This book assesses and defends Kant's Critical epistemology, and the rich yet neglected resources it provides for understanding and resolving fundamental issues regarding human experience, perceptual judgment, empirical knowledge and cognitive sciences. Kenneth Westphal first examines Kant's methods and strategies for examining human sensory-perceptual experience, and then examines Kant's central, proper, and subtle attention to judgment, and so to the humanly possible valid use of concepts and principles to judge particulars we confront. This provides a comprehensive account of Kant's (...) anti-Cartesianism, the integrity of his three principles of causal judgment, and Kant's account of disciminatory perceptual-motor behaviour, including both sensory reafference and perceptual affordances. Westphal then defends the significance of Kant's subtle and illuminating account of causal judgment for three main philosophical domains: history and philosophy of science, theory of action and human freedom, and philosophy of mind. Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

The scope of this study is both ambitious and modest. One of its ambitions is to reintegrate Hegel's theory of knowledge into main stream epist~ology. Hegel's views were formed in consideration of Classical Skepticism and Modern epistemology, and he frequently presupposes great familiarity with other views and the difficulties they face. Setting Hegel's discussion in the context of both traditional and contemporary epistemology is therefore necessary for correctly interpreting his issues, arguments, and views. Accordingly, this is an issues-oriented study. I (...) analyze Hegel's problematic and method by placing them in the context of Sextus Empiricus, Descartes, Kant, Carnap, and William Alston. I discuss Carnap, rather than a Modern empiricist such as Locke or Hume, for several reasons. One is that Hegel himself refutes a fundamental presupposition of Modern empiricism, the doctrine of "knowledge by acquaintance," in the first chapter of the Phenomenology, a chapter that cannot be reconstructed within the bounds of this study. I argue that Hegel is aware of a crucial problem in Kant’s transcendental account of the conditions of human knowledge. Unless the matter of sensation is sufficiently ordered (and sufficiently varied) we could not make any cognitive judgments. In that case we could not distinguish ourselves from objects we know, and so could not be self-conscious. This is a necessary, formal and transcendental condition of possible human experience. However, it is also (as Kant acknowledged) a material – not a conceptual (...) or an intutive – condition. Consequently, Kant’s idealism cannot account for it. This provides one key to Hegel’s internal critique of Kant’s idealism. (shrink)

Is parental control over children best understood in terms of trusteeship or similar fiduciary obligations? This essay contemplates the elements of legal trusts and fiduciarity as they might relate to the moral relationship between children and parents. Though many accounts of upbringing advocate parent-child relationship models with structural resemblance to trust-like relationships, it is unclear who grants moral trusts, how trustees are actually selected, or how to identify proper beneficiaries. By considering these and other classical elements of relationships of trust, (...) this essay seeks to clarify and explore the trust model’s role, if any, in understanding children’s rights. One inescapable feature of the Covid-19 pandemic that has swept the world in 2020 is that it has shown how inter-connected and inter-dependent is the human community. It was soon apparent that the spread of the coronavirus was a global crisis calling for a global response. Yet the human community had to meet the pandemic after a period of systematic weakening of agencies of international cooperation as populist and nationalist political movements gained control of nation after nation. This put the (...) issue of internationalism, the belief that the nations of the world should work for greater mutual understanding and cooperation, high on the agenda. The focus of this article is on the role of faith, particularly the missionary dimension of Christianity, in relation to internationalism. It explores what recent thinking about Christian mission might have to contribute to the recovery of internationalism in the crisis of the 2020s. (shrink)

With a few incisive (and legitimate) criticisms of crucial experiments in psychology that purported to bring down the foundations of modern economics, together with a broad scholarly review that is praiseworthy, Gintis attempts to build a unifying framework for the behavioral sciences. His efforts fail, however, because he fails to break with the conventional methodology, which, regrettably, is the unifying basis of the behavioral sciences. As a result, his efforts will merely recapitulate the story of the past: interesting, provocative results (...) that are soon overthrown because they are limited to the conditions of the experiment. Gintis is keenly aware of this limitation – and thus meets Brunswik, but fails to recognize him; this we know because he seems unaware of the fact that Brunswik said it all – and provided a detailed defense – a half century ago. Kenneth R. Westphal presents an original interpretation of Hume's and Kant's moral philosophies, the differences between which are prominent in current philosophical accounts. Westphal argues that focussing on these differences, however, occludes a decisive, shared achievement: a distinctive constructivist account of the basic principles of justice which justifies their strict objectivity without invoking moral realism nor moral anti- or irrealism. Westphal explores how Hume developed a kind of constructivism for basic property rights and for government, and how Kant greatly (...) refined Hume's construction of justice within his 'metaphysical principles of justice', whilst preserving the core model of Hume's innovative account. Westphal contends that Hume's and Kant's constructivism avoids the conventionalist and relativist tendencies latent if not explicit in contemporary forms of moral constructivism. (shrink)

Henry Harris noted that ‘the Baconian applied science of this world is the solid foundation upon which Hegel’s ladder of spiritual experience rests’. Understanding the philosophical character of Hegel’s Philosophy of Nature requires recognizing some basic legitimate philosophical issues embedded in the development of physics from Galileo to Newton (§2). These issues illuminate the character of Hegel’s analysis of philosophical issues regarding nature (§3) and the central aims and purposes of Hegel’s philosophy of nature (§4). Hegel recognized some key weaknesses (...) in Newton’s own mathematical treatment of planetary orbits which were only rectified when Johann Bernoulli recast Newtonian gravitational theory on the basis of mathematical analysis (calculus). So reconstructed, Newtonian physics provides sufficient grounds to ascribe gravitational force to matter (Enz. §§262, 269). Hegel incorporated this important point into his illuminating accounts of causal laws of nature and natural-scientific explanation. These points reveal how Hegel’s Science of Logic and Philosophy of Nature are interdependent works, integrated in part by Hegel’s critical, moderately holistic theory of semantic meaning and reference. Highlighting these features of Hegel’s Philosophy of Nature illuminates Hegel’s emergentist account of structural and functional organization of various kinds of natural phenomena. (shrink)

Kant’s and Hegel’s transcendental argument for mental-content externalism breaks the deadlock between ‘internal’ and genuine realists. This argument shows that human beings can only be self-conscious in a world that provides a humanly recognizable regularity and variety among the things (or events) we sense. This feature of the world cannot result from human thought or language. Hence semantic arguments against realism can only be developed if realism about the world is true. Some of Putnam’s arguments for internal realism are taken (...) as cases in point, and criticized accordingly. Pragmatic realists can use this transcendental argument, because its strong modal claims are consistent with falliblist accounts of justification. (shrink)

This book is the first detailed study of Kant's method of 'transcendental reflection' and its use in the Critique of Pure Reason to identify our basic human cognitive capacities, and to justify Kant's transcendental proofs of the necessary a priori conditions for the possibility of self-conscious human experience. Kenneth Westphal, in a closely argued internal critique of Kant's analysis, shows that if we take Kant's project seriously in its own terms, the result is not transcendental idealism but realism regarding (...) physical objects. Kant was the first great anti-Cartesian in epistemology and philosophy of mind. He criticised five central tenets of Cartesianism and developed sophisticated alternatives to them. His transcendental analysis of the necessary a priori conditions for the very possibility of self-conscious human experience invokes externalism about justification and proves externalism about mental content. Semantic concern with the unity of the proposition—required for propositionally structured awareness and self-awareness—is central to Kant’s account of the unity of any cognitive judgment. The perceptual ‘binding problem’ (...) is central to Kant’s account of the unity of the object in perception. This paper outlines Kant’s development and justification of his a rationalist account of our active intellect and its roles in perceptual consciousness and in rational judgment, including our consciousness of our rational freedom, all through a radically innovative transcendental inquiry into the necessary a priori conditions for us to be conscious at all. Kant’s anti-Cartesianism is a major philosophical breakthrough far surpassing contemporary anti-Cartesian efforts. It behoves us to give Kant his due and avail ourselves of his profound insights into the nature of human mindedness. (shrink)

This paper argues that moral particularism, defined as the view that moral judgment does not require moral principles, depends upon a constricted and untenable view of rational judgment as simple syllogistic ratiocination. This I demonstrate by re-examining Nussbaum’s (1986/2002) case for particularism based on Sophocles’ Antigone. The central role of principles in moral judgment and in educational theory is supported by explicating ‘mature judgment’, which highlights key features of Thomas Green’s account of norm acquisition and of Kant’s account of the (...) autonomy of rational judgment. Hegel’s Philosophy of Right responds to two dichotomies. One is between the freedom of rational thought in its practical application and the givenness of natural impulses and desires. Against Kant Hegel argues that pure reason alone cannot determine the content of any maxim or principle of action. Thus Hegel must find a way in which the content of natural needs and impulses – the only source of content for maxims of action – can be transfigured into contents of rationally self-given (...) principles and maxims. Hegel also responds to the dichotomy between the individual agent and the social whole within which agents act. Hegel argues that this dichotomy is specious because human beings are fundamentally social practitioners and because neither social practices nor individual agents have priority over the other. There are no social practices without social practitioners and there are no social practitioners without social practices. Hegel’s response to this second dichotomy allows him to respond to the first one as well. The elaboration and specialization of natural needs and desires through exchange relations and the social division of labor transfigures the contents of those needs and desires into collectively self-given ends. The social practices producing this transfiguration and meeting these ends form the contents of implicit principles of right. These implicit principles are collectively self-given because they result from the social practices collectively developed to meet these needs. Only acts that are executed and accepted by an agent are free acts. This strong condition requires that an agent’s intentions correspond to the actual nature and consequences of his or her act. Since the aims, the principles, and the means of action are fundamentally social, these strong constraints entail that free action is possible only within a community which makes known its structure and the role of its members within it and their contribution to it, so that its members can act on the basis of that knowledge. Hegel’s theory of the state is a theory of a communal structure that makes such explicit, free action possible. In briefest compass, Hegel holds that laws are legitimate only insofar as they codify those practices that have been developed in order to achieve human freedom, and laws are obligatory only insofar as they are necessary for achieving human freedom. Hegel’s government is designed to codify and promulgate such laws. Hegel’s legislature is designed to make known to the citizens at large, through their corporate representatives, that laws have such a basis and how individual roles and actions fit within the community as a whole. There is widespread consensus that present patterns of consumption could lead to the permanent impossibility of maintaining those patterns and, perhaps, the existence of the human race. While many patterns of consumption qualify as ‘sustainable’ there is one in particular that deserves greater attention: virtual consumption. We argue that virtual consumption — the experience of authentic consumptive experiences replicated by alternative means — has the potential to reduce the deleterious consequences of real consumption by redirecting some consumptive behavior from shifting (...) material states to shifting information states. The essay begins with an explanation of the underlying theological vision that supports Catholic social teaching's commitment to the centrality of the common good and the role of solidarity as both a virtue and a norm. The vision of humanity as one family and the church as a sacrament of unity is the foundation for a communitarian ethic that prizes inclusion, participation, and relative equality in the quest for a truly just society. An array of social science studies is then (...) employed to show that economic inequality “bleeds” into other realms of public life to undermine fundamental commitments of American society, namely, equal opportunity and political democracy. The essay concludes that an understanding of Catholic social teaching promotes a critical perspective that is deeply at odds with ongoing trends in the U.S. economy. (shrink)

In this brief article, essential content from mission statements by three different church groupings is compared and contrasted. Lausanne’s Cape Town Commitment is brought together with the WCC’s Together Towards Life and the Vatican’s Evangelii Gaudium. This article identifies considerable convergences between the three agendas and sees these as grounds not only for general optimism for the future of mission, but also for meaningful dialogue and appropriate strategies for the work.

The First World War was supposed to end all wars, though soon followed WWII. Since 1945 wars continued to abound; now we confront a real prospect of a third world war. Many armed struggles and wars arise in attempts to end repressive government; still more are fomented by repressive governments, few of which acknowledge their repressive character. It is historically and culturally naive to suppose that peace is normal, and war an aberration; war, preparations for war and threats of war (...) belong to ‘normal’ human life. Our tolerance, acceptance or fostering of such repeated injustices and atrocities indicate pervasive failures to understand fundamentals of justice, and what we owe morally to ourselves and to all others, together with our responsibilities to preserve the biosphere, not merely our own store(s) of reserves. As matters both of justice and prudence we must re-orient ourselves, individually and collectively, to promote justice, peace and ecological responsibilities by identifying and instituting just forms of social cooperation, domestically and internationally. All of these are our problems, whether we recognize them or continue our pervasive negligence. We urgently require cogent understanding of the social dimensions of human judgment, rational assessment, right action, and public reason. This requires understanding (inter alia) how Kant’s explication of rational judgment and justification is fundamentally social, how these features of rational judgment and justification are constitutive of Kant’s account of individual autonomy, and how they are central to Kant’s account of proper public use of reason. Reasoning publically remains precarious, not because – as often alleged – the ‘Enlightenment project’ has failed. It has not failed, it has been thwarted, and in our public responsibilities we have too often failed it. (shrink)

This Open Access book provides both a broad perspective and a focused examination of cow care as a subject of widespread ethical concern in India, and increasingly in other parts of the world. In the face of what has persisted as a highly charged political issue over cow protection in India, intellectual space must be made to bring the wealth of Indian traditional ethical discourse to bear on the realities of current human-animal relationships, particularly those of humans with cows. Dharma, (...) yoga, and bhakti paradigms serve as starting points for bringing Hindu--particularly Vaishnava Hindu--animal ethics into conversation with contemporary Western animal ethics. The author argues that a culture of bhakti--the inclusive, empathetic practice of spirituality centered in Krishna as the beloved cowherd of Vraja--can complement recently developed ethics-of-care thinking to create a solid basis for sustaining all kinds of cow care communities. Kant famously declares that “although all our cognition commences with experience, … it does not on that account all arise from experience”. This marks Kant’s disagreement with empiricism, and his contention that human knowledge and experience require both sensation and the use of certain a priori concepts, the Categories. However, this is only the surface of Kant’s much deeper, though neglected view about the nature of reason and judgment. Kant holds that even our a priori concepts are acquired, not from (...) sensation, but “originally,” because our mind has a fundamental capacity to judge that, upon sensory stimulation, generates the Categories through its basic logical functions of judgment. This “epigenesis” of reason and our fundamental capacity to judge that drives it is the topic of Longuenesse’s fascinating book, and the source of her title. (shrink)
