It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. It is widely known that the main figures we target worked in different areas, which is a first piece of evidence for the plausibility of our main thesis. (shrink)

Sostengo que una concepción evidencial de la seguridad (...) la hace dependiente de una condición de habilidad. Fortalezco la defensa de la epistemología anti-suerte minando dicha concepción. The following paper proposes that Sallust offers a conceptualization of civil conflict more in line with the Greek paradigm of stasis than with its Roman counterpart bellum ciuile. In doing so, it argues for the actual coexistence of these two differentiated conceptual strands in the political thought of the Late Republic. To this end, Sallust's corpus is analysed to identify the main threads that articulate civil strife in its multifarious manifestations: how it arises and who its protagonists are or, conversely, (...) how it is kept in check, how it is connected to the human passions that drive ideology, and the violence that stems from the clash between political and familial spheres of influence. The article shows how the pathos of familial drama is what characterizes civil conflict for Sallust, rather than the struggle for legitimacy found in Cicero's narrative. (shrink)

The following paper offers a study on how contestation over the meaning of language forged the political ideology present in the second of the Epistulae ad Caesarem. ‘Ideology’ being a notoriously malleable concept, Michael Freeden’s theoretical approach is used to focus what it means, how it is manifested in the sources, and how it can be located and analysed. The political thought of the Late Republic is studied by examining the vocabulary contained in one of the disputed letters that Sallust (...) addressed to Julius Caesar. Taking libertas as a case study of an ‘essentially contested concept’, the relation between language, meaning and ideology is dissected, outlining the morphological configuration that underlies the second Epistula. It is argued that the resulting array of political arguments is one iteration of what has been called popularis ideology. (shrink)

Pritchard maintains that the ability and the safety conditions impose independent demands on knowledge, i.e., that satisfying only one of them is not sufficient to acquire knowledge. I argue that there are no good reasons to suppose that the safety condition is not sufficient. I claim that TEMP, the key case proposed by Pritchard to show that there can be safety without ability, fails because therelevant cognitive process constitutes a legitimate, although anomalous, realization of a cognitive ability. In recent years, different proposals articulate specific rights for the regulation of neurotechnology, also known as "neurorights". A central concern regarding neurotechnological applications is that of mental privacy. This is the idea that we should have control over access to our neural data and the information about our mental processes and states that can be obtained by analyzing them. After proposing a detailed conceptualization of mental privacy, I will argue that the protection of this right is relevant because it is (...) at the basis of two fundamental ethical and legal dimensions of persons, identity and autonomy. I claim that mental privacy is presupposed by the relational conception of identity, and that this connection allows us to identify some limitations of current data privacy regulations. I then argue that relational identity is presupposed by the notion of autonomy, and this connection highlights relational dimensions of this concept that are not adequately articulated in current relational theories of autonomous action. This implies that the protection of mental privacy is also necessary for the protection if this second ethical and legal dimension of persons. (shrink)

Barsalou has recently argued against the strategy of identifying amodal neural representations by using their cross-modal responses (i.e., their responses to stimuli from different modalities). I agree that there are indeed modal structures that satisfy this “cross-modal response” criterion (CM), such as distributed and conjunctive modal representations. However, I argue that we can distinguish between modal and amodal structures by looking into differences in their cross-modal responses. A component of a distributed cell assembly can be considered unimodal because its responses (...) to stimuli from a given modality are stable, whereas its responses to stimuli from any other modality are not (i.e., these are lost within a short time, plausibly as a result of cell assembly dynamics). In turn, conjunctive modal representations, such as superior colliculus cells in charge of sensory integration, are multimodal because they have a stable response to stimuli from different modalities. Finally, some prefrontal cells constitute amodal representations because they exhibit what has been called ‘adaptive coding’. This implies that their responses to stimuli from any given modality can be lost when the context and task conditions are modified. We cannot assign them a modality because they have no stable relation with any input type. (shrink)

Mudanza (2010) es el primer libro de Verónica Gerber (1981), un libro donde la autora narra la migración que cinco artistas realizaron desde la literatura al arte. En este libro podemos encontrar una suerte de programa de los modos en que la autora ha pensado los traslados entre escritura y visualidad a lo largo de todo su trabajo. En Mudanza, los textos abren una zona de intervalo, de indeterminación, una suerte de tierra de nadie en el corazón de la palabra (...) y de la imagen, como si los escritores devenidos artistas sacrificaran los resultados de esa mudanza para poder explorar todo lo que acontece en ese traslado. Con esa misma ambigüedad escribe Gerber, componiendo textos a medio camino entre la literatura, el ensayo, la autobiografía, la escritura visual. Este artículo indaga en la pregunta por aquello que acontece cuando las imágenes y las palabras salen de sí mismas, perfilando lo que podríamos llamar una escritura figural que hace del intervalo el lugar de una potencia que trabaja en contra del estereotipo y el sentido unívoco. El presente artículo tiene como objetivo mostrar, a través de los textos confucianos y de sus intérpretes, cuál ha sido la posición de la mujer en la filosofía china clásica. Se analizará el papel que en las Analectas de Confucio, en los textos rituales, en el “Clásico de Poesía” y en Mencio juega la mujer, así como las interpretaciones que sobre estos pasajes, en ocasiones demasiado escuetos para posicionarse claramente sobre ellos, han realizado los comentaristas, desde la Antigüedad hasta finales (...) de la Época Imperial. Un examen atento mostrará que el confucianismo, a pesar de no preocuparse excesivamente de la cuestión, supo desafiar la “concience collective” y resaltar el papel de la mujer en la historia y en la sociedad. Finalmente, a través de una breve comparación con lo que la filosofía clásica occidental tiene que decir sobre la cuestión del género, se concluirá con unas observaciones sobre el papel del confucianismo en las sociedades modernas asiáticas y su relevancia para la formación de un discurso feminista autóctono. From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 Lienü Zhuan 列女傳 and the (...) philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy. The first and second parts of the paper will deal with the problem of assimilation and the genesis of a kind of cultural hibridity in the context of the German Jewry in the Modern Age. I will try to understand the figures of Karl Marx and Franz Rosenzweig as complementary visions of Jewish identity, the latter from within, and the former from without it. The third and the fourth parts will tackle the question of how that identity may be fully (...) realized in a socio-institutional sense, not necessarily restricted to a narrow political conception of the State. My conclusion will be that both Marx and Rosenzweig affirmed human freedom as an essentialy social phenomenon enacted through redemption, which must take always in account the problem of alterity. The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. The subject of this article is Leibnizian interpretation of the principle of reason. Although the German philosopher called it principium grande of his philosophy, we do not find its systematic exposition in Leibniz’s works. The main aim of my paper is to present a short exposition of the principle. The article consists of three parts: in the first I present systematic exposition of the principle of reason with particular emphasis on explication of terms “principle” and “reason,” in the second, I (...) show the origins of the principle, finally, in the third part, I discuss in detail three forms of it: the principle of sufficient reason, the principle of determining reason and the principle of rendering reason. I accept two main theses: firstly, a proper interpretation of this principle requires taking into account the whole context of Leibnizian philosophy, i.e. one cannot limit oneself (as it is usually happens among researchers) to only one discipline, e.g. logic. Secondly, the ultimate methodological and heuristical foundation of the principle of reason is Leibnizian metaphysics, especially natural theology. (shrink)

Der Abschnitt, mit dem ich mich im folgenden auseinandersetzten möchte, ist einer der letzen Paragraphen dieses Buches; und sein Zweck ist zu bedenken, in welchem Masse die Verwendung der Gewalt ein Mittel der ethischen Befreiung (in ihrer Praxis) sein könnte. Ich denke (und ich werde zeigen), dass dieser Abschnitt sehr repräsentativ für die wahre Deutung seiner Philosophie (...) ist. (shrink)

Se examina cómo, para Alberto Magno, la materia del hilemorfismo como pura potencia no permite explicar el cambio sustancial, por lo cual redefine los principios metafísicos del aristotelismo. Considera necesario que la forma sustancial pre-exista como forma incoada en la materia prima, para que el cambio sea continuo y teleológico. Estas formas incoadas, llamadas formae materiae o formae partis se comportan como habitudo y virtus formativa, y actualizan únicamente la materia, no la totalidad del compuesto.
