Building legal domain ontologies is a prominent challenge in the ontology engineering community. The ontology builders confront issues such as the complexity of the legal domain, the difficulty of applying existing ontology engineering approaches, and the intention of developing legal models faithful to realities. In this paper, we discuss constructing a well-founded legal domain ontology, named CargO-S, for the traceability of goods in logistic sea corridors. For building CargO-S, a pattern-oriented approach is applied, supported by ontology-driven conceptual modeling, ontology layering, (...) and ontology reuse processes. CargO-S is grounded in the unified foundational ontology UFO by using the ontology-driven conceptual modeling language OntoUML. Besides, ontology layering is proposed to simplify the development process by dividing CargO-S into three layers located at different granularity levels: upper, core, and domain. For building the upper and core layers, conceptual ontology patterns are reused from the foundational ontology UFO and the legal core ontology UFO-L. These patterns are applied, either by extension or analogy with legal rules, for building the domain layer. CargO-S is then validated by implementing the ontology as OWL and SWRL rules. Finally, the performance and the semantic accuracy of CargO-S are evaluated using a dual evaluation approach. (shrink)

The latter half of nineteenth-century England was rife with the evolution question. As English imperialism also reached its pinnacle during this time, racial gradations and superiority of the white race in the newly formed human chain loomed large culturally. In 1849, Thomas Carlyle anonymously published his anti-emancipationist perspective in “The Occasional Discourse on the Negro Question,” followed by John Stuart Mill’s divergent response to him in 1850 titled, “The Negro Question.” In 1878, The Westminster Review also published a woman’s perspective, (...) “The Importance of Race and Its Bearing on the Negro Question” by Alice Bodington, which resembled the Carlyle essay in various ways. Although Mill’s essay was a direct attack on Carlyle’s explosive article and is overtly against Carlyle and Bodington’s ideas, this paper argues that an imperialist agenda underlies Mill’s views and in fact poses the same theories of Carlyle and Bodington. The paper first proceeds to interrogate Mill’s hegemonic subtext through a comparison of these three essays by situating them within the scientific discourse of the era, arguing that science, especially phrenology and evolution theories, didn’t exist in a vacuum, but was used to perpetrate the normative racial ideologies of the period. The paper also uses Edward Said’s theory of ‘Othering the Orient’ in Culture and Imperialism to show that while Mill seemingly diverges from Carlyle’s stance, this ‘othering’ is in fact present in all three writers’ works. The present paper deals with the idea of understanding Vedic ethics as a code of righteous living, in the light of Mīmāṁsā philosophy. The paper also intends to reflect upon the possibility of such methods as a means of attaining liberation. In other words, the Vedas provide us with prescriptive codes of right and wrong actions. It commands us about duties and non-duties, through the performance of rituals, in order to lead a good life. We know that human endeavours are (...) primarily based on attaining the desired, and to prevent the unwanted ends. Hence, the entire effort of human actions lies in the fact that we want to attain the cessation of sufferings. This paves the way for studies in Soteriology, and the question arises that, could the Vedas be considered as a literature on Soteriology. The paper consists of a number of sections. The initial ones involve the linguistic analysis of the Vedic statements based on Sanskrit grammar and semantics. These are aimed at depicting the manner in which Vedic sentences act as prescriptive ethical codes. The latter ones deal with the questions raised by the opposing schools, namely Sāṁkhya-Yoga, against the idea of considering Vedas as a supreme sanction of means, leading beings to their salvation from empirical sufferings, and their plausible responses. The concern of this paper is to critique the political conception of nationalism as a theory of the nation-state. The basic point of the critique is that when the interests of the nation and the principles of the state coincide there emerges a fierce sense of national identity which endangers moral indifference to outsiders, the people within and outside the national boundary, without remorse. Here the attempt to uphold national identity is something more than nationhood. Besides involving territorial identity, common (...) language, custom and culture essential to the idea of a “nation,” it also upholds the consciousness of these as determining separate rights and allegiances, the idea of attachment to a nation and its interests. Such a consciousness can emerge only on the adoption of certain populist ideas such as racism, ethnicity and even such popular elusive myths as the “greatness” of a nation, the urge for the maintenance of “national character,” etc. Such “nationalist xenophobia” leads to the intensification of the distinction between the “own” and the “other,” “national” and the “alien,” the “citizen” and the “migrant” leading to “ethnic disharmony,” “colour bias,” hatred and suspicion of persons with whom one has lived closely as neighbours for decades. The most popular is the economic discourse of the “migrants” putting the “nationals” out of work. All this has its toll on multi-culturalism and humanitarian concerns. Many affluent nations have become cold to human misery, suffering and deaths from wars, terrorism, acute poverty, political persecution, environmental degradation, etc. This has created an “existential” crisis for millions of people on earth. This paper on friendship starts with noticing the cultural specificities of the words, “friend” and “friendship”: how they possess rich nuances and meanings in some cultures not available in others. It has then delved into Aristotle’s treatment of friendship in his three ethical treatises with special reference to the relationship between friendship and morality and that between friendship and self-knowledge. Some comments are made on whether friendship is possible between persons of unequal virtues and whether they are capable of attaining (...) self-knowledge. This paper also discusses certain challenges to Aristotle’s claims that friendship is an unalloyed good. The point of these challenges is that friendship can also be a great bad. The paper concludes with the observation how rare has friendship become in the modern world resulting in loneliness, depression and alienation. (shrink)

A wave of recent publication connected to Hugh Trevor-Roper offers cause to take stock of his life and legacy. He is an awkward subject because his output was so protean, but a compelling one because of his significance for the resurgence of the history of ideas in Britain after 1945. The article argues that the formative period in Trevor-Roper's life was 1945–57, a period curiously neglected hit her to. It was at this time that the pioneered a history of ideas (...) conceived above all as the study of European liberal and humanist tradition. Analysis of the relative importance of contemporary and early modern history in his oeuvre finds that, while the experience of Hitler and the Cold War was formative, it was not decisive. Trevor-Roper was at heart an early modernist who did not abjure specialization. However, he insisted that specialized study must be accompanied by “philosophical” reflection on the working sofa constant human nature present throughout history, a type of reflection best pursued by reading classical historians such as Gibbon and Burckhardt. Yet this imperative in turn fostered purely historical research into the history of historical writing–another branch of the history of ideas. (shrink)

This paper presents four theorems that connect continuity postulates in mathematical economics to solvability axioms in mathematical psychology, and ranks them under alternative supplementary assumptions. Theorem 1 connects notions of continuity (full, separate, Wold, weak Wold, Archimedean, mixture) with those of solvability (restricted, unrestricted) under the completeness and transitivity of a binary relation. Theorem 2 uses the primitive notion of a separately continuous function to answer the question when an analogous property on a relation is fully continuous. Theorem 3 provides (...) a portmanteau theorem on the equivalence between restricted solvability and various notions of continuity under weak monotonicity. Finally, Theorem 4 presents a variant of Theorem 3 that follows Theorem 1 in dispensing with the dimensionality requirement and in providing partial equivalences between solvability and continuity notions. Unlike previous studies that consider the Chicago Board of Options Exchange implied volatility index, we examine long memory and fractality in the universe of nine CBOE volatility indices. Using daily data from October 5, 2007, to October 5, 2020, covering calm and crisis periods, we find evidence of long memory and fractality in all indices and a change in the degree of volatility persistence, which points to inefficiency. The long memory of the SKEW index is strong before the onset of (...) three crisis periods, but eases afterwards. The findings provide new insights that matter to investment decisions and trading strategies. (shrink)

The task of rhetorical role labeling is to assign labels (such as Fact, Argument, Final Judgement, etc.) to sentences of a court case document. Rhetorical role labeling is an important problem in the field of Legal Analytics, since it can aid in various downstream tasks as well as enhances the readability of lengthy case documents. The task is challenging as case documents are highly various in structure and the rhetorical labels are often subjective. Previous works for automatic rhetorical role identification (...) (i) mainly used Conditional Random Fields over manually handcrafted features, and (ii) focused on certain law domains only (e.g., Immigration cases, Rent law), and a particular jurisdiction/country (e.g., US, Canada, India). In this work, we improve upon the prior works on rhetorical role identification by proposing novel Deep Learning models for automatically identifying rhetorical roles, which substantially outperform the prior methods. Additionally, we show the effectiveness of the proposed models over documents from five different law domains, and from two different jurisdictions—the Supreme Court of India and the Supreme Court of the UK. Through extensive experiments over different variations of the Deep Learning models, including Transformer models based on BERT and LegalBERT, we show the robustness of the methods for the task. We also perform an extensive inter-annotator study and analyse the agreement of the predictions of the proposed model with the annotations by domain experts. We find that some rhetorical labels are inherently hard/subjective and both law experts and neural models frequently get confused in predicting them correctly. (shrink)
