Violent video games (VVGs) are a source of serious and continuing controversy. They are not unique in this respect, though. Other entertainment products have been criticized on moral grounds, from pornography to heavy metal, horror films, and Harry Potter books. Some of these controversies have fizzled out over time and have come to be viewed as cases of moral panic. Others, including moral objections to VVGs, have persisted. The aim of this paper is to determine which, if any, of the (...) concerns raised about VVGs are legitimate. We argue that common moral objections to VVGs are unsuccessful, but that a plausible critique can be developed that captures the insights of these objections while avoiding their pitfalls. Our view suggests that the moral badness of a game depends on how well its internal logic expresses or encourages the players’ objectionable attitudes. This allows us to recognize that some games are morally worse than others—and that it can be morally wrong to design and play some VVGs—but that the moral badness of these games is not necessarily dependent on how violent they are. Stuttering is one of the most well-known speech disorders, but the underlying neurological mechanisms are debated. In addition to genetic factors there are also major non-genetic contributions. It is here proposed that infection with group A beta-hemolytic streptococcus (GAS) was a major underlying cause of stuttering until the mid 1900s, when penicillin was introduced for the treatment of streptococcal infections about 1946. The main mechanism proposed is an autoimmune reaction from tonsillitis, targeting specific molecules, for example within the basal ganglia. (...) It is here also proposed that GAS infections may have continued to cause stuttering to some extent, to the present date, though more rarely. If so, early diagnosis of such cases would be of importance. Childhood cases with sudden onset of stuttering after throat infection may be particularly important to assess for possible GAS infection. The support for this hypothesis primarily comes from three lines of argument. First, medical record data from the 1930s strongly indicates that there was one type of medical event in particular that preceded the onset of childhood stuttering with unexpected frequency: diseases related to GAS throat infections. In particular, this included tonsillitis and scarlet fever, but also rheumatic fever. Rheumatic fever is a childhood autoimmune sequela of GAS infection, which was a relatively widespread medical problem until the early 1960s. Secondly, available reports of changes of the childhood prevalence of stuttering indicates striking parallels between stuttering and the incidence of rheumatic fever, with (1) decline from the early 1900s, (2) marked decline from the introduction of penicillin about 1946, and (3) reaching a more stable level in the 1960s. The correlations between the data for stuttering and for rheumatic fever after introduction of penicillin are very high, at about 0.95. Thirdly, there are established biological mechanisms linking GAS tonsillitis to immunological effects on the brain. In addition, a small number of more recent case reports have provided further support for the hypothesis linking stuttering to GAS infection. Overall, it is proposed that the available data provides strong evidence for the hypothesis that GAS infection was a major cause of stuttering until the mid 1900s. (shrink)

This thesis explores whether the three standard value relations, “better than”, “worse than” and “equally as good”, exhaust the possibilities in which things can relate with respect to their value. Or more precisely, whether there are examples in which one of these relations is not instantiated. There are cases in which it is not obvious that one of these relations does obtain; these are referred to as “hard cases of comparison”. These hard cases of comparison become interesting, since if it (...) not the case that the standard three value relations obtains in these cases then the three standard relations do not exhaust the possibility of instantiated value relations. It is argued that for some of the hard cases of comparison, the standard relations determinately obtain. For some it is indeterminate, due to vagueness, which of the three relations obtains, but it is determinate that one of them obtains. Thereafter it is argued that the influential Collapsing Argument fails in ruling out other accounts of the hard cases of comparison. Since one cannot depend on the Collapsing Argument in order to conclude that all items are related by the standard three relations, the investigation continues. It is argued that none of the hard cases of comparison are cases of incomparability. Furthermore, none of them are cases of a fourth basic positive value relation such as “parity”. Consequently, for all the hard cases of comparison one of the standard value relations holds, although sometimes we do not know which one and sometimes it is indeterminate which one holds. This means that there is no reason to assume that one of the standard three value relations does not hold between items we are comparing. This is a review of contemporary philosophical discussions of population policies. The focus is on normative justification, and the main question is whether population policies can be ethically justified. Although few analytical philosophers have directly addressed this question – it has been discussed more in other academic fields – many arguments and considerations can be placed in the analytical philosophical discourse. This article offers a comprehensive review and analysis of ethically relevant aspects of population policies evaluated on the basis of (...) the main ethical theories. This analysis is preceded by a brief historical contextualisation of when and how population policies became ethically contentious and how this relates to philosophical debates in environmental ethics, population ethics and political philosophy. The article also includes a conceptual analysis of population policies in which the empirical intricacies around individual fertility decisions are sorted out and the different ways in which they can be affected are categorised in a taxonomy which highlight the most relevant ethical aspects of population policies. The ethical analysis shows that while population policies can be justified on the basis of most ethical theories, it all depends on what prior assumptions are made about what is at stake. (shrink)

In 1997 John Broome presented the Collapsing Argument that was meant to establish that non-conventional comparative relations cannot exist. Broome's argument has faced a lot of scrutiny and a certain type of counterexample has been used to undermine it. Most of the counterexamples focus on the Collapsing Principle which plays a central role in Broome's argument. In this article we will take a closer look at the most common type of counterexample and propose how to adjust the Collapsing Principle in (...) order to avoid objections based on these counterexamples. We argue that a weaker version of the Collapsing Principle is not susceptible to the classical counterexamples. Furthermore, after an explorative discussion about the intuitions behind the original principle, we show that this weaker formulation is at least as intuitive as the principle suggested by Broome. Recently a lot has been written on the topic of value incomparability. While there is disagreement on how we are to understand incomparability, most seem to accept Ruth Chang's claim that all comparisons must proceed in some specific respect. Call this the Requirement for Specification. Interestingly, even though most seem to accept this requirement, next to nothing has been written on it. In this paper I focus on the requirement and discuss two different but related topics. First, an important observation (...) is made: as it turns out, the requirement plays an important explanatory role for the thesis that incomparability is to be understood in terms of vagueness. Second, I consider what is entailed by the Requirement for Specification. There is a general worry that the requirement entails that there is no such thing as goodness simpliciter. The line of thought is that if we always must specify in which way something is e.g., better than something else, then perhaps things cannot be better simpliciter. And if there is no such thing as betterness-simpliciter, then can there be such a thing as goodness simpliciter? Finally, I consider how an answer to this question affects the view that incomparability is vagueness. (shrink)

According to John Rawls’s famous Liberal Principle of Legitimacy, the exercise of political power is legitimate only if it is justifiable to all citizens. The currently dominant interpretation of what is justifiable to persons in this sense is an internalist one. On this view, what is justifiable to persons depends on their beliefs and commitments. In this paper I challenge this reading of Rawls’s principle, and instead suggest that it is most plausibly interpreted in externalist terms. On this alternative view, (...) what is justifiable to persons is not in any way dependent on, or relativized to, their beliefs and commitments. Instead, what is justifiable to all in the relevant sense is what all could accept as free and equal. I defend this reinterpretation of the view by showing how it is supported by Rawls’s account of the freedom and equality of persons. In addition, a considerable advantage of this suggestion is that it allows for an inclusive account of to whom the exercise of political power must be made justifiable. (shrink)

This essay explores the implications of historicising John Rawls’s theory of justice. While historical research on Rawls and his social context has provided valuable insights, some scholars argue that historicising carries significant philosophical consequences. This paper critically examines one such argument that contends that historicising Rawls’s theory demonstrates its contextual nature, undermines its diagnostic powers, and leads to its complete dissolution. We offer a reconstruction of this argument and show that it fails. Further, while we argue that this argument fails, (...) we go on to suggest that historical evidence may contribute to a defensive argument against appeals to expert opinion. By examining the appropriate relationship between historical research and philosophy, this essay contributes to the evaluation of the historicist critique and offers insights into the broader role of historical research in philosophical discourse. According to a standard account of incomparability, two value bearers are incomparable if it is false that there holds a positive value relation between them. Due to the vagueness of the comparative predicates it may also be indeterminate as to which relation that holds - for each relation it is neither true nor false that it holds. John Broome has argued that indeterminacy cannot coexist with incomparability and since there seems to exist indeterminacy there cannot exist incomparability. At the core (...) of his argument lies the collapsing principle. There are several arguments against this principle; Erik Carlson has advanced most of these. In this paper two strategies in dealing with these arguments are discussed. One strategy is to deny the existence of a certain kind of properties; another strategy that has been advanced by Christian Constantinescu is to restrict the collapsing principle. In the paper it is argued that the first of these strategies is the most promising strategy. A novel argument in favour of this strategy is presented and several objections to the strategy are rebutted. Finally it is concluded that, even though this strategy deals with most objections, without a better argument in favour of the principle the debate seems to run into a stalemate. (shrink)

This article discusses the phenomenon of normative resilience, with a focus on evaluative resilience. An object can become more or less valuable. In addition to this change in an object's value, the object's value can become more or less resilient. If it is less resilient, it cannot withstand as much evaluative change without its degree of value changing, as compared to an object with more resilient value. The article consists of three parts. Stuttering is a disorder characterized by intermittent loss of volitional control of speech movements. This hypothesis and theory article focuses on the proposal that stuttering may be related to an impairment of the energy supply to neurons. Findings from electroencephalography, brain imaging, genetics, and biochemistry are reviewed: Analyses of the EEG spectra at rest have repeatedly reported reduced power in the beta band, which is compatible with indications of reduced metabolism. Studies of the absolute level of regional cerebral blood flow (...) show conflicting findings, with two studies reporting reduced rCBF in the frontal lobe, and two studies, based on a different method, reporting no group differences. This contradiction has not yet been resolved. The pattern of reduction in the studies reporting reduced rCBF corresponds to the regional pattern of the glycolytic index. High regional GI indicates high reliance on non-oxidative metabolism, i.e., glycolysis. Variants of the gene ARNT2 have been associated with stuttering. This gene is primarily expressed in the brain, with a pattern roughly corresponding to the pattern of regional GI. A central function of the ARNT2 protein is to act as one part of a sensor system indicating low levels of oxygen in brain tissue and to activate appropriate responses, including activation of glycolysis. It has been established that genes related to the functions of the lysosomes are implicated in some cases of stuttering. It is possible that these gene variants result in a reduced peak rate of energy supply to neurons. Lastly, there are indications of interactions between the metabolic system and the dopamine system: for example, it is known that acute hypoxia results in an elevated tonic level of dopamine in the synapses. Will mild chronic limitations of energy supply also result in elevated levels of dopamine? The indications of such interaction effects suggest that the metabolic theory of stuttering should be explored in parallel with the exploration of the dopaminergic theory. (shrink)

Despite remarkable empirical and methodological advances, our theoretical understanding of the evolutionary processes that made us human remains fragmented and contentious. Here, we make the radical proposition that the cultural communities within which Homo emerged may be understood as a novel exotic form of organism. The argument begins from a deep congruence between robust features of Pan community life cycles and protocell models of the origins of life. We argue that if a cultural tradition, meeting certain requirements, arises in the (...) context of such a “social protocell,” the outcome will be an evolutionary transition in individuality whereby traditions and hominins coalesce into a macroscopic bio-socio-technical system, with an organismal organization that is culturally inherited through irreversible fission events on the community level. We refer to the resulting hypothetical evolutionary individual as a “sociont.” The social protocell provides a preadapted source of alignment of fitness interests that addresses a number of open questions about the origins of shared adaptive cultural organization, and the derived genetic adaptations that support them. Also, social cooperation between hominins is no longer in exclusive focus since cooperation among traditions becomes salient in this model. This provides novel avenues for explanation. We go on to hypothesize that the fate of the hominin in such a setting would be mutualistic coadaptation into a part-whole relation with the sociont, and we propose that the unusual suite of derived features in Homo is consistent with this hypothesis. There are two main ways of understanding the function of surrogate decision making in a legal context: the Best Interests Standard and the Substituted Judgment Standard. First, we will argue that the Best Interests Standard is difficult to apply to unconscious patients. Application is difficult regardless of whether they have ever been conscious. Second, we will argue that if we accept the least problematic explanation of how unconscious patients can have interests, we are also obliged to accept that the Substituted (...) Judgment Standard can be coherently applied to patients who have never been conscious at the same extent as the Best Interests Standard. We then argue that acknowledging this result is important in order to show patients respect. (shrink)

Background: Informal coercion, that is, situations where caregivers use subtle coercive measures to impose their will on patients, is common in adult psychiatric inpatient care. It has been described as ‘a necessary evil’, confronting nurses with an ethical dilemma where they need to balance between a wish to do good, and the risk of violating patients’ dignity and autonomy. Aim: To describe nurses’ experiences of being involved in informal coercion in adult psychiatric inpatient care. Research design: The study has a (...) qualitative, inductive design. Participants and research context: Semi-structured interviews with 10 Swedish psychiatric nurses were analysed with qualitative content analysis. Ethical considerations: The study was performed in accordance with the Declaration of Helsinki. In line with the Swedish Ethical Review Act, it was also subject to ethical procedures at the university. Findings: Four domains comprise informal coercion as a process over time. These domains contain 11 categories focusing on different experiences involved in the process: Striving to connect, involving others, adjusting to the caring culture, dealing with laws, justifying coercion, waiting for the patient, persuading the patient, negotiating with the patient, using professional power, scrutinizing one’s actions and learning together. Discussion: Informal coercion is associated with moral stress as nurses might find themselves torn between a wish to do good for the patient, general practices and ‘house rules’ in the caring culture. In addition, nurses need to be aware of the asymmetry of the caring relationship, in order to avoid compliance becoming a consequence of patients subordinating to nurse power, rather than a result of mutual understanding. Reflections are thus necessary through the process to promote mutual learning and to avoid violations of patients’ dignity and autonomy. Conclusion: If there is a need for coercion, that is, if the coercion is found to be an ‘unpleasant good’, rather than ‘necessary evil’ considering the consequences for the patient, it should be subject to reflecting and learning together with the patient. Our research offers a glimpse into the process of how goals of ecological sustainability in one multinational corporation can trickle down through the organization via the sustainability support behaviors of supervisors. We asked the question “How do supervisors in a multinational corporation internalize their corporation’s commitment to ecological sustainability and, in turn, behave in ways that convey this commitment to their subordinates?” In response, we (...) created a theoretical framework for supervisor sustainability support behavior based on Stern et al., Human Ecology Review 6(2), 81-97 (1999) value-belief-norm (VBN) theory. We then tested our framework by performing a survey-based field study of supervisors in a multinational pharmaceutical company that has publicly professed a goal of ecological sustainability. Intelligence on mass media audiences was founded on representative statistical samples, analysed by statisticians at the market departments of media corporations. The techniques for aggregating user data in the age of pervasive and ubiquitous personal media build on large aggregates of information analysed by algorithms that transform data into commodities. While the former technologies were built on socio-economic variables such as age, gender, ethnicity, education, media preferences, Big Data technologies register consumer choice, geographical position, web movement, and behavioural information in (...) technologically complex ways that for most lay people are too abstract to appreciate the full consequences of. The data mined for pattern recognition privileges relational rather than demographic qualities. We argue that the agency of interpretation at the bottom of market decisions within media companies nevertheless introduces a ‘heuristics of the algorithm’, where the data inevitably becomes translated into social categories. In the paper we argue that although the promise of algorithmically generated data is often implemented in automated systems where human agency gets increasingly distanced from the data collected, one can observe a felt need among media users and among industry actors to ‘translate back’ the algorithmically produced relational statistics into ‘traditional’ social parameters. The tenacious social structures within the advertising industries work against the techno-economically driven tendencies within the Big Data economy. (shrink)

Chapter two exposits Deweyan ideas of embodiment, the primacy of the aesthetic encounter, and aesthetically expressive meaning underdeveloped in Wittgenstein. According to Ruth Chang the three standard positive value relations: “better than”, “worse than” and “equally good” do not fully exhaust the conceptual space for positive value relations. According to her, there is room for a fourth positive value relation, which she calls “parity”. Her argument for parity comes in three parts. First, she argues that there are items that are not related by the standard three value relations. Second, that these items are not incomparable, and third, that the phenomena (...) she has focused on are not due to the vagueness of the comparative predicates. This paper focuses on the second part of the argument and an objection is presented. By assuming the Small Unidimensional Difference Principle, which is a key premise for the second part of the argument, Chang’s argument could be accused of begging the question. More so, by assuming this principle, the space for incomparability gets severely limited. If these worries are justified, then Chang’s argument for parity as a fourth form of comparability is unsuccessful. (shrink)

BackgroundIn Sweden, individuals with visual field loss have their driving license withdrawn. The literature clearly indicates that individuals with VFL are unsafe drivers on a group level. However, many drivers with VFL can be safe on an individual level. The literature also suggests that self-perception, beliefs, and insights of one’s own capabilities are related to driving performance. This study had three aims: To investigate self-perceived driving capability ratings for individuals with VFL; to compare these ratings between groups with different medical (...) conditions associated with VFL ; and to relate the self-perception ratings to actual driving performance in an advanced driving simulator.MethodsParticipants comprised 723 individuals whose driver’s license had been withdrawn because of VFL and 92 normally sighted elderly individuals. All participants completed a background survey, rated difficulties with different traffic situations, rated their strengths and weaknesses as drivers, and rated aspects that were important for causing traffic accidents. Of the VFL group participants, 264 also completed a simulator-based driving test that they knew could lead to renewal of their driving license. VFL participants and normally sighted was at the same age when they completed the simulator driving test.ResultsOverall, individuals with VFL rated their capabilities as high on all instruments and scales used, even higher than the elderly normally sighted control group. The only VFL etiology group that rated lower than other groups was the diabetes group. Safety orientation and internal control orientation values were best at discriminating between VFL participants in terms of self-perception of driving performance. Participants categorized as “high” in terms of safety skills and internal control were more modest in their ratings. Finally, participants who passed the simulated driving test did not differ from those who failed, in any of the self-perception measures.ConclusionSelf-perception ratings among individuals with VFL were higher than those of normally sighted elderly individuals. Self-assessed skills did not predict driving performance. Groups with different VFL etiologies rated similarly. Self-ratings of driving abilities cannot be used to assess actual driving performance. Actual driving tests are necessary to discriminate between safe and unsafe drivers with VFL. (shrink)

Rwanda is often depicted as a success story by policy makers when it comes to issues of gender. In this paper, we show how the problem of gendered inequality in agriculture nevertheless is both marginalized and instrumentalized in Rwanda’s agriculture policy. Our in-depth analysis of 12 national policies is informed by Bacchi’s _What’s the problem represented to be?_ approach. It attests that gendered inequality is largely left unproblematized as well as reduced to a problem of women’s low agricultural productivity. The (...) policy focuses on framing the symptoms and effects of gendered inequality and turns gender mainstreaming into an instrument for national economic growth. We argue that by insufficiently addressing the socio-political underlying causes of gendered inequality, Rwanda’s agriculture policy risks reproducing and exacerbating inequalities by reinforcing dominant gender relations and constructing women farmers as problematic and men as normative farmers. We call for the policy to approach gendered inequality in alternative ways. Drawing on perspectives in feminist political ecology, we discuss how such alternatives could allow policy to more profoundly challenge underlying structural constraints such as unequal gender relations of power, gender norms, and gender divisions of work. This would shift policy’s problematizing lens from economic growth to social justice, and from women’s shortcomings and disadvantages in agriculture to the practices and relations that perpetuate inequality. In the long term, this could lead to transformed gender norms and power relations, and a more just and equal future beyond what the dominant agricultural development discourse currently permits. Timothy Michael Fowler has argued that, as a consequence of their commitment to neutrality in regard to comprehensive doctrines, political liberals face a dilemma. In essence, the dilemma for political liberals is that either they have to give up their commitment to neutrality (which is an indispensible part of their view), or they have to allow harm to children. Fowler’s case for this dilemma depends on ascribing to political liberals a view which grants parents a great degree of freedom in (...) deciding on the education of their children. I show that ascribing this view to political liberals rests upon a misinterpretation of political liberalism. Since political liberals have access to reasons based upon the interests of children, they need not yield to parent’s wishes about the education of their children. A correct understanding of political liberalism thus shows that political liberals do not face the dilemma envisaged by Fowler. (shrink)

Background: The tension between care-based and technology-based rationalities motivates studies concerning how technology can be used in the care sector to support the relational foundation of care. Objectives: This study interprets values related to care and technologies connected to the practice of good care. Research design: This research study was part of a development project aimed at developing innovative work practices through information and communication technology. Participants and research context: All staff (n = 18) working at two wards in a (...) care facility for older people were asked to participate in interviews, and 12 accepted. We analysed the data using latent content analysis in combination with normative analysis. Ethical considerations: The caregivers were informed that participation was voluntary and that they could drop out at any time without providing any explanation. Findings: Four values were identified: ‘presence’, ‘appreciation’, ‘competence’ and ‘trust’. Caregivers wanted to focus on care receivers as unique persons, a view that they thought was compromised by time-consuming and beeping electronic devices. Appraising from next-of-kin and been seen as someone who can contribute together with knowledge to handle different situations were other desires. The caregivers also desired positive feedback from next-of-kin, as they wanted to be seen as professionals who have the knowledge and skills to handle difficult situations. In addition, the caregivers wanted their employer to trust them, and they wanted to work in a calm environment. Discussion: Caregivers’ desire for disturbance-free interactions, being valued for their skills and working in a trustful working environment were interpreted as their base for providing good care. The caregivers’ arguments are based on caring rationality, and sometimes they felt the technological rationality interfered with their main mission, providing quality care. Conclusion: Introducing new technology in caring should support the caring relationship. Although society’s overall technology-based approach may have gained popularity as a problem solver, technology-based rationality may compromise a care-based rationality. A shift in attitudes towards care as a concept on all societal levels is needed. (shrink)

By setting up a dialogue with contemporary animal research the essay attempts, on the one hand, to expose the limits of Martin Heidegger’s concept of animality in The Fundamental Concepts of Metaphysics, and, on the other hand, to propose some new ways of thinking the being of those animals that most distinctly show themselves as being other than Heidegger’s claims. I suggest, with reference to Heidegger’s thesis of the animal as “poor in world,” that the being of the cognitively most (...) complex animals is better understood in terms of otherworldly worlds within the world of human world forming. With this concept I aim to develop and continue, rather than criticize, Heidegger’s way of thinking the being of animals and deepen the productive relationship between science and philosophy that Heidegger proposed in this work. The significance of mediatization in countryside settings is an under-researched topic in media studies. In this paper, based on qualitative fieldwork carried out in two rural areas in Sweden, we study how mediatization integrates the prospects of cosmopolitan social change. The current phase of the mediatization process, which imposes a more dynamic register of networked communication, nourishes a new type of cosmopolitan identity in the countryside. As shown in the study, this development is constituted by complex configurations of different forms (...) of mobility and connectivity. We argue that these spatial processes are socially structured, meaning that certain social groups are better equipped, through the appropriation of network capital, for turning cosmopolitan dispositions into a transformative resource, a ‘cosmopolitan politics of place’. Such alterations of the social structure may successively destabilize the relationship between ‘the urban’ and ‘the rural’. (shrink)

Human knowledge is a phenomenon whose roots extend from the cultural, through the neural and the biological and finally all the way down into the Precambrian “primordial soup.” The present paper reports an attempt at understanding this Greater System of Knowledge (GSK) as a hierarchical nested set of selection processes acting concurrently on several different scales of time and space. To this end, a general selection theory extending mainly from the work of Hull and Campbell is introduced. The perhaps most (...) drastic change from previous similar theories is that replication is revealed as a composite function consisting of what is referred to as memory and synthesis. This move is argued to drastically improve the fit between theory and human-related knowledge systems. The introduced theory is then used to interpret the subsystems of the GSK and their interrelations. This is done to the end of demonstrating some of the new perspectives offered by this view. The Will Theory of Rights has commonly been criticized for excluding from the class of rights bearers all subjects who are incapable of agency. The Interest Theory of Rights faces the challenge of avoiding undue proliferation of the class of rights bearers. I advance a novel argument for a specific demarcation of the class of rights bearers. I then argue that this demarcation implies that the function of the moral rights of subjects incapable of exercising agency is to protect them (...) from being treated with illegitimate disregard in a certain sense. I advance reasons for holding that this theory is neither a Will Theory nor an Interest Theory, or a combination of these theories. The proposed account is significant also if it is interpreted as a version of the Interest Theory. It brings significant benefits in the form of cohesiveness, simplicity, and intuitive appeal. The article describes the founding principles, work program, and accomplishments of a Reference Group with both expert and layperson stakeholders for the corrosion of copper canisters in a proposed deep repository in Sweden for spent nuclear fuel. The article sets the Reference Group as a participatory effort within a broader context of stakeholder and public participation. It is argued that for the future it will be necessary to more precisely define the roles of different approaches to public participation in relation (...) to the actual societal decision-making procedures, and the issue is raised whether an increasing level of their institutionalization is required. In particular, the focus is set on the safe-space approach to stakeholder participation designed to suit situations where independence and autonomy are crucial elements for the participants. This thesis is an inquiry into the Liberal Principle of Legitimacy, formulated by John Rawls in his later writings. According to this principle, the exercise of political power is legitimate only if it is justifiable to all citizens. This view can be interpreted in different ways, and I argue that the presently most popular way of doing so faces serious problems. The aim is to identify and defend a more plausible version of the principle, which overcomes these problems, and yet (...) preserves the most essential and appealing features of the approach. Among the most central issues for how to interpret the principle are how to understand the notion of justifiability to a person, and who should be included in the group of persons referred to as "all citizens". On the currently received view, only justifiability to those who count as "reasonable" matter, and justifiability to these persons is understood in non-moral terms, as being determined by what is accessible to them, given the beliefs that they happen to hold. I argue that we have good reasons to reject both of these suggestions. We should instead spell out justifiability to a person in terms of what could be reasonably accepted in a moral sense, which allows us to retain the appealing idea that legitimacy is dependent on justifiability to all citizens over whom political power is exercised. I further suggest that we can use the original position – Rawls’s version of the social contract – to determine what is justifiable to all in this sense. I defend this suggestion against the expected objection that it will not be able to take reasonable pluralism – the assumption of deep disagreement between citizens – into account, by explaining why we should sharply distinguish this principle of political legitimacy from the theory of Political Liberalism. This distinction also contributes to my response to the objection, raised against this principle, that it is self-defeating. That my suggested interpretation allows us to convincingly respond to this line of criticism is yet another reason as to why it is preferable to the standard view. (shrink)

Recently, there have been attempts at offering new justifications of the Rawlsian idea of public reason. Blain Neufeld has suggested that the ideal of political autonomy justifies public reason, while R.J. Leland and Han van Wietmarschen have sought to justify the idea by appealing to the value of political community. In this paper, I show that both proposals are vulnerable to a common problem. In realistic circumstances, they will often turn into reasons to oppose, rather than support, public reason. It has been suggested that people who will face hardship in the future may deserve our sympathies now. Similar intuitions can be adopted regarding the deservingness of jobs and scholarships, where andidates may be deserving now based on their expected future performance. To accommodate these intuitions, some have contended that desert is sometimes forward-looking. In this paper, I argue that it is a mistake to think of desert as forward-looking. The forward-looking view struggles to explain the deservingness of subjects that (...) have conflicting desert-making features in the future, it requires that we accept asymmetries and exceptions in desert theory and that we commit to a form of moderate determinism. In response, I present a comparative approach that offers a unified framework for explaining forward-looking cases without the drawbacks associated with the forward-looking view. (shrink)

This paper considers the view that the basis of equality is the range property of being a moral person. This view, suggested by John Rawls in his A Theory of Justice (1971), is commonly dismissed in the literature. By defending the view against the criticism levelled against it, I aim to show that this dismissal has been too quick. The critics have generally failed to fully appreciate the fact that Rawls's account is restricted to the domain of distributive justice. On (...) Rawls's view distributive justice is a matter of the fair terms of cooperation among the participants of a system of social cooperation. I argue that this understanding of distributive justice can provide a compelling rationale for considering moral personality as the basis of equality for this domain of morality. That moral persons are indeed equal is further supported by an intuitive argument concerning the irrelevance of morally arbitrary factors, giving us reasons to believe that varying capacities among moral persons does not result in an unequal moral status. The dismissal of Rawls's account of equality has thus been premature, and it remains an important view to consider. (shrink)

A longitudinal study of 308 white -collar U.S. employees revealed that feelings of hope and gratitude increase concern for corporate social responsibility. In particular, employees with stronger hope and gratitude were found to have a greater sense of responsibility toward employee and societal issues; interestingly, employee hope and gratitude did not affect sense of responsibility toward economic and safety/quality issues. These findings offer an extension of research by Giacalone, Paul, and Jurkiewicz.

IntroductionRights-ethicists intensely debate what properties of an individual are necessary and sufficient in order for that individual to have moral rights. At the heart of this important debate is the issue of whether individuals such as human foetuses, infants, and unconscious adults have moral rights, and if so, what these rights are. Paperbound. his is a selected anthology (...) of Russell’s writings and interviews on war, Tpeace and pacifism edited by the Norwegian Øystein Hide, who was born in 1975 and has the equivalent of a ma in philosophy from a Norwegian university. He did graduate work at the University of Southampton in 2001–04. He has worked at the Wittgenstein Archives in Bergen and at the University of Bergen. He has done research at the Bertrand Russell Archives1 and is a member of the Mind Association. He has translated Wittgenstein’s Zettel and Über Gewissheit into Norwegian and has done other philosophically relevant work in both Norwegian and English. Øystein Hide has supplied his anthology with an introduction that contains a number of minor factual mistakes that are a bit disturbing, but they do not overshadow his main message that Russell’s writings on war, peace and pacifism are still worth reading. He starts out by distinguishing between “the two Bertrand Russells”: the philosopher and what he calls “the political humanist”. Although Hide does not spend much energy on explaining exactly what he means by it, I find this a thought-provoking expression that to me suggests a secular humanist who is prepared to act on his convictions. He compares Russell to the Norwegian philosopher Arne Næss, who also was a political activist and acted according to his deepest beliefs. In this paper, I carry out an analysis of an event in Sweden called ‘the spring turnout’. It is a traditional event where cows are allowed out into the fields after the winter. I show how it has been colonized by Arla Foods, the diary company which controls part of the milk production in Sweden and in many other countries. Of interest in this analysis is how Arla infuses the event, and its own marketing, with discourses about nature that are (...) specifically Swedish and can be traced to the nation building of the nineteenth and twentieth centuries, used systematically as part of the social democratic project for equality and progress through a strong welfare system. The paper examines how Arla recontextualizes these discourses for commercial purposes. I show how such recontextualized discourses carry reassurances to Swedish people that this project is still intact despite huge social political changes in Swede over the past decades embracing neoliberalism, global capitalism and becoming one of the fastest deregulating countries in the world. Jag inleder med en kort presentation av huvuddragen i Rawls rättviseteori. Efter det går jag igenom, och bemöter, kritiken mot idealteori. Jag diskuterar sedan förhållandet mellan rättvisa och ekonomisk ojämlikhet, och förklarar varför teorin är radikalare än vad många kritiker insett. This article investigates discourses of Sweden’s success in gender mainstreaming. Using the theoretical concept of myth, discourse analysis is performed on different categories of texts. The aim is to analyse how this discourse of success is constructed and to increase the understanding of its components. The themes identified in the reading include adaptation, integration, volume and initiatives. In conclusion, it is argued that a conflation of gender mainstreaming with gender equality has been a vital part of the construction of Sweden (...) as the best case of gender mainstreaming. In constructivist contractualist theories, such as Rawls’, principles of justice should mirror beliefs that we all, in some sense, share. One would then arrive at principles that everybody could, in that sense, accept. These principles should specify, among other things, to whom to distribute the relevant benefits and burdens and to whom to assign responsibility for the distribution. In addition to this classical assignment problem, however, constructivist contractualism must also deal with a new, and quite different, assignment problem sincewhat to (...) count as beliefs that weall share depends on how the set of people that make up the “we” is delimited. Thus, for constructivist contractualism, the questions of whom to assign a part in the justification procedure and whom to exclude, and how to justify these inclusions and exclusions, are of crucial importance. In this chapter we consider the inclusion or exclusion of future generations, and how this case illuminates a general problem for constructivist contractualism. (shrink)

Abstract During the Copernican revolution the supporters of the Ptolemaic theory argued that the tower experiment refuted the Copernican hypothesis of the (diurnal) motion of the earth, but was in agreement with the Ptolemaic theory. In his defence of the Copernican theory Galileo argued that the experiment was in agreement both with Copernican and Ptolemaic theory. The reason for these different views of the same experiment was not that the two theories were incommensurable, as Paul Feyerabend argues, but that Galileo (...) introduced a new theory of motion which he used as an auxiliary hypothesis in his discussion of the tower experiment, while those defending the Ptolemaic theory used the old Aristotelian theory of motion. Already before the Copernican revolution the Aristotelian theory of motion was criticized by philosophers in Paris, who suggested the impetus theory of motion. The later versions of this theory had the consequence that the tower experiment no longer refuted the hypothesis of the (diurnal) motion of the earth. Thus the impetus theory removed an old and important objection to the heliocentric theory. Galileo's inertial dynamics had the same function in the discussion of the tower experiment. (shrink)

We derive and estimate a production function for microfinance institutions to provide empirical evidence of the ethical dilemma of balancing social and financial logics in hybrid organizations. A worldwide panel dataset of microfinance institutions is utilized and a production function augmented by average loan size is estimated using the control function approach. We show how this framework can be used to quantify the tradeoff between social outreach and financial sustainability in relation to the expansion of microfinance institutions’ credit operations. The (...) study reveals that expanding the extensive margin (increasing the number of loan clients) requires on average more than twice as many inputs as expanding the intensive margin (increasing the average loan size) to achieve the same growth in assets. Beyond the case of microfinance our production function illustrates that as hybrid organizations expand, they will inevitably face an ethical dilemma as the laws of economic efficiency exert pressure on their social missions. This paper argues that recent advancements in value theory can inform discussions on the interrelation of human rights. More precisely it is argued that the importance of human rights, i.e., the ranking of their priority, cannot be fully accounted for by “more important” and “equally as important”. The concept of “on a par importance” is introduced and it is argued that this concept captures implicitly held intuitions in the debate. Furthermore, with this new conceptual insight, it is possible to justify (...) certain assumptions that previously lacked a justificatory ground. (shrink)

In this paper, a rights-based argument for the impermissibility of abortion, infanticide and neglect of some pre-natal organisms and infants/children is advanced. I argue, in opposition to most rights-ethicists, that the potentiality for autonomous agency gives individuals negative rights. I also examine the conjecture that potential autonomous agents have positive rights in virtue of their vulnerability. According to this suggestion, once an individual obtains actual autonomous agency, he or she has merely negative rights. Possible solutions to conflicts of rights between (...) parents and their offspring are investigated. Finally, I discuss a lexical order between positive and negative rights, which may solve conflicts between the rights of potential autonomous agents and actual autonomous agents. (shrink)

This article is the first indepth ethical analysis of empirical studies that support the claim that children born without major parts of their cerebral cortex are capable of conscious experiences and have a rudimentary capacity for agency. Congenitally decorticate children have commonly been classified as persistently vegetative, with serious consequences for their well-being and opportunities to flourish. The paper begins with an explication of the rights-based normative framework of the argument, including conceptual analysis of the terms ‘agency’, ‘potentiality for agency’ (...) and ‘gradual approach of agency’. It critically examines Alan Gewirth’s account of the criteria for being a rights bearer and principles for settling rights conflicts between agents and potential agents. It then applies the rights-based normative framework to the ethical challenges associated with care for congenitally decorticate children. It argues that recent empirical studies support the claim that the concepts ‘potential for agency’ and ‘capacity for rudimentary agency’ apply to children who are born without major parts of their cerebral cortex. The article finally discusses important medical ethical implications of these results. It specifically focuses on congenitally decorticate children’s preparatory rights to a stimulating intellectual and social environment. (shrink)

In this article I call for an awareness of the mobile commons– the informal support that exists among migrating people, NGOs, and activists – in relation to the realization of family reunification. Taking its point of departure in a concrete case of family reunification for young unaccompanied children, the article seeks to expose how the traditional legal notion of the liberal subject fails to provide protection in the context of legal practice. I argue for using the vulnerable subject as a (...) starting point, in order to make more visible the context in which law operates and ensure protection even for the youngest children. (shrink)
