Conçues pour des biens ayant une consistance matérielle, nombre d'infractions pénales ont été sollicitées ces dernières années pour s'appliquer à des biens immatériels tels qu'un numéro de carte bancaire, un projet de borne informatique, du temps de travail ou encore des données informatiques. Au-delà de la matière répressive, l'ambition de cet ouvrage est de se livrer à une étude plus générale de l'adaptation du droit au développement de l'immatériel pour déterminer jusqu'où l'on peut juridiquement aller dans sa prise en compte. (...) C'est un fait indéniable que l'immatériel prend une place de tout premier plan dans la société contemporaine. Le droit des siècles passés connaissait, certes, déjà l'incorporalité, mais nul doute que les potentialités actuelles ouvrent des perspectives nouvelles. L'ouvrage propose tout d'abord de préciser la notion d'immatériel en recourant à des approches non juridiques. Le point de vue du philosophe et celui du physicien peuvent fournir des clés pour percer un concept que le juriste pourra ensuite aborder de manière pragmatique. S'agissant de l'appréhension juridique de l'immatériel, deux mouvements peuvent être observés. D'une part, l'immatériel est un objet que le droit s'efforce d'intégrer ; d'autre part, il est un outil que le droit peut exploiter. Sur le premier point, il s'agit d'examiner comment le droit parvient à s'adapter à l'émergence de nouvelles formes d'objet et surtout d'identifier les limites qui ne pourront ou ne devront pas être dépassées. Même lorsque l'on s'intéresse à des matières qui ont été conçues pour régir l'immatériel, telle que la propriété intellectuelle, on observe en effet que tout objet ne peut être saisi et on devine alors que de telles limites doivent a fortiori exister lorsque l'on est en présence de branches du droit qui n'étaient originairement pas destinées à s'appliquer à de tels biens et qui ne peuvent y parvenir qu'au terme d'une adaptation. Sur le second aspect, il s'agit d'observer les perspectives qu'ouvre l'immatériel comme moyen d'accéder au droit et de mettre en relation les acteurs de la scène juridique. Là aussi, certains aspects ne sont pas totalement nouveaux et si la prolifération des contrats conclus par voie électronique ne constitue que le développement récent du phénomène ancien des contrats à distance, la dématérialisation des procédures et des échanges entre professionnels du droit va être relayée par un accès direct du justiciable aux services judiciaires qui est de nature à changer de manière significative le mode de relation au juge et à l'institution judiciaire. Dumézil’s trifunctional theory applied to the only grail plot in Chrétien de Troyes’ Conte du Graal proves to be neither faithful nor worthy of credit. Philological, historical, cultural, cognitive and narratological arguments raise critical objections and question its artificial character. In fact, the incidental episode of the grail functions as a narrative drawer in a plot belonging to the global tale ATU 910B (Good precepts) relating to the part of the work regarding Perceval.

Numerous studies suggest that both emotion knowledge and language abilities are powerfully related to young children’s theory of mind. Nonetheless, the magnitude and direction of the associations between language, emotion knowledge, and theory-of-mind performance in the first years of life are still debated. Hence, the aim of this study was to assess the direct effects of emotion knowledge and language on theory-of-mind scores in 2- and 3-year-old children. A sample of 139 children, aged between 24 and 47 months ( M (...) = 35.5 months; SD = 6.73), were directly administered measures of emotion knowledge, theory of mind, and language. We conducted structural equation modeling (SEM) to evaluate the effects of these variables within a single comprehensive framework, while also controlling for any effects of age and gender. The proposed structural equation model provided an excellent fit for the data, indicating that both children’s emotion knowledge, and their language ability had direct positive effects on theory of mind scores. In addition, age was found to wield statistically significant effects on all the variables under study, whereas gender was not significantly associated with any of them. These findings suggest the importance of fostering young children’s emotion knowledge and language ability with a view to enhancing their comprehension of mental states. (shrink)

In this paper, a model of norms as cognitive objects is applied to establish connections between social conventions and prescriptions. Relevant literature on this issue, especially found in AI and the social sciences, will be shown to suffer from a dychotomic view: a conventionalistic view proposed by rationality and AI scientists; and a prescriptive view proposed by some philosophers of law (Kelsen 1934/1979, Hart 1961, Ross, 1958).In the present work, the attempt is made to fill the gap between these views (...) by putting forward a hypothesis concerning the process from perceived behavioural regularities to normative assumptions. The emergence of norms will be here seen as intrinsically intertwined with the emergence of normative beliefs. Unlike that assumed by the conventionalistic sight, the process of emergence is seen as a non-continuous phenomenon. A given behavioural regularity will be argued to give rise to a normative belief if and as long as that regularity is believed to be prescribed within the community. Two corollaries of this hypothesis will be examined: (1) unlike that implied by the conventionalistic view, the spreading of norms is not only due to a passive behavioural social influence (imitation) but also to an active cognitive one (the spreading of normative wants and beliefs); (2) unlike that assumed by the prescriptive view, a norm is not necessarily explicitly and deliberately issued by some normative authority, but is grounded upon the norm-addressees' beliefs that they are generally prescribed to comply with it. What are the problems that teaching encounters today? In what way today is teaching spoken of? The words that speak of the school today, which words are they and where do they come from? What rationality more generally informs them? The Essay tries to answer these questions by employing a critical-theoretical perspective. Starting from the presupposition that teaching has principally to do with the knowledges deposited in the disciplinary contents, the first step, following Lyotard, considers the conditions of knowledge in (...) the more developed societies, examining in particular what knowledge is expected to be and who takes this decision. Then the Essay moves further critically examining the hegemonic advent of neo-liberalism and the paradigmatic horizon of connections and economical-political presuppositions that follows. The analysis continues by focusing on the words that characterize the Neo-Language that today insists on education and teaching, proposing the practice of a ‘foreignizing’ translation as a premise to rethink the emancipatory education. Using information on students’ past participation in economic experiments, we analyze whether behavior in public goods games is affected by experience and history. We find that: on average, the amount subjects contribute and expect others to contribute decreases with experience; at the individual level, the proportion of unconditional cooperators decreases with experience, while the proportion of selfish people increases. Finally, history influences behavior less than experience. Researchers are urged to control for subjects’ experience and history to improve the external validity (...) and replicability of results. This chapter delineates the theory of the black or white screen as a force of deterritorialization in minor, or modern political cinema. In the previous chapter I relied on the molar and the molecular for the description of deterritorializations in corporeal and cerebral modern cinema, but here I shift emphasis to the major and the minor. These latter concepts help us to better understand the connection between thought, body, and social milieu. Various impossibilities in the social field create conditions that (...) are enabling for minor filmmaking machines. In terms of abstract machining, a social impasse is not an obstacle or loss; instead, it produces continuous variations that either open relative alternative paths or offer radical lines of flight. I first present an overview of concepts that intersect with minor cinema. I then examine Deleuze's concept of modern political-or minor-cinema as a blended form of "minor(itarian) cinema," the resistant cinema of experimentation that under certain conditions embraces the cinema of minorities. In my discussion of the characteristics of minor cinema borrowed from Deleuze and Guattari's concept of minor literature, I "minorize" typical narrative questions by putting them to flight. In his essay, "One Manifesto Less" (1979), Deleuze defines "less" (in opposition to "more") as a quintessential principle for minor artworks. Following the method of "less," which operates by subtraction and rendition in a minor key, I explore the indefinite coordinates of minor cinema. Specifically, I probe the genetic and cerebral power of the black or white screen as an avatar of "less" in relation to parameters of minor literature and minor cinema such as the connection between the private and the political, collective value of enunciation, and deterritorialization of the major language. In this essay I engage the perspective of film phenomenology to analyze the black screen as a frame-breaking negative experience, based on an understanding of cinema as event. Relying on Vivian Sobchack’s phenomenological approach and taking inspiration from Cecil M. Hepworth’s How It Feels to Be Run Over, a case in point for a method predicated on the question of “how,” I place emphasis on the “film’s body” and consciousness which, through its own paralysis and impairment, affects the spectator’s lived-body. Following the terminology of sociologist Erving Goffman, I approach both a car accident at the turn of the twentieth century and 9/11 on the cusp of the new millennium as frame-breaking events that generate a profound negative experience. I then describe the black screen in 9/11 films as a frame-breaking occurrence that creates a negative event in its own right. The encounter with the breakage of the conventional mechanisms and modes of the “film’s body” as well as the forced sensory shift lead the spectator to a heightened awareness of his/her own body as a receiving medium that empathetically partakes in the experience of a negative event at the scene of cinema, both perceptually and reflexively. Ce texte fait d’abord l’histoire très méconnue de l’Institut d’Esthétique d’Étienne Souriau qui s’est prolongé dans les années soixante-dix avec les recherches poïétiques de René Passeron et aujourd’hui avec l’Institut ACTE dont l’acronyme illustre bien des préoccupations concernant à la fois l’art, la création, les sciences de l’art et l’esthétique. De fait, après Valéry, Souriau a fortement contribué à féconder la poïétique tout en restant fondamentalement du côté de l’ Aisthèsis. Aussi, Passeron, reprenant à son compte la terminologie de Souriau, (...) place t-il la notion d’ instauration (qui peut faire débat) au centre du dispositif poïétique. Par ailleurs Souriau procède aussi à une clarification des concepts aristotéliciens dont il montre qu’ils font système dans l’analyse de la création et de la réception des œuvres.
