In contemporary bioethics, the autonomy of the patient has assumed considerable importance. Progressing from a more limited notion of informed consent, shared decision making calls upon patients to voice the desires and preferences of their authentic self, engaging in choice among alternatives as a way to exercise deeply held values. One influential opinion in Jewish bioethics holds that Jewish law, in contradistinction to secular bioethics, limits the patient's exercise of autonomy only in those instances in which treatment choices are sensitive (...) to preferences. Here, we analyze a discussion in the Mishna, a foundational text of rabbinic Judaism, regarding patient autonomy in the setting of religiously mandated fasting, and commentaries in the Babylonian and Palestinian Talmuds, finding both a more expansive notion of such autonomy and a potential metaphysical grounding for it in the importance of patient self-knowledge. This chapter evaluates the use of the Babylonian Talmud for the study of the history of late-Roman Palestine using astrology as a case example. It explains that the Babylonian Talmud contains much material which derives from Palestine and may sometimes preserve Palestinian rabbinic material in a form closer to the original than is found in Palestinian compilations. Palestinian sources often do not contain trustworthy evidence about Palestinian Sages and institutions.

In the rabbinic literature from the land of Israel the poor are depicted not as passive recipients of gifts and support, but as independent agents who are responsible for their own behaviour. Communal care for the needy was expected to go beyond their basic needs for food, clothing and shelter; the physical safety of the poor and the value of their time as well as their dignity and self-worth were also included in the scope of charity. In this monograph, Yael (...) Wilfand offers a comprehensive and contextual analysis of major rabbinic texts on poverty and charity composed during the first five centuries of the Common Era in the land of Israel, principally the Mishnah, the Tosefta, the Palestinian Talmud and midrashim. She shows that, for the rabbis, the poor were not necessarily considered outsiders; indeed, some students and rabbis in Palestine may have personally experienced poverty. Wilfand claims that such socio-economic diversity contributed to the thinking of these rabbis, who rarely saw poverty as a result of transgression (in contrast to the Babylonian Talmud). This book presents a number of contrasting viewpoints held by Palestinian rabbis over such questions as: Must communal administrators ensure applicants' eligibility for alms? Should the newly indigent from wealthy families receive exceptional levels of support? Might neighbouring gentiles qualify for economic assistance from Jewish communal sources? By examining Palestinian rabbinic sources within the contexts both of the hegemonic Greco-Roman (later, Christian) milieu and of the biblical heritage, this volume offers an absorbing account of some ancient approaches to timeless social challenges. Like Chris Marker's La Jeteé , the accompanying static images distort the viewer's temporality: are these archaeological items, images from a past, or a future? Why isn't this our future? In Between States (...) can also be seen as complementing Larissa Sansour's provocative science fiction works, Space Exodus (2009) which "documents" the Palestinian space program, and her Nation Estate (2012), in which Palestine is relocated into a skyscraper. In 1941 an investigation by the US Justice Department exposed a marriage cartel between John D. Rockefeller’s Standard Oil (now ExxonMobil) and I.G. Farben. The two corporations had formed a joint operation in 1927 called Standard IG Farben. It was revealed that the two had shared patents in order to control prices and markets in their respective regions. Standard was accused of hiding patents from the US Navy and supplying fuel to German submarines, which lead to charges of criminal conspiracy. The Pentagon intervened, requesting that President Roosevelt stop the investigation in order to protect war production and oil supply. Roosevelt agreed, and the Senate committee investigating the matter, headed by Senator Harry Truman, was halted. Standard Oil paid a fine of $5000 and promised to stop supplying fuel to the enemies. Formed by Allied forces using the seized assets and engineering expertise of Hitler’s hitherto classified space program (conquer Earth, then the stars), the North Atlantic Space Agency was a pre-NATO foray into interstellar nation building, with orbital occupation as the first point of order. By 1947, NASA was nearly ready to deploy the first manned space station. Standard Oil and I.G. Diplomatic efforts to establish a Jewish homeland in Palestine were failing to gain traction, while post-colonial England held its ground on immigration restrictions and bands of Jews and Arabs battled over territory on the ground. More immediate was the issue of temporarily housing Holocaust survivors and refugees across scorched Europe. Leaders of the continental nations demonstrated, at best, reluctance to accommodate the Jews, who in turn were, at the least, resistant to returning to the same bloody cocktail from which they had fled. Truman used the impasse to advance a plan for NASA’s space station to be put to use as a temporary Jewish outpost, an orbital displaced persons camp, to be operated by the US Army. Viewing the orbital displaced persons (ODP) camp as a solution to their immigration problem both at home and abroad, England came on board as a willing partner. Spaceship Exodus was positioned for takeoff on German farmland 20 kilometers southwest of Frankfurt. On December 30, 1947, one month after the UN General Assembly voted down the separation plan for Palestine, Exodus rocketed into the atmosphere hauling the first module of barracks designed to house 1,500 refugees. Additional installations were positioned to form swollen clusters of interlocking units – sleeping quarters, schools, clinics, canteens. The UN was brought in to monitor the camp following two chaotic years of US Army control in which food shortages, pandemic diseases, and rampant black market trade had brought the camp to near total collapse. No less bureaucratic or ineffectual, the UN relief agency at least had prior experience facilitating contexts of a similar magnitude and could potentially predict outcomes. What had been unexpected was the degree to which the camp would evolve into its own self-regulated, hive-like ecosystem where previously accepted rules of conduct were not applicable. The ODP camp was an exceptional space, a riverboat casino, an offshore research lab of social experimentation and entrepreneurial innovation. No longer Earth-bound, touching soil knotted by prescripts of Talmudic law, the camp residents were able to rationalize loopholes and detonate barriers standing in the way of absolute production. The Jewish archipelago was renamed Israel after the ancient homeland. If the temple couldn’t be rebuilt in the motherland, a post-national rhizome would sprout up in its stead. Rabbinic tradition, as given in the Palestinian and Babylonian versions of the Talmud, transmits an account of Rabbi Elisha ben Abuyah only to depreciate him for the “pariah” that he was during his lifetime. For one who accepts rabbinic authority, there can be no moral ambiguity about the character of the man, his beliefs, or his aspirations.1 The twelfth-century philosopher and rabbi Moses Maimonides spared no criticism of Elisha. Maimonides wrote The Guide for the Perplexed with the object (...) of enlightening “a religious man who has been trained to believe in the truth of our holy Law, who conscientiously fulfills his moral and religious duties, and at the same time has been successful in his philosophical studies .. Wide-ranging and astutely argued, Talmud /and/ Philosophy examines the intersections, partitions, and mutual illuminations and problematizations of western philosophy and the Talmud. Among its devoted students or "learners," the Talmud - both as text and mode of thought - is a constantly unfolding truth about humans in their relationship to God in the world. Among many philosophers, the Talmud has been at best an idealized and remote object, and at worse, if noticed at all, an object (...) for curiosity. The contributors to this volume collectively turn on and probe a new mode of inquiry by approaching the very question of partitions, conjunctions and disjunctions between the Talmud and philosophy as the guiding question of their inquiry. Rather than using the Talmud and its modes of argumentation to develop existing philosophical themes, the essays probe the question of how the Talmud as an intellectual discipline sheds new light on the unfolding of philosophy in the history of thought. This paper examines the deontic logic of the Talmud. We shall find, by looking at examples, that at first approximation we need deontic logic with several connectives: O T A Talmudic obligation F T A Talmudic prohibition F D A Standard deontic prohibition O D A Standard deontic obligation. In classical logic one would have expected that deontic obligation O D is definable by $O_DA \equiv F_D\neg A$ and that O T and F T are connected by $O_TA \equiv (...) F_T\neg A$ This is not the case in the Talmud for the T (Talmudic) operators, though it does hold for the D operators. We must change our underlying logic. We have to regard {O T , F T } and {O D , F D } as two sets of operators, where O T and F T are independent of one another and where we have some connections between the two sets. We shall list the types of obligation patterns appearing in the Talmud and develop an intuitionistic deontic logic to accommodate them. We shall compare Talmudic deontic logic with modern deontic logic. (shrink)

We describe the state of the Talmudic Logic project as of end of 2019. The Talmud is the most comprehensive and fundamental work of Jewish religious law, employing a large number of logical components centuries ahead of their time. In many cases the basic principles are not explicitly formulated, which makes it difficult to formalize and make available to the modern student of Logic. This project on Talmudic Logic, aims to present logical analysis of Talmudic reasoning using modern logical (...) tools. We investigate principles of Talmudic Logic and publish a series of books, one book or more for each principle. The series begins with the systematic analysis of Talmudic inference rules. The first book shows that we can present Talmudic reasoning intuitions as a systematic logical system basic to modern non-deductive reasoning, such as Argumentum A Fortiori, Abduction and Analogy. The second book offers a systematic common sense method for intuitively defining sets and claims that this method adequately models the Talmudic use of the rules Klal uPrat. These books also criticize modern Talmudic research methodology. Later books deal with additional topics like Deontic logic, and Temporal logic, Agency and processes in the Talmud and more. The aims of the project are two fold: 1. To import into the Talmudic study modern logical methods with a view to help understand complicated Talmudic passages, which otherwise cannot be addressed. 2. To export from the Talmud new logical principles which are innovative and useful to modern contemporary logic. (shrink)

The research aims to identify the trends of Palestinian higher educational institutions in Gaza Strip as learning organizations from the perspective of senior management in the Palestinian universities in Gaza Strip. The researchers used descriptive analytical approach and used the questionnaire as a tool for information gathering. The questionnaires were distributed to senior management in the Palestinian universities. The study population reached (344) employees in senior management is dispersed over (3) Palestinian universities. A stratified random sample (...) of (182) employees from the Palestinian universities was selected and the recovery rate was (69.2%). Statistical analysis (SPSS) program was used for analysis and processing the data. The study found the following results: There is an agreement about: the importance of the focus of "organizational structure" with an average approval, the importance of "technological infrastructure" axis with high approval, and the importance of "strategic" with an average approval. The results concluded that the study sample agree on the importance of "organizational dimension" highly. The results showed that the sample believe that the "strategic leadership" level in the universities got medium-approval. There is a fair level agreement about the axis of interest "teams / committees". There is an agreement about the importance of the "human dimension" moderately. The results showed that the sample is highly agreed about the importance of focus of the "knowledge management", and the focus of the "continuing education". They agreed weakly to somewhat about the importance of the focus of "scientific research", moderately agree about the importance of the center of "institutional culture", agree moderately on the importance of "cognitive dimension". The results showed that the sample largely agree on the importance of the focus of "strategic partnerships and alliances". They agree highly on the axis "keep up with the labor market" and on the focus of the importance of "technology incubators". The results showed that the sample moderately agree about the importance of the theme on "consulting and training", the importance of the focus of "social responsibility", and the focus of the "Community dimension". The study found a group of recommendations including: there is a need to provide suitable environment that achieve learning organizations. There is a need to develop the technological infrastructure (hardware, software, networks, databases, and human skills) because of the great advantages that they offer. The universities need to adopt knowledge management in the academic and administrative departments because knowledge is the core of the work of these departments. The establishment of technology incubators in universities to adopt outstanding university research projects, to protect, to supports, and to market them; furthermore, to develop the capabilities and skills of employees in the field of information technology. The present article focuses on the case of the 2012 hunger-strike of Palestinian prisoners in Israeli jails. We analyze the ethical dilemma involved in the way the Israeli medical community reacted to these hunger-strikes and the question of force feeding within the context of the fundamental dual-loyalty structure inherent in the Israeli Prison Services—system. We argue that the liberal perspective that focuses the discussion on the dilemma between the principle of individual autonomy and the sanctity of life tends to (...) be oblivious to the asymmetrical relation of power that characterizes the prison system and to the socio-political context in which hunger-strikes take place. Emphasizing hunger-strikes as political acts implies that health practitioners’ conducts cannot be analyzed only through the prism of clinical medical ethics. It requires a public health ethics’ approach, an approach that understands health in the context of the complex relationship between society, state, organizations, communities and individuals. The authors are both academics and volunteers in Physicians for Human Rights—Israel thus our analysis is based both on sociological and public health ethics principles and on the continuous work and advocacy for the right to health of prisoners. This article examines the Palestinian women's autonomous movement that emerged in the early 1990s, emphasizing changes in the sociopolitical context to account for the movement's emergence, dynamics, and challenges. Using interviews obtained during fieldwork in Palestine in 1992, 1993, and 1994, and employing historical and archival records, I argue that Palestinian feminist discourses were shaped and influenced by the sociopolitical context in which Palestinian women acted and with which they interacted. The multiplicity of views voiced by the (...) women I interviewed attests to the impossibility of homogenizing and flattening women's experiences, while the range of actions and strategies employed by different groups and organizations calls attention to contextual limitations on social action. A single document, the Talmud of Babylonia – that is to say, the Misha, a philosophical law code that reached closure at ca 100 C.E., as read by the Gemara, a commentary to thirty-seven of the sixty-three tractates of that code, compiled in Babylonia, reaching closure by ca 600 C.E. – from ancient times to the present day has served as the medium of instruction for all literate Jews, teaching, by example alone, the craft of clear thinking, compelling argument, (...) correct rhetoric. That craft originated in Athens with Plato’s Socrates for the medium of thought, and with Aristotle for the method of thought, and predominated in the intellectual life of Western civilization thereafter. When we correlate the modes of thought and analysis of the Talmud with the ones of classical philosophy that pertain, we see how the Talmud works, by which I mean, how its framers made connections and drew conclusions, for the Mishnah and Gemara respectively. And when we can explain how the Talmud works, I claim, we may also understand why it exercised the remarkable power that it did for the entire history of Judaism from its closure in the 7th century into our own time. Supporters of a Palestinian right of return assume that Israeli Jews bear responsibility for both the past and present suffering of the Palestinian refugees. Accordingly, the Palestinian claim for return is a demand to realize this responsibility by way of the return of the refugees to their places of origin or to uninhabited regions in the Land of Israel/palestine. The purpose of this article is to examine the responsibility of the Israeli Jews for the Palestinian return (...) of the refugees in light of the question of the justice of Zionism. Part I presents various approaches rejecting or affirming Zionism. The subsequent parts investigate the implications of the disparities between these approaches rejecting/affirming Zionism and Zionism’s actual history as it unfolded in terms of Jewish responsibility for the Palestinian plight and the question of Palestinian return. I argue that some of the approaches to Zionism are irrelevant to the dispute over the Palestinian right of return as it is understood within the framework of Israeli internal discourse and the Israeli-Palestinian dialogue. However, my main point is that those approaches rejecting/ affirming Zionism that are relevant, though they may vary in their implications for the scope of Jewish responsibility for Palestinian suffering, nevertheless lead to very similar conclusions with respect to discharging that responsibility by way of Palestinian repatriation. Levinas’s conception of listening for the “trace” of the infinite implies that the human spirit grows when it comes into contact with something greater than it had previously known. When Levinas reads the Talmud, sourcebook of Jewish Law, he tries to enter into conversation with it, allowing the meaning of the text to expand to touch his own contemporary concerns. At the flip side of this expansion, however, lies my worry that the text junctions as a “totality,” assimilating all (...) contemporary concerns to its discussions. At this time of rebuilding in Jewish history, Jews cannot afford narrow conceptions of Jewish practice. This essay does not attempt to elucidateLevinas’s thought, but to use some insights gained from reading his work to think about contemporary Judaism. (shrink)

The essay offers a Jewish account of education in nonviolence by examining the first of Emmanuel Levinas' Talmudic readings ‘Toward the Other.’ I begin by exploring Levinas' unique philosophy of religious education, which nurtures responsibility for the other, as part of an alternative to enlightenment-orientated modern Jewish thought pioneered by the likes of Gershom Scholem, Martin Buber, and Franz Rosenzweig. I then consider a question raised by Yusef Waghid and Zehavit Gross at the 2012 meeting of the Philosophy of Education (...) Society of Great Britain in Oxford concerning whether one must forget in order to forgive great wrong doing such as South African Apartheid or the Holocaust of European Jewry. Through an examination of Levinas' treatment of several Talmudic passages, I argue that the Jewish tradition takes a paradoxical approach to this question. We should forget in order to remember wrong doing. The spiritual process that both perpetrators and victims must undergo in order to embrace this paradox, I contend, is a genuine education in nonviolence. (shrink)

In the course of 20th-century European history Jews and Arabs, as well as Jews and Muslims, were put in the position of a ‘civilizational’ conflict that is not only political but also quasi-metaphysical. This article examines an impact of the conflict on the attitudes towards anti-Semitism and Islamophobia and considers Islamophobic implications of the ‘new anti-Semitism’ discourse. A thesis of the text is that both the struggle against anti-Semitism and Islamophobia and the one against the mechanism creating, in certain circumstances, (...) a kind of negative feedback loop between them requires not only opposing the anti-Jewish and anti-Muslim prejudices, but also a deep, critical reconsideration of the concepts of Europeanness that lie at their foundation. The author suggests that a good starting point for this reconsideration might be the postcolonial reading of the Jewish intellectual tradition, especially the one focusing on the figure of the Mizrahi Jew. The paper argues that individual Palestinians have a right of return to historic Palestine in virtue of being members of the Palestinian people that continues to have occupancy rights in historic Palestine. More specifically, the paper argues that the Palestinians were, when Israel was founded, a people with occupancy rights to their lands, that they continue to be a people to this day, and that their occupancy right has not been alienated, forfeited, or prescripted. Because the right has been blocked by Israel since 1948, the right of return is the right of individual Palestinians to be allowed to return to their homeland and exercise their occupancy rights there. This monograph uses deconstruction—a philosophical movement originated by Jacques Derrida—to read the most authoritative book in Judaism: the Talmud. Examining deconstruction in comparison with Kant’s and Hegel’s philosophies, the volume argues that the movement opens an innovative debate on Jewish Law. -/- First, the monograph interprets deconstruction within the major streams of continental philosophy; then, it criticizes many aspects of Foucault’s and Agamben’s philosophy, rejecting their notion of law. On these premises, the research delivers a close examination of many (...) fundamental aspects of the Talmud. Consequently, it provides a short history of Rabbinic literature, a history of the dissemination of the Talmud from Babylon to Northern France, and an analysis of Talmudic vocabulary from a deconstructive perspective. This chapter examines the rabbinic Judaism from the Palestinian context. It suggests that it is not possible to provide any unambiguous framework which will offer clues to the context, or contexts, in which the extraordinary corpus of rabbinic works was composed. It concludes that the composition of the rabbinic literature could only take place in a society marked by a complex interplay of beliefs, ethnic identities and languages and identifies the most common points of reference in Jewish religious writing.

It is often suggested that the resolution of the Israel-Palestine conflict will require forgiveness on the part of both Palestinians and Israelis. This paper looks at what such forgiveness might involve for one party to the conflict. It begins by offering an account of political forgiveness in which both collective actions and collective emotions play a significant role. It then explores whether there is a collective Palestinian agent capable of forgiving as well as whether it would be permissible for (...) such an agent to forgive. Logic in the Talmud is a ‘thematic compilation’ by Avi Sion. It collects in one volume essays that he has written on this subject in Judaic Logic (1995) and A Fortiori Logic (2013), in which traces of logic in the Talmud (the Mishna and Gemara) are identified and analyzed. Abstract: The study aimed to identify the creative behavior in the Palestinian civil organizations between reality and expectations, and the study used the descriptive analytical approach and the questionnaire as a main tool for collecting data from employees of associations operating in the governorates of Gaza Strip, and the cluster sample method was used and the sample size was (343) individuals and has been recovered (298) Resolution. The following results were reached: The relative weight of the measure of creative (...) behavior was 78.99 (%), and there were no statistically significant differences in creative behavior according to the gender variable, age group, educational qualification, specialization, while the results indicated that there were differences according to the number of years of service. The study presented a set of recommendations, the most important of which are: the necessity of working to follow up the strategic plan for NGOs using electronic messages as it paves the way for achieving excellence and creativity in the field of work, the need to hold meetings and workshops with the local community and this helps them determine the needs of the community. ABSTRACTThe ‘City of David’ in Silwan is on the original site of Jerusalem. Located in Israeli-occupied East Jerusalem, it is both an illegal Israeli settlement in a Palestinian neighbourhood and a popular international tourist destination. This article examines how the site is narrated by tour operators and tourists through fieldwork, interviews and analysis of tourist comments on the TripAdvisor site. It argues that Israeli settlers have successfully harnessed tourist discourse in order to present their vision of a Jewish Jerusalem (...) in which Palestinian existence is ignored or treated as a threat. The site allows tourists to connect to and experience a mythical biblical past, something which answers to tourist desires to have an authentic encounter with the destination culture. In the site’s narratives, the presence of Palestinians in the area is elided over through spatial and linguistic separation and by denying their legitimate presence. This indicates how the congruence between Zionist and tourist discourses discursively legitimises Israeli colonisation of Silwan. (shrink)

The research aims to identify the organizational excellence in Palestinian universities of Gaza Strip, from the perspective of senior management. The questionnaires were distributed the top senior management in the Palestinian universities, and the study population was (344) employees in senior management in Palestinian universities. A stratified random sample were selected from of employees in the Palestinian universities consist of (182) employees at return rate of (69.2%). SPSS program for analyzing and processing the data was used. (...) The study reached the following results: the senior management agrees largely on the importance of the axis of "Leadership Excellence" and "Excellence service sectors". The senior management agrees moderately about the importance of the axis of the “Knowledge excellence". The study showed that there is a weakness in the employment of scientific research to serve the community, there is weakness in the follow-up of the universities management for the performance of their graduates in the institutions in which they work. Senior management agrees on the importance of the "Organizational Excellence" moderately. The recommendations of study includes: the need to develop principles and fair criteria for the selection of the best candidates for the university and university leaders based on specialization, competence, experience, skills, integrity and not on the basis of favoritism. The paradigmatic bases, which sustain traditional western psychological interpretative efforts, need not be just a footnote to Plato. In this paper we introduce the Talmudic interpretative perspective, which we use to point at some weaknesses we identify in contemporary research imaginings. While the empiricist approach may be traced to Plato and the interpretative and the critical approaches may be traced to Heraclitus, we argue that the Talmudic approach is a differentiated and unique perspective that, because of its non-epistemic nature, its (...) dialogical character, and its recognition of two intermingled levels of interpretation, can make an important contribution to new ways of thinking about understanding and meaning in research. Abstract This article traces a historical shift, and in particular its erasure from memory on the intellectual map of the West, in concepts of subjectivity across practices of rabbinic thinking in late antiquity, medieval interpretations of the Talmud, and modern talmudic scholarship. I first introduce a comparative perspective that relies on a mutual hermeneutics of philosophical and talmudic traditions. I consequently engage with Alain de Libera's archaeological analysis of the birth of the thinking subject in medieval philosophy and theology. (...) In this light, I analyze the role of the notion of the thinking subject in construing the Talmud from Maimonides to contemporary Talmud criticism. Finally, I explore the implications of de Libera's program of a philosophical archaeology of the thinking subject for mapping the complex relationship of mutual presupposition and exclusion between philosophical, rhetorical, and talmudic traditions of thinking in antiquity, as manifested in the larger scope of these traditions. From Sartre to Levinas, continental philosophers have looked to the example of the Jew as the paradigmatic object of and model for ethical inquiry. Levinas, for example, powerfully dedicates his 1974 book Otherwise than Being to the victims of the Holocaust, and turns attention to the state of philosophy after Auschwitz. Such an ethics radically challenges prior notions of autonomy and comprehension-two key ideas for traditional ethical theory and, more generally, the Greek tradition. It seeks to respect the opacity of (...) the other and avoid the dangers of hermeneutic violence. But how does such an ethics of the other translate into real, everyday life? What is at stake in thinking the other as Jew? Is the alterity of the Jew simply a counter to Greek universalism? Is a rhetoric of exceptionalism, with its unavoidable ontological residue, at odds with shifting political realities? Within this paradigm, what then becomes of the Arab or Muslim, the other of the Jew, the other of the other, so to speak? This line of ethical thought-in its desire to bear witness to past suffering and come to terms with subjectivity after Auschwitz-arguably brackets from analysis present operations of power. Would, then, a more sensitive historical approach expose the Palestinian as the other of the Israeli? Here, Zahi Zalloua offers a challenging intervention into how we configure the contemporary. We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j (...) =? undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. In fact we have here a general method for executing non-deductive inferences. (shrink)

Robert Brandom's "The Pragmatist Enlightenment" describes the advent of American pragmatism as signaling a sea-change in our understanding of human reason away from the top-down Euclidian models of reasoning, warrant and knowledge inspired by the physical sciences, toward the far more bottom-up, narrative, inherently fallible and dialogical forms of reasoning of the life and human sciences. It is against this backdrop that Talmudic Judaism emerges not only as an early anticipation of the pragmatist enlightenment, but as going a substantial and (...) radical step beyond it, that in the context of religious commitment and reasoning, is unprecedented. The idea of corporate social responsibility is neither new nor radical. The core belief is that business managers, even in their role as managers, have responsibilities to society beyond profit maximization. Managers, in pursuing their primary goal of increasing shareholder value, have social responsibilities in addition to meeting the minimal requirements of the law. Nevertheless, the call for increased social responsibility on the part of business managers remains controversial. At least two major perspectives on social responsibility can be isolated. The (...) classical view, most closely identified with Milton Friedman, suggests that social responsibility is incompatible with a free enterprise economy. By contrast, advocates of increased social responsibility point out the desirability for voluntary (and at times costly) corporate activities which promote society's well being. The purpose of this essay is to briefly describe both the classical and pro-social responsibility perspectives. We suggest that while important differences in assumptions characterize the two distinct views, there is enough overlap and agreement to move the debate beyond the current stalemate. Specifically, we argue that the concept oflifnim mishurat hadin, an innovative and ancient Jewish legal doctrine which is usually translated as beyond the letter of the law, might serve as a model for modern legal and social thought. We examine talmudic and post-talmudic sources which apply this concept to the area of business ethics, and explore its applicability to the modern situation. Although the business ethics literature rarely refers to Talmudic and rabbinic sources, these texts reflect a sophisticated understanding of business practices and ethical problems. (shrink)

Palestinian teachers at the pre-collegiate level who participate in the CEEPAT programme will, it is hoped, learn to place new emphasis on enhancement of their students' analytical skills and discourage an identification of knowledge with memorisation. For their part, Palestinian professors who have been trained to teach in the programme will presumably constitute a growing reservoir of talent which may be expected to raise the quality of Palestinian university education. Plans are now under way to give all (...) Palestinians teaching under the auspices of CEEPAT an opportunity to attend an annual, three-week winter seminar in Gaza and/or a summer seminar in the United States, both of which will focus on issues of pedagogy and methodology. Such professors can be expected to “pass on their new understanding of teaching via discussion to their colleagues and to their university students, thereby spreading an important pedagogical method to other segments of the Palestinian... community”. 7 CEEPAT clearly has the potential to make a significant contribution to the elevation of educational standards in Palestine at a time of major historical change.In Palestine, higher education of quality is obviously a very serious business. It is understood that it underlies any possibility of individual betterment, economic development, or the evolution of an independent Palestinian state. If ever the Israeli occupation is completely terminated and the present financial crisis of the universities is solved, Palestinian university and post-baccalaureate training may reasonably be expected to become fully competitive on an international scale. Levinas is often credited with introducing a strong notion of ethics into postmodern thought. But his commitment to Zionism, his views on the Palestinian people, and his underformulated theory of justice raise questions about the desirability of his thinking for politics. In this study, the well-known encounter between Levinas and the Palestinians is addressed in order to determine how his philosophy of ethics can be deployed for political ends. As the philosopher famously concerned with the connection between self and (...) the Other, the relation between Levinas, Israel and the Palestinians stands as the natural political test of his ethics. Based on this encounter, it is demonstrated that Levinasian justice is too unsafe as a prescription for a political order. Only when Levinas' ethics as first philosophy is supported by love as first politics is his Messianic polity acceptable. (shrink)

The Babylonian Talmud, compiled from the 2nd to 7th centuries C.E., is the primary source for all subsequent Jewish laws. It is not written in apodeictic style, but rather as a discursive record of (real or imagined) legal (and other) arguments crossing a wide range of technical topics. Thus, it is not a simple matter to infer general methodological principles underlying the Talmudic approach to legal reasoning. Nevertheless, in this article, we propose a general principle that we believe helps (...) to explain the variety of methods used by the Rabbis of the Talmud for resolving uncertainty in matters of Jewish Law (henceforth: Halakhah).
