This article offers a qualified defence of the view that there is a moral difference between telling lies to one's patients, and deceiving them without lying. However, I take issue with certain arguments offered by Jennifer Jackson in support of the same conclusion. In particular, I challenge her claim that to deny that there is such a moral difference makes sense only within a utilitarian framework, and I cast doubt on the aptness of some of her examples of non-lying deception. But I argue that lies have a greater tendency to damage trust than does non-lying deception, and suggest that since many doctors do believe there is a moral boundary between the two types of deception, encouraging them to violate that boundary may have adverse general effects on their moral sensibilities. Circulation of ideas among philosophers is the core of Philosophy itself. The lack of this circulation can lead to obscurantism and cultural provincialism. The latter, for instance, afflicted Italy during the first half of the 20th century because of the close-minded neo-idealism of Croce and the mutual indifference of science and philosophy. Antonio Gramsci tried to overcome the problem of provincialism. In this essay, I explain how he attempted to overcome it. Immanuel Kant is better known as a philosopher but in the pre-critical period he studied in a very deep way many aspects of the natural sciences and that’s why the new volume of the English edition of Kant’s works is devoted to the publications of Kant’s writings on natural science. This massive volume is edited by Erik Watkins and Kant’s writing are translated by Lewis White Back, Jeffrey B. Edwards, Olaf Reinhardt, Martin Schönfeld and Erik Watkins.

In this engaged and engaging survey Piers Benn examines the major currents of ethical theory, concentrating on sound reasoning about morality. Benn's account offers a qualified defence of Aristotelian virtue theory, while bringing out what is distinctive and valuable in a broad range of approaches, such as those of Kant and the Utilitarians. The essays in this volume investigate the question of where, and in what sense, the bounds of intelligible thought, knowledge, and speech are to be drawn. Is there a way in which we are limited in what we think, know, and say? The legacy of the Platonic dialogues may well lie, not in any classical idealist “doctrine of forms,” but in an inquisitive stance towards the puzzle behind any such doctrine—how thought can be about anything at all. This Platonic puzzle may, however, yield a different guise of idealism that is recognizably diagnostic: it aims to dispel our worry about thought’s objectivity as a confusion, engendered by a self-alienation of thought. These themes of diagnosis and idealism resurface in Wittgenstein, who in his (...) treatment of rules calls for an understanding of thought’s normativity from within. This is taken up by Cora Diamond, who urges philosophy to attend to thought’s real needs by exorcizing any desire for agreement with something other than itself. I argue that Wittgenstein and Diamond lead us back to Kant’s idealism, which identifies transcendental realism as the deep-seated prejudice at the root of the puzzle. (shrink)

In this paper, for the benefit of reflection processes in clinical and in local, regional, and national priority-setting, we aim to develop an ethical theoretical framework that includes both ethical principles and medium-range narratives. We present our suggestion in the particular case of having to choose between treatment interventions for attention deficit hyperactivity disorder (ADHD) and treatment interventions for other conditions or diseases, under circumstances of scarcity. In order to arrive at our model, we compare two distinct ethical approaches: a (...) generalist (principles) approach and a particularist (narratives) approach. Our focus is on Sweden, because in Sweden prioritization in healthcare is uniquely governmentally regulated by the “ethics platform.” We will present a (fictional) scenario to analyse the strengths and weaknesses of the generalist principled perspective of the ethics platform and the particularist perspective of narrative ethics. We will suggest an alternative (moderately particularist) approach to prioritization, which we dub a “principles plus medium-range narratives” approach. Notwithstanding the undeniably central role of principles in distributive justice, we claim that medium-range narratives concerning individuals or groups who stand to benefit or lose from ADHD prioritization practices should also be read or listened to and taken into account at all levels of priority-setting. These narratives are expected to ethically optimize clinical priority-setting, as well as that undertaken at local, regional, and national levels. (shrink)

Introduction Two ethical challenges of nursing home nurses during the COVID-19 pandemic in Sweden are discussed in this paper. Background Historically, the nurse’s primary concern is for the person who is ill, which is the core of nurses’ moral responsibility and identity. In Sweden, person-centered care is generally deemed important in nursing older nursing home residents. Objective To chart moral responsibilities of nursing home nurses in two cases involving older residents during the COVID-19 pandemic in Sweden. Methods We used Margaret (...) Urban Walker’s framework for moral responsibilities and the International Council of Nurses (ICN) code of ethics for nurses (2021) for our normative analysis. Ethical considerations Written and verbal consent was obtained before the interviews, and information was given that participation was entirely voluntary and possible to cancel at any time before the work was published. The Swedish Ethical Review Agency gave an advisory opinion stating that there were no ethical objections to this research project (Dnr. 2020-05649). Findings Case #1: a palliative older nursing home resident who was coercively tested for COVID-19, and case #2: a COVID-19–infected resident with dementia who was isolated using sedation. The decision that was finally made in the respective case was analyzed in the light of either consequentialist/utilitarian or non-consequentialist/deontological reasons. Discussion Empowerment of nurses as moral agents is required for the application of practical wisdom in the balancing of different care relationships (responsibilities), moral identities (professional virtues), and competing moral values. This requires resources and opens possibilities for profound ethical reflection in nursing education and at work. Conclusion During the COVID-19 pandemic, the moral and professional responsibility of nursing home nurses to deliver person-centered care was sometimes problematically abandoned in favor of a more utilitarian manner of ethical decision-making. Kant scholarship often refers to transcendental idealism as a ‘theory.’ Kant’s project, however, is not easily reconciled with that term in its current use. This paper contends that his critique and idealism should be seen as a remedial response against our natural albeit confused prejudice of transcendental realism. Kant’s idealism articulates a ‘metametaphysical’ ethos that is supposed to provide a new grounding of metaphysics by proceeding ‘from the human standpoint:’ it aims to dispel the temptation of transcendental realism in favor (...) of a resolute inhabitation of, and contentment with, our own humanity. This project comes under pressure in post-Kantianism: Fichte is among the first to voice the worry that Kant’s critique is well-intentioned, but not well-executed. His concern is that, while it ‘bring[s] man into harmony with himself,’ this mere contentment with our own humanity will not suffice to achieve the scientificity that, by Kant’s own lights, is the mark of any promising metaphysics. Fichte’s charge is that Kant’s idealism, in its very confinement to the brute facts of the human condition, surrenders itself to unacceptable contingency or ‘facticity.’ The paper explores Kant’s idealist project of grounding metaphysics, Fichte’s facticity charge against it, and whether Kantian idealism can withstand it. Ernst Cassirer’s epistemological trilogy – Substanzbegriff und Funktionsbegriff (1910), Zur Einsteinschen Relativitätstheorie (1921) and Determinismus und Indeterminismus (1937) – is well known to Western scholars, some of whom recently devoted a number of in-depth and interesting studies to Cassirer’s epistemology. Nonetheless, they overlooked aspects of Cassirer’s concept of idealisation and his model of science as found in his last epistemological work: Determinismus und Indeterminismus. In this essay I will consider these two almost disregarded aspects of Cassirer’s epistemology in order to (...) provide a better understanding of his idea of science. (shrink)

This contribution proposes to reflect on a different way of considering the link be-tween temporality and nature, between aiôn and physis, in dialogue with the words and works of the Italian sculptor Giuseppe Penone. The basic idea is the following: we will not be able to essentially determine our cognitive and experien-tial relationship with nature, until we are able to know, experience and represent the time inscribed in being itself. The philosophical tradition has developed its conception of temporality mainly along (...) two lines: a “cosmic” line, of a physical, objective temporality, and a “phenomenological” one, of a temporality as an in-ternal articulation of human consciousness. Through the archaeological and conceptual excavation carried out by Penone, we will ask ourselves what it does mean to take care of the “subjective time of things”. (shrink)

Engraved portable objects from Upper Palaeolithic and earlier sites are argued to be cognitive tools designed to store information for the purposes of calculation, record-keeping, or communication. This paper reviews the surprisingly long intellectual history of comparisons between these ancient objects and message sticks: marked graphic devices traditionally used for long-distance communication in Indigenous Australia. I argue that, while such comparisons have often been misguided, more cautious applications of ethnographic analogy may yield useful insights. A systematic analysis of historical observations (...) together with more recent fieldwork, indicate that Australian message sticks are primarily tools of social cognition, as opposed to cognition tout court, and rely on orality and other context to become meaningful. Further, the practice of message stick communication may help clarify ongoing problems in the interpretation of Upper Palaeolithic objects including their possible role in aggregation activities, the distinction between decoration and notation, and the interplay between graphic sequences and speech. In these brief remarks I propose a reading of the “Fragment on Machines” in Marx's Grundrisse. This reading recognizes in the “Fragment” the central problematic of the Grundrisse's fundamental analyses of the relation between objectified labor and living labor, the meaning of this relationship within a comprehensive interpretation of the theory and, finally, the meaning of the contradiction within the relation itself which is essential for the comprehension and critique of the entire capitalist mode of production. Here this “Fragment” will (...) be analyzed from the viewpoint of the criticism of fetishism, thus indicating some of the Fragment's ambiguous elements. (shrink)

This paper attempts to clarify what is, and is not, meant by claiming that special moral considerations apply to sexual behaviour that cannot apply to other areas of life. It then poses the problem by reference to virtue ethics, asking whether there are any virtues or vices specific to sex, which go beyond general considerations like justice and benevolence. This leads to a mostly sympathetic treatment of Scruton’s Aristotelian derivation of sexual morality, which stresses how some behaviour and fantasies are (...) debarred by a stable disposition to seek erotic flourishing. However, doubts are raised about some of the supposed implications of this account, and it is suggested that a better way to understand the moral distinctness of sex is to focus on the goods, rather than the evils, that arise uniquely in the erotic sphere. Mill argues that, apart from the principle of utility, his utilitarianism is incompatible with absolutes. Yet in On Liberty he introduces an exceptionless anti-paternalism principle—his liberty principle. In this paper I address ‘the absolutism problem,’ that is, whether Mill's utilitarianism can accommodate an exceptionless principle. Mill's absolute claim is not a mere bit of rhetoric. But the four main solutions to the absolutism problem are also not supported by the relevant texts. I defend a fifth solution—the competence view—that turns on (...) his attention to decision-making structures and, in particular, on the role of expertise considerations in his account. (shrink)

William James’s radical empiricism and pragmatism constitutes a philosophy that can reconcile the split between intrinsic value theorists, who stress the development and relevance of theoretical axiology, and pragmatists who have favored a more direct emphasis on environmental policy and application. By distinguishing James’s emphasis on direct personal experience from John Dewey’s more socialized approach, James’s distinctive emphasis on the transformative possibilities of pure experience and his links to romantic sensibility enable us to articulate and validate the noninstrumental aspects of (...) experienced environmental values that anti-pragmatists habitually regard pragmatism as unable to speak for. Using James’s framework to explicate and support Anthony Weston’s radically noninstrumental “immediate values” better expresses the felt noninstrumental worth of nature than intrinsic value theory can. Nonetheless, a rapprochement between the two sides is possible: although James’s pragmatic naturalism is the framework that can best capture nature’s experienced noninstrumental worth and link it to wider human values, intrinsic value theory has real practical application in the realm of law, and pragmatists can support it in that domain, thus upholding the primary emphasis on practicality and policy that is usually seen as pragmatism’s main strength.
