This article tries to confront certain difficulties and reefs that there presents the analysis of the contemporary Law. Is it possible still to formulate new conceptions of Law? How does it affect in the juridical world the current tension between corruption and regeneration? Is it possible to maintain a relation between the theory and the practice of Law? Given the confluence of the problematics, it might say synthetically that the theoretical aspects of Legislation and Jurisprudence have to agree with the (...) practical aspects. But how do we reach the general just thing for legislation and the particular just thing for court decision in the Constitutional Contemporary State? In the face of the extent and complexity of these problems the author of this article centres on approach basically what names the judicial equitable act. (shrink)

El derecho natural spinozista es el concepto central que articula este estudio. Y en relación con el derecho natural trataremos de explicar otros conceptos fundamentales de la filosofía de Spinoza: el común decreto, las supremas potestades y la salvación del pueblo o concordia. Los elementos a analizar son, pues, la materia, la forma, los agentes y los fines. El autor de este artículo parte de un presupuesto simple: el derecho natural representa el aspecto material del pensamiento de Spinoza. Ahora bien, (...) así como el derecho natural nos debe dar razón de la materialidad en la filosofía de Spinoza, lo que él llama el común decreto nos puede ayudar a describir el aspecto formal. Por otro lado, lo que Spinoza denomina las supremas potestades nos pueden servir para descubrir el plano de los agentes. Present research proposes the application of unsupervised and supervised machine-learning techniques to characterize Android malware families. More precisely, a novel unsupervised neural-projection method for dimensionality-reduction, namely, Beta Hebbian Learning, is applied to visually analyze such malware. Additionally, well-known supervised Decision Trees are also applied for the first time in order to improve characterization of such families and compare the original features that are identified as the most important ones. The proposed techniques are validated when facing real-life Android malware data by (...) means of the well-known and publicly available Malgenome dataset. Obtained results support the proposed approach, confirming the validity of BHL and DTs to gain deep knowledge on Android malware. (shrink)

Automatic control of physiological variables is one of the most active areas in biomedical engineering. This paper is centered in the prediction of the analgesic variables evolution in patients undergoing surgery. The proposal is based on the use of hybrid intelligent modelling methods. The study considers the Analgesia Nociception Index to assess the pain in the patient and remifentanil as intravenous analgesic. The model proposed is able to make a one-step-ahead prediction of the remifentanil dose corresponding to the current state (...) of the patient. The input information is the previous remifentanil dose, the ANI variable and the electromyogram signal. Modelling techniques used are Artificial Neural Networks and Support Vector machines for Regression combined with clustering methods. Both training and validation were done with a real dataset from different patients. Results obtained show the potential of this methodology to calculate the drug dose corresponding to a given analgesic state of the patient. (shrink)

Current suggestions for capacities that should be targeted for moral enhancement has centered on traits like empathy, fairness or aggression. The literature, however, lacks a proper model for understanding the interplay and complexity of moral capacities, which limits the practicability of proposed interventions. In this paper, I integrate some existing knowledge on the nature of human moral behavior and present a formal model of prosocial motivation. The model provides two important results regarding the most friction-free route to moral enhancement. First, (...) we should consider decreasing self-interested motivation rather than increasing prosociality directly. Second, this should be complemented with cognitive enhancement. These suggestions are tested against existing and emerging evidence on cognitive capacity, mindfulness meditation and the effects of psychedelic drugs and are found to have sufficient grounding for further theoretical and empirical exploration. Furthermore, moral effects of the latter two are hypothesized to result from a diminished sense of self with subsequent reductions in self-interest. (shrink)

Corporate social responsibility (CSR) has become a much-discussed subject in the business world. The Internet has become one of the main tools for CSR information disclosure, allowing companies to publicise more information less expensively and faster than ever before. As a result, corporations are increasingly concerned with communicating ethically and responsibly to the diversity of stakeholders through the web. This paper addresses the main question as whether CSR information disclosure on corporate websites is influenced by country of origin and/or industry (...) sector. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). Based on the data studied, country of origin has a stronger influence over CSRIDOW than industry sector. (shrink)

This article asks the question “Why did Plato not write the ‘unwritten doctrine’?” and answers it by citing a combination of two obstacles. The first derives from the limitations of the episteme available to an embodied soul about the essence of the good. Even if the dialectician has access to some kind of knowledge, the mismatch between the unchanging essence of the good and the precarious logoi which aim to identify it (and allow others some measure of access to it) (...) can never fully be overcome. At best, Socrates (or Plato) can lead souls to an incomplete account of it: It is possible that even the most expert dialectician can only have a claim to knowledge, but no absolute certainty. Another obstacle lies in the audience or readership itself: No shortcut to understanding is possible, and yet a mere written presentation, which is all they have, is just such a shortcut, and so represents an empty promise. In memory of Charles H. Kahn (1928–2023), a letter of his from September 5, 1989, concerning the question “Why did Plato not write the ‘unwritten doctrine’?” is published, along with some comments. En este artículo me propongo analizar dos aspectos, a menudo obviados, de la teoría kantiana del conocimiento. Se trata de la teoría del dar por verdadero y de su conexión con las hipótesis. En una primera aproximación intentaré precisar qué distingue a la opinión de otros modos de dar por verdadero como lo son el saber y la creencia. En segundo lugar, habiendo dado debida cuenta de qué son las opiniones, intentaré explicar por qué Kant considera que las hipótesis son (...) opiniones. En tercer y último lugar, pondré de manifiesto qué entiende Kant por hipótesis y de qué tipo de inferencia tiene en mente cuando habla de éstas. (shrink)

El desarrollo de internet en los últimos años ha sido espectacular. Con la explosión del internet de las cosas (IoT) el procesamiento de datos incrementa su complejidad, pero también sus beneficios. No obstante, en la última década han surgido periódicamente noticias que nos muestran una serie de efectos de esta tecnología, alejados de la visión casi mítica que siempre ha tenido y que pudiera afectar a elementos básicos de nuestra democracia. En este trabajo se señalan tres de los principales retos (...) que tienen nuestros Estados democráticos de derecho. El primero es el de los datos y la forma en qué son procesados. El segundo es el uso de la tecnología de la información para la vigilancia de la ciudadanía con el uso de instrumentos que vulneren las garantías contempladas por los derechos fundamentales. Finalmente, la manera en que internet impacta en la formación y educación cívica. Se finalizarán con unas breves conclusiones donde se contemplarán algunas propuestas. (shrink)

In this I draw attention to the strangeness (atopia) that Plato’s Republic has not only for Plato’s contemporaries, but also for us. This strangeness for us consists of the fact that Plato’s Republic does not allow for a plurality of philosophical opinions, but enforces one true philosophy (philosophia alêthê) or one conception of the Good to all citizens. The platonic Republic describes not only a state, but also a kind of pre-Christian church. Second, I emphasize that the Socratic principle in (...) which every soul does everything for the Good (panta prattei) can be translated in two ways: Every soul does everything for the sake of the Good, or goes to all lengths for the sake of the Good. Depending on the different translations, we have a different picture of the platonic Socrates in the Republic, an intellectualiste Socrates for whom irrational desires do not exist, or a Socrates who also accepts irrational desires. Third, I discuss the laughter after Socrates’ claim that the Good is even “beyond being”. Who here is laughing about whom, Glaucon about Socrates, or Socrates about Glaucon, or perhaps Plato about himself? (shrink)

The article first gives an exegesis of the famous passage in the "Republic", 505d11-506a2. Attention is drawn to the fact that the principle that every soul does everything for the Good can be translated in two ways: Every soul does everything for the sake of the Good, or goes to all lengths for the sake of the Good. Depending on the different translations, we have a different picture of the platonic Socrates in the Republic, an intellectualistic Socrates for whom irrational (...) desires do not exist, or a Socrates who also accepts irrational desires. The article favours the first one. Then it attempts to show that we can elucidate some dark points in the Socratic thesis that the Good is what every soul pursues and for which every soul does everything, with the help of Aquinas’s distinction between it actio hominis and actio humana. Finally, the article outlines three substantive answers to the question “What is the Good?” – the henological, the perfectionist and the structuralist. Instead of advancing a new answer, the article suggests an uncontroversial formal starting point for an answer to this question. (shrink)

Así lo pone de manifiesto el prólogo en el que Avendeuth dedica la traducción del De anima al Arzobispo de Toledo. En la transmisión medieval de la filosofía se concreta la significación que la transmisión del saber en general tiene para la historia de la filosofía del Occidente medieval como búsqueda (...) de una cultura cristiana que pudiera estar de acuerdo con los progresos de la razón humana. In ‘A politics of reminding: Khoisan resurgence and environmental justice in South Africa’s Sarah Baartman district’, Burnett et al. scrutinize the memory activism of the Gamtkwa Khoisan Council, which is part of the wider ‘Khoisan resurgence’ sweeping across post-apartheid South Africa. Although the authors missed important nuances, they also pointed out flaws in the way I used Niezen’s ‘therapeutic history’ [Niezen, R. (2009). The rediscovered self: Indigenous identity and cultural justice. McGill-Queen’s Press] in my work to account for why Khoisan (...) activists turn to the past. I therefore not only respond to their criticism, but also revise aspects of my theoretical framework. Therapeutic history is not divorced from material concerns. Nor is it representative of all engagements with the past by indigenous people or simply the opposite of academic history. Instead, by drawing on my ethnographic fieldwork and theorizing alongside the Khoisan, I show how it captures emic discourses on the past that entangle notions of indigenous identity, healing, and history in order to resist settler colonialism and its oppressive etic histories. While the concept of therapeutic history has its limitations, it effectively highlights indigenous people’s agency in the face of settler colonialism in South Africa and elsewhere. (shrink)

It is presently unclear whether a distinct “rural ethics” of navigating professional boundaries exists, and if so, what theoretical approaches may assist practitioners to manage overlapping relationships. To be effective clinicians while concurrently partaking in community life, practitioners must develop and maintain safe, ethical, and sustainable therapeutic relationships in rural and remote healthcare. A narrative review was conducted identifying a significant body of qualitative and theoretical literature which explores the pervasiveness of dual relationships for practitioners working in rural and remote (...) healthcare. Rather than viewing dual relationships as ethically unacceptable, much contemporary work focusses on the lived experiences of healthcare workers and explores what approaches may be available that both protect the therapeutic relationship while recognizing the unique nature of rural and remote healthcare practice. We conclude that practitioners must have a means of operating within a contextually informed ethics of professional boundaries. Drawing on pre-existing work, one schema is proposed that could form the basis for further engagement through interactive teaching sessions, professional development, mentoring, or guidelines. There have been two major lines of research aimed at capturing resource-bounded players in game theory. The first, initiated by Rubinstein (), charges an agent for doing costly computation; the second, initiated by Neyman (), does not charge for computation, but limits the computation that agents can do, typically by modeling agents as finite automata. We review recent work on applying both approaches in the context of decision theory. For the first approach, we take the objects of choice in a (...) decision problem to be Turing machines, and charge players for the “complexity” of the Turing machine chosen (e.g., its running time). This approach can be used to explain well-known phenomena like first-impression-matters biases (i.e., people tend to put more weight on evidence they hear early on) and belief polarization (two people with different prior beliefs, hearing the same evidence, can end up with diametrically opposed conclusions) as the outcomes of quite rational decisions. For the second approach, we model people as finite automata, and provide a simple algorithm that, on a problem that captures a number of settings of interest, provably performs optimally as the number of states in the automaton increases. The debate over Plato’s “ so called unwritten doctrines”, which he communicated only to a small circle of trusted disciples, has caused a stir among philosophers in recent decades. Rafael Ferber assumes a differentiated position in this controversy. He is convinced that the unwritten doctrines did exist, but that Plato, for reasons inherent in the process of gaining knowledge, was unable to communicate these doctrines even to his closest disciples. In this book, Ferber outlines the discussion and summarizes the (...) standpoints of greatest interest. Ever since Aristotle, we have known that Plato did not put his most important teachings into writing, but instead communicated them only orally to the inner circle of his disciples. While the extant dialogues merely pass down Plato’s “exoteric” doctrines, his most important “esoteric” insights were not meant for the general public. In the meantime, the contents and the significance of Plato’s “unwritten doctrines” have become the subject of debate in philosophical circles. Fifteen years ago, at the height of the controversy over the “unwritten doctrines”, Rafael Ferber entered the fray with a small book. He proposed that Plato was also unable to communicate the “unwritten doctrines” because the highest principles (i.e. the subject of the unwritten doctrines) cannot be known through logical operations due to an epistemological paradox. Ferber’s differentiated position met with great respect and acceptance, although in individual cases it was also rejected. Ferber’s new book again presents the text of 1991, but significantly expands on it through new perspectives and an outline of the discussion it triggered. In this book, the reader learns what is meant by Plato’s unwritten doctrines and what the controversy is all about. (shrink)

We study global dynamical properties of the isometry group of the Borel randomization of a separable complete structure. We show that if properties such as the Rokhlin property, topometric generics, and extreme amenability hold for the isometry group of the structure, then they also hold in the isometry group of the randomization.

A conflict of interest is a situation in which a person has competing loyalties or interests that make it difficult to fulfil his or her duties impartially. Conflict of interest is not categorically improper in itself but requires proper management. A SCOPUS literature search was performed for publications on the efficacy/safety of Phospho-Di-Esterase Inhibitors for treating erectile dysfunction. A categorization tool was used to review and classify the publications as supportive/not-supportive for the discussed active ingredient and reporting or not reporting (...) a COI for that specific drug or for the remaining PDEIs. Multivariable binary logistic regression was performed. In the 419 selected records the prevalence of supportive opinions was higher when a COI for the index label was declared. The CoOpCaT showed good internal consistency, discriminative validity and intra/inter-rater agreement. The strongest predictor for a supportive opinion was the total number of financial COIs for the index label. A mild protective effect of the total number of financial COIs for any competitor label was noted. Financial COIs have frequently been associated with bias, and the measures currently adopted to restrain it lack effectiveness. Some evidence for monitoring and/or compensating this bias is reported here, but the ultimate solution remains distant. (shrink)

La muestra mas característica de ello acaso pueda ser el peculiar replanteamiento neohistoricista llevado a cabo, desde posiciones diferentes, por Mccintyre y por Rorty. Este neohistoricismo se revela, (...) sin embargo, insuficiente para solucionar el viejo problema de las relaciones entre la filosofía y su historia, incluyendo aquí la configuración de "historiador" que debe acompañar el "filosofo" cuando trata de adentrarse en el terreno de la historia de la filosofía. Oases have served as sacred landscapes and sources of ritual plants in arid regions of the Old and New Worlds. We evaluate the Jesuit mission oases of the Baja California peninsula for their role in agrobiodiversity persistence, and extend theories of sacred landscapes and biodiversity conservation to agricultural species and practices. Jesuit missionaries on the peninsula introduced a suite of crops species and agricultural and water management systems that persist in the oases and have become an integral part of the (...) cultural and religious identity of the peninsula. The sacred landscapes of the oases are defined by elements of the Jesuit mission systems, such as water capture systems and irrigation canals, stone field borders and terraces, field gardens or huertas, groves of olive trees and date palms, and multi-tiered agroecosystems. Sacred practices—including pilgrimages, religious rites, and Catholic-based community celebrations—depend on the integrated “landscapes” of the oases and on the ritual use of wild and cultivated oasis plant species. We propose that some, though not all, of the peninsula oases may be considered as sacred landscapes responsible for maintaining heritage crop species, biodiversity, and traditional farming and foodways practices. Not only is freedom a shared concern of Sartre and Schelling, which would not be anything particularly unique, but for both philosophers, freedom must be articulated out of an ontological ground, or within the confines of an ontological system. A contradiction nevertheless appears to arise regarding the “orientation” of Sartre and Schelling’s respective “ontologies of freedom”: the freedom of Sartre, reflecting a contemporary stoic-inspired doctrine, is directed toward the future, while for Schelling, with affinities to the temporal logic of psychoanalysis, (...) freedom is oriented toward the past. This article presents both Sartre and Schelling’s ontological reasoning out of which either a progressively oriented freedom (the freedom to negate the present in the name of future “possibles”) or a retrogressively oriented freedom (the freedom to determine the ground of the present out of an indefinite, a-temporal becoming), before attempting to resolve this contradiction in the temporality of freedom by examining the position and role of the negative (of negation, contradiction, or nothingness), as either secondary or primary, within the ontology of each respective philosopher.
