Over 1.3 billion people in the world are challenged to access good and cheap healthcare when become ill. Health insurance policies are a fantastic strategy to assist people who can't afford medical care. For middle- and low-income nations, there hasn't been much research on the ability to pay for health insurance for public employees like school teachers. Therefore, this cross-sectional questionnaire based research has been undertaken to explore the reflection of health insurance among 383 Bangladeshi school teachers of 5 divisional (...) city center primary school and were being surveyed online between 1st August to 30th August 2022. According to survey, monthly average (mean) health expenditure of respondents were 7668.93 BDT (Bangladeshi Taka equivalent to $80.72) with 95% confidence interval. Of 35% responders suffered from high blood pressure, approximately 8% people were suffering from arthritis and asthma, 7.8% people have heart disease and 8.1 % people suffer from cholesterol problem. Maximum respondents (80%) agreed that health insurance is burden for them. About 51% teachers had no idea about health insurance. However, there was no significant relation in between educational status and health insurance perception for male and female teacher respondents. Moreover, the comparative data highlighted that more awareness and more exploration might be needed in health insurance perception for primary school teachers. This result can contribute to form people’s choice-oriented health insurance policy. (shrink)

Marx says of alienated labor that it does not “belong” to the worker, that it issues in a product that does not belong to her, and that it is unfulfilling, unfree, egoistically motivated, and inhuman. He seems to think, moreover, that the first of these features grounds all the others. All of these features seem quite independent, however: they can come apart; they share no obvious common cause or explanation; and if they often occur together, this seems accidental. It is (...) not clear, then, how Marx’s concept of alienated labor could possess the strong unity that he takes it to have. This article defends a reinterpretation of the concept that explains this unity. The various features of alienated labor, the article argues, all follow from a single, hitherto underappreciated feature of its formal motivational structure: the fact that such labor is motivated not by its product but by an incentive. Presents results of free‐recall experiments conducted in France, Gabon and Nepal, to test predictions of a cognitive model of religious concepts. The world over, these concepts include violations of conceptual expectations at the level of domain knowledge (e.g., about ‘animal’ or ‘artifact’ or ‘person’) rather than at the basic level. In five studies we used narratives to test the hypothesis that domain‐level violations are recalled better than other conceptual associations. These studies used material constructed in the same way as religious (...) concepts, but not used in religions familiar to the subjects. Experiments 1 and 2 confirmed a distinctiveness effect for such material. Experiment 3 shows that recall also depends on the possibility to generate inferences from violations of domain expectations. Replications in Gabon (Exp. 4) and Nepal (Exp. 5) showed that recall for domain‐level violations is better than for violations of basic‐level expectations. Overall sensitivity to violations is similar in different cultures and produces similar recall effects, despite differences in commitment to religious belief, in the range of local religious concepts or in their mode of transmission. However, differences between Gabon and Nepal results suggest that familiarity with some types of domain‐level violations may paradoxically make other types more salient. These results suggest that recall effects may account for the recurrent features found in religious concepts from different cultures. (shrink)

Belief is not a unified phenomenon. In this paper I argue, as a number of other riters argue, that one should distinguish a variety of belief-like attitudes: believing proper - a dispositional state which can have degrees - holding true - which can occur without understanding what one believes - and accepting - a practical and contextual attitude that has a role in deliberation and in practical reasoning. Acceptance itself is not a unified attitude. I explore the various relationships and (...) differences between these doxastic attitudes, and claim that although acceptance is distinct from belief, it rests upon it, and is therefore a species of belief. Ritualized behavior, intuitively recognizable by its stereotypy, rigidity, repetition, and apparent lack of rational motivation, is found in a variety of life conditions, customs, and everyday practices: in cultural rituals, whether religious or non-religious; in many children's complicated routines; in the pathology of obsessive-compulsive disorders (OCD); in normal adults around certain stages of the life-cycle, birthing in particular. Combining evidence from evolutionary anthropology, neuropsychology and neuroimaging, we propose an explanation of ritualized behavior in terms of an evolved Precaution System geared (...) to the detection of and reaction to inferred threats to fitness. This system, distinct from fear-systems geared to respond to manifest danger, includes a repertoire of clues for potential danger as well as a repertoire of species-typical precautions. In OCD pathology, this system does not supply a negative feedback to the appraisal of potential threats, resulting in doubts about the proper performance of precautions, and repetition of action. Also, anxiety levels focus the attention on low-level gestural units of behavior rather than on the goal-related higher-level units normally used in parsing the action-flow. Normally automatized actions are submitted to cognitive control. This “swamps” working memory, an effect of which is a temporary relief from intrusions but also their long-term strengthening. Normal activation of this Precaution System explains intrusions and ritual behaviors in normal adults. Gradual calibration of the system occurs through childhood rituals. Cultural mimicry of this system's normal input makes cultural rituals attention-grabbing and compelling. A number of empirical predictions follow from this synthetic model. Since its origin, bioethics has attracted the collaboration of few social scientists, and social scientific methods of gathering empirical data have remained unfamiliar to ethicists. Recently, however, the clouded relations between the empirical and normative perspectives on bioethics appear to be changing. Three reasons explain why there was no easy and consistent input of empirical evidence into bioethics. Firstly, interdisciplinary dialogue runs the risk of communication problems and divergent objectives. Secondly, the social sciences were absent partners since the beginning of (...) bioethics. Thirdly, the meta‐ethical distinction between ‘is’ and ‘ought’ created a ‘natural’ border between the disciplines. Now, bioethics tends to accommodate more empirical research. Three hypotheses explain this emergence. Firstly, dissatisfaction with a foundationalist interpretation of applied ethics created a stimulus to incorporate empirical research in bioethics. Secondly, clinical ethicists became engaged in empirical research due to their strong integration in the medical setting. Thirdly, the rise of the evidence‐based paradigm had an influence on the practice of bioethics. However, a problematic relationship cannot simply and easily evolve into a perfect interaction. A new and positive climate for empirical approaches has arisen, but the original difficulties have not disappeared. (shrink)

The field of bioethics is increasingly coming into contact with empirical research findings. In this article, we ask what role empirical research can play in the process of ethical clarification and decision-making. Ethical reflection almost always proceeds in three steps: the description of the moral question,the assessment of the moral question and the evaluation of the decision-making. Empirical research can contribute to each step of this process. In the description of the moral object, first of all, empirical research has a (...) role to play in the description of morally relevant facts. It plays a role in answering the “reality-revealing questions” (what, why,how, who, where and when), in assessing the consequences and in proposing alternative courses of action. Secondly, empirical research plays a role in assessing the moral question. It must be acknowledged that research possesses “the normative power of the factual,” which can also become normative by suppressing other norms. However, inductive normativity should always be balanced out by a deductive form of normativity. Thirdly, empirical research also has a role to play in evaluating the decision-making process. It can rule out certain moral choices by pointing out the occurrence of certain unexpected consequences or effects. It can also be useful, however, as a sociology of bioethics in which the discipline of bioethics itself becomes an object of research. (shrink)

In this critical introduction to contemporary philosophical issues in the theory of truth Pascal Engel provides clear and authoritative exposition of recent and current ideas while providing original perspectives that advances discussion of the key issues. This book begins with a presentation of the classical conceptions of truth - the correspondence theory, the coherence theory and verificationist and pragmatist accounts - before examining so-called minimalist and deflationist conceptions that deny truth can be anything more than a thin concept holding (...) no metaphysical weight. The debates between those who favour substantive conceptions of the classical kind and those who advocate minimalist and deflationist conceptions are explored. Engel argues that, although the minimalist conception of truth is basically right, it does not follow that truth can be eliminated from our philosophical thinking as some upholders of radical deflationist views have claimed. Questions about truth and realism are examined and the author shows how the realism/anti-realism debate remains a genuine, meaningful issue for a theory of truth and has not been undermined by deflationist views. Even if a metaphysical substantive theory of truth has little chance to succeed, Engel concludes, truth can keep a central role within our thinking, as a norm or guiding value of our rational inquiries and practices, in the philosophy of knowledge and in ethics. This field study investigated the relationship between strategic human resource management, internal environmental concern, organizational citizenship behavior for the environment, and environmental performance. The originality of the present research was to link human resource management and environmental management in the Chinese context. Data consisted of 151 matched questionnaires from top management team members, chief executive officers, and frontline workers. The main results indicate that organizational citizenship behavior for the environment fully mediates the relationship between strategic human resource management and environmental (...) performance, and that internal environmental concern moderates the effect of strategic human resource management on organizational citizenship behavior for the environment. The purpose of this study was to examine the relationships between perceived co-worker support, commitment to colleagues, job satisfaction, intention to help others, and pro-environmental behavior with the emphasis on eco-helping, with a view to determining the extent to which peer relationships encourage employees to engage in pro-environmental behaviors at work. This paper is framed by adopting social exchange theory through the lens of ethics of care. Data from a sample of 449 employees showed that receiving support from peers triggers (...) an exchange process that encourages eco-helping among colleagues. The knowledge account of assertion (KAA) is the view that assertion is governed by the norm that the speaker should know what s/he asserts. It is not the purpose of this article to examine all the criticisms nor to try to give a full defence of KAA, but only to defend it against the charge of being normatively incorrect. It has been objected that assertion is governed by other norms than knowledge, or by no norm at all. It seems to (...) me, however, that a number of these criticisms are based on a number of misunderstandings of the notion of a norm and of the way it can regulated a given practice. Once we spell out in what sense knowledge can play a normative role in this context, the KAA appears much more plausible. (shrink)

This paper tries to say in what sense truth is a norm, a thesis that Donald Davidson, whose view are examined, denies. After skteching his conception of rationality, it is argued that truth is a norm in only the sense that we ought to believe what we believe is true, not that we all to believe everything which is true. This minimal norm of truth is isolated and defended.

A growing literature is taking an institutionalist and governance perspective on how algorithms shape society based on unprecedented capacities for managing social complexity. Algorithmic governance altogether emerges as a novel and distinctive kind of societal steering. It appears to transcend established categories and modes of governance—and thus seems to call for new ways of thinking about how social relations can be regulated and ordered. However, as this paper argues, despite its novel way of realizing outcomes of collective steering and coordination, (...) it can nevertheless be grasped with an old and fundamental figure in political philosophy: that of Thomas Hobbes’ Leviathan. Comparing algorithmic governance with this figure serves to highlight their similarities as socio-political arrangements, and specifically to clarify how algorithmic governance parallels the apolitical traits of the Leviathan—it eliminates the political as it requires compliance and forgoing contestation to best fulfill its role and to produce satisfying outcomes. Ownership is universal and ubiquitous in human societies, yet the psychology underpinning ownership intuitions is generally not described in a coherent and computationally tractable manner. Ownership intuitions are commonly assumed to derive from culturally transmitted social norms, or from a mentally represented implicit theory. While the social norms account is entirelyad hoc, the mental theory requires prior assumptions about possession and ownership that must be explained. Here I propose such an explanation, arguing that the intuitions result from the interaction of (...) two cognitive systems. One of these handles competitive interactions for the possession of resources observed in many species including humans. The other handles mutually beneficial cooperation between agents, as observed in communal sharing, collective action and trade. Together, these systems attend to specific cues in the environment, and produce definite intuitions such as “this is hers,” “that is not mine.” This computational model provides an explanation for ownership intuitions, not just in straightforward cases of property, but also in disputed ownership (squatters, indigenous rights), historical changes (abolition of slavery), as well as apparently marginal cases, such as the questions, whether people own their seats on the bus, or their places in a queue, and how people understand “cultural appropriation” and slavery. In contrast to some previous theories, the model is empirically testable and free ofad hocstipulations. (shrink)

Decisions in security contexts, including armed conflict, law enforcement, and disaster relief, often need to be taken under circumstances of limited information, stress, and time pressure. Since AI systems are capable of providing a certain amount of relief in such contexts, such systems will become increasingly important, be it as decision-support or decision-making systems. However, given that human life may be at stake in such situations, moral responsibility for such decisions should remain with humans. Hence the idea of “meaningful human (...) control” of intelligent systems. In this opinion paper, we outline generic configurations of control of AI and we present an alternative to human control of AI, namely the inverse idea of having AI control humans, and we discuss the normative consequences of this alternative. The last two decades have seen a massive increase in the scholarly interest in technology, and have provoked new lines of thought in philosophy, sociology and cultural studies. Gilbert Simondon (1924 - 1989) was one of Frances's most influential philosophers in this field, and an important influence on the work of Gilles Deleuze and Bernard Stiegler. His work is only now being translated into English. Chabot's introduction to Simondon's work was published in French in 2002 and is now available in (...) English for the first time. It is the most accessible guide to Simondon's important but often opaque work. Chabot provides an excellent introduction to Simondon, positioning him as a philosopher of technology, and he describes his theory of individuation including his crystalline ontology. Résumé Cette recherche porte sur le rôle joué par les différents éléments d’une image dans l’interprétation de cette image et dans les émotions qu’elle induit. A partir de l’approche structurale de la théorie des représentations sociales on suppose que certains des éléments d’une image seraient centraux tandis que d’autres seraient périphériques. Pour explorer cette piste on a retouché trois photographies originales afin de supprimer certains des éléments qu’elles montraient. Les photographies originales et les photographies retouchées ont été présentées à trois (...) groupes de participants qui devaient, pour chaque photographie, produire trois associations verbales puis évaluer le niveau d’activation des émotions ressenties. Les résultats montrent que certains des éléments d’une image en déterminent à la fois le sens et les émotions qu’elle induit, d’autres n’en déterminent que les émotions, d’autres enfin ne déterminent ni la signification, ni les émotions induites. Ces résultats suggèrent que dans le cadre de la théorie des représentations sociales, l’analyse des images en termes d’éléments centraux et périphériques pourrait être très utile pour mieux comprendre comment fonctionnent ces images en tant que systèmes sémiotiques. I argue that the normative dimension in mental content does not figure in the content as a direct feature of this content. But I do not take is as an extrinsic feature due to the properties of our ascriptions either. I suggest that the normativity has to do with the possibility of self attribution of mental states. The views of Robert Brandom are examined in this respect.

Religions “in the wild” are the varied set of religious activities that occurred before the emergence of organized religions with doctrines, or that persist at the margins of those organized traditions. These religious activities mostly focus on misfortune; on how to remedy specific cases of illness, accidents, failures; and on how to prevent them. I present a general model to account for the cross-cultural recurrence of these particular themes. The model is based on features of human psychology—namely, epistemic vigilance, the (...) set of systems whereby we evaluate the quality of information and of sources of information, and threat-detection psychology, the set of evolved systems geared at detecting potential danger in the environment. Given these two sets of systems, the dynamics of communication will favor particular types of messages about misfortune. This makes it possible to predict recurrent features of religious systems, such as the focus on nonphysical agents, the focus on particular cases rather than general aspects of misfortune, and the emergence of specialists. The model could illuminate not just why such representations are culturally successful, but also why people are motivated to formulate them in the first place. (shrink)

I defend a necessary condition of local autonomy inspired by Aristotle and Marx. One does something autonomously, I argue, only if one does it for its own sake and not for the sake of further ends alone. I show that this idea steers an attractive middle path between the subjectivism of Dworkin- and Frankfurt-style theories of autonomy on the one hand and the objectivism of Raz-style theories on the other. By doing so, it vindicates and explains two important pieces of (...) common sense of which those theories struggle to make sense. First, it explains how external sources of compulsion, such as coercion by other people and duress by unfavorable circumstances, can compromise the autonomy of an activity. Second, it explains this by articulating the sense in which to act autonomously is to do what one really or truly wants to do, and the correlative sense in which to do something unfreely is instead to be forced or necessitated to do it. At the same time, my proposal brings into view distinctive species of external unfreedom beyond the traditional paradigm cases of coercion and duress. Most importantly, it implies that toil—labor which is not valued intrinsically but is done purely on account of its instrumental necessity—is essentially unfree. (shrink)

This essay is concerned with two interrelated questions. First, a broad question: in what sense is Skepticism a philosophy− or in what sense is it “philosophy” (as we will see, these are not identical questions)? Second, a narrow one: how should we understand the process whereby ataraxia (freedom from disturbance) emerges out of epochē (suspension of judgment)? The first question arises because Skepticism is often portrayed as anti-philosophy. This depiction, I contend, surreptitiously turns a Skeptical method into a so-called Skeptical (...) doctrine which is then either condemned for being self-refuting or salvaged as a plausible (albeit odd) epistemological theory. Instead, philosophy, for the Skeptics, is a matter of practice. Skepticism is not so much a philosophy that has a worldview to proclaim as it is a philosophy that invites us to perform something. Ageing brings together biological, personal, and social horizons. Attempts to reduce it or to privilege one of these dimensions over the others fail to fully capture the phenomenon. The temporality of ageing presents an irreducible complexity. It is the inextricable intertwinement of three temporalities, three rhythms on different scales: biological time, personal-narrative time, and historical time. In all these dimensions something is of crucial concern: time and temporality. Yet, many philosophers who have thought about time (even those who take seriously (...) the lived experience of temporality) have paid little attention to ageing. Drawing from Heidegger, Scheler, and Schutz, this paper argues that ageing is an irreducible complex of different temporalities where one encounters the historicity of the world through a process of losing touch with it. This chapter analyzes stupidity as a problem for epistemology. Its proper home belongs to virtue epistemology, as a specific epistemic vice, which has to be studied along the lines of both reliabilist virtue epistemology and of responsibilist virtue epistemology. The author distinguishes between two kinds of stupidity: stupidity proper and foolishness. The former is a defect in the competence of an agent, as well as in the performance of judgment, and it is generally studied as a failure of rationality along (...) intellectualist lines. The second is a failure to evaluate properly the nature of the epistemic goal, and is a form of epistemic indifference, which involves an insensitivity to epistemic values and norms. This chapter analyzes their varieties, and suggest that the boundaries between stupidity and foolishness are often less clear than it is suggested by the author’s taxonomy. (shrink)

Résumé Considéré comme l’action individuelle par excellence, le dribble renvoie le plus souvent à l’exercice d’une maîtrise technique que seuls quelques protagonistes d’exceptions sont à même d’exécuter. Cette image purement descriptive, centrée sur le seul pratiquant, n’entretient qu’un lointain rapport avec la réalité de ce qui constitue la raison d’être profonde de cette action motrice. Le dribble, entendue comme un acte qui consiste à conduire un objet, – une balle, un palet –, en alternant des temps de contact et de (...) non contact, est avant tout à envisager dans sa dimension collective. Là est le point aveugle des analyses menées à son propos. Dans cette étude, on considérera le dribble comme un type de conduite motrice porteur d’intentions auxquelles sont attachées des significations de nature essentiellement sociale. Fondamentalement le dribble est relation, c’est-à-dire interaction. Il doit être envisagé sous l’angle de la sémiotricité, autrement dit des significations que les pratiquants lui accordent. Sa fonction est essentiellement d’annoncer les actions futures. À ce titre, il renvoie à une classe de comportements tactiques dont les significations relèvent d’une interprétation en situation sous la dépendance directe des règles du jeu sportif considéré. Loin d’être univoque, le dribble doit être envisagé comme un « signe » qui doit être décodé par les pratiquants en fonction de la grammaire du jeu considéré selon un double axe ; syntagmatique et sémantique. Ce travail à pour objectif de repérer les différentes significations possibles du « signe-dribble », considéré comme un praxème. (shrink)

Le maintien des relations parent-enfant en prison représente un véritable défi au regard des différentes formes d’empêchement – véritable mise en suspens de la parentalité – auxquels se trouvent confrontés les parents détenus et les enfants ainsi que leurs accompagnants. Membre d’une recherche inter-disciplinaire (droit et psychologie), menée en France dans trois établissements pénitentiaires en appui sur des questionnaires et la conduite de focus-groups, l’auteur met en évidence, au travers d’une approche clinique psychodynamique, la tension qui s’exerce entre les attentes (...) exprimées par les parents détenus à l’égard de leurs enfants et la disqualification dont leur lien est l’objet, en raison du vécu des conditions de détention et d’accueil des enfants ainsi que de l’accès à la prison des personnes qui, de l’extérieur, sont en mesure de soutenir les relations parent-enfant (conjoint ou ex-conjoint, famille...). This study aimed to investigate the student-athletes' capability to face the academic, sport, and social challenges during the coronavirus disease 2019 (COVID-19) lockdown and to disclose novel aspects of dual careers. A 32-item online survey encompassing demographic characteristics, sport and university engagement, support and dual-career benefits, physical activity, sitting time, and the time deemed necessary to recover the previous level of performance was developed. Four hundred sixty-seven student-athletes (males: 57%, females: 43%) from 11 countries, competing in 49 different sports (individual: (...) 63.4%, team: 36.6%) at regional (17.5%), national (43.3%), and international (39.2%) levels, and enrolled at high school (21.9%) and university (78.1%) levels completed the survey. During the lockdown, the respondents decreased the time dedicated to sport and academics, although they maintained an active lifestyle. Student-athletes from countries under severe contagion were more likely to train at home, dedicate to academics, and receive support from the coach but less likely receive support from their teachers. With respect to their team sport counterparts, athletes competing in individual sports trained more and were more likely to receive support from their coaches. International athletes showed the highest training time and support from their coaches and as student-athletes. High school students received more support from their coaches and teachers, whereas university students were more likely considering dual careers useful to cope with the COVID-19 pandemic. This study substantiates the relevant role of competitive sports participation in the maintenance of active lifestyles, with student-athletes considering home training and e-learning valuable resources during the lockdown. Furthermore, their sport and academic commitments helped student-athletes cope with the emergency of the COVID-19 pandemic. (shrink)

The diversity of interpretations of Aristotle’s treatment of chance and luck springs from an apparent contradiction between the claims that “chance events are for the sake of something” and that “chance events are not for the sake of their outcome.” Chance seems to entail the denial of an end. Yet Aristotle systematically refers it to what is for the sake of an end. This paper suggests that, in order to give an account of chance, a reference to “per accidens causes” (...) is not sufficient. Chance occurs as a parody of teleology; it is a“for-no-purpose” that looks like a purpose. The notion of “irony” is suggested as a way of accounting for a situation that keeps an ambiguity open. The fact that chance is thought of in relation to teleology does not mean that it is “reappropriated” by teleology. Rather,chance reveals a hiatus that betrays the limitation of a language concerned with substances to account for events. (shrink)

The master argument posits a metaphysical thesis: Diodorus does away with Aristotle’s dunamis understood as a power simultaneously oriented toward being and non-being and proclaims that possibilities that fail to actualize are simply nothing. My contention is that this claim is not a mere application of Diodorus’ contribution to modal logic. Rather, Diodorus creates an ontologico-temporal concept of possibility and impossibility. Diodorus envisions the future as the past that the future will become. Since what will have been can never be (...) the accomplishment of a possibility that did not obtain, and since the future is destined to become past, any futural possibility that doesn’t actualize is neither futural nor even possible. Zeki and co-workers recently proposed that perception can best be described as locally distributed, asynchronous processes that each create a kind of microconsciousness, which condense into an experienced percept. The present article is aimed at extending this theory to metacognitive feelings. We present evidence that perceptual fluency—the subjective feeling of ease during perceptual processing—is based on speed of processing at different stages of the perceptual process. Specifically, detection of briefly presented stimuli was influenced by figure-ground contrast, but not by symmetry (...) or the font of the stimuli. Conversely, discrimination of these stimuli was influenced by whether they were symmetric and by the font they were presented in , but not by figure-ground contrast. Both tasks however were related with the subjective experience of fluency . How do people detect mental dysfunction? What is the influence of cultural models of dysfunction on this detection process? The detection process as such is not usually researched as it falls between the domains of cross-cultural psychiatry and anthropological ethno-psychiatry . I provide a general model for this “missing link” between behavior and cultural models, grounded in empirical evidence for intuitive psychology. Normal adult minds entertain specific intuitive expectations about mental function and behavior, and by implication they infer that specific (...) kinds of behavior are the result of underlying dysfunction. This suggests that there is a “catalogue” of possible behaviors that trigger that intuition, hence a limited catalogue of possible symptoms that feed into culturally specific folk-understandings of mental disorder. It also suggests that some mental dysfunctions, as they do not clearly violate principles of intuitive psychology, are “invisible” to folk-understandings. This perspective allows us to understand the cultural stability and spread of particular views of madness. It also suggests why certain types of mental disorder are invisible to folk-understandings. This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in.
