The majority of studies on natural resources management in both developed and developing countries are silent on the issue of analysis of corruption – or they treat it tangentially, as an annoying anomaly, or simply deviance from the rules. As a result, the issue has hardly been subjected to in-depth characterisation or reforms. This study employed and integrated mainstream principal-agent theory and more recently developed collective action theory to enhance our understanding – in different but complementary ways − of the (...) socio-political underpinnings of corruption. A supposed ‘best case’ participatory forest management scheme in Tanzania reveals significant forest-related corrupt undertakings, which led to forest encroachment in the form of charcoal and timber exploitation. The findings point to contextual grounds for corruption, namely: undermined assumptions of the mainstream principal-agent institutions; the presence of alternative informal principal-agent institutions; the presence of immediate and substantial benefits that flow to such alternative institutions; and the huge market demands for their forest products and services. Through such a nuanced approach that blends the two above-mentioned theories in meaningful ways, more appropriate options for policy formulation and implementation are proposed. (shrink)

We live in an ageing society, where people are living longer, and where decreases in the birth rate mean that the proportion of the population above retirement age is steadily increasing. An ageing population has considerable implications for health services and care provision. Consequently there is a growing interest among researchers, medical practitioners, and policy makers in older adults, their capabilities, and the changes in their cognitive functioning. As the first full-length book dedicated to the philosophical legacy of Hans Jonas, The Integrity of Thinking is largely dedicated to summarizing and integrating the diverse phases in Jonas’ lifework. But the book has another, more ambitious goal. David Levy attempts to demonstrate that Hans Jonas is, for matters of public policy, nothing less than the most important philosopher of the twentieth century. This alleged importance stems from his unique philosophical achievements and their manifold practical applications. According to Levy, Jonas’ (...) massive future importance will not be constrained to philosophy. Levy makes a series of admittedly “bold claims” regarding Jonas’ significance, culminating in the claim that he is “perhaps the pre-eminent practical thinker of our time”. This is excessive praise for a thinker who is still a relatively minor figure in twentieth-century philosophy, and who is still somewhat unknown by non-specialists outside his native Germany. Yet Levy hopes that the heightened public awareness of tensions between technology and ethics will create an audience for the thinker who has most successfully probed the origins of those tensions. Levy wishes to disseminate Jonas’ practical importance to a wider audience. But does Jonas merit these excessive claims, and therefore a wider audience? (shrink)

This article examines two cases that present ethical challenges encountered by social workers in making decisions either to maintain professional boundaries or fulfil moral obligations while working with service users in vulnerable situations. In the first case, a Lebanese social worker narrates how she was motivated to step out of her official responsibilities to assist a refugee mother of three who showed suicidal ideation. In the second case, a Ugandan social worker recounts her experience while working with a family whose (...) 12-year-old daughter was raped and became pregnant, but whose parents refused to accept abortion when medical diagnosis showed that the girl’s life was in danger. A commentary from the authors is provided after each case. Both social workers were arguably motivated to act based on their concern to care for people, protect human rights, and save lives in the two case scenarios. This underscores the relevance of the ethics of care and virtue ethics in describing the associated ethical challenges in both cases. Furthermore, the dynamic nature of the ethical challenges encountered by the social workers demands open minds and flexibility in decision-making. (shrink)

Agonism is a political theory that places contestation at the heart of politics. Agonistic theorists charge liberal theory with a depoliticization of pluralism through an excessive focus on consensus. This paper examines the agonistic critiques of liberalism from a normative perspective. I argue that by itself the argument from pluralism is not sufficient to support an agonistic account of politics, but points to further normative commitments. Analyzing the work of Mouffe, Honig, Connolly, and Owen, I identify two normative currents of (...) agonistic theory: emancipatory agonism, aimed at challenging violence and exclusion, and perfectionist agonism, aimed at the cultivation of nobility. From a normative perspective the former presents an internal challenge to liberalism, while the latter constitutes an external challenge to liberalism by providing a competing account of the ends of politics. Recognition of the distinction between emancipatory and perfectionist agonism is crucial in assessing the purchase of agonistic critiques of liberalism. Furthermore, this analysis draws us beyond the simple opposition between contestation and consensus. It is not simply a question of valuing genuine pluralism and therefore criticizing consensus; rather the question comes to be: what are the ends of politics? (shrink)

Human persons can act with libertarian freedom in heaven according to one prominent view, because they have freely acquired perfect virtue in their pre-heavenly lives such that acting rightly in heaven is volitionally necessary. But since the character of human persons is not perfect at death, how is their character perfected? On the unilateral model, God alone completes the perfection of their character, and, on the cooperative model, God continues to work with them in purgatory to perfect their own (...) character. I argue that although both models can make sense of all human persons enjoying free will in heaven on various assumptions, the cooperative model allows all human persons in heaven to enjoy a greater degree of freedom. This consideration about the degree of heavenly freedom provides a reason for God to implement the cooperative model. (shrink)

In his Doctrine of Right, Immanuel Kant calls Moses Mendelssohn, the towering figure of the German and the Jewish Enlightenment, a ‘Rechtsforscher’—a legal scholar. Yet not only Kant, but numerous scholars of Natural law in the 18th and 19th centuries refer to and reflect on the juridical aspects of Mendelssohn’s work, in particular his thoughts on the law of contract. In this article, I hope to shed some light on this hitherto rather unexplored facet of Mendelssohn’s oeuvre. Mendelssohn develops his (...) theory of contract from the starting point of the officium amoris: the unenforceable ‘duty of love’ to exercise beneficence. Mendelssohn’s theory knows nothing yet of the modern contrast between altruism, distributive justice and ‘freedom of contract’. By exploring Mendelssohn’s theory, we will thus be able to catch a glimpse of the birth pangs of the modern Western discourse on the ‘freedom of contract’, which formed the backdrop as well as the jumping-off point of the development of a ‘liberal’ will theory of contract. Since this ‘liberal’ model is still the paradigm of how contract is mostly perceived today, Mendelssohn’s theory also exemplifies the possibility of an alternative to our own conceptualizations of contract that inescapably shape the way we think. Some have argued that unipersonal concepts of God collapse into incoherence, so that such a being is no more possible than a square circle, or at least that such theologies are, as non-trinitarian, significantly less probable than some trinitarian theologies. I discuss the general strategy and examine recent arguments by William Lane Craig, C. Stephen Layman, Thomas V. Morris, and Richard Swinburne based on divine love, flourishing, and glory. My argument proceeds in two stages. In §I, I sum up the intuitions of a popular argument for 'satisfaction accounts' of Purgatory that I label, TAP. I then offer an argument, taken from a few standard orthodox Christian beliefs and one axiom of Christian theology, to so show that TAP is unsound. In the same section, I entertain some plausible responses to my argument that are prima facie consistent with these beliefs and axiom. I find these responses wanting. In §II, (...) I offer a sorites problem for TAP, given the orthodox Christian understanding of Christ’s parousia, showing that TAP and the intuitions driving it are faulty. To attempt something of a corrective, I end by offering some modest theological suggestions for thinking through “the logic of total transformation.”. (shrink)

In this paper, I investigate David Hume’s theory of well-being or prudential value. That Hume was some sort of hedonist is typically taken for granted in discussions of his value theory, but I argue that Hume was a hedonist of pathbreaking sophistication. His hedonism intriguingly blends traditional hedonism with a form of perfectionism yielding a version of qualitative hedonism that not only solves puzzles surrounding Hume’s moral theory, but is interesting and important in its own right.

Whatever ethical stance one takes in the debate regarding the ethics of human enhancement, one or more reference points are required to assess its morality. Some have suggested looking at the bioethical notions of safety, justice, and/or autonomy to find such reference points. Others, arguing that those notions are limited with respect to assessing the morality of human enhancement, have turned to human nature, human authenticity, or human dignity as reference points, thereby introducing some perfectionist assumptions into the debate. In (...) this article, we ask which perfectionist assumptions should be used in this debate. After a critique of views that are problematic, we take a positive approach, suggesting some perfectionist elements that can lend guidance to the practice of human enhancement, based on the work of Martha Nussbaum's Capability Approach. We suggest that the central capabilities can be used to define the human aspect of human enhancement and thereby allow a moral evaluation of enhancement interventions. These central capabilities can be maximized harmoniously to postulate what an ideal human would look like. Ultimately, the aim of this article is twofold. First, it seeks to make explicit the perfectionist assumptions found in the debate and eliminate those that are problematic. Second, the paper clarifies an element that is often neglected in the debate about human enhancement, the view of the ideal human towards which human enhancement should strive. Here, we suggest that some central capabilities that are essential for an ideal human being can be maximized harmoniously and can therefore serve as possible reference points to guide human enhancement. Transhumanism advances an ideology promising a positive human advance through the application of new and as yet unrealized technologies. Underlying the whole is a libertarian ethos married to a very Christian eschatology promising a miraculous transformation that will answer human needs and redress human failings. In this paper, the supposedly scientific basis on which transhumanist promises are built is critiqued as futurist imaginings with little likelihood of actualization. Transhumanists themselves are likened to the affable con man Professor Harold Hill who, (...) in The Music Man, describes as dire social problems whose solution is a youth band he seeks to sell but has no intention of building. Even were some of the transhumanist imaginings to be realized, I argue, the result would be a dystopia in which the few received benefits denied to the many. In advancing imaginary technologies as a solution to human needs, transhumanists and their bioethical fellow travelers handily avoid discussion of or advocacy for the kind of pedestrian social actions that demonstrably could achieve many of their purported goals. So their enthusiasms, I conclude, are not merely fanciful but damaging to the humanist goals they pretend to advance. (shrink)

A foundational problem in population ethics is the “repugnant conclusion", introduced by Derek Parfit in Reasons and Persons. It holds that for any possible population of at least ten billion lives of very high positive welfare, there is some larger possible population of lives of very low positive welfare whose existence would be better, if other things are equal. I call this claim RC1. In this article, I argue that by carefully considering the nature and variety of possible lives of (...) very low positive welfare, and distinguishing RC1 from a related but stronger claim I call RC2, we can show that RC1 is more acceptable than it first appears. It has been claimed that perfectionism— that is, a special concern for the best things in life—is a reason to reject the repugnant conclusion. I argue that although perfectionism gives us a reason to reject RC2, it does not give us any reason to reject, and might in fact support, RC1. In his last two papers on the subject, Parfit develops a strategy for avoiding the repugnant conclusion that appeals in part to perfectionism. In the final part of this article, I argue that Parfit’s strategy can help us avoid RC2 but not RC1. If I am right that RC1 is more acceptable than RC2, this may not be an unwelcome result. (shrink)

In Lars von Trier’s Breaking the Waves, the protagonist Bess McNeill is often viewed as a Christ-figure, in particular, as an image of Christ’s love. In this essay, I address the feminist critique that taking Bess in this way represents a serious distortion of Christ's love, arguing that Bess need not be seen as endorsing a self-destructive and victimizing form of love that feminist critics rightly reject. Instead, I suggest that we can view her love as an indictment of the (...) institutions structuring its expression. Finally, I argue that Bess’s love for Jan combines aspects of love that have typically been segregated into eros and agape in a way that enriches our understanding of agape and prompts us in turn to re-evaluate our understanding of Christ’s love and death. Recording has transformed the nature of music as an art by reconfiguring the opposition between the aesthetics of perfection and imperfection. A precursor article, ‘The Art of Improvisation and the Aesthetics of Imperfection’, contrasted the perfectionist aesthetic of the ‘work-concept’ with the imperfectionist aesthetic of improvisation. Imperfectionist approaches to recording are purist in wanting to maintain the diachronic and synchronic integrity of the performance, which perfectionist recording creatively subverts through mixing and editing. But a purist transparency thesis cannot evade (...) the fact that the recorded image is crafted; against creative editing, however, the imperfectionist ideal of the ‘complete take’ is humanistic and anti-mechanistic, and not mere Romantic illusion. The article concludes with a discussion of the question of the artistic status of recording, and contrasts the possibility of a non-acousmatic sound art with the essentially acousmatic art of music. Abū Bakr al-Rāzī (d. ca. 925), a well-known physician and Muslim philosopher, has not yet been widely considered for his philosophical reflections on animals. An inspection of al-Rāzī’s works demonstrates his endeavor, based on his cosmology, to come up with a way of the perfection of the soul and becoming liberated from the terrestrial world. As this paper maintains, his investigation of animals is aimed at developing his theory of the perfection of the soul. After a brief clarification (...) of the theory, which entails a discussion of the interaction of the two theoretical and practical aspects of human reason, this paper will discuss seven cases in which al-Rāzī uses the discussion of animals to develop his theory of the perfection of the soul. Leibniz is unclear about the nature of pleasure. In some texts, he describes pleasure as a perception of perfection, while in other texts he describes pleasure as being caused by a perception of perfection. In this article, I disambiguate two senses of “perception of perfection”, which clarifies Leibniz’s considered position. I argue that pleasure is a perception of an increase in a substance’s power which is caused by a substance’s knowledge of a perfection of the universe (...) or God. This reading helps clarify the nature of Leibnizian happiness. Happiness is a cognitive process (akin to a mood), constituted fundamentally out of pleasure, which is grounded in increases in a substance’s power. A rational substance will sustain its happiness so long as it is more powerful than it is weak, and it is engaging in activities that increase its power. (shrink)
