Aristoteles' Ethik basiert auf der These, dass sich Güter als Strebensziele begreifen lassen. Die vorliegende Arbeit soll dabei helfen, diese These besser zu verstehen. Sie untersucht die Voraussetzungen und die Konsequenzen der teleologischen Konzeption des Guten. Der Gemeinplatz von der Aristotelischen "Strebensethik" wird neu beleuchtet. Als Ausgangspunkt dient eine genaue Lektüre der ersten Kapitel der Nikomachischen Ethik. Hier wird deutlich, dass Aristoteles einer teleologischen Güterkonzeption kritischer gegenübersteht, als üblicherweise angenommen wird. Die Gleichsetzung von Gütern und Zielen bietet zwar den Zugang (...) zur Bestimmung des Glücks; sie ist aber keine Definition des Guten. Aristoteles geht vielmehr davon aus, dass die als Ziele aufgefassten Güter in relevanter Hinsicht verschieden sind. Wie aber kann man dieser Verschiedenheit gerecht werden, ohne die Identifikation von Gütern und Zielen aufzugeben? Die Arbeit zeigt, dass sich wesentliche Bestandteile der Nikomachischen Ethik auf genau diese Frage beziehen lassen. Dazu gehören etwa das "ergon-Argument" und die Einführung des Tugendhaften als "Maßstab" des in Wahrheit Guten. Auf diese Weise wird eine Antwort auf einige Deutungsprobleme gegeben, die die Debatten um diese Schrift nachhaltig geprägt haben. Außerdem eröffnet sich eine andere Sicht auf das Projekt, das Aristoteles in seiner Ethik verfolgt. (shrink)

Der Protreptikos, die ›Ermunterung zur Philosophie‹, gehört zu den Schriften des Aristoteles, die uns nicht direkt überliefert sind. Das heißt: Alles, was wir über den Protreptikos wissen, stammt aus Hinweisen oder Zitaten in den Werken anderer Autoren. Diese Hinweise und Zitate ergeben zwar eine relativ umfangreiche Sammlung von Fragmenten.

David Furley has suggested that we think of Callicles’ immoralism as attacking a thick concept. I take up this suggestion and apply it to the argument of Plato’s Gorgias more generally. I show that the discussion between Socrates, Gorgias and Polus, which prepares the ground for Callicles, is precisely addressing the thickness of the concept of justice: it reveals that this concept is both descriptive and evaluative and that formulating a revisionist position about justice is therefore extremely difficult. Callicles’ strategy (...) is best read as a response to this difficulty, which sets the stage for Socrates’ revisionist account of justice. (shrink)

Übersetzt man eudaimonia mit ›Glück‹, dann ist zu berücksichtigen, dass der griechische Term weder das Zufallsglück meint noch Glück im Sinne einer Emotion. Der Ausdruck eudaimonia bezeichnet vielmehr ein insgesamt gelungenes und glückliches Leben – ein Leben, auf das die Charakterisierungen eu zên und eu prattein zutreffen. Die Frage ›Was ist das Glück?‹ entspricht also der sokratischen Frage ›Wie soll man leben?‹.

In den moralphilosophischen Debatten der Gegenwart besteht eine Tendenz, bei der Entwicklung neuer Ansätze auf Elemente antiker Theorien zurückzugreifen, wobei v. a. die Ethik des Aristoteles eine wichtige Rolle spielt. Am Anfang dieses Rückgriffs auf die Antike steht eine grundlegende Kritik an modernen Ethik-Konzeptionen. Um die Wiederbelebung der aristotelischen Ethik zu verstehen, ist es sinnvoll, sich zunächst diese Kritik vor Augen zu führen.

Das Korpus der aristotelischen Schriften enthält drei Ethiken: die Nikomachische Ethik in zehn Büchern, die Magna Moralia in zwei Büchern und die Eudemische Ethik in acht Büchern. Das Verhältnis zwischen diesen drei Abhandlungen ist schwierig zu bestimmen. Auf der einen Seite scheinen die Untersuchungen einander nicht zu ergänzen. Sie behandeln weder verschiedene Themen, noch vertreten sie stark voneinander abweichende Thesen, noch arbeiten sie mit völlig unterschiedlichen Methoden.

Ciceros De officiis, geschrieben 44 v. Chr., gehört zu den anerkannten Klassikern der Philosophie, ist aber in seinen philosophischen Dimensionen und Gehalten bisher nicht hinreichend für ein breiter interessiertes Fachpublikum im deutschsprachigen Raum erschlossen. Die Schrift behandelt zentrale Themen der antiken Moralphilosophie und ist eine der wichtigsten Quellen zur stoischen Ethik. Die Konzepte des Tugendhaften (honestum) und des Nützlichen (utile) werden sowohl begrifflich als auch kasuistisch untersucht und ihr Verhältnis genauer bestimmt. So entwickelt Cicero eine differenzierte Pflichtenethik, die im Rahmen (...) der berühmten Vier-Personen-Lehre auch ein Schlaglicht auf die philosophischen Wurzeln des Konzepts der Menschenwürde wirft. Das Werk ist eine Gelenkstelle in der Geschichte der Ethik und hat nicht zuletzt die Entwicklung der neuzeitlichen Deontologie (etwa bei Ch. Garve und I. Kant) entscheidend beeinflusst. Im Rahmen dieses Bandes erfährt De officiis zum ersten Mal eine philosophisch orientierte kooperative Kommentierung aus der Feder renommierter Fachleute, die das Werk sowohl für Studierende und Dozierende in Philosophie sowie Klassischer Philologie als auch für interessierte Laien zugänglich macht. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

Wie verhalten sich Freiheit und Staatlichkeit in Kants Rechtslehre? Und welche Bedeutung kommt hierbei seiner kritischen Moralphilosophie zu? Hirschs Untersuchung zeigt, dass bei Kant Recht und Staat notwendige Realisationsbedingungen individueller Autonomie sind. Erst als autonome und selbstzweckhafte Personen haben wir Freiheitsrechte, welche wir aber nur im Staat legitim behaupten können. Denn nur unter der Idee von Staatlichkeit als Vereinigung des gesetzgebenden Willens aller kann rechtliche Fremdverpflichtung als Selbstverpflichtung begriffen werden. Staatlichkeit dient damit der Verwirklichung individueller Autonomie und Freiheit. Hierin liegt (...) das Reformideal politischer Herrschaft. Doch Rechtsdurchsetzung gegen den Staat ist unmöglich, sodass aktiver Widerstand nie rechtens, aber mitunter entschuldbar ist. Damit gelingt es Hirsch erstmals, Kants Rechts- und politische Philosophie ausgehend vom kategorischen Imperativ als integralen Bestandteil seiner kritischen Moralphilosophie auszuweisen. Gleichzeitig lässt sich so erklären, wie Anerkennung individueller Freiheitsrechte, staatlicher Rechtszwang und unbedingte staatsbürgerliche Gehorsamspflicht als Ausdruck des politischen Liberalismus Kants miteinander vereinbar sind. Attention has a role in much of perception, thought, and action. On the erotetic theory, the functional role of attention is a matter of the relationship between questions and what counts as answers to those questions. Questions encode the completion conditions of tasks for cognitive control purposes, and degrees of attention are degrees of sensitivity to the occurrence of answers. Questions and answers are representational contents given precise characterizations using tools from formal semantics, though attention does not depend on language. (...) The erotetic theory proposes an integrated account of attention in cognitive control and of attentional focus in perception. The functional role of attentional focus on objects, properties, and locations has to do with picking out something that corresponds to what a task is ‘about’. The erotetic theory of attention opens new avenues in theorizing about the relationship between attention, representational content, phenomenal character, and practical reason. A novel representationalist account of salience is proposed. The theory also provides an account of distraction that suggests when distraction is a defect in practical reasoning. (shrink)

It is well known that Husserl considered phenomenology to be First Philosophy—the ultimate science. For Husserl, this means that phenomenology must clarify the ultimate phenomenological-epistemological principle that leads to ultimate elucidation. But what is this ultimate principle and what does ultimate elucidation mean? It is the aim of this paper to answer these questions. In section 2, we shall discuss what role Husserl’s principle of all principles can play in the quest for ultimate elucidation and what it means for a (...) principle to be ultimately elucidating and ultimately elucidated. We will see that the Husserlian thesis that originary presentive intuitions are an immediate and the ultimate source of justification qualifies as the ultimate epistemological principle. (shrink)

How can the friction between genesis and validity be understood? Is it possible to »dissolve« it? This paper argues that the genesis/validity-problem reflects the fundamental epistemological differences between History and Philosophy, and it takes Michel Foucault’s »Archeology« as a model case for this problem. Since Foucault’s »archaeological« methodology, i.e. his discourse analysis, is deeply affected by these tensions, I will show, firstly, that the epistemological model for Foucault’s anti-hermeneutical and genealogical approach was rooted not in philosophy, but in medicine, especially (...) in anatomy. Secondly, I will argue that the »paradoxical« position of discourse analysis, in Foucault’s eyes, is necessarily a political one – i.e. as a position within political struggles. (shrink)

This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. This is achieved by exemplifying how current debates can benefit from ideas, insights, and methods we find in the phenomenological tradition. (shrink)

In 2006, mountaineer David Sharp died on the slopes of Mount Everest. Sharp’s death led to public outrage after allegedly 40 climbers passed by the dying Sharp on their way to the peak, without stopping to help. But, since the slopes of Everest are a high-risk environment and rescuing Sharp would have entailed great risks for the rescuers, it is not clear whether the other mountaineers had a moral duty to rescue him. In a recent article, Patrick Findler introduces a (...) principle to analyse such cases which states that we have a duty to rescue under dangerous circumstances, if the involved risks are not higher than the risks we are already taking in the pursuit of our own, morally less worthy ends. However, Findler then rejects this principle as too demanding. In this paper I will defend the principle against its inventor and argue in favour of such a duty. And while it may be true that the other mountaineers were justified in passing Sharp for different reasons, the principle shows that not only climbers, but adventure-sport athletes in general and people who engage in high-risk endeavours, may have a duty to rescue that doesn’t apply to others. Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. While the former is economically, legally, and perhaps most importantly ethically problematic, there are no such troubles with the latter. (shrink)

Abstract Theories of descriptions tend to involve commitments about the ambiguity of descriptions. For example, sentences containing descriptions are widely taken to be ambiguous between de re , de dicto , and intermediate interpretations and are sometimes thought to be ambiguous between the former and directly referential interpretations. I provide arguments to suggest that none of these interpretations are due to ambiguities (or indexicality). On the other hand, I argue that descriptions are ambiguous between the above family of interpretations and (...) what may be called ‘institutional’ as well as generic interpretations. My arguments suggest that an adequate theory of descriptions may require considerable rethinking. Most contemporary theories of descriptions appear to be committed to one or more claims about the ambiguity of descriptions that I reject in this paper. I suggest that my observations provide a reason to renew efforts to develop a theory of descriptions within a representationalist theory of interpretation. This chapter examines the neo-republican thesis of the compatibility between freedom and the state under conditions of ‘equally shared control’. It first considers the neo-liberal conception of the relation between freedom and the state as well as the socialist-social-democratic criticism of the neo-liberal understanding of freedom. It then discusses the neo-republicanism of Philip Pettit and the ‘republican thesis’ that freedom and political order are not contradictory to each other. It also analyses Robert Nozick's libertarianism and Friedrich Hayek's liberalism, along with (...) their argument that all actions of a government should be in strict accordance with the rule of law. Furthermore, it looks at the political philosophy of neo-liberalism, the implications of nondomination and the ‘neo-republican thesis’ that even a state's power and interferences can be controlled by its citizens. The chapter concludes by rejecting the thesis that freedom and the state are compatible. (shrink)

Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects.
