Utilising literature as a serious source of challenges to questions in philosophy and law, this book provides a fresh perspective not only upon the inculcation of the legal subject, but also upon the relationship between modernism, postmodernism and how such concepts might evolve in the construction of community ethics. The creation and role of the legal subject is just one aspect of jurisprudential enquiry now attracting much attention. How do moral values act upon the subject? How do moral (...) 'systems' impinge upon the subject - jurist and judged - throughout the 20th century, when religious values are called into question, when 'existential' doubt prevails? To what extent do issues of gender and identity inform these questions? Many sources can provide insights into these issues: this book intends to concentrate upon fiction as just such a resource. However it is not just another law and literature compilation. Spanning the last century, each chapter will attempt to fulfil four objectives: to identify key texts in relation to a given period; to look for linked legal and philosophical developments from that period; to establish fresh links from these sources regarding concrete doctrinal, or practical legal questions, and finally draw a more general inference about the legal subject and the frequently less evident feminine citizen-subject. Central to this approach will be the consideration of contemporary case law and legal materials as social documents of the relationship between law and the wider community. (shrink)

Implementing a postcolonial feminist perspective in nursing research related to non‐Western populationsIn this article, I argue that implementing a postcolonial feminist perspective in nursing research transcends the limitations of modern cultural theories in exploring the health problems of non‐Western populations. Providing nursing care in pluralist countries like Canada remains a challenge for nurses. First, nurses must reflect on their ethnic background and stereotypes that may impinge on the understanding of cultural differences. Second, dominant health ideologies that underpin nurses’ (...) everyday practice and the structural barriers that may constrain the utilization of public healthcare services by non‐Western populations must be further examined. Postcolonial feminism is aimed at addressing health inequities stemming from social discriminative practices. I will draw on extant literature and data of an ongoing ethnography exploring the Haitian caregivers’ ways of caring for ageing relatives at home to unveil how the larger social and cultural world has an impact on caregivers’ everyday lives. Marginalized locations represent privileged sites from which health problems, intersecting with power, race, gender, and social classes, can be addressed. Postcolonial feminism provides the analytic lens to look at the impact of these factors in shaping health experiences. It also suggests redirecting nursing cultural research and practice to achieve social justice in the healthcare system. (shrink)

The successes of the human genome project and genomics research programs portend great potential to improve upon health and enhance life. As scientific advancements continue, bioethicists and policy makers deliberate over the social and ethical implications of genetic and genomic technologies and information (ggT/I). The application of ggT/I to human reproduction raises conceptual and moral questions about being human and the links between offspring, parents, and society. Given ggT/I’s ability to significantly affect the biological constitution of humans and future human (...) generations thinking through such issues is fundamental to ethical and policy analysis. By means of a systematic literature review and accompanying content analysis, this paper highlights the dominant ethical concerns raised within recent bioethics discourse over the use of ggT/I for human reproduction. Based on these findings it aso offers a framework through which, and demarcates where, religious perspectives can add value to genethics debates and policy deliberation. (shrink)

The question of what is philosophy, leads, it would seem, inevitably to diverse and conflicting, if not at times contradictory, answers. It is not only a matter of different philosophic perspectives, but also of fundamentally opposed conceptions of philosophy. Varying philosophic intentions and aims underlie what is taken to be the nature of philosophy and disagreement abounds. Philosophies then tend to differ not so much in terms of what they disagree about but what they consider philosophically sound and important. Phenomenology (...) may share some concerns about basic philosophic problems, like intentionality, with ordinary language philosophy. But they diverge again sharply about the question of what philosophy should accomplish for, and what difference it makes to, human knowledge and understanding. The one sees intentionality as the pervasive structure of human consciousness and reality, and the other sees it as simply part of the various ways in which the uses of language can explain, and thus do away with, philosophical questions on perplexity. This difference about what philosophy should accomplish, its purpose, is not resolvable. It is what on each approach must be considered the very nature of philosophy and its primary task. (shrink)

Stakeholder literature has acknowledged the need to complement the extant theory on stakeholder management by more dynamic perspectives. This article makes use of the recent terminology of stakewatcher and stakeseeker to illustrate the dynamic aspect of stakeholder theory transposed in the graphical representation of Freeman’s stakeholder model. Presenting a few selected case studies, it applies the scheme on the concept of value responsibility chain; it exemplifies the role of stakeseekers in various forms of activism, from shareholders, NGOs and government, (...) in the stakeholder mobilisation process. This article clarifies how stakewatchers and stakeseekers can profoundly affect stakeholder salience, especially in crises. The transposition and integration of the dynamic aspect of stakeholder theory into the graphical representation strengthen the forceful pedagogical value of the Freeman’s stakeholder graphical model. Many studies have emphasized the importance of medical, insurance, and workplace systems treating individuals fairly in work disability prevention and return-to-work. However, ethical theories and perspectives from these different systems are rarely discussed in relation to each other, even though in practice these systems constantly interact. This paper explores ethical theories and perspectives that may apply to the WDP–RTW field, and discusses these in relation to perspectives attributed to dominant stakeholders in this field, and to potential differences in different jurisdictional (...) contexts. Literature was sought primarily in biomedical ethics, business ethics, and public administration ethics. In biomedical ethics, four ethical principles are dominant: autonomy, beneficence, nonmalevolence, and justice. Business ethics involve theories on Corporate Social Responsibility, social contracts, and organizational justice. Public administration ethics focus on constitutional theory, citizenship, social equity, virtue, and public interest. Several concepts were identified as relevant for ethical analyses in the WDP–RTW field, including justice; individual autonomy; nonmalevolence; economic and social responsibility; and social contracts. These concepts provide a vocabulary that may be used to analyze stakeholders’ actions and interactions in RTW processes. It was also noted how the power balance between stakeholders will influence which ethical perspectives will influence RTW. Jurisdictional differences that influence RTW processes with regard to stakeholder responsibilities were identified, as well as varying beliefs as to who is the client in different compensation systems. A social contractual approach may inform an analysis of cultural and legal differences. (shrink)

Definition of the problemFeminist approaches to medical ethics are well established in international discourses. By contrast, in the German-speaking medical ethical discourse, they still seem to be rather marginal. In this article, we analyze which feminist perspectives are prominent in German medical ethics and suggest new approaches.ArgumentsWe present our results from a systematized review of the literature, in which we identify existing feminist approaches within the German-speaking medical ethics discourse as well as research gaps. Based on the review, our (...) preliminary research and discussions in the working group “Feminist perspectives in bio and medical ethics”, we defend three hypotheses aimed at advancing the German feminist medical ethical discourse. We posit that (1) feminist medical ethics aim at (epistemic) justice, (2) feminist medical ethics are critical and context-sensitive, and (3) intersectional and postcolonial approaches within feminist medical ethics may contribute to epistemically just, critical, and context-sensitive medical ethics.ConclusionWe argue that feminist perspectives should be implemented as a fundamental perspective in medical ethics because they can bring together key dimensions such as epistemically just, critical, context-sensitive, intersectional, and postcolonial thinking. This paper offers a reading of Hartmann’s philosophy of literature from the perspective of contemporary aesthetics. In particular, I focus on his defense of the truth-value of literary works. After outlining the main concern of the paper (sect. 1), I place Hartmann’s view within the context of current aesthetic cognitivism (sect. 2). In the following three sections, I discuss Hartmann’s account, examining his critique of the thesis that literature is cognitively valuable because it transmits factual truths (sect. (...) 3); his defense of the view that literature discloses life (sect. 4); and the link between cognitive value and the ontology of the literary work (sect. 5). Finally, I discuss Hartmann’s focus on the concept of “truth” in the light of recent debates on knowledge of “what it is like” and on “understanding” (sect. 6). (shrink)

This volume contains a selection of nine essays with an interdisciplinary perspective. They were originally presented at the Sixth International Conference on Word and Music Studies, which was held at Edinburgh University in June 2007 and was organized by the International Association for Word and Music Studies (WMA). The Turkish market of Qur'an translations and studies is exceedingly oversaturated. Critics find some of these lacking in proper hermeneutical judgement, impelling them to reflect on the conditions of judicious Qur'anic exegesis. These reflections have remained relatively unexplored in English academic literature. In Critical Hermeneutics, Celik explores and compares the hermeneutical philosophies of three Turkish intellectuals, namely Alpyagil, Cündioglu, and Öztürk. As an empirical example of introspective conditions in which the normal sense of self is disrupted, the delusion of thought insertion is of special interest to philosophers investigating the epistemic and phenomenological structures of introspection. A common strategy is to use immunity to error through misidentification as a tool with which to pick apart the implications of thought insertion for our understanding of the faculty of introspection. In this paper I turn that strategy on its head: I draw on our (...) understanding of introspection and of thought insertion to make two correctives to the literature on immunity to error through misidentification. The first is the identification of a formal distinction between two phenomena sometimes conflated under the rubric of misidentification errors. The second is a weakening of the presumed significance of claims to immunity to error through misidentification. With these tightenings to the notion of immunity to error through misidentification in hand, we will be in a better position to turn again to questions about the epistemic and phenomenological nature of introspection. This article offers an innovative perspective on the literary landscapes of the 1960s in France, Ukraine, and the USA serving as exemplars of a global literary project that views literary works as heterotopias that, while being distinct, collectively constitute a cohesive whole. Using a comparative approach, complemented with distant reading techniques, the study examines how these literary realms are interconnected, revealing shared aesthetic foundations guided by an overarching law. This law, rooted in Theodor Adorno’s concept of negativity, becomes evident (...) in in countercultural movements and consequential shifts in literary form, content, and canon. While not the primary focus of analysis, other unifying elements in this global literary panorama include dissent as defined by Jaques Rancière, and a Sartrian-infused interpretation of existentialism. The article suggests that this global phenomenon may have emerged due to the confluence of two factors: the seismic global impact of events like WWII and the evolving postmodern trajectory of the era. The volume represents a selection of the articles which were presented at a colloquium on new research topics in aesthetics at the Austrian Library in Pilsen in September 2010. Their authors, Czech and Austrian scholars, address various topics, ranging from the institutional history of aesthetics to the relationship between philosophical aesthetics and psychology, and from the philosophy of literature to the aesthetics of fine arts, dramatic arts, and architecture.

The term exaptation, describing the phenomenon that an existing trait or tool proves to be of new adaptive value in a new context, is flourishing in recent literature from cultural evolution and cognitive archaeology. Yet there also exists an older literature from the nineteenth and twentieth centuries which studied more or less systematically the phenomenon of “change of function” in culture and tool use. Michel Foucault and Ludwig Noiré, who devoted themselves to the history of social institutions and (...) material tools, respectively, occupy an important place among them. This article offers a brief overview of this literature and attempts to show that it provided ideas that remain relevant to current approaches to cognitive archaeology, in particular regarding attempts to understand the impact of technological evolution on the human mind. Qualitative research from a feminist perspective in the postmodern era: methodological, ethical and reflexive concerns Developing methodology is an ongoing process in certain types of qualitative research. This paper describes the process in a study of single midlife women, detailing reflexive concerns on the ethics of data collection and dissemination of research findings from a feminist postmodern perspective, as well as the way in which modification of techniques of analysis occurred as the study progressed. Beginning research questions were (...) concerned with identifying the impact of menopausal symptoms, and the debate surrounding HRT on the lives and decision‐making processes of single midlife women. Initial analysis of data, using grounded theory techniques, indicated a need to place greater emphasis on the way the women constructed or talked about the self, including the embodied self. This led to an exploration of the literature relating to reflexivity, identity construction and embodiment, including feminist poststructuralist interpretations of the discursive and embodied construction of self, and informed both the theoretical framework and the method. The way in which a type of analysis fitting under the broad rubric of discourse analysis, that is one that gave added emphasis to gendered subjectivity, directed further analysis is discussed, as well as the influence on the women of social and scientific discourses in circulation. Depression has been widely studied by researchers from different fields, but its causes, and mechanism of action are still not clear. A difficulty emerges from the shifting from objective diagnosis or analysis to exploration of subjective feelings and experiences that influence the individuals' expression, communication and coping in facing depression. The integration of the experiential dimension of the first-person in studies on depression–and related methodological recommendations–are needed to improve the validity and generalizability of research findings. It will allow the development (...) of timely and effective actions of care. Starting from providing a summary of the literature on theoretical assumptions and considerations for the study of the mind, with particular attention to the experiential dimension of patients with depression, this contribution is aimed to provide practical suggestions for the design of research able to incorporate first- and third-person accounts. It is also aimed to review qualified phenomenological methods for the acquisition and interpretation of experiential data in patients with depression. Recognizing the first-person perspective in the study of depression is a major step toward a better understanding and treatment of this disorder. Theoretical constructs and technique suggestions that result from this review offer a valid starting point for the inclusion of the experiential dimension to common third-person research in the study of the mind. Gender, ‘race’, poverty, health and discourses of health reform in the context of globalization: a postcolonial feminist perspective in policy researchIn this paper, I draw on extant literature and my empirical work to discuss the impact of globalization and healthcare reform on the lives of women — those from countries of the South as well as of the North. First, I review briefly the economic hardships identified in different sectors of the population that have been attributed to how (...) globalization is now working. Second, I examine what these global processes mean for health, with particular focus on poverty, gender, racialization and health. Third, I reflect on how nurse scientists might develop research agendas in the 21st century that would foster social transformation and social justice for all people. The position taken here is not an indictment of globalization. Rather, I argue that globalization is a fact in all of our lives. There are positive aspects of globalization. There are also negative aspects which we must collectively address, given that the issues identified can have deleterious consequences for the world’s poor, women in particular. I suggest that, to construct knowledge for practice and praxis, research agendas of the future should be inclusive of subaltern voices. I argue that drawing on a postcolonial feminist epistemology might help us to define such agendas, and express the multilayered sociopolitical contexts of health and illness in advocacy with policy‐makers. For more than 30 years and until his death in 2004 Jacques Derrida remained one of the most influential contemporary philosophers. It may be difficult to evaluate what forms his heritage will take in the future but _Derrida Now_ provides some provocative suggestions. Derrida’s often-controversial early reception was based on readings of his complex works, published in journals and collected in books. More recently attention has tended to focus on his later work, which grew out of the seminars that he (...) presented each year in France and the US. The full texts of these seminars are now the subject of a major publication project, to be produced over the next ten years. _Derrida Now_ presents contemporary articles based on or around the study of Derrida. Looking closely at Adam Smith’s account of the spectator perspective – along with the compatible spectator accounts in Hutcheson and Hume – is especiallyhelpful to understanding one of the main themes of the Scottish Enlightenment. The Scots in response to Hobbesian egoism described a morality that does not need to overcome a human nature that pits individuals against each other. Rather each of the three Scots describes the empirical formation of our humanity and our moral sentiments in the context (...) of relating to and observing others. The three spectator accounts of Smith, Hutcheson, and Hume clearly describe this involvement of others in the formation of morality. Adam Smith explicitly gives an accounting of the importance and, in fact, necessity of others in the formulating of not only our moral evaluations but also the very possibility of understanding one’s humanity and having an idea of morality at all. In this paper, I explain Smith’s account specifically along with its similarity to Hutcheson’s and Hume’s and argue that these empiricists ground moral sentiments in person to person relationships. For the three Scots, being human and developing a morality is begun in interactions with others. We formulate who it is we are and can be and determine acceptable ways to interact in the company of others. (shrink)

This essay is an attempt to link aspects of Kierkegaard’s experimental writings with new contemporary ecological perspectives which—in the act of interpenetration—are fusing philosophy, science, literature, anthropology, political thought, new economic perspectives, and visual and sound media, in order to open up new ways to live and flourish on a damaged planet—in our “age of disintegration.” I present Kierkegaard’s diagnosis of his time as “the age of disintegration” (from 1848) as something that can be connected to the contemporary socio-political (...) conditions in late modernity, and to the new epoch on the horizon which we are now experiencing. I interpret Kierkegaard’s expression “out into the middle of life” as the kernel of Kierkegaard’s authorship of interruption and unsettling. I argue it can be implicitly included in aspects of ecological perspectives offered by innovative writers today. (shrink)

BackgroundPsychiatric staff members have the power to decide the options that frame encounters with patients. Intentional as well as unintentional framing can have a crucial impact on patients’ opportunities to be heard and participate in the process. We identified three dominant ethical perspectives in the normative medical ethics literature concerning how doctors and other staff members should frame interactions in relation to patients; paternalism, autonomy and reciprocity. The aim of this study was to describe and analyse statements describing real (...) work situations and ethical reflections made by staff members in relation to three central perspectives in medical ethics; paternalism, autonomy and reciprocity.MethodsAll staff members involved with patients in seven adult psychiatric and six child and adolescent psychiatric clinics were given the opportunity to freely describe ethical considerations in their work by keeping an ethical diary over the course of one week and 173 persons handed in their diaries. Qualitative theory-guided content analysis was used to provide a description of staff encounters with patients and in what way these encounters were consistent with, or contrary to, the three perspectives.ResultsThe majority of the statements could be attributed to the perspective of paternalism and several to autonomy. Only a few statements could be attributed to reciprocity, most of which concerned staff members acting contrary to the perspective. The result is presented as three perspectives containing eight values.•Paternalism; 1) promoting and restoring the health of the patient, 2) providing good care and 3) assuming responsibility.•Autonomy; 1) respecting the patient’s right to self-determination and information, 2) respecting the patient’s integrity and 3) protecting human rights.•Reciprocity; 1) involving patients in the planning and implementation of their care and 2) building trust between staff and patients.ConclusionsPaternalism clearly appeared to be the dominant perspective among the participants, but there was also awareness of patients’ right to autonomy. Despite a normative trend towards reciprocity in psychiatry throughout the Western world, identifying it proved difficult in this study. Tragedy and Redress in Western Literature: A Philosophical Perspective, by GaskinRichard. New York and London: Routledge, 2018. Pp. ix + 412.

This paper primarily aims at conceptualizing a new philosophical approach to literature education, one that we—in the vein of certain pedagogical trends—propose to call “thing-centered”. Point of departure is the ongoing confrontation with a two-sided educational problem: on the one hand, the confrontation with the steady decline of younger generations’ engagements with ‘classical’ literature; on the other hand, that with the unsatisfactory answers which either accept this development, in light of the world’s irresistible digitization, or try overcoming it (...) through a more student-centered, ‘biographical’ appropriation of literature. Beyond the more immediate didactical difficulties which this two-fold problem poses, we ask ourselves the question whether it is not time for a more fundamental renewal of our understanding of literature’s contemporary educational significance. In answering this question, for which we turn to such diverse authors as Rousseau, Deleuze and Calvino, it is argued that if education is to continue its care for both classical literacy and literary classics—and not so much against as in relation to ascending digital literacies—a more radically immanent, thing-centered perspective is likely to prove the most sustainable, in the sense of enabling truly new, ‘care-ful’ literary-educational practices to emerge. Constructive Deviant Behavior (CDB) raises an ethical dilemma that poses a significant challenge within the realm of business ethics. This ethical dilemma is the extent to which individuals should be allowed, or even encouraged, to challenge established norms in the name of organizational and stakeholder well-being before compromising ethical principles. Despite the growing body of research in this field, which highlights the emergence of a new domain, there remains a lack of a comprehensive framework to define and understand CDB within (...) organizational contexts. Therefore, the main objective of this study is to fill this gap by conducting a thorough analysis of the literature using the PRISMA methodology. In order to systematically review previous research, a sample of relevant articles was selected and analyzed in depth with the aim of defining a comprehensive framework clarifying the nature, forms, and dimensions of CDB. In addition, the relationships between CDB and its antecedents and outcomes were investigated from a business ethics perspective. Within this context, the study proposes a unified CDB framework while acknowledging and integrating the diverse perspectives that have emerged in past studies. Furthermore, this research reveals that individual and organizational characteristics are the predominant antecedents of CDB. Finally, as an emerging domain of increasing practical relevance within business ethics, this subject offers fertile avenues for future research, as delineated by the findings of this study. Introduction: Dignity is one of the most important values sensitively perceived by patients in nursing care. Older patients have been identified as having a high risk of losing their dignity in institutional care. To promote optimum nursing care, a deeper insight into the problem of older patients’ dignity is needed. Aim: The aim was to identify, analyse and synthesise the qualitative evidence of dignity views and factors affecting it from the nurses’ and older patients’ perspective in the context of (...) nursing care and to compare synthesised finding from the both perspective. Methods: A literature review of qualitative evidence was chosen as a study design. The ENTREQ statement was implemented to enhance transparency. The CASP – Qualitative checklist and the thematic synthesis for synthesised findings were used. The electronic databases Academic Search Complete, CINAHL, Health Source: Nursing/Academic Edition, MEDLINE and PROQUEST were used to gather information for qualitative studies. Results: A total of 306 papers were retrieved. Fourteen qualitative studies met the inclusion criteria and were included in the review after methodological quality assessment using CASP. Four main themes of dignity from nurses’ perspective were synthesised: seeing the patient as a unique person, communication and privacy, involving the patient, and working culture and environment. From the patients’ perspective, six main themes were synthesised: autonomy and control, privacy, relationships, care and comfort, communication and identity. The comparison shows that the key difference is that older patients highlighted the theme relationships and nurses underlined the theme working culture and environment. Conclusion: The model structures of the older patients’ dignity from both the nurses’ and patients’ perspectives support the idea of a multidimensional structure of human dignity. The resulting model might be used in a nursing self-reflection, in the management of the institutions providing all-day care for the older people and in the education and practice. (shrink)

Evil remains a primary source of inquiry in contemporary literature of French expression, even among its most secular writers. In considering French-speaking authors from France, Belgium, the United States, the Maghreb, and Sub-Saharan Africa, this collection delineates a rich international perspective on some of the most disturbing events of our time. Each essay testifies to the urgency expressed in works of fiction to give an account of human catastrophes, from the Shoah and the Rwandan genocide to the terrorist (...) attacks of September 11, and the ongoing oppression of women in Islamic nations. Themes underlying this volume include an investigation into the origins of evil, its representations in writing, and the ethical responsibilities of authors who write on human suffering. Contemporary fiction on evil confronts us with fundamental questions: Can evil be attributed to intentionality, is evil "subconscious," or is it the result of impersonal forces? Which styles of writing are ethically appropriate or effective for depicting evil? Can we speak of a veritable "poetics of evil" shared by contemporary authors? When does a literary text on evil become "evil"? In providing informed and nuanced answers to these important questions, the scholars engage in crucial theories of psychoanalysis, post-structuralism, and post-modernism, address a number of issues raised by trauma and genocide studies, and draw from critical frameworks in literary theory on testimony, the limits of representing the extreme, and "transgressive" writing. In the paper I point out to some problems of the traditional epistemology, i.e. epistemology oriented to search the foundations of cognitive evaluation. The epistemology of that kind which makes up the world outlook of science, I oppose the cultural studies reflection in a scientific knowledge practiced within one of the humanities domains of knowledge, for example, the theoretical history of science, which is limited in its cognitive tasks to the descriptive, reconstructive and explanatory study of science.

This book deals with themes concerning religious education and the spirituality of children. Throughout the seventeen chapters, the book stimulates a scholarly discussion about children and theology. The book makes clear that classical Christian theology can benefit from taking seriously children's voices and reflections about children. The volume demonstrates how nuanced and interdisciplinary reflections can be relevant for Christian and social practices of adults with children and how these practices can influence theology. This volume asks the following questions: - Why (...) is it important that we hear the 'voices of children' and what does this mean for how we treat children and relate to them? - What do the 'voices of children' express? How do children experience society and, in particular, religion, and what do they have to say about it? - What do the 'voices of children' mean for theology, ethics and religious education? In what way can our theology change when we see reality from the perspective of children? This book consists of five parts. In the first part the reader receives an overview of the current challenges concerning children and spirituality. The two chapters of this part offer an introduction to contemporary thinking about children, theology and spirituality and the place of 'children's voices' within this scope. The second part refers to biblical sources for contemporary theological reflection on children. The third part contains pedagogical and ethical reflections on children, as well as a view from practical theology about children in the world and the responsibility of churches. This third part looks mainly at children in relation to society, both in the past and in the present. The fourth part focuses on children living in the family, which is seen as a domestic church. The fifth part takes up the theme of children's spirituality again, showing children's own spiritual reflection and ways of theologizing with children in church and family contexts, by communication, literature and all forms of religious education and/or catechesis.
