In Homelessness, Liberty and Property, Terry Skolnik establishes a novel theory about the government's duties to end homelessness, maintain public property's value, and legitimize laws that regulate public space. In doing so, Skolnik provides new insight into how the property law system and the regulation of public space limit unhoused persons' freedom and political equality. The book deepens our understanding of how various areas of law, such as constitutional law, legal philosophy, criminal law, and property law, approach the (...) reality of homelessness and advances original arguments to provide new justifications for the right to housing. Many jurisdictions confer a constitutional right to be protected against cruel and unusual punishments. This right is typically justified by three considerations. First, cruel and unusual punishments undermine human dignity. Second, such punishments shock the community’s conscience or violate evolving standards of decency. Third, grossly excessive sanctions violate proportionality constraints. This article advances an additional justification for the prohibition against cruel and unusual punishments. Drawing on Kantian theories of public authority, republicanism, and fiduciary theories of legal authority, it argues that (...) cruel and unusual punishments are objectionable because they constitute a form of legislative gross negligence that the Constitution prohibits. The core arguments of this article demonstrate why lawmakers have a fiduciary duty to ensure that the punishments they enact do not inflict needless harm and suffering—an obligation that requires them to enact sanctions that respect proportionality constraints. Lawmakers engage in legislative gross negligence when they enact cruel and unusual sanctions that are either indifferent to individuals’ interests to avoid unnecessary harm or depart significantly from the applicable standard of care. Ultimately, the right to be protected against cruel and unusual sanctions safeguards individuals against legislative gross negligence that results in grossly excessive punishments. (shrink)

This book is divided into three parts: in Part I, R. M. Hare offers a justification for the use of philosophy of language in the treatment of moral questions, together with an overview of his moral philosophy of ‘universal prescriptivism’. The second part, and the core of the book, consists of five chapters originally presented as a lecture series under the title ‘A Taxonomy of Ethical Theories’. Hare identifies descriptivism and non‐descriptivism as the two main positions in modern moral philosophy. (...) The former he divides into Naturalism and Intuitionism, and the latter into Emotivism and Rationalism. Hare argues that all forms of descriptivism tend to lead to Relativism because the truth conditions of moral statements are culturally variant. Of the positions discussed, only Hare's own position, a form of Rationalism, which he calls Universal Prescriptivism, meets all of the requirements that an adequate ethical theory should meet. Part III consists of Hare's previously published essay ‘Could Kant have been a Utilitarian?’ (Utilitas 5, 1993). We discuss five kinds of representations of rationales and provide a formal account of how they can alter disputation. The formal model of disputation is derived from recent work in argument. The five kinds of rationales are compilation rationales, which can be represented without assuming domain-knowledge (such as utilities) beyond that normally required for argument. The principal thesis is that such rationales can be analyzed in a framework of argument not too different from what AI already has. The result is (...) a formal understanding of rationales, a partial taxonomy, and a foundation for computer programs that represent and reason with rationales.The five kinds of rationales are as follows: (c)ompression and (s)pecialization, which yield rules, and (d)isputation, which yields a decision. These are modeled as potentially changing the focus of the dispute. Then there are (f)it, a rationale for rules, and (r)esolution, a rationale for decisions. These cannot be modeled as simply; they force disputation to a meta-level, at least temporarily. (shrink)

This remarkable collection of almost 1,400 aphorisms was originally published in three instalments. The first appeared in 1878, just before Nietzsche abandoned academic life, with a first supplement entitled The Assorted Opinions and Maxims following in 1879, and a second entitled The Wanderer and his Shadow a year later. In 1886 Nietzsche republished them together in a two-volume edition, with new prefaces to each volume. Both volumes are presented here in R. J. Hollingdale's distinguished translation with a new introduction by (...) Richard Schacht. In this wide-ranging work Nietzsche first employed his celebrated aphoristic style, so perfectly suited to his iconoclastic, penetrating and multi-faceted thought. Many themes of his later work make their initial appearance here, expressed with unforgettable liveliness and subtlety. In his very interesting book The Grounds of Moral Judgement, Dr. G. R. Grice tries to reconstitute contract theory so as to give an account of morality such that moral requirements can be explained in terms of what he calls the contract ground. He wants to go on and argue from this that it is irrational to be immoral, but my concern lies immediately with the contract ground. I think that faults can be found in the setting up of the (...) contract ground, which is the core of Grice's theory. (shrink)

In 1962 appeared one of the classic articles in Anglo-Saxon manuscript studies, the publication of two eleventh-century fragments of leaves of Old English found in the binding of a seventeenth-century printed book in the library of the University of Kansas, Lawrence. The fragment that more nearly concerns the present article now carries the shelf mark Pryce MS C2:1 in the Kenneth Spencer Research Library . It is a large part of a single leaf from The Legend of the Holy Cross (...) before Christ, an edifying work known in full only in a twelfth-century copy, Oxford, Bodleian Library, MS Bodley 343, fols. 14v–20v . Working from a photograph the great paleographer and codicologist N. R. Ker attributed the hand of the Kansas fragment to the scribe who also wrote the texts of two bits of the same work found in the library of Matthew Parker, archbishop of Canterbury , at Corpus Christi College, Cambridge, now MS 557 . He concluded, no doubt rightly, that all three are part of one manuscript. (shrink)

Interpretive Political Science is the second of two volumes featuring a selection of key writings by R.A.W. Rhodes. Volume II looks forward and explores the 'interpretive turn' and its implications for the craft of political science, especially public administration, and draws together articles from 2005 onwards on the theme of 'the interpretive turn' in political science. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of research (...) methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. The supervenience thesis about value customarily expresses two intuitions: (i) that there is some kind of dependence between the value and the natural properties of the value bearer; (ii) that if you assert that x is valuable and if you agree that y is relevantly similar to x, with regard to natural properties, you must be prepared to assert that y too is valuable. R M Hare’s account of supervenience is problematic since it only expresses (ii) but not (i). A (...) solution to this problem is outlined, which ought to be endorsable by a prescriptivist such as Hare. (shrink)

Though nominalism is a major presupposition in academia and western society, R. Scott Smith shows that nominalism undermines all knowledge whatsoever. In light of the many clear examples of knowledge that we do have, nominalism should be replaced by a realist view of properties.

The key word in the title of this book is "essay," for Strawson has not written an introduction to Kant, nor a commentary on the Critique. It would be closer to truth to say that Strawson has attempted to extract and to translate into a contemporary idiom what he takes to be philosophically important in the Critique. Kant's major positive achievement, according to Strawson, is the partial carrying out of a certain program, viz., "that of determining the fundamental general structure (...) of any conception of experience such as we can make intelligible to ourselves." But this program can be dissociated from the Kantian motif that the structure of experience is "imposed by our capacities." Thus Strawson speaks of the "doctrinal fantasies of transcendental idealism." Given Strawson's concern with what he takes to be Kant's positive achievement, he doesn't hesitate to expose the weakness of some of Kant's arguments, to restate many of them in a more convincing way, or even to supply new arguments. But Strawson also exhibits a remarkable sensitivity to many recondite aspects of the Critique, e.g., the role of "pure intuition" in Kant's theory of geometry, and the status of "self-consciousness." The result of Strawson's essay is a philosophically exciting encounter where one can learn as much about Kant as he can about Strawson's own central concerns, and indeed about some of the most central issues of philosophy, both past and present.—R. A defence of the idea that there are sui generis duties of love: duties, that is, that we owe to people in virtue of standing in loving relationships with them. I contrast this non‐reductionist position with the widespread reductionist view that our duties to those we love all derive from more generic moral principles. The paper mounts a cumulative argument in favour of the non‐reductionist position, adducing a variety of considerations that together speak strongly in favour of adopting it. The first three chapters discuss "death" or "cessation" in inorganic, organic, and human nature. The last resumes the history of Western opinion on the subject. The subtitle, "an outline of an integrationist philosophy," indicates no facile eclecticism but a willingness to avoid absolutes. The main asset of this enormously learned (...) book is the brilliance with which the author leads us through a labyrinth of conflicting attitudes and presuppositions, always sustained by the dynamism of an inquiry in which doubt is not an abyss but a ground.--A. A discussion of the influence of Nietzsche in the Spanish-speaking world, extensive in scope but lacking in depth. Rukser fails to evaluate properly the extent and significance of Nietzsche's effect upon Machado, and he treats Baroja at length but superficially. The bibliography of works on Nietzsche in Spanish is unusually extensive. Unfortunately his acquaintance with the material often does not extend beyond the title, and many important works are left unevaluated.--A. R.

This voluminous treatise develops a "temporal" theory of knowledge out of the basic premisses of Sein und Zeit. It depends completely on Heidegger, aping his style as well as his terminology.--A. R.

Diagnosing the "breakdown of modern philosophy" as a result of a neglect of existence and metaphysics, leading to a radical separation of theory and practice, the author examines the attempts of existentialism to correct the shortcomings of post-Cartesian "intellectual subjectivity." The book begins with a short history of existentialism, following which are critical expositions of Jaspers, Sartre, Heidegger and Marcel. The range of topics considered--epistemology, ethics and ontology--prevents detailed discussion of any single problem, and both the exposition and the criticism (...) remain on a very general level. The final chapters of the book are devoted to correcting what the author considers the excesses of the existentialistic reaction to intellectualism by supplementing it with realism. Here, however, he promises more than he delivers. Though sometimes too facile, the book constitutes an important attempt to come to grips with existentialism by relating it to trends in traditional philosophy.--A. R. (shrink)

This is much more than a translation of Binswanger's important papers. Needleman's stimulating introduction explicates the core of Binswanger's Daseinanalyse. Focusing his attention on what Needleman calls the "existential a priori," he attempts to show how Binswanger's thought is related to the tradition of Kant, Husserl and Heidegger. In a suggestive analysis of the nature of explanation, Needleman also argues that Binswanger's Daseinanalyse complements Freudian psychoanalysis. A well-designed study which serves as an excellent introduction to the thought of Binswanger and (...) the more general topic of existential psychoanalysis.—R. J. B. (shrink)

This autobiography is a sheer joy to read. It can be read solely for the biographical information it provides, especially of Sartre's childhood. But it combines the best of Sartre's philosophical and literary skills and is an example of what might be called "phenomenological biography." Sartre, in describing his youth, self-referentially exhibits in a vivid and concrete way the themes that have preoccupied him as an intellectual. The crisis to which the title refers concerns the "progressive deterioration of accurate knowledge of the self and of the right relation between the self and the culture." Freud's contribution to our understanding of the self in culture is deftly outlined, and it is suggested that his theories of culture are not so fantastic as has often been supposed.--D. R.

This magnificent volume is the basic text for the study of Jung. Originally published in 1912 under the title, Wandlungen und Symbole der Libido, it marked Jung's first serious deviation from Freudian psychoanalysis and led to the complete break between the two men the following year. The chapter on "The Concept of Libido" gives Jung's reasons for generalizing this crucial notion from its specifically sexual meaning to that of psychic energy. The predicament itself, namely the gulf between knowledge and faith, is not disposed of in any definitive manner, but many points that must be considered on both sides are discussed in a way that is both critical and fair.--D. This work, the Yale Terry Lectures for 1954, provides a condensed survey of historiography from the earliest times to the present day. Comments on individual authors are brief but deft. The author renews his polemic against Toynbee and other system-builders who impose imaginative constructions on history. A tone of genteel common sense and judicious balance pervades the work; this makes it, if unexciting, at least quite satisfying.--D. R.

With his usual conciseness and lucidity, Körner attempts to show what philosophy is by looking at what it does, i.e., by investigating its problems, its branches and its history. Körner begins by setting out classic problems ranging from the problem of class-existence to the problem of freedom, and follows this by an investigation of various methodologies. After this introductory material the bulk of the book ranges over the central problems of most branches of philosophy and concludes with a brief sketch (...) of the history of philosophy. Of special note is Körner's treatment of metaphysics to which he gives an entire section of almost seventy pages. Those familiar with Körner's other work will find it a concise summary of his notion of metaphysics as exhibition and/or replacement-analysis of categorial frameworks. Also of note is his refreshing treatment of philosophy of mind. He sees the problem of intentionality as the chief consideration for that branch of philosophy. Although he makes mention of the linguistic approach to philosophy of mind his main thrust is to set the problems in Brentano's terms and show how the mind-body problem and theories of truth are handled from that framework. There are some drawbacks in the book. First: given the length of his treatment of metaphysics one could wish that somewhere Körner in his explication of metaphysics had given some recognition to the realistic alternatives to his transcendental metaphysics. Second: one must wonder to whom the book is addressed. The conciseness of Körner's style allows him to range over an unbelievably large area, but in such a pithy manner that it seems almost unimaginable that the educated layman will be able to follow the presentations and arguments, particularly those interspersed with logical notation. For example, how much value is there in condensing the logic of truth-functions, quantification and axiomatization into less than ten pages? For those in the field it is repetitive, for those not, it must be nearly unintelligible. One feels Körner really wanted to write a defense of metaphysics. This may have been a more efficacious project eliminating the need to write first for one audience then for another. The book is concise, lucid, and illuminating.--R. F. D. (shrink)

This is a systematic and critical account of Berkeley’s philosophy of science. Brook’s intention is to evaluate Berkeley’s analysis of significant scientific concepts, his general theories in optics, physics, and mathematics, and finally Berkeley’s own interpretation and criticism of Newton’s principles. That Berkeley’s writings are pervaded with ambiguities, inconsistencies, and misinterpretations of Newton seems to be the conclusion that Brook reaches, although he does distinguish in the writings the areas in which he feels Berkeley is on target. Berkeley conceived the (...) purpose of science to be the practical mastery of nature, and his philosophy is indicative of a phase in the evolution of a "new" science that had its roots as far back as Galileo who envisioned a universe that could be read off in terms of mathematical relationships. This view entailed the overthrow of traditional physics and its concern with substantial forms and qualitative changes. As Brook points out, the object of physics for Berkeley is a phenomenal order that can at best display only uniformities, efficient causality belongs to the realm of metaphysics. Brook does not go into the metaphysical or historical foundations of Berkeley’s philosophy of science, but his first chapter on the theory of signification presents sufficient background for the more detailed and complex chapters that deal with his theory of vision, philosophy of physics and mathematics. This is not an easy book to read, and the chapter on Berkeley’s mathematics may prove to be especially difficult to those who lack an orientation to this field. Yet Brooks could hardly do better than he does considering the obscurities and obfuscatory trappings that are to be found in the primary sources from which he is working. A good bibliography is included that should serve to facilitate a reading of this book. Brook’s study is the only work to date that takes into account Berkeley’s scientific works as a whole and not just some aspects.—K.R.M. (shrink)
