Many studies have addressed the justice of public land acquisition, but few studies have addressed the question of what landowners perceive as just. Individual perceptions drive an important part of the social and scientific debates on legitimate and just land acquisition. This article addresses this gap by studying landowners’ and land purchasers’ perceptions of just land acquisition. We did this by uncovering the prevailing discourse on just land acquisition and studying the values that shaped people’s perceptions of just land acquisition. (...) The results showed that perceptions of justice are based on the values of lawfulness, decentness and equality. These values were translated into different norms that resulted in expectations pertaining to just land acquisition. Insight into the different perceptions and the prevailing discourse of just land acquisition and their underlying values increases the understanding of land acquisition processes and land policy strategies. First, it becomes apparent that land acquisition has an essential element of injustice that cannot be avoided by a good process or a just compensation fee. Second, insight in different discourses provides valuable input for debates on just land acquisition. Third, such insight shows that money is not always a sufficient means of indemnification. The combination of sufficient financial compensation, the opportunity of a new location, attractive selling conditions and accurate and open process are all important requisites to ensure that public land acquisition is perceived by the majority of landowners as just. I defend Kant’s definition of analyticity in terms of concept “containment”, which has engendered widespread scepticism. Kant deployed a clear, technical notion of containment based on ideas standard within traditional logic, notably genus/species hierarchies formed via logical division. Kant’s analytic/synthetic distinction thereby undermines the logico-metaphysical system of Christian Wolff, showing that the Wolffian paradigm lacks the expressive power even to represent essential knowledge, including elementary mathematics, and so cannot provide an adequate system of philosophy. Officially, for Kant, judgments are analytic iff the predicate is "contained in" the subject. I defend the containment definition against the common charge of obscurity, and argue that arithmetic cannot be analytic, in the resulting sense. My account deploys two traditional logical notions: logical division and concept hierarchies. Division separates a genus concept into exclusive, exhaustive species. Repeated divisions generate a hierarchy, in which lower species are derived from their genus, by adding differentia(e). Hierarchies afford a straightforward sense of containment: (...) genera are contained in the species formed from them. Kant's thesis then amounts to the claim that no concept hierarchy conforming to division rules can express truths like '7+5=12.' Kant is correct. Operation concepts ( ) bear two relations to number concepts: and are inputs, is output. To capture both relations, hierarchies must posit overlaps between concepts that violate the exclusion rule. Thecontributions to informal logic by StephenToulmin and Douglas Walton are explicated andtheir relevance for evidence-based medicine isdiscussed in relation to a common clinicalscenario: hypertension management. CONTRARY TO HUME’S VIEW, THERE COULD BE GOOD HISTORICAL EVIDENCE BOTH THAT A VIOLATION HAD OCCURRED AND THAT IT WAS DUE TO THE ACT OF A GOD.

The distinction between the agent-relative and the agent-neutral plays a prominent role in recent attempts to taxonomize normative theories. Its importance extends to most areas in practical philosophy, though. Despite its popularity, the distinction remains difficult to get a good grip on. In part this has to do with the fact that there is no consensus concerning the sort of objects to which we should apply the distinction. Thomas Nagel distinguishes between agent-neutral and agent-relative values, reasons, and principles; Derek Parfit (...) focuses on normative theories (and the aims they provide to agents), David McNaughton and Piers Rawling focus on rules and reasons, Skorupski on predicates, and there are other suggestions too. Some writers suspect that we fundamentally talk about one and the same distinction. This work is about practical reasons for action rather than theoretical reasons for belief. Moreover, focus is on whether reasons do or do not essentially refer to particular agents. A challenge that undermines the dichotomy in this sense is posed. After having rejected different attempts to defend the distinction, it is argued that there is a possible defence that sets out from Jonathan Dancy’s recent distinction between enablers and favourers. There has been much discussion about how to obtain legitimacy at macro-level priority setting in health care by use of fair procedures, but how should we consider priority setting by individual clinicians or health workers at the micro-level? Despite the fact that just health care totally hinges upon their decisions, surprisingly little attention seems being paid to the legitimacy of these decisions. This paper addresses the following question: what are the conditions that have to be met in order to ensure (...) that individual claims on health care are well aligned with an overall concept of just health care? Drawing upon a distinction between individual and aggregated needs, I argue that even though we assume the legitimacy of macro-level guidelines, this legitimacy is not directly transferable to decisions at micro-level simply by adherence to the guidelines’ recommendation. Further, I argue that individual claims are subject to the formal principle of equality and the demands of vertical and horizontal equity in a way that gives context- and patient-related equity concerns precedence over equity concerns captured at the macro-level. I conclude that if we aim to achieve just health care, we need to develop a complementary framework for legitimising individual judgment of patients’ claims on health care resources. The use of the historical development of representationalism to pose a central problem in contemporary cognitive science is unique.

Scholars and practitioners across domains are increasingly concerned with algorithmic transparency and opacity, interrogating the values and assumptions embedded in automated, black-boxed systems, particularly in user-generated content platforms. I report from an ethnography of infrastructure in Wikipedia to discuss an often understudied aspect of this topic: the local, contextual, learned expertise involved in participating in a highly automated social–technical environment. Today, the organizational culture of Wikipedia is deeply intertwined with various data-driven algorithmic systems, which Wikipedians rely on to help manage (...) and govern the “anyone can edit” encyclopedia at a massive scale. These bots, scripts, tools, plugins, and dashboards make Wikipedia more efficient for those who know how to work with them, but like all organizational culture, newcomers must learn them if they want to fully participate. I illustrate how cultural and organizational expertise is enacted around algorithmic agents by discussing two autoethnographic vignettes, which relate my personal experience as a veteran in Wikipedia. I present thick descriptions of how governance and gatekeeping practices are articulated through and in alignment with these automated infrastructures. Over the past 15 years, Wikipedian veterans and administrators have made specific decisions to support administrative and editorial workflows with automation in particular ways and not others. I use these cases of Wikipedia’s bot-supported bureaucracy to discuss several issues in the fields of critical algorithms studies; critical data studies; and fairness, accountability, and transparency in machine learning—most principally arguing that scholarship and practice must go beyond trying to “open up the black box” of such systems and also examine sociocultural processes like newcomer socialization. The idea of freedom plays a key role in Plato's moral and political thought. In the Republic justice is shown to be beneficial because the just man alone is truly free. There are parallels here with modern discussions of freedom. The Laws argues that to be free a city must avoid the extremes of liberty and of authoritarianism. The legislator should rely on persuasion, not force, so that people willingly obey his laws. The underlying idea is that we are free (...) if we willingly follow the demands of reason rather than being coerced by external forces or by unruly desires. (shrink)

Following the 1980 US Supreme Court decision to allow a patent on a living organism, debate has continued on the moral issues involved in biotechnology patents of many kinds and remains a contentious issue for those opposed to the use of biotechnology in industry and agriculture. Attitudes to patenting in the life sciences, including those of the research scientists themselves, are analysed. The relevance of morality to patent law is discussed here in an international context with particular reference to the (...) law of the European Patent Convention administered by the European Patent Office (EPO). The EPO has been the principal forum for opposition to such patents and the few cases under dispute in the EPO are reviewed, including patents for the onco-mouse, human relaxin gene, and the PGS herbicidally resistant plant (gmo). Morality provisions in the European Parliament and Council Directive 98/44/EC are also summarised. (shrink)

In this paper, the Helmholtz equation with quadratic damping themes is used for modeling the dynamics of a simple prey-predator system also called a simple Lotka–Volterra system. From the Helmholtz equation with quadratic damping themes obtained after modeling, the equilibrium points have been found, and their stability has been analyzed. Subsequently, the harmonic oscillations have been studied by the harmonic balance method, and the phenomena of resonance and hysteresis are observed. The primary and secondary resonances have been researched by the (...) multiple-scale method, and the conditions of stability of the amplitudes of oscillations are determined. Chaos is detected analytically by the Melnikov method and numerically using the basin of attraction, the bifurcation diagram, the Lyapunov exponent, the phase portrait, and the Poincaré section. The effects of all the parameters of the system are analyzed in detail, and special emphasis is placed on the new parameters. Through this analysis, the complex phenomena such as hysteresis, bistability, amplitude jump, resonances, and chaos have been obtained. The control of the parameters and the necessary conditions to control the aforementioned phenomena have been found. (shrink)

The debate about the relative epistemic weights carried in favour of a theory by predictions of new phenomena as opposed to accommodations of already known phenomena has a long history. We readdress the issue through a detailed re-examination of a particular historical case that has often been discussed in connection with it-that of Mendeleev and the prediction by his periodic law of the three 'new' elements, gallium, scandium and germanium. We find little support for the standard story that these predictive (...) successes were outstandingly important in the success of Mendeleev's scheme. Accommodations played an equal role-notably that of argon, the first of the 'noble gases' to be discovered; and the methodological situation in this chemical example turns out to be in interesting ways different from that in other cases-invariably from physics-that have been discussed in this connection. The historical episode when accurately analysed provides support for a different account of the relative weight of prediction and accommodation-one that is further articulated here. (shrink)

The results generated by experimentalists in psychology and economics haveled to numerous advances in the study of human decision making under risk.Camerer (1995) and Rabin (1998) provide excellent reviews of the relevantliterature. These results clearly display the gap between normative theoriesof ideal behavior and descriptive theories of observed behavior. The mostprominent result is loss aversion – the observation that a loss is given greatervalue than a gain of an equal size – and the resulting S-shaped utility function.Rabin puts the key (...) point as follows: ``Researchers have identified a pervasive feature of reference dependence: In a wide variety of domains, people are significantly more averse to losses than they are attracted to same size gains''(Rabin 1998, 13–14). In what follows, I will show that the ``wide variety of domains'' is wide indeed. In particular, I will review the effects of the S-shaped utility function on the resolution of the decision to commit a crime, to decision to violate professional ethics, and the decision to participate in a rebellion. I argue that the conjunctive distribution of permissibility over or, which is a puzzling feature of free-choice permission is just one instance of a more general class of conjunctive occurrences of the word, and that these conjunctive uses are more directly explicable by the consideration that or is a descendant of oper than by reference to the disjunctive occurrences which logicalist prejudices may tempt us to regard as semantically more fundamental. I offer an account of how the disjunctive uses of (...) or may have come about through an intermediate discourse-adverbial use of or, drawing a parallel with but, which, etymologically, is disjunctive rather than conjunctive and whose conjunctive uses seem to represent just such a discourse-adverbial application. The present comment on Solari and Natiello’s paper values their constructivist approach to Newtonian Mechanics. My critical point concerns only the link between the concept of force and phenomena. It will be shown that the idealised form of the law of inertia created by the authors avoids criticism of the law and that this law leads to the concept of force as the cause of acceleration. This concept appears in the authors’ reconstruction as an assumption. They add that this assumption (...) must be contrasted with experiments. Following this, I address an experiment, in which the force that is taken as the cause of acceleration, is not present in the phenomenon at stake. As it thus does not satisfy the property of locality, which any cause has to, force cannot be a cause. (shrink)

This chapter affirm a thinking of time as difference. It does not claim to figure time as such, because whatever time is, time remains essentially in excess of figuration. Instead this chapter elaborates instances of the effort to think time as difference in Aristotle, Henri Bergson, and Luce Irigaray. I suggest that each of these philosophers affirms the fundamentally elusive nature of time while also articulating valuable ideas for thinking time as difference.
