S’interroger sur les variations intra-individuelles des comportements culturels, et notamment chercher à saisir les variations du degré de légitimité culturelle des goûts et des pratiques, selon le domaine ou le type de pratique considéré, permet de respecter un peu plus que d’ordinaire la complexité des patrimoines de dispositions et de compétences culturelles individuels. Angesichts der Zunahme chronischer Erkrankungen erscheint es geboten, vermehrt auf Präventionsmaßnahmen zurückzugreifen, die den Einzelnen zu einer gesundheitsfördernden Lebensweise anhalten und exogene gesundheitsschädigende Einflüsse reduzieren. Dabei ergeben sich zwei ethische Problemkonstellationen: 1) Welche Einschränkungen der Entscheidungsautonomie des Einzelnen sind gerechtfertigt, um bestimmte Präventionsziele zu erreichen? 2) Welche Verantwortung kann und soll der Einzelne für seine Gesundheit tragen? Fünf ethische Anforderungen sind an jede Präventionsmaßnahme zu stellen: 1) nachgewiesene Wirksamkeit, 2) günstiges Kosten-Nutzen-Profil, 3) akzeptables Kosten-Nutzen-Verhältnis, 4) möglichst geringe Restriktivität und 5) (...) faire Entscheidungsverfahren. Je nachdem, wie weit diese Anforderungen erfüllt sind, lässt sich eine unterschiedlich starke Beeinflussung der individuellen Entscheidungsautonomie rechtfertigen. Anstatt den Einzelnen für gesundheitsschädigendes Verhalten retrospektiv zu bestrafen, sollte er – im Sinne einer Stärkung der Gesundheitsmündigkeit – prospektiv in die Lage versetzt werden, Sorge für seine eigene Gesundheit zu tragen. À travers une enquête qualitative par entretiens menée auprès des sportifs de haut niveau de l’INSEP, nous nous intéressons à leur rythme de vie qui articule des temps nombreux et variés : temps sportif, temps scolaire ou universitaire, temps professionnel, temps de récupération, temps de loisir privé et social, etc. Dans ce contexte il apparaît que leur temps objectif et leur temps subjectif ne coïncident pas toujours. Nous identifions à la fois une capacité générale de ces sportifs à gérer une (...) organisation temporelle particulièrement chargée, mais aussi de profondes variations d’un profil de sportif à l’autre, d’où l’idée d’une construction sociale du temps subjectif. Après avoir présenté l’organisation objective des temps à l’INSEP, nous analysons le poids de plusieurs facteurs sportifs et extra-sportifs pour expliquer cette disjonction et comprendre quels éléments ont tendance à favoriser un meilleur vécu d’un emploi du temps objectivement chargé. Cela nous conduit à ouvrir la discussion sur la conception des différentes temporalités de la préparation des sportifs qui demeure floue, entre temps de travail et temps de loisir. Cette préparation s’inscrit elle-même dans un contexte institutionnel spécifique : la construction du rythme de vie de ces sportifs est alors la recherche d’un compromis entre temps collectif et temps individuel. Qu’est-ce qu’un jeu sérieux ? Ce terme galvaudé nous semble devoir être remplacé par celui de jeu utile. Dans cet article, nous développons ce concept dans le cadre de Jeu Serai. Il s’agit d’un projet retenu à l’appel d’offres Serious Game du ministère de l’Industrie. Dans ce projet nous visons à utiliser les mécanismes fondamentaux du jeu vidéo pour évaluer les centres d’intérêts et de motivation de l’utilisateur, ainsi que la façon dont il réalise des choix afin de l’aider dans (...) sa démarche individuelle d’orientation. Le prototype développé combine un jeu à autoproduction, de type livre interactif et des mini-jeux de différents types dont les résultats servent à définir un profil psychologique du joueur. Ce travail d’introspection et de mise en situation sera effectué par la personne dans le cadre d’un accompagnement réalisé par un conseiller professionnel.What is a “serious” game? Believing that this frequently misused term should be replaced with “useful game”, we develop the idea here through a discussion of Jeu Serai. This is a project that was selected under the Ministry of the Industry’s call for Serious Game ideas. Our aim in this project is to use the basic video game mechanisms to assess the centres of interest and motivations of users and how they make choices, in order to help them make individual career decisions. The prototype we developed combines game playing with the production by players of an interactive story and different kinds of mini-games, whose results are used to define their psychological profile. La frontière entre légitimité et illégitimité culturelles ne sépare pas seulement les pratiques des différentes classes sociales, mais divise plus ou moins fortement, dans toutes les classes, les différentes pratiques et préférences culturelles des mêmes individus. Les processus de distinction culturelle ne mettent donc pas seulement en jeu les classes sociales et leurs luttes symboliques pour le monopole de la définition légitime des goûts légitimes, mais concernent tout aussi bien la variation intra-individuelle des pratiques. La figure du «populaire» sert ainsi (...) fréquemment de repoussoir dans les luttes de soi contre soi que mènent tous ceux qui, étant donné la mixité de leurs pratiques culturelles, expriment une peur de la régression ou de la chute culturelles. Si le monde social est, sans conteste, un champ de luttes entre groupes ou classes, les individus aux profils culturels hétérogènes ou dissonants sont souvent eux-mêmes les arènes d'une lutte des classements.The boundary between "cultural legitimacy" and "cultural illegitimacy" separates not only the different social classes, but also the different cultural practices and preferences of the same individuals in all classes. The cultural distinction process bring into play not only social classes and their symbolic struggles for the monopoly of legitimate definition of legitimate tastes, but also the intra-individual variation of behaviours. The "popular" figure frequently serves also as a foil in the struggles of oneself against oneself {illegitimate) that lead all those who express a fear of cultural regression or fall because of their cultural practices mixity. If social world is, indisputably, a field of struggles between groups or classes, individuals characterized by heterogeneous or dissonant cultural profiles are themselves often the arenas of a classifications' struggle. Alors que dans la majorité des démocraties libérales le mandat d’élu·e au législatif national est rempli à plein temps depuis la fin du XIX e siècle, les membres de l’Assemblée fédérale en Suisse exercent leur fonction comme une charge à temps partiel faiblement indemnisée, dite de « milice ». Notre article illustre comment le principe de milice, véritable norme culturelle dominante de l’engagement public, a influencé les temporalités du travail parlementaire. Pour ce faire, l’analyse se penche, d’une part, sur l’impact (...) que ce principe exerce sur les carrières politiques individuelles, en participant à accroître la sélectivité des trajectoires biographiques des parlementaires helvétiques sur le plan socioprofessionnel. In Emotions, Values & Agency, Christine Tappolet develops a sophisticated, perceptual theory of emotions and their role in wide range of issues in value theory and epistemology. In this paper, we raise three worries about Tappolet's proposal.

Background Hospital ethical climate has important implications for clinical nurses’ service behavior; however, the relationships are complicated by the fact that five types of ethical climate (caring, law and code, rules, instrumental, and independence) can be combined differently according to their level and shape differences. Recent developments in person-centered methods (e.g., latent profile analysis (LPA)) have helped to address these complexities. Aim From a person-centered perspective, this study explored the distinct profiles of hospital ethical climate and then examined the relationships (...) of the profiles with clinical nurses’ service behavior (both in-role and extra-role service behavior). Research design A quantitative study was conducted using cluster random sampling. Latent profile analysis and binary coded hexadecimal (BCH) analysis were conducted using Mplus 8.2. Participants and research context A total of 871 clinical nurses in China were surveyed using the Ethical Climate Scale and Nurses’ Service Behavior Questionnaire. Ethical considerations Ethical approval was obtained from the IRB of the First Affiliated Hospital of Jinan University (No. KY-2020-090). Results A four-profile hospital ethical climate model provided the best fit for the data. The four different profiles not only varied in level, but also in shape: high normative and low egoism (45.8%), high ethical climate (19.9%), low ethical climate (3.6%), and moderate ethical climate (30.8%). These profiles differentially predicted clinical nurses’ overall, in-role, and extra-role service behaviors. Conclusions The results reveal new insights into the nature of hospital ethical climate and how different clinical nurses in these profiles can be best managed to accomplish different forms of service behavior. The tendency towards an increasing integration of the informational web into our daily physical world (in particular in so-called Ambient Intelligent technologies which combine ideas derived from the field of Ubiquitous Computing, Intelligent User Interfaces and Ubiquitous Communication) is likely to make the development of successful profiling and personalization algorithms, like the ones currently used by internet companies such as Amazon, even more important than it is today. I argue that the way in which we experience ourselves necessarily goes through (...) a moment of technical mediation. Because of this algorithmic profiling that thrives on continuous reconfiguration of identification should not be understood as a supplementary process which maps a pre-established identity that exists independently from the profiling practice. In order to clarify how the experience of one’s identity can become affected by such machine-profiling a theoretical exploration of identity is made (including Agamben’s understanding of an apparatus, Ricoeur’s distinction between idem- and ipse-identity, and Stiegler’s notion of a conjunctive–disjunctive relationship towards retentional apparatuses). Although it is clear that no specific predictions about the impact of Ambient Intelligent technologies can be made without taking more particulars into account, the theoretical concepts are used to describe three general scenarios about the way wherein the experience of identity might become affected. To conclude, I argue that the experience of one’s identity may affect whether the cases of unwarranted discrimination resulting from ubiquitous differentiations and identifications within an Ambient Intelligent environment, will become a matter of societal concern. A full understanding of emotions and emotion characteristics can only be reached when their dynamic nature is taken into account. As such, a primary objective of the present study is to describe and account for variability in temporal profiles of experienced emotional intensity. Participants were asked to make detailed drawings of intensity profiles of recently experienced episodes of anger, sadness, joy and affection. Functional data analysis revealed three features that together accounted for 84% of the total variability: (i) steepness at (...) onset; (ii) skewness; and (iii) the number of peaks. Emotions differed with regard to the first two features, with the rise at onset being steeper for sadness and joy and affection being the most negatively skewed emotion under study. Individual differences regarding each of the three features were found, however, they did not strongly generalise across emotions. (shrink)

Both corporate and global governance seem to demand increasingly sophisticated means for identification. Supposedly justified by an appeal to security threats, fraud and abuse, citizens are screened, located, detected and their data stored, aggregated and analysed. At the same time potential customers are profiled to detect their habits and preferences in order to provide for targeted services. Both industry and the European Commission are investing huge sums of money into what they call Ambient Intelligence and the creation of an ‘Internet (...) of Things’. Such intelligent networked environments will entirely depend on real time monitoring and real time profiling, resulting in real time adaptation of the environment. In this contribution the author will assess the threats and opportunities of such autonomic profiling in terms of its impact on individual autonomy and refined discrimination and indicate the extent to which traditional data protection is effective as regards profiling. This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

This paper tries to explain why racial profiling involves a serious injustice and to do so in a way that avoids the problems of existing philosophical accounts. An initially plausible view maintains that racial profiling is pro tanto wrong in and of itself by violating a constraint on fair treatment that is generally violated by acts of statistical discrimination based on ascribed characteristics. However, consideration of other cases involving statistical discrimination suggests that violating a constraint of this kind may not (...) be an especially serious wrong in and of itself. To fully capture the significant wrong that occurs when racial profiling is targeted at black Americans or other similarly situated groups, it is argued that we should appeal to the idea that this basic injustice is exacerbated when it forms part of a larger pattern of similar actions that collectively realize a state of cumulative injustice. It is well-established that algorithms can be instruments of injustice. It is less frequently discussed, however, how current modes of AI deployment often make the very discovery of injustice difficult, if not impossible. In this article, we focus on the effects of algorithmic profiling on epistemic agency. We show how algorithmic profiling can give rise to epistemic injustice through the depletion of epistemic resources that are needed to interpret and evaluate certain experiences. By doing so, we not only demonstrate how (...) the philosophical conceptual framework of epistemic injustice can help pinpoint potential, systematic harms from algorithmic profiling, but we also identify a novel source of hermeneutical injustice that to date has received little attention in the relevant literature: epistemic fragmentation. Epistemic fragmentation is a structural characteristic of algorithmically-mediated environments that isolate individuals, making it more difficult to develop, uptake and apply new epistemic resources. This, in turn, can impede the identification and conceptualisation of emerging harms in these environments. We trace the occurrence of hermeneutical injustice back to the fragmentation of the epistemic experiences of individuals, who are left more vulnerable by the inability to share, compare, and learn from shared experiences. What kind of reading and viewing space is created within contemporary platforms? While existing research has explored the impact of surveillance, this article moves on to theoretically discuss the intersection of technosocial reading. It examines how algorithmic interpellation and profiling function as enunciative strategies, and how this is explored from a transgender perspective. The article raises theoretical questions about the flattening of enunciation and its implications for a critical reading and observation space. To further explore these concepts, it analyses Ada (...) Ada Ada’s year-long in transitu Instagram performance. Through this analysis, the challenges posed by fixed, binary gender categorisations prevalent on platforms like Instagram are unpacked. Ada Ada Ada’s performance serves as an imminent criticism of the enunciative, representational and gender policies of platforms, demonstrating their arbitrary and absurd nature. Ultimately, in transitu invites platform users to reconsider their roles as technosocial readers and observers. (shrink)

abstract A police technique known as racial profiling draws on statistical beliefs about crime rates in racial groups. Supposing that such beliefs are true, and that racial profiling is effective in fighting crime, is such profiling morally justified? Recently, Risse and Zeckhauser have explored the racial profiling of African‐Americans and argued that justification is forthcoming from a utilitarian as well as deontological point of view. Drawing on criticisms made by G. A. Cohen of the incentives argument for inequality, I argue (...) that, assuming that crime rates between different racial groups would converge in the absence of racial discrimination and unjust inequality, racial profiling is comprehensively unjustified. I also explain that, because Risse and Zeckhauser simply compare the status quo with an outcome that differs from it only in respect of the practice of racial profiling, they fail to show that such profiling is non‐comprehensively justified. And, exploring the problem from the point of view of a deontological concern for fairness, I identify a number of situations in which it would be non‐comprehensively unjustified to implement racial profiling (as well as some in which it might be non‐comprehensively unjustified not to implement racial profiling). The science of animal consciousness investigates (i) which animal species are conscious (the distribution question) and (ii) how conscious experience differs in detail between species (the quality question). We propose a framework which clearly distinguishes both questions and tackles both of them. This two-tier account distinguishes consciousness along ten dimensions and suggests cognitive capacities which serve as distinct operationalizations for each dimension. The two-tier account achieves three valuable aims: First, it separates strong and weak indicators of the presence of consciousness. (...) Second, these indicators include not only different specific contents but also differences in the way particular contents are processed (by processes of learning, reasoning or abstraction). Third, evidence of consciousness from each dimension can be combined to derive the distinctive multi-dimensional consciousness profile of various species. This study assessed the extent to which within-individual variation in schizotypy and paranormal belief influenced performance on probabilistic reasoning tasks. A convenience sample of 725 non-clinical adults completed measures assessing schizotypy (Oxford-Liverpool Inventory of Feelings and Experiences; O-Life brief), belief in the paranormal (Revised Paranormal Belief Scale; RPBS) and probabilistic reasoning (perception of randomness, conjunction fallacy, paranormal perception of randomness, and paranormal conjunction fallacy). Latent profile analysis (LPA) identified four distinct groups: class 1, low schizotypy and low paranormal belief (43.9% (...) of sample); class 2, moderate schizotypy and moderate paranormal belief (18.2%); class 3, moderate schizotypy (high cognitive disorganization) and low paranormal belief (29%); and class 4, moderate schizotypy and high paranormal belief (8.9%). Identification of homogeneous classes provided a nuanced understanding of the relative contribution of schizotypy and paranormal belief to differences in probabilistic reasoning performance. Multivariate analysis of covariance revealed that groups with lower levels of paranormal belief (classes 1 and 3) performed significantly better on perception of randomness, but not conjunction problems. Schizotypy had only a negligible effect on performance. Further analysis indicated that framing perception of randomness and conjunction problems in a paranormal context facilitated performance for all groups but class 4. (shrink)

This paper examines philosophically the nature and possible moral justification of racial profiling in terms of color profiling. Precisely what is such profiling, and can it ever be morally justified? If so, under what conditions is it morally justified?

Das primäre Ziel dieses Open-Access-Buches besteht in der Entwicklung einer Theorie pluraler epistemischer Autoritäten. Epistemische Autoritäten spielen in unserer durch Spezialisierung geprägten und hochgradig arbeitsteilig organisierten modernen "Informations-" oder "Wissensgesellschaft" eine zentrale Rolle. Die Philosophie hat diesem Umstand in den letzten Jahren durch eine zunehmend intensive Diskussion Rechnung getragen. Ein entscheidendes Defizit dieser Debatte besteht nach Diagnose des Autors allerdings darin, dass sie sich fast ausschließlich auf individuelle epistemische Autoritäten konzentriert hat. In unserer epistemischen Praxis sind plurale epistemische Autoritäten - (...) d.h. wissenschaftliche Gemeinschaften, Expertengremien, Geschworenenjurys usw. - aber mindestens genauso bedeutsam. Wir berufen uns auf "wissenschaftlichen Konsens", orientieren uns an "herrschenden Meinungen" usw. und stützen uns damit auf plurale epistemische Autoritäten. Das Buch möchte die Potentiale, aber auch die Herausforderungen und Fallstricke analysieren, die diese Praxis des Sich-Stützens auf plurale epistemische Autoritäten mit sich bringt. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

It is commonly held that, given multiple medically permissible ways of proceeding, each with a different impact on the patient’s future, it is extremely important, and part of respecting patient autonomy, that patients not be under substantial pressure to defer to their physicians’ presumed authority. Some, however, worry that the focus on patient autonomy can be detrimental and that, at least in cases where it is hard to grasp what it is really like to live with certain outcomes without any (...) first‐hand or second‐hand experience, it is best if patient choice is firmly directed, or at least effectively nudged, by the recommendation of an experienced medical professional. The idea seems to be that, since physicians cannot get their patients to promptly assimilate a large amount of information and experience, physicians must, if they are to really help their patients make good decisions in hard cases, exert non‐argumentative influence on them. But this neglects an interesting possibility, namely the possibility of influencing patients by providing them with evidence regarding what decisions have proved most satisfactory for patients with their profile. Approximations of patient profile tests are already employed in medical practice. But the potential of the profile‐test approach in medical practice (and research) has been obscured by ongoing debate that neglects the significance of the approach with respect to the apparent dilemma faced by patients who need to make informed, autonomous decisions but cannot be expected to fully assimilate, in short order, the knowledge and experience of their physicians. Using the profiles of dialogue method we identify a species of ad verecundiam fallacy that works by forestalling of questioning in arguments from expert opinion. A profile of dialogue is a graph structure used to model a sequence of speech acts surrounding both the putting forward of an argument and the response to it at the next moves in a dialogue. A growing body of research suggests that scientific and religious beliefs are often held and justified in different ways. In three studies with 707 participants, we examine the distinctive profiles of beliefs in these domains. In Study 1, we find that participants report evidence and explanatory considerations (making sense of things) as dominant reasons for beliefs across domains. However, cuing the religious domain elevates endorsement of nonscientific justifications for belief, such as ethical considerations (e.g., believing it encourages people to be (...) good), affiliation (what loved ones believe), and intuition (what feels true in one's heart). Study 2 replicates these differences with specific scientific and religious beliefs held with equal confidence, and documents further domain differences in beliefs’ personal importance, openness to revision, and perceived objectivity. Study 3 replicates these differences, further finding that counter‐consensus beliefs about contentious science topics (such as climate change and vaccination) often have properties resembling religious beliefs, while counter‐religious beliefs about religion (e.g., “There is no God”) have properties that more closely resemble beliefs about science. We suggest that beliefs are held and justified within coherent epistemic frameworks, with individuals using different frameworks in different contexts and domains. (shrink)

Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)

In the United States and elsewhere, there is substantial controversy regarding the use of race and ethnicity by police in determining whom to stop, question, and investigate in relation to crime and security issues. In the ethics literature, the debate about profiling largely focuses on the nature of profiling and when (if ever) profiling is morally justifiable. This essay addresses the related, but distinct, issue of whether states have a duty to collect information about the race and ethnicity of persons (...) stopped by police. I argue that states in the U.S. do have such a duty on the grounds that such information collection would help secure the value of persons’ human rights against discrimination and unfair policing. Nonetheless, a large number of states do not require it. I begin by distinguishing rights from the value of rights, and arguing that under certain conditions persons have claims to the value of rights themselves, and that states have duties to secure that value. I then turn to the issue of profiling and offer the value of rights argument in favor of information collection about the race and ethnicity of persons stopped by police. (shrink)

In a constitutional democracy, the imputation of a legal violation to an individual must be related to the fact that democratic approval of a norm - under limiting conditions - is coupled with the obligation to follow that norm. The neutrality of modern law toward the quality of motives for following a norm, however, challenges the assumption of such a connection. This challenge is overlooked by those who take the position that individual imputation should be based on the morally autonomous (...) individual's self-contradiction. In contrast, deterrence theories fail to see the other relevant aspect, namely that individual imputation cannot be completely divorced from the perspective of the individual as a citizen, who could indeed follow the norm because of his insight into the reasons for its validity. Individual imputation takes account of this double classification of a person subject to law as citizen and as private autonomous legal subject only if the actor is addressed as citizen in the reasoning given to support the determination of culpability without simultaneously requiring him to actually adopt the perspective of a citizen. Die individuelle Zurechnung einer Rechtsverletzung muß in einem demokratischen Verfassungsstaat etwas damit zu tun haben, daß mit der demokratischen Zustimmung zu einer Norm unter einschränkenden Bedingungen - auch die Verpflichtung zur Normbefolgung verbunden ist. Gegen die Vermutung eines solchen Zusammenhangs spricht jedoch die Neutralität des modernen Rechts gegenüber der Qualität der Motive seiner Befolgung. Dies wird von denjenigen Positionen übersehen, die eine individuelle Zurechnung auf den Selbstwiderspruch der sittlich autonomen Person gründen wollen. Dagegen übersehen präventive Schuldtheorien den anderen Aspekt, daß sich individuelle Zurechnung nicht gänzlich von der Perspektive des Staatsbürgers lösen darf, der eine legitime Norm aus Einsicht in die Gründe ihrer Geltung auch befolgen könnte. Der doppelten Codierung der Rechtsperson als Staatsbürger und als privatautonomes Rechtssubjekt entspricht die individuelle Zurechnung nur dann, wenn der Täter durch die Begründung des Schuldurteils als Staatsbürger angesprochen wird, ohne daß ihm ein Wechsel in die Perspektive eines Staatsbürgers auch zugemutet würde. This study examined parents’ implicit theories of intelligence and self-regulation from a person-centered perspective using latent profile analysis. First, we explored whether different belief profiles exist. Second, we examined if the emergent belief profiles differ by demographic variables and are related to parents’ failure beliefs, goal orientation, and co-regulatory strategies. Data were collected from N = 137 parents of preschoolers who answered an online survey comprising their implicit theories about the malleability and relevance of the domains intelligence and self-regulation. We (...) identified three belief profiles: profile 1 displayed an entity theory, profile 2 showed a balanced pattern of both domains of implicit theories, and profile 3 was characterized by high incremental self-regulation theories. Analyses showed that parents differed significantly in education and their perception of child self-regulatory competence depending on profile membership, with parents in profile 1 having the lowest scores compared to parents of the other profiles. Differences in parents’ failure beliefs, goal orientation, and co-regulatory strategies were also found depending on profile membership. Parents in profile 3 reported failure-is-enhancing mindsets, and mastery-oriented strategies significantly more often than parents in profiles 1 and 2. The results provide new insights into the interplay of important domains of implicit theories, and their associations with parents’ failure beliefs, goal orientation, and co-regulatory strategies. I argue that a compelling way to articulate what is wrong with racial profiling in policing is to view racial profiling as a violation of the presumption of innocence. I discuss the communicative nature of the presumption of innocence as an expression of social trust and a protection against the social condemnation of being undeservingly investigated, prosecuted, and convicted for committing a crime. I argue that, given its communicative dimension, failures to extend the presumption of innocence are an expression of (...) disrespect. I take the New York Police Department’s stop-and-frisk policy as an example of racial profiling and argue that its use of race-based forms of suspicion as reasons for making stops is a violation of the presumption of innocence. I maintain that this systemic failure to extend the presumption of innocence to profiled groups reveals the essentially disrespectful nature of the NYPD policy. (shrink)

Background: The three-dimensional model of nurses’ moral sensitivity has typically been studied using a variable-centered rather than a person-centered approach, preventing a more complete understanding of how these forms of moral sensitivity are expressed as a whole. Latent profile analysis is a person-centered approach that classifies individuals from a heterogeneous population into homogeneous subgroups, helping identify how different subpopulations of nurses use distinct combinations of different moral sensitivities to affect their service behaviors. Objective: Latent profile analysis was used to identify (...) three distinct profiles of nurses’ moral sensitivity. Associations of the profiles with service behaviors were then examined. Methods: Five hundred twenty-five nurses from three tertiary hospitals in China were investigated with Moral Sensitivity Questionnaire and Nurses’ Service Behavior Scale. Latent profile analysis was used to analyze the data. Ethical considerations: Approval was obtained from the Ethics committee for biomedical research of Medical College, the Hebei University of Engineering. Results: A three-profile moral sensitivity model provided the best fit to the data. The resulting profiles were low moral sensitivity, moderate moral sensitivity, and high moral sensitivity. There were significant differences in service behaviors among different profiles of moral sensitivity. Conclusion: The results provide a new and expanded view of nurses’ moral sensitivity, which may be used to monitor nurses’ service behaviors comprehensively and to evaluate nursing ethics management strategies. Psychological characteristics of athletes play a key role in sport performance and may moderate and mediate the influence of technical, tactical, and physical abilities athletes show. Different authors have emphasized the special attention such psychological characteristics should receive considering the extent they can influence athletes’ behavior either in training or in competition. This paper is aimed at describing the psychological profiles of two cycling sports: triathlon and road cycling. One hundred and twenty-nine male and female professional and amateur cycling athletes (...) (35.74 years old average age ±12.79; 14.94 average number of years practicing cycling ±11.20) were assessed on different psychological characteristics. For that purpose, the Psychological Characteristics related to the Sport Performance (CPRD) Questionnaire and the Psychological Skills Inventory for Sports (PSIS) was used. Results showed significant differences among triathlon and road cyclists (Stress control = t 116 =-3.711, p = 0.000, d = 0.48 ; Influence of Performance Evaluation = t 115 =-3-115, p = 0.002, d = 0.49; Motivation = t 124 =-5.520, p = 0.000, d = 0.82; Mental Skills = t 119 =-4.985, p = 0.000, d = 1.02). There were no significant differences between men and women though there were differences among pros and amateur athletes. Triathlon professional, compared to amateurs, showed higher scores in all the psychological dimensions assessed (Stress control = t 85 = 3.005, p = 0.003, d = 1.07; Influence of Performance Evaluation = t 83 = 2.858, p = 0.005, 0.77; Motivation = t 91 = 2.721, p = 0.008, d = 0.26; Mental Skills = t 87 = 2.556, p = 0.012, d = 0.77). The results of this descriptive study contribute to establishing a model of optimal psychological profiling applied to the different cycling groups that can be used by sport psychologist, trainers, and coaches in order to promote peak performance of these athletes. Many theorists hold that outright verdicts based on bare statistical evidence are unwarranted. Bare statistical evidence may support high credence, on these views, but does not support outright belief or legal verdicts of culpability. The vignettes that constitute the lottery paradox and the proof paradox are marshalled to support this claim. Some theorists argue, furthermore, that examples of profiling also indicate that bare statistical evidence is insufficient for warranting outright verdicts.I examine Pritchard's and Buchak's treatments of these three kinds of (...) case. Pritchard argues that his safety condition explains the insufficiency of bare statistical evidence for outright verdicts in each of the three cases, while Buchak argues that her treatment of the distinction between credence and belief explains this. In these discussions the three kinds of cases – lottery, proof paradox, and profiling – are treated alike. The cases are taken to exhibit the same epistemic features. I identity significant overlooked epistemic differences amongst these three cases; these differences cast doubt on Pritchard's explanation of the insufficiency of bare statistical evidence for outright verdicts. Finally, I raise the question of whether we should aim for a unified explanation of the three paradoxes. (shrink)

In the past, deception detection research has explored whether there were specific personal characteristics that were related to lying and found that factors such as personality and morality are indeed related to lying. However, past research has usually focused on a variable-centered approach. Yet, a person-centered might be more suitable here as it allows for the study of people in an integrative manner. In this experiment, 673 students completed a questionnaire which included measures of the five factors of personality, the (...) level of moral disengagement, the perceived cognitive load when lying, lying strategies, frequency of lying and the LiES scale, a tool measuring the tendency to tell self-serving, altruistic and vindicative lies. We performed a Latent Profile Analysis to integrate personality, moral disengagement, and perceived cognitive load scores into specific profiles. Then, we related profile membership to lying behavior. We obtained four profiles, and found that extraversion, moral disengagement, and the perceived cognitive load contributed most to profile differences. We also found that lying frequency did not differ across profiles, whereas lying tendency did. In conclusion, our results suggest that several facets of the individual play a joint role in lying behavior, and that adopting a person-centered approach might be a good strategy to explore the role of interpersonal differences in lie detection research. How, exactly, must we strike the balance between security and equality? Must we insist, out of respect for the equality of persons, that the police refrain from using ethnic profiling and opt for some other strategy in their pursuit of terrorists, or must we allow the police to continue with this policy, which seems to sacrifice equality for the sake of security? This paper assesses the ethical status of ethnic profiling from the perspective of the ideal of equality. The paper (...) shows how the ethical status of ethnic profiling changes depending on how exactly we specify the egalitarian ideal. Furthermore, it argues that on a plausible interpretation of the ideal of equality, ethnic profiling is not in principle objectionable. (shrink)

Emerging adult newlywed couples often experience many demands on their time, and three common problems may surface as couples try to balance these demands—problems related to finances, sleep, and sex. We used two waves of dyadic data from 1,001 emerging adult newlywed couples to identify four dyadic latent profiles from husbands’ and wives’ financial management behaviors, sexual satisfaction, and sleep quality: Flounderers, Financially Challenged Lovers, Drowsy Budgeters, and Flourishers. We then examined how husbands’ and wives’ marital satisfaction, in relation to (...) profile membership, varied at a later wave. We found that Financially Challenged Lovers and Flourishers had significantly higher marital satisfaction than Drowsy Budgeters and Flounderers. Whereas, Financially Challenged Lovers and Flourishers did not differ in terms of marital satisfaction, Drowsy Budgeters seemed to have slightly higher marital satisfaction than Flounderers for wives only. However, we did not find evidence that these connections meaningfully differed by sex. Implications for the efforts of clinicians and educators are discussed. (shrink)

This investigation uses the technique of the profile of dialogue as a tool for the evaluation of arguments from ignorance (also called lack-of-evidence arguments, negative evidence, ad ignorantiam arguments and ex silentio arguments). Such arguments have traditionally been classified as fallacies by the logic textbooks, but recent research has shown that in many cases they can be used reasonably. A profile of dialogue is a connected sequence of moves and countermoves in a conversational exchange of a type that is goal-directed (...) and can be represented in a normative model of dialogue. Selected case studies are used to probe special features of using the profile technique as applied to arguments from ignorance of a kind that occur frequently in everyday conversational exchanges. One of these special features is the use of Gricean implicature. Another is the need to use negative profiles of argument. (shrink)

The Entrepreneurial University plays a central role in entrepreneurial ecosystems and actively influences the development of entrepreneurial human capital, which is a critical asset for many economies. There is thus a requirement for the identification and strengthening of entrepreneurial competences, but no previous studies have included any analysis of these competences in the university context using an approach based on profiles. The present study fills this gap by investigating the existence of different entrepreneurial profiles among students, based on their competences. (...) It also defines key competences that are critical for differentiating between these profiles and improving entrepreneurial competence levels more generally. To meet these objectives, a field research campaign was developed. Data on 1104 students from various degrees and faculties were collected and analyzed using a quantitative methodological approach. The results reveal the existence of four entrepreneurial competence profiles, namelylow profile,top profile,social profile, andgrit profile. Among as many as 12 possible entrepreneurial competences, the most prominent can explain to a large extent the entrepreneurial profiles of students; these are networking and professional social skills, community engagement, perseverance of effort, and consistency of interest. The results provide evidence of the importance of social capital andgrit. In addition to their contribution to the theory in this area and the development of the Entrepreneurial University paradigm, the results are also useful for the design of training strategies aimed at strengthening the levels of competence of students, thereby providing universities with tools to foster the creation of entrepreneurial human capital. Nietzsche unternimmt im Begriff des "individuellen Gesetzes" den Versuch, Individualität and Allgemeinheit so zusammenzudenken, daß die Gesetzlichkeit an die Selbstdeutung des Individuums gebunden bleibt. Dieser Begriff trägt jedoch eine innere Spannung in sich, auf die in verschiedener Weise reagiert werden kann. Der Beitrag zeigt dies zunächst am Gegensatz von Herren- und Sklavenmoral und an der Gesetzgebung des Manu . Beide sind individuelle Gesetze, die jedoch keinen Bestand haben können, weil die von ihnen Beherrschten eine allgemeinere, gerechtere Gesetzgebung einklagen. Dagegen geht (...) es dem freien Geist um Freiheit gegenüber sich selbst, um die Aufgabe, Individualität nicht neuerlich als allgemeine Eigenschaft zu fixieren. Simmels Idee des individuellen Gestzes basiert auf der Möglichkeit einer Versöhnung zwischen den Polen; das Individuum ist in den sozialen Rollen, die es einnimmt, es selbst. Die Spannung, die für Nietzsche besteht, wird dadurch aufgehoben.With the notion of an "individual law", Nietzsche tries to combine individuality and universality in a way that allows to conceive lawfulness under the perspective of the individual, and not in opposition to it. However, the notion of an individual law is characterized by a certain tension, which has led to different reactions. The paper illustrates this tension in regard to master versus slave morality. and the law of Manu . Both are individual laws which have been overcome because the ruled began to claim a more general, a more equitable legislation. On the other side, the free spirit is concerned with freedom from itself, its challenge is to see individuality not as a new general quality. Simmel's notion of the individual law is based on the possibility of a reconciliation between the opposites; the individual remains individual even in its general social roles. I argue that traditional views on which beliefs are subject only to purely epistemic assessment can reject demographic profiling, even when based on seemingly robust evidence. This is because the moral failures involved in demographic profiling can be located in the decision not to suspend judgment, rather than supposing that beliefs themselves are a locus of moral evaluation. A key moral reason to suspend judgment when faced with adverse demographic evidence is to promote social equality—this explains why positive profiling is (...) dubious, along with more familiar cases of negative profiling, and why profiling is suspect even when no particular action is at stake. My suspension-based view, while compatible with revisionary normative positions, does not presuppose them. Philosophers of all stripes can reject demographic profiling both in thought and deed.
