Our core hypothesis is that the emergence of human language arose very rapidly from the linking of two pre-adapted systems found elsewhere in the animal world—an expression system, found, for example, in birdsong, and a lexical system, suggestively found in non-human primate calls (Miyagawa et al., 2013, 2014 ). We challenge the view that language has undergone a series of gradual changes—or a single preliminary protolinguistic stage—before achieving its full character. We argue that a full-fledged combinatorial operation Merge triggered the (...) integration of these two pre-adapted systems, giving rise to a fully developed language. This goes against the gradualist view that there existed a structureless, protolinguistic stage, in which a rudimentary proto-Merge operation generated internally flat words. The relationship between reason and faith is one of the most important topics in the philosophy of religion. This issue has been investigated from several aspects. One of these aspects is the relationship between action and religious belief. John Cottingham, a contemporary analytical philosopher, emphasizes the primacy of religious practice over belief, as well as the involuntary nature of belief. In his opinion, the factor that causes people to become religious is not intellectual discussions about God but the internal aspects (...) of religion itself and the transforming power of religious practices in human life and experiences. In the present work, a critique has been made of his point of view with an explanatory-critical method. Criticisms that his point of view includes: First, the belief resulting from the course of action is only psychological certainty and such certainty is beyond the logic of verification. Secondly, knowledge of God and the practical system is a condition for entering it and precedes it. The third criticism is the problem of the plurality of religions and practical systems which causes people to mistrust reasons of the heart. The fourth criticism is that entering into a practical system is a confirmation of its benefits and anyone who does not believe this would have no reason to enter such a system. Introduction John Cottingham is a contemporary English philosopher, and one of the contemporary theorists in the field of the relationship between reason and faith. The relationship between reason and religious faith can be examined from four aspects: 1) The relationship between reason and the epistemological area of faith, 2) the relationship between reason and the practical area of faith, 3) the relationship between reason and the commitment area of faith, and 4) the relationship between reason and the area of faith. Explanation of Cottingham’s view Cottingham’s view can be presented in seven steps: -/- Criticism of the current situation in analytical philosophy; Changing the topic of discussion from the religious field to the spiritual field in order to expand the topic of discussion to non-religious spiritual fields; Comparison of spiritual practice with devotional orders in the past philosophical tradition; Understanding religion is based on practical participation in it; -/- This introduction is expressed according to Pascal’s point of view. According to Pascal, faith should be acquired in the atmosphere of a living tradition of practical religious worship, not through discussion and analysis in a seminar room. The basis of this view is that issues related to the nature and existence of God are beyond the reach of reason. -/- The role of emotions in human understanding; -/- Using Nussbaum’s point of view, Cottingham says: There are types of truth that the intellectual effort to obtain is equivalent to not reaching them. Religious truth is also a part of these truths. Because religious truths are beyond the direct understanding of humans and trying to understand them through logical analysis is moving away from them. -/- Involuntary belief; -/- Human belief, whether religious or otherwise, is not optional and there is a kind of passivity in all human perceptions. According to Cottingham, this point is shared by philosophers such as Hume and Descartes. Cottingham is also influenced by Pascal in this introduction. According to Pascal, although belief in God is not optional, there are indirect ways such as participating in religious activities to realize it, which are available to humans. The role of these ways in the formation of belief is a preliminary role and creating the ability to accept. -/- The necessity of trusting the witnesses of the heart; -/- According to Cottingham, such a thing is necessary for the human condition, and this issue exists in all fields of human knowledge, as well as in human daily life. For example, to go to work, a person must believe that when he turns the switch on the car, the car will not explode, even if such a belief is not the result of checking the car’s electrical system, you still have to trust this article or you will lose your job. Cottingham’s conclusion from the seven premises is that the factor that causes people to become religious is not intellectual discussions about God but the internal aspects of religion itself and the transformative power of religious practices in human life and experiences. Accordingly, faith in God is a product of trust and participation in a living community of faith. When the truth of religion is obtained through faith, and faith depends on a practical religious tradition, then there will be no other choice but to enter into the practical system of religion. Of course, he emphasizes that entering the life of faith does not mean abandoning the critical method in content analysis, and the previous reasons resulting from religious practice must be supplemented or regularized by subsequent intellectual reflections. Secondly, knowing God and the practical system is a condition for entering this system and has precedence over it. The third criticism is the problem of the plurality of religions and practical systems which causes people to mistrust reasons of the heart. The fourth criticism is that entry into a practical system is a confirmation of its benefits and anyone who does not believe this would have no reason to enter such a system. Therefore, at this stage as well, it is necessary to have a rational way to confirm the usefulness of this path. His view on Doxastic voluntarism is also under the involuntary approach of indirect belief, which is Pascal’s view. This component is also present in the opinions of Allamah Tabatabai. The difference between Cottingham and Allameh’s points of view is that Cottingham and Pascal consider rational arguments to be inefficient in the realization of belief and scientific verification, and they consider a practical commitment to be necessary for the realization of such verification, but Allameh Tabatabai considers scientific premises and rational proof to be the necessary conditions for faith. Conclusion Although the theory of the precedence of action over belief is faced with numerous criticisms, it is an undeniable matter. Paying attention to different levels of religious faith makes the value of theoretical discussions as well as paying attention to practical refinement and participation in spiritual actions be considered together. El modelo globalizador, el cual es el básico en la mayor parte de los ejercicios de planificación; el modelo sectorial, que tiene un importante arraigo en el sector educativo latinoamericano, y el modelo situacional, cuya noción básica consiste en que planificar es una acción de todos los actores. Igualmente se describen otros como el denominado complejo, el cual va cobrando interés en los estudiosos del tema; pues aunque esta línea de pensamiento posee sus ángulos de interés en el campo específico de la planificación estratégica, en el ámbito universitario aún le queda camino por recorrer para el logro de una mayor profundización en la temática, de manera que ella pueda ser aplicada al proceso formativo universitario. In the article, a general revision of the strategic planning models that are applied to the present times in the field of high education institutions was made. The models are: the globalizing model, which is the basic in the most part of the planning exercises; the sectorial model, which is very well established in the Latin-American educational sector; and the situational model, the basic notion of which consists on the fact that planning is an action that correspond to all the actors. The model known as complex was described as well. This model has become important among the specialists in the subject because, although this line of thinking has established its angles of interest in the specific field of strategic planning, it still has a long way to run, in the university field, for getting a greatest deepening in the theme, in a way that it could be applied to the university formative process. In general, the development of the theory of the legal system has focused on the contributions of legal positivism authors, leaving to one side the contributions of natural law theory. This study seeks to rebuild the theory of the legal system developed by the School of Salamanca’s founder, Francisco de Vitoria, showing its explanatory advantages in comparison with the first analytical legal theory of legal system formulated by John Austin. This study shows that, just as in Austin, it is possible (...) in Francisco de Vitoria to reconstruct the existence and identity criteria of legal systems from the notions of command and sovereignty. These findings allow us to maintain that 300 years before Austin, and in a non-analytical environment, Francisco de Vitoria developed a theory of legal system. (shrink)

While developments of a shared intellectual tradition, the enactivist approach and the organizational account proffer importantly different accounts of organismic normativity. Where enactivists tend to follow Hans Jonas, Andres Weber, and Francisco Varela in grounding intrinsic affordance norms in existential concern, organizational theorists such as Alvaro Moreno, Matteo Mossio, and Leonardo Bich seek a more deflationary account of these normative phenomena. Critiques directed at both of these accounts of organismic normativity motivate the introduction of the precedential account of organismic normativity, (...) which I nevertheless locate within the enactivist approach, broadly construed. The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the (...) constraint that a precedent imposes based on the relationship of the precedent court and the instant court. Each of the major engineering societies has its own code of ethics. Seven “common core” clauses and several code-specific clauses can be identified. The paper articulates objections to and rationales for two clauses that raise controversy: do engineers have a duty to provide pro bono services and/or speak out on major issues, and to associate only with reputable individuals and organizations? This latter “association clause” can be justified by the “proclamative principle,” an alternative to Kant’s universalizability requirement. At the heart (...) of engineering codes of ethics, and implicit in what it is to be a moral agent, the “proclamative principle” asserts that one’s life should proclaim one’s moral stances. More specifically, it directs engineers to strive to insure that their actions, thoughts, and relationships be fit to offer to their communities as part of the body of moral precedents for how to be an engineer. Bioethicists are widely agreed that patients have a right of self-determination over how they are treated. Our duty to respect this is said to be based on the principle of respect for autonomy. In end-of-life care the patient may be incompetent and unable to exercise that right. One solution is to exercise it in advance. Advance directives, which include living wills and powers of attorney for health care, enable people to decide what medical treatment they will receive later, when they (...) become incompetent. Advance directives have been criticized in two general ways. First, many critics contend that advance directives fail on a practical level to effect a patient's autonomous choices because, for example, people cannot foresee their futures well enough to make informed decisions in advance. Judges wield substantial political power, and the justifications they offer for their decisions are a vital means by which citizens can assess the legitimacy of how that power is exercised. However, to evaluate judicial justifications requires close attention to the method of reasoning behind decisions. Philosophical Foundations of Precedent offers a broad, deep, and diverse range of philosophical investigations of the role of precedent in law, adjudication, and morality. The forty chapters present the work of a large and inclusive group of authors which comprises of well-established leaders in the discipline and new voices in legal philosophy. The magnitude of the resulting project is extraordinary, presenting a diverse array of innovative and creative philosophical investigations of the practice of adhering to past decisions, in law and (...) allied fields of practical reasoning. And by the same token, the contributions elucidate the reasons that courts and other decision-makers may have for departing from what has been done before. The phenomena under investigation include the law and practice of common law and civil jurisdictions around the world. In addition to its fundamental relevance to common law jurisdictions, this work will be of broad and significant interest to theoretically minded audiences in continental Europe, Latin America, and Asia because it involves an extensive study of practices of precedent in civil law systems as well as common law systems. Doctrinally, a precedent is a case of the same or higher court that furnishes an authoritative rule for the determination of the case at hand, either because the facts are alike, or, if the facts are different, because the principle that governed the first case is applicable to the different facts. In this article I try to free precedent form the dominant doctrinal view by offering a more intuitive conception: that to be precedent means to be treated as precedent. Put (...) differently, I attempt to see precedent not as descriptive of a previous decision or rule but as the aggregate effect of responses to one or a series of court decisions in the legal community. I illustrate this viewpoint by developing a version of a response-dependent concept that incorporates our intuitive grasp of how precedent works. In the pursuit of this task I rely on the basic philosophical premises of response-dependence theory and on one paradigmatic response-dependent concept—the quality of being funny. (shrink)

This article examines the claim of Paul Badham that there is theological precedent for ‘a Christian case for assisted dying’. The writings of Rev. William Inge and Joseph Fletcher do indeed advocate forms of assisted dying. However, this precedent is deeply problematic for its ugly attitude towards people with disabilities.

I will, first, outline what we currently know about the last 4 million years of human evolutionary history, from bipedal but small‐brained Australopithecus to modern Homo sapiens, our species, through the prolific toolmaker Homo habilis and the continent wanderer Homo erectus. I shall then identify anatomical traits that distinguish us from other animals and point out our two kinds of heredity, the biological and the cultural.Biological inheritance is based on the transmission of genetic information, in humans very much the same (...) as in other sexually reproducing organisms. But cultural inheritance is distinctively human, based on transmission of information by a teaching and learning process that is in principle independent of biological parentage. Cultural inheritance makes possible the cumulative transmission of experience from generation to generation. Cultural heredity is a swifter and more effective (because it can be designed) mode of adaptation to the environment than the biological mode. The advent of cultural heredity ushered in cultural evolution, which transcends biological evolution.I will, finally, explore ethical behavior as a model case of a distinctive human trait, and seek to ascertain the causal connections between human ethics and human biology. My conclusions are that (1) moral reasoning—that is, the proclivity to make ethical judgments by evaluating actions as either good or evil—is rooted in our biological nature; it is a necessary outcome of our exalted intelligence, but (2) the moral codes that guide our decisions as to which actions are good and which ones are evil are products of culture, including social and religious traditions. This second conclusion contradicts those evolutionists and sociobiologists who claim that the morally good is simply that which is promoted by the process of biological evolution. (shrink)

In this paper several recent factor- and dimension-based models of precedential constraint are formally investigated and an alternative dimension-based model is proposed. Simple factor- and dimension-based syntactic criteria are identified for checking whether a decision in a new case is forced, in terms of the relevant differences between a precedent and a new case, and the difference between absence of factors and negated factors in factor-based models is investigated. Then Horty’s and Rigoni’s recent dimension-based models of precedential constraint are critically (...) examined. A familiar jurisprudential view is that a judicial decision functions as a legal precedent by laying down a rule and that the content of this rule is set by officials. Precedents can be followed only by acting in accordance with this rule. This view is mistaken on all counts. A judicial decision functions as a precedent by being an example. At its best, it is an example both for officials and for a target population. Even precedents outside of (...) law function as examples when they have conduct-guiding significance. Examples may be rule-like in their scope, but need not be. Their import is independent of their justification; this point has implications for coherence theories of precedent meaning. A general practice of precedent is one that can plausibly apply to any well-functioning legal system. This practice, which can be grounded in the Rule of Law, needs to make it the case that courts always have a legal reason for following relevant precedent – even if the precedent is morally suboptimal, so long as it is not evil. Without this reason, a precedent may be treated as having no legal influence for the later court (‘the Null Model’), and this (...) runs counter to the Rule of Law. On top of this reason, courts may have a general legal obligation to follow precedent – stare decisis – but this risks entrenching morally bad decisions in the law. We need, therefore, a type of reason that lies in between the Null Model and stare decisis as a necessary step for any future justification of stare decisis. But how can courts have a legal reason for following morally suboptimal precedent? They can have that reason, I argue, in virtue of a specific judicial duty, positively laid down in a legal source, which aims to advance the Rule of Law in an institutionalised way. 본 연구의 목적은 고현향약에 대한 선행연구의 오류를 바로잡고, 선행연구에서 온전하 게 살펴보지 못했던 고현향약의 전기 규약에 대해 살펴보는 것이다. 고현향약은 현존하는 대한민국의 가장 오래된 향약 가운데 하나로 조선시대 지역자치조직 및 그 규약의 모습을 규명하는데 매우 중요한 자료이다. 조선이 건국된 지 100년도 되기 전부터 실시되어 시대 적 부침 속에서 존속하며 현재까지 지속되고 있는 고현향약을 정밀하게 분석할 수 있다면 우리는 전통 지역자치조직의 모습을 좀 정확하게 규명할 수 있을 것이다. 그리고 이와 같 은 연구를 통해 우리 사회의 바람직한 지역자치조직의 모델도 제시할 수 있을 (...) 것이다. 그런데 문제는 현재 고현향약과 관련된 규약의 전모가 제대로 규명되지 않고 있다는 것 이다. 고현향약 관련 선행 연구가 몇 건 있긴 하지만 이들 연구에 오류가 있기 때문이다. 이러한 이유로 현존하는 고현향약의 최고(最古) 규약이 무엇인지, 그러한 규약이 언제, 어 떤 배경과 목적에 의해 몇 차례 수정을 거쳤는지 등에 대한 연구가 명확히 이루어지지 않 고 있다. 토대 자료에 대한 연구가 미비하거나 그것에 오류가 있다고 한다면 더 이상의 연 구를 진행하기 어렵다. 이러한 문제를 해결하기 위해 본 논문에서는 먼저, 선행연구의 오 류를 바로잡아 11차례에 걸쳐 개정된 고현향약의 규약을 시대순으로 분류하였다. 다음으 로 선행연구에서 다루었던 규약 가운데 특히 오류가 많았던 초기 규약에 대한 전문을 소개 하고, 그것에 대해 간략히 분석하였다. Analytical jurisprudence has been mostly silent on the role of precedent in legal adjudication.

In this paper, it is shown (1) that there are two schemes for argument from analogy that seem to be competitors but are not, (2) how one of them is based on a distinctive type of similarity premise, (3) how to analyze the notion of similarity using story schemes illustrated by some cases, (4) how arguments from precedent are based on arguments from analogy, and in many instances arguments from classification, and (5) that when similarity is defined by means of (...) episode schemes, we can get a clearer idea of how it integrates with the use of argument from classification and argument from precedent in case-based reasoning by using a dialogue structure. Honoring a living will typically involves treating an incompetent patient in accord with preferences she once had, but whose objects she can no longer understand. How do we respect her precedent autonomy by giving her what she used to want? There is a similar problem with subsequent consent: How can we justify interfering with someone''s autonomy on the grounds that she will later consent to the interference, if she refuses now?Both problems arise on the assumption that, to respect someone''s autonomy, (...) any preferences we respect must be among that person''s current preferences. I argue that this is not always true. Just as we can celebrate an event long after it happens, so can we respect someone''s wishes long before or after she has that wish. In the contexts of precedent autonomy and subsequent consent, the wishes are often preferences about which of two other, conflicting preferences to satisfy. When someone has two conflicting preferences, and a third preference on how to resolve that conflict, to respect his autonomy we must respect that third preference. People with declining competence may have a resolution preference earlier, favoring the earlier conflicting preference (precedent autonomy), whereas those with rising competence may have it later, favoring the later conflicting preference (subsequent consent). To respect autonomy in such cases we must respect not a current, but a former or later preference. (shrink)

This chapter provides an explanation of precedent as a kind of artefact, in keeping with broader accounts of law that do so, specifically the author’s account of law as a genre of institutionalized abstract artefact. The chapter develops its explanation by responding to an argument by Dan Priel against seeing the common law as an artefact when understood to be a form of custom. The chapter shows that customs can themselves be artefacts but also that the precedential elements of common (...) law are not necessarily quite as customary as sometimes considered, showing that the common law built from precedents fits within a distributed design model of artefacts and that stare decisis has a wider systemic function of upholding certain rule of law principles. It ends with some considerations about the institutional nature of precedents, specifically that judicial decisions are most often both applications and developments of legal norms, but also determinations of legal validity. This paper finds its origin in a debate between Georges Bataille (1897-1962) and Octavio Paz (1914-1998) on what is central to the idea of eroticism. Bataille posits that violence and transgression are fundamental to eroticism, and without prohibition, eroticism would cease to exist. Paz, however, views violence and transgression as merely intersecting with, rather than being intrinsic to, eroticism. Paz places focus on imagination, and transforms eroticism from a transgressive, to a ritualistic act. Eroticism thus functions as an intermediary, turning (...) animal sexuality into ceremony and rite. In this paper, I argue that Paz and Bataille are not fundamentally at odds in their conceptualisation of eroticism. Instead, Paz redefines the locus of eroticism by subverting its unsettling aspects. His conception of eroticism gives precedence to the imagination, which in itself is an act of violation. Imagination transgresses normal life, but this transgression – the violation of the habitual world – also introduces a glimpse of the numinous that Paz associates with belongingness. The paper further explores eroticism, as this is perceived today, and argues that it ultimately eliminates the threshold marked by transgression. The rise of the contemporary pornographic society is marked by a loss of imagination and transcendence, which ultimately reduces the subject into a mere automaton that demands instant gratification. This Article discusses what a “super-precedent” is in American Constitutional Law. Additionally, it describes the current criteria used to identify super-precedents and the limitations of these criteria. It then mentions the various precedents that have been afforded this august title and suggests the need for an additional criterion to ensure the continued protection of those precedents most closely associated with the protection of human rights. Finally, the article identifies three additional precedents, beyond those usually recognized, that (...) ought to be ranked super-precedents and provides a basis for ranking all precedents, grounded in autonomy, when they either conflict with one another or encounter a compelling state interest. Replicability is widely taken to ground the epistemic authority of science. However, in recent years, important published findings in the social, behavioral, and biomedical sciences have failed to replicate, suggesting that these fields are facing a “replicability crisis.” For philosophers, the crisis should not be taken as bad news but as an opportunity to do work on several fronts, including conceptual analysis, history and philosophy of science, research ethics, and social epistemology. Second, I discuss methodological, statistical, and social-structural factors that have contributed to the crisis. Third, I focus on the philosophical issues raised by the crisis. We present a longitudinal computational study on the connection between emotional and amodal word representations from a developmental perspective. In this study, children's and adult word representations were generated using the latent semantic analysis (LSA) vector space model and Word Maturity methodology. Some children's word representations were used to set a mapping function between amodal and emotional word representations with a neural network model using ratings from 9‐year‐old children. The neural network was trained and validated in the child semantic space. (...) Then, the resulting neural network was tested with adult word representations using ratings from an adult data set. Samples of 1210 and 5315 words were used in the child and the adult semantic spaces, respectively. Results suggested that the emotional valence of words can be predicted from amodal vector representations even at the child stage, and accurate emotional propagation was found in the adult word vector representations. In this way, different propagative processes were observed in the adult semantic space. These findings highlight a potential mechanism for early verbal emotional anchoring. Moreover, different multiple linear regression and mixed‐effect models revealed moderation effects for the performance of the longitudinal computational model. First, words with early maturation and subsequent semantic definition promoted emotional propagation. Second, an interaction effect between age of acquisition and abstractness was found to explain model performance. The theoretical and methodological implications are discussed. (shrink)

In 'The Standard Picture and its Discontents', Mark Greenberg remarks that the typical way that legal theorists think about legal obligations does not sit well with the way the common law works. I argue that Alexander's and Sherwin’s Rule Model of precedent can deal with all the problems that Greenberg accuses the Standard Picture of having. Nonetheless, I further argue that combining the Standard Picture and the Rule Model ultimately leads to another problem: the inability of the Standard Picture – (...) ABSTRACTI contextualize and interpret the distinction in Hobbes’ Leviathan between the capacities of the sovereign and show its importance for contemporary debates on the nature of Hobbesian sovereignty. Hobbes distinguishes between actions the sovereign does on personal title, and actions he undertakes in a political capacity. I argue that, like royalists defending King Charles I before and during the English civil war, he maintains that the highest magistrate is sovereign in both his natural and political capacities because the capacities are (...) inseparable, though district. This position goes back to the treatment of Calvin’s Case by Francis Bacon and Edward Coke and has further precedents in medieval English constitutional thought. An important reason for Hobbes to include this doctrine in Leviathan, I suggest, is to provide a response to parliamentarians who employed the sovereign’s multiple capacities to justify armed resistance against the king. I show the relevance of this contextualization by intervening in two recent debates, regarding the possibility of constitutionalist limitations on the actions of the Hobbesian sovereign and regarding whether sovereignty is held by the commonwealth or by the person of the sovereign. The result model of precedent holds that a legal precedent controls a fortiori cases—those cases, that is, that are at least as strong for the winning side of the precedent as the precedent case itself. This paper defends the result model against some objections by Larry Alexander, drawing on ideas from the field of Artificial Intelligence and Law in order to define an appropriate strength ordering for cases.
