideas, whether thoughtful speech is speech accompanied by thought, whether thinking, i.e. reasoning and (...) inferring, is a process, and what is meant by the claim that ‘thinking is the last interpretation’. I propose to consider photon tunneling as a space-time correlation phenomenon between the emission and absorption of a photon on the two sides of a barrier. Standard technics based on an appropriate counting rate formula may then be applied to derive the tunneling time distribution without any ad hoc definition of this quantity. General formulae are worked out for a potential model using Wigner–Weisskopf method. For a homogeneous square barrier in the limit of zero tunneling probability a vanishing tunneling time (...) is obtained. (shrink)

Mapping one's ignorance also has affective benefits. Wherever mastery of knowledge and skills creates professional status, especially in practices that give professional power over clients, there arises a natural pride that rests on what one knows, and a regrettable tendency for authority to develop arrogance. We know the effects: failure to listen, premature dismissal of relevant information, overreaching and overbearing professional conduct, mistakes and the denial of them, and so on. An explicit acknowledgement of ignorance may generate a corrective humility, (...) a desire to see rather than presume understanding, alertness to unforeseen consequences, and openness to alternative approaches.
