Corporations evolved from serving a public purpose at the beginning of the seventeenth century to, legally and culturally, primarily maximizing profit for shareholders which continues at the beginning of this twenty-first century. Government and civil society have largely continued serving the public interest over time, but have struggled to keep pace with increasing and rapidly evolving challenges in recent decades. While social entrepreneurs and the corporate sector have stepped in to help address these challenges, through the practice of corporate responsibility, (...) they have faced unnecessary hurdles in doing so. The benefit corporation was established in 2010 both to remove these hurdles and also help further unleash the power of business to address society’s most pressing problems. Despite various criticisms, benefit corporations are doing just that – enhancing the practice of corporate responsibility in the process – and will continue to improve over time. This paper summarizes the advantages of benefit corporations, points out some shortcomings which serve as areas for improvement, and addresses some of these criticisms. (shrink)

Trading on non-public material information is fertile ground for a discussion of ethical behavior. The long-running legal tug-of-war over what constitutes illegal insider trading delivers challenges to regulatory authorities charged with detecting and enforcing the law, and is likely one of the reasons that prosecution of insider trading events remains rather uncommon. One can observe both increased volume in the equity and option markets and run-ups in the stock price prior to the announcement of the acquisitions; however, the detection of (...) illegal or unethical insider trading can be difficult. Given the legal uncertainty around insider trading and the circumstantial evidence from the trading activity, it is almost impossible to identify unethical insider trades unless there is a whistleblower or trades are large in size and impeccable in timing. Using call option trading around two merger announcements with similar firms that resulted in different ultimate treatment from the SEC, we illustrate the struggle regulators and prosecutors have with identifying and enforcing unethical insider trades. Jean-Paul Sartre, novelist, playwright, biographer, was undoubtedly one of the greatest philosophers of the 20th century. Above all, however, he was an embodiment of the engagé intellectual, active in a variety of political causes, as well as an individual who attempted to live his life in accordance with the philosophy he professed. These interviews take Sartre on a wide-ranging tour of his philosophy and politics. Here we have Simone de Beauvoir challenging Sartre on his own attitude towards machismo and feminism; (...) and Sartre responding thoughtfully to questions which range from Freud, Marx, and the drama of Bertolt Brecht to the Cultural Revolution, Stalinism, the May 'Events' and of course, the US war on Vietnam. Abstractabstract:In this essay, I engage in an exercise of interreligious theology focusing on Muslim and Shin Buddhist perceptions of Jesus. I ask if and how a Christian might take Muslim and Shin Buddhist views as genuine insights that may enrich and correct some Christian views. I further hold that lest getting incoherent such an exploration must keep all three perspectives together. It must combine the insight behind Christians' affirmation of incarnation with, on one hand, the insight behind Muslims' concern about (...) the concept of incarnation as such and, on the other hand, the insight behind the concern of Buddhists about the assertion of merely one single incarnation. By interpreting incarnation as an implication of revelation, I suggest that such a Christology is indeed possible. (shrink)

Education often relies on an implicit assumption that decisions are made rationally, and focuses on situations in which there are correct answers that can be known with certainty. The proposal that decision-making is often narrative, especially in contexts of radical uncertainty, suggests important changes to education practice and new questions for education research.

Just war theory applied to counterinsurgency.

Whether in journalism or medicine, education, law, or television, trans writers and trans studies scholars consistently develop this critique of the representational totalization of trans people, whereby they are and have been made whats, not whos; objects, not subjects; voiceless, not vocal; passive, not active; dehistoricized, not historical; and single, not multiple. In what follows, I aim to supplement this critique by attending to the role of curiosity both as a technique of (trans) objectification and as a practice of (trans) (...) freedom, on both the individual and social level. That is, I trace how curiosity—through the monadic and collective acts of gazing, inquiring, investigating, and imagining—functions as part of the project of the representational totalization of trans people but also as part of trans people’s own praxis of resistant de-totalization. Perry argues that certain sorts of indexicals are 'essential', in the sense that they cannot be eliminated in favor of descriptions. This paper also introduces the influential idea that certain sorts of indexicals play a special role in thought, and have a special connection to action.

In a well-known 1964 essay on the “recovery” of American religious history, Henry F. May observed that some scholars had “revived” religious interpretations of the nation's greatest political crises, including the Civil War. But there was more work to be done. “A religious, or partly religious explanation of the Civil War,” May suggested, would “rest on two assertions: that serious and intractable moral conflicts were important in causing the war and that in nineteenth-century America such conflicts were particularly difficult to (...) avoid or compromise because of the dominance of evangelical Protestantism in both sections.” In fact, both the importance of the moral conflict over slavery and the role of evangelicalism in intensifying hostilities were already attracting attention as historians reexamined previous emphases on economic factors and political bungling as explanations of a tragically unnecessary war. In this essay I elaborate a particular, and particularly important, morality: the morality of human rights. Next, I ask the ground-of-normativity question about the morality of human rights and go on to elaborate a religious response. Then, after explaining why one might be skeptical that there is a plausible secular response to the ground-of-normativity question, I comment critically on John Finnis's secular response. Finally, I consider what difference it makes if there is no plausible secular response to the ground-of-normativity question.

A collection of twelve essays by John Perry and two essays he co-authored, this book deals with various problems related to "self-locating beliefs": the sorts of beliefs one expresses with indexicals and demonstratives, like "I" and "this." Postscripts have been added to a number of the essays discussing criticisms by authors such as Gareth Evans and Robert Stalnaker. Included with such well-known essays as "Frege on Demonstratives," "The Problem of the Essential Indexical," "From Worlds to Situations," and "The Prince (...) and the Phone Booth" are a number of important essays that have been less accessible and that discuss important aspects of Perry's views, referred to as "Critical Referentialism," on the philosophy of language and the philosophy of mind. Following his recently expanded _The Problem of the Essential Indexical and Other Essays,_ John Perry develops a reflexive-referential' account of indexicals, demonstratives and proper names. On these issues the philosophy of language in the twentieth century was shaped by two competing traditions, descriptivist and referentialist. Oddly, the classic referentialist texts of the 1970s by Kripke, Donnellan, Kaplan and others were seemingly refuted almost a century earlier by co-reference and no-reference problems raised by Russell and Frege. Perry's theory, borrowing (...) ideas from both traditions as well as from Burks and Reichenbach, diagnoses the problems as stemming from a fixation on a certain kind of content, coined referential or fully incremental. Referentialist tradition is portrayed as holding that indexicals contribute content that involves individuals without identifying conditions on them; descriptivist tradition is portrayed as holding that referential content does not explain all of the identifying conditions conveyed by names and indexicals. Perry reveals a coherent and structured family of contents — from reflexive contents that place conditions on their actual utterance to fully incremental contents that place conditions only on the objects of reference — reconciling the legitimate insights of both traditions. Philosophers and logicians use the term “indexical” for words such as “I”, “you” and “tomorrow”. Demonstratives such as “this” and “that” and demonstratives phrases such as “this man” and “that computer” are usually reckoned as a subcategory of indexicals. (Following [Kaplan, 1989a].) The “context-dependence” of indexicals is often taken as a defining feature: what an indexical designates shifts from context to context. But there are many kinds of shiftiness, with corresponding conceptions of context. Until we clarify what we mean by (...) “context”, this defining feature remains unclear. In sections 1–3, which are largely drawn from [Perry, forthcoming(a)], I try to clarify the sense in which indexicals are context-dependent and make some distinctions among the ways indexicals depend on context. In sections 3–6, I contrast indexicality with another phenomenon that I call “unarticulated constituents.”. (shrink)

It's too easy to say of Mai '68 that the police are incurious while protesters are curious, that administrators are incurious and students are curious. A more honest assessment of these moments, striated as they are with social tensions, would identify at least two modes of inquiry and two sets of questions vying for dominance: the one located on the side of the status quo, the other on the side of change. In what follows, I provide historico-theoretical resources to justify (...) that assessment. I first review Michel Foucault and Jacques Ranciere's theories of the police, identifying the incipient role of curiosity in their accounts both of resistance and of power and the police. I then turn to the Prisons Information Group (GIP), where I trace the clear clash between state curiosity as implemented by police and resistant curiosity as practiced by GIP activists. Finally, in light of this clash, I explore implications for interpreting Mai '68 and Black Lives Matter as instances of curiosities at war. (shrink)
