A central concept in Dutch health law is the care of a good caregiver. We find this standard in various statutes and in legal doctrine. This concept is, however, vague and open and must be made more concrete in professional practice, in moral theory, and in law. In this article, we explore the implications of this complex standard and analyze what moral philosophy and jurisprudence can contribute to its clarification and implementation in professional practice and law. This article presents the history of the medieval Latin translations of Aristotle’s Nicomachean Ethics. It features the names of some key figures of the period like Burgundio of Pisa, Robert Grosseteste, and William of Moerbeke. The main focus lies on the question whether Robert Grosseteste had access to a complete copy of the earlier translation by Burgundio of Pisa, or only to the fragmentary version that has come down to us. To reach an answer, the Latin versions and their Greek (...) models are studied as “fluid texts”, which indicates that all individual witnesses of the text and of its translations contain readings and variants that differentiate them from each other and from the translator’s ultimate intentions. In their turn, the fluid elements cause changes to persist throughout the transmission process and continue to exert mutual influence. A detailed, though necessarily largely incomplete study of some of these aspects leads to unnoticed evidence and to an uncertain but optimistic conclusion. (shrink)

Stiegler understands the Anthropocene as the age in which planetary enframing engenders an avalanche of entropization, putting humanity’s survival at risk. To avoid catastrophe, the so-called technosphere should be transformed from an entropic-destructive into a negentropic-constructive assemblage, ushering in the Neganthropocene. Stiegler’s focus is on the noetic dimension, in particular as constituted and conditioned overwhelmingly today by the digital pharmakon. In this article I want to make a case for the importance of an entirely other noetic pharmakon not addressed by (...) Stiegler: the nontechnical pharmakon of psychedelics, which allows for the expansion of humanity’s noetic frontier beyond the digital, providing access to dimensions of experience—and possibly also of reality—that may support the emerging neganthropos to awaken on a postanthropocentric planet in which it is enabled to commune in a noosphere made up by many other, nonhuman intelligences, which may prove essential for the neganthropic transformation to succeed. Doping scandals can reveal unresolved tensions between the meritocratic values of equal opportunity + reward for effort and the “talentocratic” love of hereditary privilege. Whence this special reverence for talent? We analyze the following arguments: (1) talent is a unique indicator of greater potential, whereas doping enables only temporary boosts (the fluke critique); (2) developing a talent is an authentic endeavor of “becoming who you are,” whereas reforming the fundamentals of your birth suit via artifice is an act of alienation (...) (the phony critique); (3) your (lack of) talent informs you of your proper place and purpose in life, whereas doping frustrates such an amor fati self-understanding (the fateless critique). We conclude that these arguments fail to justify a categorical preference for natural talent over integrated artifice. Instead, they illustrate the extent to which unsavory beliefs about “nature’s aristocracy” may still be at play in the moral theatre of sports. (shrink)

In the past two decades, individual explanations of scientific misconduct have increasingly given way to systemic explanations. Where did this interest in systemic factors come from? Given that research ethicists often present their interventions as responses to scientific misconduct, this article tests the hypothesis that these systemic explanations were triggered by high-visibility cases of scientific norm violation. It does so by examining why Dutch scientists in 2011 explained Diederik Stapel’s grand-scale data fabrication largely in systemic terms, whereas only fifteen years (...) earlier, in the René Diekstra affair, such explanations had been close to absent. Drawing on a wealth of historical sources, the article suggests that cases like Stapel’s as such do not explain why early 21st-century commentators exchanged individual explanations for systemic ones. Only against the background of an existing discourse of criticism of the science system, developed in the 1990s and 2000s in response to rapidly increasing competition for research funding, could the Stapel affair achieve notoriety as an example of how systemic factors provoke bad conduct. Starting from a perspective of democratic politics, this essay argues that the problem lies not in any “unjustified” politicization of risk controversies; quite to the contrary, it lies in their depoliticization or their capture in a postpolitical consensus. To this end, the prevailing storylines in public discourse on risk controversies are shown to be based on invalid assumptions regarding nature and science and on exclusionary mechanisms. In response, the risk conflicts perspective is put forward as an analytical framework, which allows (...) us to evaluate mediated public discourse on the extent to which democratic debate and citizenship are facilitated. For the fields of science and environment communication, this entails a shift in emphasis from a focus on the epistemic level to the level of the political. We conclude by discussing the potential transformative impacts of this perspective for academic research, public discourse, as well as the directly involved social actors, in relation to the controversies in question. Aristotle's philosophically most explicit and sophisticated account of the concept of a (primary-)universal proof is found, not in "Analytica Posteriora" 1.4, where he introduces the notion, but in 1.5. In 1.4 Aristotle merely says that a universal proof must be of something arbitrary as well as of something primary and seems to explain primacy in extensional terms, as concerning the largest possible domain. In 1.5 Aristotle improves upon this account after considering three ways in which we may delude ourselves into (...) thinking we have a primary-universal proof. These three sources of delusion are shown to concern situations in which our arguments do establish the desired conclusion for the largest possible domain, but still fail to be real primary-universal proofs. Presupposing the concept of what may be called an immediate proof, in which something is proved of an arbitrary individual, Aristotle in response now demands that a proof be immediate of the primary thing itself and goes on to sketch a framework in which an intensional criterion for primacy can be formulated. For the most part this article is a comprehensive and detailed commentary on Aristotle's very concise exposition in 1.5. One important result is that the famous passage 74a17-25 referring to two ways of proving the alternation of proportions cannot be used as evidence for the development of pre-Euclidean mathematics. In this article, I discuss manuscript material written by Petrus van Musschenbroek (1692–1761) related to his first experiments with the Leiden jar. Despite the importance of the discovery of the Leiden jar for the history of electricity and the questions that still surround its discovery, a detailed treatment of this manuscript material is lacking in the literature. The main aim of this paper is to provide an outline of the manuscript material and to contextualize van Musschenbroek’s first experiments with the (...) Leiden jar. I show how the experiment fits within his research program on electricity and I discuss van Musschenbroek’s initial reactions to and analysis of the phenomenon. Before doing so, I first provide a short overview of the treatment of the early history of the Leiden jar in the secondary literature. After that, I discuss van Musschenbroek’s treatment of the topic of electricity in the textbooks he published in the years before the discovery of the device. Van Musschenbroek repeatedly emphasized that not enough experimental results were available for an informed theoretical treatment of the phenomenon of electricity to be possible. I then turn to the manuscript material, where I give a general description of the contents of the manuscript and van Musschenbroek’s experimental practice. The manuscript material further confirms recent work on the Leiden jar by Silva and Heering, and provides new insights into the way van Musschenbroek himself reacted to the discovery. (shrink)

In this article, we discuss the development of the concept of a ‘law’ (of nature) in the work of the Dutch natural philosopher and experimenter Petrus van Musschenbroek (1692–1761). Since Van Musschenbroek is commonly described as one of the first ‘Newtonians’ on the Continent in the secondary literature, we focus more specifically on its relation to Newton’s views on this issue. Although he was certainly indebted to Newton for his thinking on laws (of nature), Van Musschenbroek’s views can be seen (...) to diverge from Newton’s on crucial points. We show, moreover, how his thinking on laws of nature was shaped by both international and local factors. We start with a brief discussion of Newton’s concept of ‘laws of nature’ in order to set the stage for Van Musschenbroek’s. We then document the development of Van Musschenbroek’s views on laws of nature in chronological order. We demonstrate how his thinking on laws of nature was tied to institutional, theological and scientific factors. We conclude by pointing to the broader significance of this case study for our understanding of the development of the concept ‘law of nature’ during the eighteenth century. (shrink)

We generalize the modal interpretation of quantum mechanics so that it may be applied to composite systems represented by arbitrary density operators. We discuss the interpretation these density operators receive and relate this to the discussion about the interpretation of proper and improper mixtures in the standard interpretation.

The aim of this paper is to evaluate etiological accounts of functions for the domain of technical artefacts. Etiological theories ascribe functions to items on the basis of the causal histories of those items; they apply relatively straightforwardly to the biological domain, in which neo-Darwinian evolutionary theory provides a well-developed and generally accepted background for describing the causal histories of biological items. Yet there is no well-developed and generally accepted theory for describing the causal history of artefacts, so the application (...) of etiological theories to the technical domain is hardly straightforward. In this paper we consider the transposition of etiological theories in general from the biological to the technical domain. We argue that a number of etiological theories that appear defensible for biology become untenable for technology. One of the older questions in the debate about Corporate Social Responsibility (CSR) is whether it is worthwhile for organizations to pay attention to societal demands. This debate was emotionally, normatively, and ideologically loaded. Up to the present, this question has been an important trigger for empirical research in CSR. However, the answer to the question has apparently not been found yet, at least that is what many researchers state. This apparent ambivalence in CSR consequences invites a literature study that (...) can clarify the debate and allow for the drawing of conclusions. The results of the literature study performed here reveal that there is indeed clear empirical evidence for a positive correlation between corporate social and financial performance. Voices that state the opposite refer to out-dated material. Since the beginnings of the CSR debate, societies have changed. We can therefore clearly state that, for the present Western society, “Good Ethics is Good Business.”. (shrink)

This article has two general aims. It first of all critically reconsiders the empirical turn’s dismissal of transcendentalism in the philosophy of technology, in particular through the work of Ihde and Verbeek, and defends the continuing relevance of the notion of the transcencental in thinking about technology today, illustrating this mainly through a reading of Stiegler’s understanding of the human condition as a technical condition and his view of human (noetic) evolution as proceeding from a process of technical exteriorization. The (...) crucial issue that is missed by postphenomenology and the empirical turn is that technology itself in its empiricity occupies the (periodically changing) place of the transcendental. It thus fails to consider the transcendental operativity of technical artifacts within its own empiricist stance. Secondly, it argues for the continuing importance and usefulness of the idea of Technology with a capital T, equally discarded by the representatives of the empirical turn, in particular against the emerging backdrop of the Anthropocene as the age of decisive anthropogenic forcing of the planet and the growing dominance of what has recently been called the technosphere in Earth system science. With Stiegler I show that a proper, inherent dynamic of technology must be acknowledged historically, anthropologically, techno-evolutionarily as well as (techno)phenomenologically. I conclude by demonstrating that our time of planetary crisis summons us to redirect our attention to technology from the empirical to the transcendental, and from the micro-level to the macro-level again. he 4th Industrial Revolution introduced a highly automated and connected business environment. Nevertheless, many organizations are reeling in the wake of the speed and severity of the COVID-19 pandemic's impact, catching many unawares, and placing their sustainability in question. Given the connectedness promulgated by the 4th Industrial Revolution, one might expect organizational resilience to be a given - only time will tell whether this was the case. This article considers the concept of cybernetics as contributing to systems-thinking, which may enable (...) resilience strategies to come to fruition. Cybernetics is a goal-driven approach in which constant feedback is analyzed and applied in correcting the current course. We reflect on the roots and principles of the cybernetic concept, developing it into a management cybernetics concept. We take a non-technological approach in acknowledging organizations as systems. Management theories such as stakeholder and stewardship theories are systems components that can play a crucial role in effectively communicating management information within the cybernetic loop. We conclude that an integrative and cooperative relationship with legitimate stakeholders can play an essential role in an organization's preparedness. (shrink)

Since Aristotle and the Stoa, there has been a clash, worsened by modern predicate logic, between logically defined operator meanings and natural intuitions. Pragmatics has tried to neutralize the clash by an appeal to the Gricean conversational maxims. The present study argues that the pragmatic attempt has been unsuccessful. The “softness” of the Gricean explanation fails to do justice to the robustness of the intuitions concerned, leaving the relation between the principles evoked and the observed facts opaque. Moreover, there are (...) cases where the Gricean maxims fail to apply. A more adequate solution consists in the devising of a sound natural logic, part of the innate cognitive equipment of mankind. This account has proved successful in conjunction with a postulated cognitive mechanism in virtue of which the universe of discourse is stepwise and recursively restricted, so that the negation selects different complements according to the degree of restrictedness of Un. This mechanism explains not only the discrepancies between natural logical intuitions and known logical systems; it also accounts for certain systematic lexicalization gaps in the languages of the world. Finally, it is shown how stepwise restriction of Un produces the ontogenesis of natural predicate logic, while at the same time resolving the intuitive clashes with established logical systems that the Gricean maxims sought to explain. Dr Seuren's study deals with the problem of presenting an adequate model of grammatical description. The model he proposes conforms in its main outlines to the transformational generative grammar established by Chomsky, but differs in important respects. These mainly affect that part of Chomsky's syntactic component known as the 'base', which generates basic or 'deep' structures. In the model of the base proposed here two main constituents are distinguished for every deep structure representation of a sentence, vis-a-vis the operators and (...) the nucleus. The deep structure of a sentence is thus seen to be very similar to the logical structure of a proposition. The arguments given in support of this analysis are based on mainly on considerations of simplicity and semantic adequacy. (shrink)

This paper investigates the impact of negative screening on the investment universe as well as on financial performance. We come up with a novel identification process and as such depart from mainstream socially responsible investing literature by concentrating on individual firms’ conduct and by studying a much wider range of issues. Firstly, we study the size and financial performance of fourteen potentially controversial issues: abortion, adult entertainment, alcohol, animal testing, contraceptives, controversial weapons, fur, gambling, genetic engineering, meat, nuclear power, pork, (...) stem cells, and tobacco. We investigate an international sample of more than 1,600 stocks for more than twenty years. We then analyze the impact of applying negative screens to a market portfolio. Our findings suggest that the choice for negative screening strategies does matter for the size of the investment universe as well as for risk-adjusted return performance. Investing in controversial stocks in many cases results in additional risk-adjusted returns, whereas excluding them may reduce financial performance. These findings suggest that there are opportunity costs to negative screening. (shrink)

‘The art of living with ICTs ’ today not only means finding new ways to cope, interact and create new lifestyles on the basis of the new digital technologies individually, as ‘consumer-citizens’. It also means inventing new modes of living, producing and, not in the least place, struggling collectively, as workers and producers. As the so-called digital revolution unfolds in the context of a neoliberal cognitive and consumerist capitalism, its ‘innovations’ are predominantly employed to modulate and control both production processes (...) and consumer behavior in view of the overall goal of extracting surplus value. Today, the digital networks overwhelmingly destroy social autonomy, instead engendering increasing social heteronomy and proletarianization. Yet it is these very networks themselves, as technical pharmaka in the sense of French ‘technophilosopher’ Bernard Stiegler, that can be employed as no other to struggle against this tendency. This paper briefly explores this possibility by reflecting upon current diagnoses of our ‘technological situation’ by some exemplary post-operaist Marxists from a Stieglerian, pharmacological perspective. In a footnote of his La Communaute Desoeuvree, Jean Luc Nancy writes that it is necessary to investigate more closely the entry of myth into modern political thinking and more generally the relationship between myth and ideology (Nancy 1990, 116n). In this paper, I will explore the way in which we should understand this strange relation between myth and ideology. To do so, I will first briefly outline Nancy's now already known thinking of myth. Teaching is an important aspect of scientific practice. However, it has only recently become the subject of detailed historical and philosophical analyses. In this paper, I argue that Joseph Rouse’s philosophy of scientific practice has important implications for the study of scientific education. Rouse’s dynamic conception of scientific knowledge entails that education should occupy a central place in our analyses of scientific practices, as it is crucial in guaranteeing their temporal extension and sustenance. However, Rouse’s reconceptualization of scientific knowledge also (...) has implications for our understanding of scientific education itself. I will work out these implications, focussing on Rouse’s non-subject-centered account of scientific practices. More generally, I show how Rouse’s philosophy of science entails that the study of scientific education should take the form of an integrated history and philosophy of scientific education. (shrink)

In this chapter we consider computer tools for architectural design based on shape grammar design systems, and evaluate the advantages and disadvantage of handing over these tools to inhabitants for the design of their apartments. This evaluation is qualitative by considering the values of inhabitants, architects, and cities that are affected by this hand-over. Shape grammar design systems when applied to architecture enable computer tools to generate new designs and adjustments of existing designs of apartments on the basis of design (...) rules. First, focussing on individual housing, it is argued in this chapter that the use of shape grammar design systems by inhabitants for designing their apartment realises the values of customisation and inhabitant autonomy without compromising design quality and structural safety. Second, focussing on cities, it is argued that a wide-spread use of these grammar design systems creates for cities a bottom-up inhabitant-led renewal of neighbourhoods and urban structures that maintains the social fabric in neighbourhoods and the architectural identity of cities. Values that are less realised by the hand-over are financial feasibility and ecological sustainability. Third, shifting to philosophy of technology, we present shape grammar design systems as a technology for design for values in architecture that allows for flexibility in the values designed for over the longer time periods characteristic to architecture. These systems are a technology that enables the incorporation of values of inhabitants, architects, and cities by the designs of apartments, and they are a technology that enables inhabitants to adjust their apartments through time to their developing needs and wishes. In this reply I try to show that, contrary to Milberry’s apparent assertion, the general intellect of the multitude does not have the explanatory robustness she accredits to it. Digital network technologies are currently overwhelmingly effective in proletarianizing and disempowering the cognitariat and only an active technopolitics of deproletarianization could reverse this hegemonic situation. In my response to Verbeek, I attempt to correct his misinterpretation of the Stieglerian approach as being dialectical in nature and show that, far from reinstating the (...) humanist dichotomy between human beings and technologies, my analysis assumes their original, albeit fundamentally ambiguous and even ‘uncanny’ [unheimlich] interconnection. I conclude with pointing out some implications of this view for a ‘really realistic’ political theory of technology. (shrink)

SUMMARYThe present study paints the intellectual environment in which Ferdinand de Saussure developed his ideas about language and linguistics during the fin de siècle. It sketches his dissatisfaction with that environment to the extent that it touched on linguistics, and shows the new course he was trying to steer on the basis of ideas that seemed to open new and exciting perspectives, even though they were still vaguely defined. As Saussure himself was extremely reticent about his sources and intellectual pedigree, (...) his stance in the lively European cultural context in which he lived can only be established through textual critique and conjecture. On this basis, it is concluded that Saussure, though relatively uninformed about its historical roots, essentially aimed at integrating the rationalist tradition current in the sciences in his day into a new, ‘scientific’ general theory of language. In this, he was heavily indebted to a few predecessors, such as the French philosopher-psychologist Victor Egger, and particularly to the French psychologist, historian and philosopher Hippolyte Taine, who was a major cultural influence in nineteenth-century France, though now largely forgotten. The present study thus supports Hans Aarsleff's analysis, where, for the first time, Taine's influence is emphasised, and rejects John Joseph's contention that Taine had no influence and that, instead, Saussure was influenced mainly by the romanticist Adolphe Pictet. Saussure abhorred Pictet's method of etymologising, which predated the Young Grammarian school, central to Saussure's linguistic education. The issue has implications for the positioning of Saussure in the history of linguistics. Is he part of the non-analytical, romanticist and experience-based European strand of thought that is found in art and postmodernist philosophy and is sometimes called structuralism, or is he a representative of the short-lived European branch of specifically linguistic structuralism, which was rationalist in outlook, more science-oriented and more formalist, but lost out to American structuralism? The latter seems to be the case, though phenomenology, postmodernism and art have lately claimed Saussure as an icon. (shrink)

Questions about the naturalness or unnaturalness of homosexuality are as old as the hills, and the answers have often been used to condemn homosexuals, their behaviors, and their relationships. In the past two centuries, a number of sciences have involved themselves in this debate, introducing new vocabularies, theories, arguments, and data, many of which have gradually helped tip the balance toward tolerance and even acceptance. In this book, philosophers Pieter R. Adriaens and Andreas De Block explore the history and (...) philosophy of the gay sciences, revealing how individual and societal values have colored how we think about homosexuality. The authors unpack the entanglement of facts and values in studies of male homosexuality across the natural and human sciences and consider the extent to which science has mitigated or reinforced homonegative mores. The focus of the book is on homosexuality's assumed naturalness. Geneticists rephrased naturalness as innateness, claiming that homosexuality is innate-colloquially, that homosexuals are born gay. Zoologists thought it a natural affair, documenting its existence in myriad animal species, from maybugs to men. Evolutionists presented homosexuality as the product of natural selection and speculated about its adaptive value. Finally, psychiatrists, who had initially pathologized homosexuality, eventually appealed to its naturalness or innateness to normalize it. Discussing findings from an array of sciences--comparative zoology, psychiatry, anthropology, evolutionary biology, social psychology, developmental biology, and machine learning--this book is essential reading for anyone interested in what science has to say about homosexuality.
