Background The rapidly growing quantity of health data presents researchers with ample opportunity for innovation. At the same time, exploitation of the value of Big Data poses various ethical challenges that must be addressed in order to fulfil the requirements of responsible research and innovation (Gerke et al. 2020 ; Howe III and Elenberg 2020 ). Data sovereignty and its principles of self-determination and informed consent are central goals in this endeavor. However, their consistent implementation has enormous consequences for the (...) collection and processing of data in practice, especially given the complexity and growth of data in healthcare, which implies that artificial intelligence (AI) will increasingly be applied in the field due to its potential to unlock relevant, but previously hidden, information from the growing number of data (Jiang et al. 2017 ). Consequently, there is a need for ethically sound guidelines to help determine how data sovereignty and informed consent can be implemented in clinical research. Methods Using the method of a narrative literature review combined with a design thinking approach, this paper aims to contribute to the literature by answering the following research question: What are the practical requirements for the thorough implementation of data sovereignty and informed consent in healthcare? Results We show that privacy-preserving technologies, human-centered usability and interaction design, explainable and trustworthy AI, user acceptance and trust, patient involvement, and effective legislation are key requirements for data sovereignty and self-determination in clinical research. Zusammenfassung Hintergrund Die exponentiell wachsende Verfügbarkeit von Gesundheitsdaten bietet Forschenden ungeahnte Potenziale für Innovationen. Gleichzeitig gehen mit der Verwertung von Big Data auch große ethische Herausforderungen einher, die es zu bewältigen gilt, um den Anforderungen an verantwortungsvolle Forschung und Innovation gerecht zu werden (Gerke et al. 2020; Howe III und Elenberg 2020). Datensouveränität und die damit verbundenen Grundsätze der Selbstbestimmung und der informierten Zustimmung sind dabei zentrale Ziele. Allerdings hat deren konsistente Umsetzung enorme Konsequenzen für die Datenerhebung und -verarbeitung in (...) der Praxis. Dies trifft insbesondere angesichts einer Zunahme an Quantität und Komplexität von Daten im Gesundheitswesen zu. Denn aufgrund des Potenzials, relevante aber bisher verborgene Informationen aus der Datenmenge zu erschließen, ist eine zunehmende Anwendung von künstlicher Intelligenz (KI) in diesem Bereich zu erwarten (Jiang et al. 2017). Folglich besteht ein Bedarf an ethisch fundierten Handlungsanweisungen, die helfen, Datensouveränität und informierte Zustimmung in der klinischen Forschung umzusetzen. Material und Methoden Durch Anwendung einer narrativen Literaturrecherche in Kombination mit einem Design-Thinking-Ansatz soll das vorliegende Papier einen Beitrag zur Literatur leisten, indem die folgende Forschungsfrage beantwortet wird: Welche praktischen Anforderungen gibt es für eine konsequente Umsetzung von Datensouveränität und informierter Einwilligung im Gesundheitswesen? Ergebnisse Es wird gezeigt, dass Privatsphäre wahrende Technologien, menschenzentriert entwickelte Nutzungs- und Interaktionslösungen, erklärbare und vertrauenswürdige KI, Nutzerakzeptanz und -vertrauen, Patientenbeteiligung und eine wirksame Gesetzgebung zentrale Voraussetzungen für Datensouveränität und Selbstbestimmung in der klinischen Forschung sind. Our scientific theories, like our cognitive structures in general, consist of propositions linked by evidential, explanatory, probabilistic, and logical connections. Those theoretical webs ‘impinge on the world at their edges,’ subject to a continuing barrage of incoming evidence. Our credences in the various elements of those structures change in response to that continuing barrage of evidence, as do the perceived connections between them. Here we model scientific theories as Bayesian nets, with credences at nodes and conditional links between them modelled (...) as conditional probabilities. We update those networks, in terms of both credences at nodes and conditional probabilities at links, through a temporal barrage of random incoming evidence. Robust patterns of punctuated equilibrium, suggestive of ‘normal science’ alternating with ‘paradigm shifts,’ emerge prominently in that change dynamics. The suggestion is that at least some of the phenomena at the core of the Kuhnian tradition are predictable in the typical dynamics of scientific theory change captured as Bayesian nets under even a random evidence barrage. The ability to recognise the actions of conspecifics from displays of biological motion is an essential perceptual capacity. Physiological and psychological evidence suggest that the visual processing of biological motion involves close interaction between the dorsal and ventral systems. Norman's strong emphasis on the functional differences between these systems may impede understanding of their interactions.

We model scientific theories as Bayesian networks. Nodes carry credences and function as abstract representations of propositions within the structure. Directed links carry conditional probabilities and represent connections between those propositions. Updating is Bayesian across the network as a whole. The impact of evidence at one point within a scientific theory can have a very different impact on the network than does evidence of the same strength at a different point. A Bayesian model allows us to envisage and analyze the (...) differential impact of evidence and credence change at different points within a single network and across different theoretical structures. The influence of stakeholders, organisational commitment, personal values, goals of the organisation and socio-demographic characteristics of individuals on the ethical dimension of behavioural intentions of employees in various organisations are investigated. The research results show that employees working for the public sector or in educational institutions take more ethical aspects into account than employees working in the "private" sector. The influence of stakeholders and organisational commitment do not significantly affect the ethical behaviour of employees, and only some personal values and (...) goals of the organisation have a significant influence on ethical behaviour. The most significant explanatory factor of ethical decision making seems to be what may be called "stage in the career of the employee": "ethical" employees can be described as young, with a relatively low income, limited work experience and a low level of responsibility in the company. The paper reports the findings of a study of CPAs designed to determine whether they tend to find factors related to their professional environment (especially the guides to professional conduct of the American Institute of Certified Public Accountants) to be more helpful than factors related to their business environment when faced with ethics problems. Like internal auditors surveyed earlier, the CPAs tend to view a number of factors in their business environment to be even more helpful than factors related to (...) their professional environment in dealing with ethical dilemmas. Fibroblast growth factor receptors (FGFRs) have been implicated in many developmental and regenerative events, including axial organisation, mesodermal patterning, keratinocyte organisation and brain development. The consensus view that this reflects a role for one or other of the nine known members of the fibroblast growth factor family in these processes has recently been challenged by the suggestion that FGFRs might be directly activated by a much wider range of ligands, including heparan sulphate proteoglycans and neural cell adhesion molecules. In addition, (...) two novel soluble ligands for FGFRs have been identified using yeast two‐hybrid technology. Overall, the new findings suggest that in terms of ligand binding the FGFRs might be an even more promiscuous family of receptor tyrosine kinases than was already appreciated. (shrink)

Probabilistic models of sentence comprehension are increasingly relevant to questions concerning human language processing. However, such models are often limited to syntactic factors. This restriction is unrealistic in light of experimental results suggesting interactions between syntax and other forms of linguistic information in human sentence processing. To address this limitation, this article introduces two sentence processing models that augment a syntactic component with information about discourse co-reference. The novel combination of probabilistic syntactic components with co-reference classifiers permits them to more (...) closely mimic human behavior than existing models. The first model uses a deep model of linguistics, based in part on probabilistic logic, allowing it to make qualitative predictions on experimental data; the second model uses shallow processing to make quantitative predictions on a broad-coverage reading-time corpus. This paper contains a short outline of the rationale behind a workshop aimed at seeking connections between corporate social responsibility and corporate political activity. Two ‘provocateurs’ gave their view on these connections. After this kick-off two groups of ~10 persons each engaged in lively discussions on these connections, identifying a range of issues for further research and an interest in keeping this issue on the agenda.

Sickle cell haemoglobin polymerization reduces erythrocyte deformability, causing deleterous vaso-occlusions. The double-nucleation model states that polymers grow from HbS aggregates, the nuclei, in solution , onto existing polymers . When linearized at initial HbS concentration, this model predicts early polymerization and its characteristic delay-time :591–610, 611–631, 1985). Addressing its relevance for describing complete polymerization, we constructed the full, non-linearized model . Here, we compare the simulated outputs to experimental progress curves . Within 10% from start, average root mean square deviation (...) between simulated and experimental curves is 0.04 ± 0.01 . Conversely, for complete progress curves, averaged rms is 0.48 ± 0.04. This figure is improved to 0.13 ± 0.01 by adjusting heterogeneous pathway parameters : the nucleus stability , and the fraction of polymer surface available for nucleation , from 5e−7, to 13 . Similar results are obtained at 37°C. We conclude that the physico-chemical description of heterogeneous nucleation warrants refinements in order to capture the whole HbS polymerization process. An historical overview of the United Nations sustainable development initiative reflects a convergence of political and ethical concerns, and a need to incorporate business and the ethics of business into an inclusive perspective. Underlying all of the resolutions and recommendations ensuing from that initiative is the age-old question of “the one and the many,” with which theology and philosophy have grappled for centuries, and sociology and politics in more recent times. Inherent to sustainable development is a need to overcome that (...) question, especially with respect to the power of the wealthier nations. Good old American Pragmatism offers a solution which, at once, respects individual and communal sovereignty while positing a dynamic interaction between the two. That interaction offers an optimistic approach to global business and to global business ethics. (shrink)

Extinct megafaunal mammals in the Americas are often linked to seed-dispersal mutualisms with large-fruiting tree species, but large-fruiting species in Europe and Asia have received far less attention. Several species of arboreal Maloideae (apples and pears) and Prunoideae (plums and peaches) evolved large fruits starting around nine million years ago, primarily in Eurasia. As evolutionary adaptations for seed dispersal by animals, the size, high sugar content, and bright colorful visual displays of ripeness suggest that mutualism with megafaunal mammals facilitated the (...) evolutionary change. There has been little discussion as to which animals were likely candidate(s) on the late Miocene landscape of Eurasia. We argue that several possible dispersers could have consumed the large fruits, with endozoochoric dispersal usually relying on guilds of species. During the Pleistocene and Holocene, the dispersal guild likely included ursids, equids, and elephantids. During the late Miocene, large primates were likely also among the members of this guild, and the potential of a long-held mutualism between the ape and apple clades merits further discussion. If primates were a driving factor in the evolution of this large-fruit seed-dispersal system, it would represent an example of seed-dispersal-based mutualism with hominids millions of years prior to crop domestication or the development of cultural practices, such as farming. In this discussion, we have agreed that an "ontology repository is a facility where (...) ontologies and related information artifacts can be stored, retrieved and managed." -/- We believe in the promise of semantic technologies based on logic, databases and the Semantic Web, a Web of exposed data and of interpretations of that data (i.e., of semantics), using common standards. Such technologies enable distinguishable, computable, reusable, and sharable meaning of Web and other artifacts, including data, documents, and services. This is a long critical discussion of Frank Wilderson's Afropessimism, focusing primarily on Wilderson's claim that Blackness is equivalent to Slaveness. The article draws out some strengths of the book, but argues that the book's central arguments often rest on shaky methodological, metaphysical, epistemic, and political grounds. Along the way, we consider some complications endemic to the project of evaluating a text so clearly geared towards Black audiences from the perspective of a non-Black reader.

ScanlanWriting in his own voice, in letters, notebooks, and diaries, Fyodor Dostoevsky frequently attacked the philosophy of the Russian “nihilists,” as he typically called them—Nikolay Chernyshevsky, Dmitry Pisarev, and other representatives of the radical Russian intelligentsia in the third quarter of the nineteenth century. But because Dostoevsky also used fiction to argue against them, if we wish to (...) discern the full contours of his opposition, we must turn to his stories and novels; and there we face the problem of determining to what extent, if any, the statements of his narrators and characters express his own views.This problem is particularly challenging in regard to the radicals’ “Rational Egoism,” to use the label by which the Russian variant of the theory of enlightened egoism came to be known. 1 Dostoevsky’s most sustained and spirited attack on that aspect of “nihilist” philosophy is found in Part One of Notes from Underground (1864), but it is voiced by one of the darkest, least sympathetic of all his characters—the nameless narrator and protagonist known as the Underground Man. Was this repellent creature speaking for Dostoevsky? The Underground Man, moreover, can easily be viewed as a sheer irrationalist whose rejection of Rational Egoism is a tortured emotional outburst with no logical credentials. Robert L. Jackson, in his groundbreaking study of 1958, describes the Underground Man’s thinking at one point as follows: “It is impossible to argue [End Page 549] with the rationalists: reason is on their side. All that remains is irrationally to negate reason.” 2 If those words were to be taken not simply as a moment in Jackson’s rich analysis but as a comprehensive description of the Underground Man’s attitude, it would be senseless to expect philosophically nuanced arguments from him. And we would have no grounds for thinking that Dostoevsky’s own treatment of Rational Egoism went beyond emotional rejection.Critics from Vasily Rozanov to Joseph Frank have debated the Underground Man’s stance toward Rational Egoism and its relation to Dostoevsky’s, with no sign yet of a definitive resolution. Frank’s recent treatment, presented in the third volume of his monumental literary biography of Dostoevsky, offers a helpful history of the dispute as well as his own finely elaborated interpretation of the Underground Man as an irrational opponent of Rational Egoism. 3 Frank reads Notes from Underground as satire, and he contends that the Underground Man is caught in an agonizing self-contradiction: intellectually, he accepts the basic premises of the Rational Egoists’ outlook, such as the denial of free will; but he finds that, “despite the convictions of his reason,” he cannot live with the amoral and dehumanizing implications of those premises, which strip human beings of moral responsibility. 4 From a rational point of view, of course, rejection of the implications should force the Underground Man to reject the premises as well (by the hoary logical law of modus tollendo tolens), and indeed he does at times passionately condemn them. But according to Frank, these condemnations simply show the depth of his predicament: his “intellectual acceptance” of Chernyshevsky’s determinism is conjoined with “simultaneous rejection of it with the entire intuitive-emotional level of personality identified with moral conscience,” causing him to respond irrationally in a multitude of instances. 5 Frank’s Underground Man, then, is an intellectual disciple but an emotional critic of Rational Egoism; and he is triply an irrationalist: his thinking is mired in self-contradiction, he acts irrationally as a result, and his opposition to Rational Egoism has not a rational but an “intuitive-emotional” basis.But where does this leave Dostoevsky? Must we conclude that he, too, is somehow suspended between acceptance and rejection of Rational Egoism and for that reason has created in Notes from Underground a Bakhtinian equilibrium in which neither position is clearly privileged? For Frank, certainly not. This book presents the origins of Central and Eastern European phenomenology. It features chapters that explore the movement's development, its most important thinkers, and its theoretical and historical context. This collection examines such topics as the realism-idealism controversy, the status of descriptive psychology, the question of the phenomenological method, and the problem of the world. The chapters span the first decades of the development of phenomenology in Czechoslovakia, Poland, Romania, Russia, and Yugoslavia before World War II. The contributors track the (...) Brentanian heritage of the development. They show how this tradition inspired influential thinkers like Celms, Špet, Ingarden, Frank, Twardowski, Patočka, and others. The book also puts forward original investigations. Moreover it elaborates new accounts of the foundations of phenomenology. While the volume begins with the Brentanian heritage, it situates phenomenology in a dialogue with other important schools of thought of that time, including the Prague School and Lvov-Warsaw School of Logic. This collection highlights thinkers whose writings have had only a limited reception outside their home countries due to political and historical circumstances. It will help readers gain a better understanding of how the phenomenological movement developed beyond its start in Germany. Readers will also come to see how the phenomenological method resonated in different countries and led to new philosophical developments in ontology, epistemology, psychology, philosophy of culture, and philosophy of religion. Recent advances in artificial intelligence offer many beneficial prospects. However, concerns have been raised about the opacity of decisions made by these systems, some of which have turned out to be biased in various ways. This article makes a contribution to a growing body of literature on how to make systems for automated decision-making more transparent, explainable, and fair by drawing attention to and further elaborating a distinction first made by Nozick between first-level bias in the application of standards and (...) second-level bias in the choice of standards, as well as a second distinction between discrimination and arbitrariness. Applying the typology developed, a number of illuminating observations are made. First, it is observed that some reported bias in automated decision-making is first-level arbitrariness, which can be alleviated by explainability techniques. However, such techniques have only a limited potential to alleviate first-level discrimination. Second, it is argued that second-level arbitrariness is probably quite common in automated decision-making. In contrast to first-level arbitrariness, however, second-level arbitrariness is not straightforward to detect automatically. Third, the prospects for alleviating arbitrariness are discussed. It is argued that detecting and alleviating second-level arbitrariness is a profound problem because there are many contrasting and sometimes conflicting standards from which to choose, and even when we make intentional efforts to choose standards for good reasons, some second-level arbitrariness remains. From ancient and especially from medieval times, this recognition was traditionally accorded him first and foremost, if not exclusively, on the basis of a passage from the Fourth (...) Eclogue celebrating the birth of a new progeny ("progenies nova") from heaven and the consequent renewal of the world.1 This passage lent itself to Christian messianic interpretations, thanks especially to its reference to a Virgin ushering in a return of the golden age of peace on earth ("iam redit et uirgo, redeunt Saturnia regna"). Historical research reveals Virgil to have, in all probability, intended in this text to hyperbolically hail the birth of a son to a particular Roman consul.2 Yet, even apart from historical intentions and inevitable doubts about them, to pin Virgil's claim to being a prophet to this text is to miss the momentous discovery that makes him truly a prophet in a way unprecedented in pagan antiquity.Modern treatments of Virgil as prophet have not remained beholden to this Christian medieval framework and have opened suggestive avenues for more accurate elucidation of Virgilian prophecy, particularly in terms of its own historical context and the role of the Latin vates in Imperial Rome.3 What I wish to propose, however, is not a more accurately historicized understanding of prophecy in Virgil, but rather a philosophical interpretation of the conception of history as prophetic that is realized in the text of the Aeneid. This is actually analogous to the medieval Christian misprision of Virgil in that it focusses on Virgil's potential significance in a new and different historical context, our own. The justification for this approach lies in the fact that historical research into prophecy during the Augustan Empire cannot exhaustively [End Page 73] explain the significance of Virgil's text in its astonishing creation of an original conception of history as prophetic, nor in its potential to illuminate the nature of prophecy as it may concern us today. Study of Virgil can help make the concept of prophecy vital to reflection on history and the structure of time in our own post-Heideggerian era.The question of whether Virgil foresaw the birth of Christ concerns prophecy only in the relatively banal sense of being able to foretell the future. In this, Virgil would be no different from myriad seers and divines and sorcerers with which the ancient world was rife. But the originality of Virgil, his particular claim to being an authentic prophet rather than simply, like many other major Roman authors, to have incorporated prophetic topoi into his works rests on his surpassing prophecy in precisely this sense. It is Virgil's single-handed invention, as if out of nowhere, of a genuinely prophetic mode of understanding history that is the seeming miracle on which his justly deserved fame as a prophetic poet has every right to rest.Whereas the certainly rather forced Christian interpretation of the Fourth Eclogue concerns "prophecy" only in a surface sense of factually foretelling the future, the deep meaning of prophecy as it develops in Virgil and Dante and the whole lineage of prophetic poets they foster down through Tasso, Spenser, Milton, and Blake, concerns rather the interpretation of history from its endpoint and seen as a whole, so that every moment in that history receives new meaning in light of a synoptic vision. In the biblical prophetic tradition, this perspective extends even beyond history and time altogether, and this marks a crucial difference from Virgil, whose end-vision is envisaged primarily as intrahistorical rather than as eschatological or as beyond the end (eschaton) of history. Still, in Virgil, just as in the Bible, the prophetic vantage point transcends history in order to understand it as a whole. Modern society makes extensive use of automated algorithmic decisions, fueled by advances in artificial intelligence. However, since these systems are not perfect, questions about fairness are increasingly investigated in the literature. In particular, many authors take a Rawlsian approach to algorithmic fairness. This article aims to identify some complications with this approach: Under which circumstances can Rawls’s original position reasonably be applied to algorithmic fairness decisions? First, it is argued that there are important differences between Rawls’s original position and a (...) parallel algorithmic fairness original position with respect to risk attitudes. Second, it is argued that the application of Rawls’s original position to algorithmic fairness faces a boundary problem in defining relevant stakeholders. Third, it is observed that the definition of the least advantaged, necessary for applying the difference principle, requires some attention in the context of algorithmic fairness. Finally, it is argued that appropriate deliberation in algorithmic fairness contexts often require more knowledge about probabilities than the Rawlsian original position allows. Provided that these complications are duly considered, the thought-experiment of the Rawlsian original position can be useful in algorithmic fairness decisions. (shrink)

Although declarations of the death of God seem to be provocations announcing the end of the era of theology, this announcement is actually central to the Christian revelation in its most classic forms, as well as to its reworkings in contemporary religious thought. Indeed provocative new possibilities for thinking theologically open up precisely in the wake of the death of God. Already Hegel envisaged a revolutionary new realization of divinity emerging in and with the secular world through its establishment of (...) a total order of immanence. However, in postmodern times this comprehensive order aspired to by modern secularism implodes or cracks open towards the wholly Other. A hitherto repressed demand for the absolute difference of the religious, or for “transcendence”, returns with a vengeance. This difference is what could not be stated in terms of the Hegelian System, for reasons that poststructuralist writers particularly have insisted on: all representations of God are indeed dead. Yet this does not mean that they cannot still be powerful, but only that they cannot assign God any stable identity. Nietzsche’s sense of foreboding concerning the death of God is coupled with his intimations of the demise of representation and “grammar” as epistemologically bankrupt, but also with his vision of a positive potential for creating value in the wake of this collapse of all linguistically articulated culture. He points the way towards the emergence of a post-secular religious thinking of what exceeds thought and representation. (shrink)

Examples of unsayability of the most disparate sorts are cited from literature (Shakespeare, Melville, James, Aeschylus, and others) in order to suggest the uncircumscribable diversity of motives for unsayability. The question is whether they all have anything in common. When something cannot be said because of politeness or obscenity or deceit or strategy, does this have anything to do with the metaphysical motives for unsayability? These things are not per se unsayable but only conditionally so, under certain circumstances. The problem (...) is that any way of distinguishing accidental from essential unsayability is itself circumstantial. Any essential unsayability must necessarily remain, precisely, unsayable. Therefore any determinate distinction between essential and contingent unsayability itself proves to be inarticulable.
