The systems of patent rights in force in Europe today, both at the level of national law and on the regional level, contain general clauses prohibiting the patenting of inventions whose publication and exploitation would be contrary to “ordre public” or morality. Recent years have brought frequent discussion about limiting the possibility of patent protection for biotechnological inventions for ethical reasons. This is undoubtedly a result of the dynamic development in this field in the last several years. Human genome sequencing, (...) the first successful cloning of mammals, and the progress in human stem cell research present humanity with many new questions of an ethical nature. Directive 98/44 of the European Parliament and of the Council of July 6, 1998, on the Legal Protection of Biotechnological Inventions created a new basis for patent protection in this field of technology. Based on the European experience to now, however, it must be said that patent law is not the right place to legislate the consequences of the morality of an invention. (shrink)

The purpose of this paper is to compare the notion of a Grzegorczyk point introduced in [19] (and thoroughly investigated in [3, 14, 16, 18]) to the standard notions of a filter in Boolean algebras and round filter in Boolean contact algebras. In particular, we compare Grzegorczyk points to filters and ultrafilters of atomic and atomless algebras. We also prove how a certain extra axiom influences topological spaces for Grzegorczyk contact algebras. This article is devoted to the problem of ontological foundations of three-dimensional Euclidean geometry. Starting from Bertrand Russell’s intuitions concerning the sensual world we try to show that it is possible to build a foundation for pure geometry by means of the so called regions of space. It is not our intention to present mathematically developed theory, but rather demonstrate basic assumptions, tools and techniques that are used in construction of systems of point-free geometry and topology by means of mereology (...) and Whitehead-like connection structures. We list and briefly analyze axioms for mereological structures, as well as those for connection structures. We argue that mereology is a good tool to model so called spatial relations. We also try to justify our choice of axioms for connection relation. Finally, we briefly discuss two theories: Grzegorczyk’s point-free topology and Tarski’s geometry of solids. (shrink)

In this paper, I develop a speech-act based account of presumptions. Using a score-keeping model of illocutionary games, I argue that presumptions construed as speech acts can be grouped into three illocutionary act types defined by reference to how they affect the state of a conversation. The paper is organized into two parts. In the first one, I present the score-keeping model of speech act dynamics; in particular, I distinguish between two types of mechanisms—the direct mechanism of illocution and the (...) indirect one of accommodation—that underlie the functioning of illocutionary acts. In the second part, I use the presented model to distinguish between the unilateral act of individual presumption, the point of which is to shift the burden of proof by making the hearer committed to justifying his refusal to endorse the proposition communicated by the speaker, whenever he refuses to endorse it, the bilateral act of joint presumption—‘bilateral’ in that it is performed jointly by at least two conversing agents—the function of which is to confer on the proposition endorsed by the speaker the normative status of jointly recognized though tentative acceptability, and the indirect or back-door act of collective presumption, the purpose of which is to sustain rules and practices to which the conversing agents defer the felicity of their conversational moves. The insinuating speaker, when successful, achieves two goals: they introduce a contentious content into a conversation while simultaneously marking it as not being officially stated. This positioning allows the speaker to plausibly deny any intention behind the implied message when challenged. I argue that reconciling the communicative nature of insinuation and its off-record status within the Gricean framework of overt communication appears to present a significant conceptual puzzle. In this paper, I address this challenge by introducing the notion of Gricean (...) insinuation, which I define as communication that is both partially overt and partially covert. I start by exploring the nature and complexity of the insinuation puzzle mentioned earlier and reviewing two existing Gricean solutions to it. Then, I proceed to analyse three concepts relevant to the insinuation phenomenon: indirectness, cancellability, and plausible deniability. Following this, I introduce the concept of Gricean insinuation. In particular, I use the common ground framework to elucidate what I refer to as the ‘Fake One-Way Mirror Effect’, and apply the resulting model to explain some examples of insinuation as acts of off-record communication. In conclusion, I assess the model’s effectiveness and propose directions for future research. (shrink)

The purpose of this paper is twofold. First, it aims at providing an account of an indirect mechanism responsible for establishing one's power to issue biding directive acts; second, it is intended as a case for an externalist account of illocutionary interaction. The mechanism in question is akin to what David Lewis calls presupposition accommodation: a rule-governed process whereby the context of an utterance is adjusted to make the utterance acceptable; the main idea behind the proposed account is that the (...) indirect power-establishing mechanism involves the use of imperative sentences that function as presupposition triggers and as such can trigger off the accommodating change of the context of their utterance. According to the externalist account of illocutionary interaction, in turn, at least in some cases the illocutionary force of an act is determined by the audience's uptake rather than by what the speaker intends or believes; in particular, at least in some cases it is the speaker, not her audience, who is invited to accommodate the presupposition of her act. The paper has three parts. The first one defines a few terms — i.e., an “illocution”, a “biding act”, the “audience's uptake” and an “Austinian presupposition” — thereby setting the stage for the subsequent discussion. The second part formulates and discusses the main problem of the present paper: what is the source of the agent's power to perform binding directive acts? The third part offers an account of the indirect power-establishing mechanism and discusses its externalist implications. (shrink)

This article proposes a mereological approach to the dao-you relation in the Daodejing. It is claimed here that dao and you can be conceived of as two integrated subregions, defined in terms of rules of composition and their persistence through time. It is shown that dao is an atemporal object (a fourdimensional unrestricted composition), whereas you is a temporal object (a three-dimensional restricted composition). This particular approach can provide a new understanding of essential issues in Daoist metaphysics.

The paper develops a speech act-based model of verbal irony. It argues, first, that ironic utterances are speech actions performed as conforming to a socially accepted procedure and, second, that they are best understood as so-called etiolated uses of language. The paper is organized into four parts. The first one elaborates on Austin's doctrine of the etiolations of language and distinguishes between the normal or serious mode of communication and its etiolated mode. The second part discusses the dominant approaches to (...) verbal irony and argues that the irony-as-a-trope theories can be viewed as attempts to describe ironic utterances as cases of normal speech, whereas the metalinguistic theories seem to treat them as etiolated uses of language. The third part proposes a set of felicity conditions for ironic acts and puts forth a hypothesis that echo and overt pretence are complementary techniques of linguistic etiolation used for ironizing. The fourth part uses the proposed model to discuss the social dimension of ironizing and argues that utterances intended as acts of ironizing may trigger the accommodating process of context-repair. The take-home message is that ironic utterances are essentially social actions: acts performed by invoking a socially accepted procedure. (shrink)

The goal is to sketch a nominalist approach to mathematics which just like neologicism employs abstraction principles, but unlike neologicism is not committed to the idea that mathematical objects exist and does not insist that abstraction principles establish the reference of abstract terms. It is well-known that neologicism runs into certain philosophical problems and faces the technical difficulty of finding appropriate acceptability criteria for abstraction principles. I will argue that a modal and iterative nominalist approach to abstraction principles circumvents those (...) difficulties while still being able to put abstraction principles to a foundational use. The paper develops a score-keeping model of illocutionary games and uses it to account for mechanisms responsible for creating institutional facts construed as rights and commitments of participants in a dialogue. After introducing the idea of Austinian games—understood as abstract entities representing different levels of the functioning of discourse—the paper defines the main categories of the proposed model: interactional negotiation, illocutionary score, appropriateness rules and kinematics rules. Finally, it discusses the phenomenon of accommodation as it occurs in illocutionary games and (...) argues that the proposed model presupposes an externalist account of illocutionary practice. The aim of this paper is to reformulate the Linguistic Underdeterminacy Thesis by making use of Austin’s theory of speech acts. Viewed from the post-Gricean perspective, linguistic underdeterminacy consists in there being a gap between the encoded meaning of a sentence uttered by a speaker and the proposition that she communicates. According to the Austinian model offered in this paper, linguistic underdeterminacy should be analysed in terms of semantic and force potentials conventionally associated with the lexical and syntactic properties of (...) the pheme uttered by the speaker; in short, it is claimed that the conventionally specified phatic meaning of an utterance underdetermines its content and force. This Austinian version of the Linguistic Underdeterminacy Thesis plays a central role in a contextualist model of verbal communication. The model is eliminativist with respect to rhetic content and illocutionary force: it takes contents and forces to be one-off constructions whose function is to classify individual utterances in terms of their representational and institutional effects, respectively. This is a spin-off paper to [3, 4] in which we carried out an extensive analysis of Andrzej Grzegorczyk’s point-free topology from [5]. In [1] Loredana Biacino and Giangiacomo Gerla presented an axiomatization which was inspired by the Grzegorczyk’s system, and which is its variation. Our aim is to compare the two approaches and show that they are slightly different. Except for pointing to dissimilarities, we also demonstrate that the theories coincide in presence of axiom stipulating non-existence of atoms.

Recently predominant forms of anti-realism claim that all truths are knowable. We argue that in a logical explanation of the notion of knowability more attention should be paid to its epistemic part. Especially very useful in such explanation are notions of group knowledge. In this paper we examine mainly the notion of distributed knowability and show its effectiveness in the case of Fitch’s paradox. Proposed approach raised some philosophical questions to which we try to find responses. We also show how (...) we can combine our point of view on Fitch’s paradox with the others. Next we give an answer to the question: is distributed knowability factive? At the end, we present some details concerning a construction of anti-realist modal epistemic logic. (shrink)

Polish medical law does not explicitly regulate the possibility of off-label use of medicines. Such procedures therefore raise doubts in medical practice, where medicines are often prescribed beyond the Characteristic of Medicinal Product. This phenomenon particularly affects the treatment of children, as there is a lack of registered medicines in this age group, but they are registered for use in adults. Since such treatment goes beyond the scope of registration, a dilemma arises as to whether it is permissible and, if (...) so, under what conditions and whether sanctions are imposed on the medical professional using the off-label medicine. These issues are addressed in an article by Dr Maria Gutowska-Ibbs, entitled 'Off label - practical consequences of unclear legislation". The present study complements these considerations and is in part an ad vocem statement. The article attempts to differentiate between the use of off-label medicines and medical experiments, following the criterion of the purpose for which a given medical action is performed. The limits of admissibility of such actions under criminal law are also discussed in more detail. Off-label treatment is considered through the prism of the required precautionary rules, compliance with which is the antithesis of inadvertence. It is assumed that if the drug was administered in accordance with current medical knowledge and the treatment is adequate to the patient's condition, there is no violation of these rules, which excludes the imputation of inadvertence. An extensive section of the study is devoted to the issue of the patient's consent to treatment outside the indications. Above all, it emphasises the need to explain in detail to the patient the circumstances of prescribing such a drug and, on this basis, to obtain informed consent. It also stresses the importance of the written form of consent, which can have a significant evidentiary impact in potential litigation. (shrink)

The paper describes the circumstances in which digital technology arises; the change is recognized in the literature as the basis of digital transformation. This transformation is understood as a deterministic economic process. However, the analysis of the deeper circumstances of this process shows that we are dealing with a vast change in the ways of understanding and describing the world, i.e. with an epistemological change. This change concerns, on the one hand, the method of creating general mathematical (including geometric) structures (...) that are the basis of models used to describe the world, and on the other hand—tools for its description, e.g. network theory, systems theory, complexity theory. Such a broadly understood change makes the deterministic description proposed by the digital transformation too simple and shallow. Instead, the concept of predigital transformation is proposed. It includes not only the omitted historical part but also creates better and richer conditions for understanding the digital transformation process, as well as for developing appropriate conceptual tools for its use. The purpose of this article is a critical reconstruction of the Platonic conception of laughter, which is presented primarily in Republic and Philebus. A comic quality calls, in his opinion, to lower emotions, it throws human mind out of balance and undermines the prevailing order of values. The philosopher associates a laughter with the feeling of envy, which comes down to the joy of humiliating of someone weaker. The comic envy - as opposed to passive jealousy - almost automatically leads (...) to the activity, to the enhancement of humiliation. Laughter is caused according to Plato by a defect resulting from the ignorance about himself. The key feature of the comic situation is the asymmetry between the victim's weakness and the strength of a laughing person. Plato's concept of laughter turns out to be one-sided, when we compare it with "laughter of Democritus" which serves as a therapeutic and catharctic means. Laughter is here a clear signal that initiates the critical reflection on himself and gives impetus to a change of attitude towards the world. In his writings Plato did not include such educational and cognitive aspects of laughter because in his philosophy it becomes a specific antagonist of true knowledge. The negative attitude towards laughter does not go hand in hand with Plato’s recognition of Socrates, who used irony as a key element in his method of inquiry leading to truth. (shrink)

It is not hard to distinguish within Christianity its Manichaean component whose characteristic feature is a grudge against matter, body and sexuality. This complexity of ideas brought about the contempt of vital elements of human existence, so that its animal past, still present in Zivilisationsprozess. An alternative anthropology inspired by an evolutionism should based on the presumption that only through the appreciation of an (...) animal dimension of us—instead of monastic desire of becoming an angel—will it be possible to create new perspectives for renegotiation of the human–animal boundaries. This is the first, out of two papers, devoted to Andrzej Grzegorczyk’s point-free system of topology from Grzegorczyk :228–235, 1960. https://doi.org/10.1007/BF00485101). His system was one of the very first fully fledged axiomatizations of topology based on the notions of region, parthood and separation. Its peculiar and interesting feature is the definition of point, whose intention is to grasp our geometrical intuitions of points as systems of shrinking regions of space. In this part we analyze separation structures and Grzegorczyk structures, and (...) establish their properties which will be useful in the sequel. We prove that in the class of Urysohn spaces with countable chain condition, to every topologically interpreted representative of a point in the sense of Grzegorczyk’s corresponds exactly one point of a space. We also demonstrate that Tychonoff first-countable spaces give rise to complete Grzegorczyk structures. The results established below will be used in the second part devoted to points and topological spaces. (shrink)

In the second installment to Gruszczyński and Pietruszczak we carry out an analysis of spaces of points of Grzegorczyk structures. At the outset we introduce notions of a concentric and \-concentric topological space and we recollect some facts proven in the first part which are important for the sequel. Theorem 2.9 is a strengthening of Theorem 5.13, as we obtain stronger conclusion weakening Tychonoff separation axiom to mere regularity. This leads to a stronger version of Theorem 6.10. Further, we show (...) that Grzegorczyk points are maximal contracting filters in the sense of De Vries, but the converse inclusion is not necessarily true. We also compare the notions of a Grzegorczyk point and an ultrafilter, and establish several properties of topological spaces based on Grzegorczyk structures. The main results of the paper are representation and completion theorems for G-structures. We prove both set-theoretical and topological representation theorems for various classes of G-structures. We also present topological object duality theorem for the class of complete G-structures and the class of concentric spaces, both restricted to structures which satisfy countable chain condition. We conclude the paper with proving equivalence of the original Grzegorczyk axiom with the one accepted by us as axiom. (shrink)

This paper offers a critical reconstruction of the motivations that led to the development of mereology as we know it today, along with a brief description of some problems that define current research in the field.

The paper reconstructs and discusses three different approaches to the study of speech acts: (i) the intentionalist approach, according to which most illocutionary acts are to be analysed as utterances made with the Gricean communicative intentions, (ii) the institutionalist approach, which is based on the idea of illocutions as institutional acts constituted by systems of collectively accepted rules, and (iii) the interactionalist approach the main tenet of which is to perform illocutionary acts by making conventional moves in accordance with patterns (...) of social interaction. It is claimed that, first, each of the discussed approaches presupposes a different account of the nature and structure of illocutionary acts, and, second, all those approaches result from one-sided interpretations of Austin’s conception of verbal action. The first part of the paper reconstructs Austin's views on the functions and effects of felicitous illocutionary acts. Thesecond part reconstructs and considers three different research developments in the post-Austinian speech act theory—the intentionalist approach, the institutionalist approach, and the interactionalist approach. Legal probabilism is the view that juridical fact-finding should be modeled using Bayesian methods. One of the alternatives to it is the narration view, according to which instead we should conceptualize the process in terms of competing narrations of what happened. The goal of this paper is to develop a reconciliatory account, on which the narration view is construed from the Bayesian perspective within the framework of formal Bayesian epistemology.

It is a commonplace remark that the identity relation, even though not expressible in a first-order language without identity with classical set-theoretic semantics, can be defined in a language without identity, as soon as we admit second-order, set-theoretically interpreted quantifiers binding predicate variables that range over all subsets of the domain. However, there are fairly simple and intuitive higher-order languages with set-theoretic semantics in which the identity relation is not definable. The point is that the definability of identity in higher-order (...) languages not only depends on what variables range over, but also is sensitive to how predication is construed. This paper is a follow-up to , where it has been proven that no actual axiomatization of Leśniewski’s Ontology determines the standard semantics for the epsilon connective. (shrink)

Philosophy of religion has been the object of penetrating critiques concerning its continued near-complete blindness to all but a single religion. The need for philosophy of religion to open up so as to include more than merely occasional and tokenistic treatments of ‘Other’ religions is clearly evident from the slew of recently published titles concerned with diversifying the field. In this light, a book such as Victoria Harrison’s Eastern Philosophy of Religion should surely come as a welcome addition. And yet, (...) unfortunately, this book turns out to be a case study in how not to diversify philosophy of religion in the twenty-first century. (shrink)

My aim in this paper is to contribute to the debate on the foundations of semantics and pragmatics by developing an Austinian alternative to the Gricean programme. The Gricean approach has been criticised by Ernie Lepore and Matthew Stone who claim that most of the interpretive effects that are usually accounted for as inferentially recognized aspects of meaning are in fact determined by grammar. I argue, however, that it is the Austinian perspective rather than the extended-grammar outlook, that constitutes a (...) genuine alternative to the Gricean programme. Viewed from the Austinian perspective, using language is a social practice that consists of performing conventional speech acts: acts done conforming to a convention. Unlike the Griceans and the proponents of the extended-grammar outlook, however, the Austinians assume that following a convention is not an algorithmic procedure, but a socially controlled process that involves interactional negotiation. They claim, namely, that each language convention — phatic, rhetic, illocutionary, rhetorical, procedural, etc. — is a lineage of reproduced precedents that put some constraints on what can be regarded as saying and doing the same, but underdetermine the exact properties of its new members. The aim of this paper is twofold. First, the author examines Mitchell Green’s account of the expressive power and score-changing function of speech acts; second, he develops an alternative, though also evolutionist approach to explaining these two hallmarks of verbal interaction. After discussing the central tenets of Green’s model, the author draws two distinctions – between externalist and internalist aspects of veracity, and between perlocutionary and illocutionary credibility – and argues that they constitute a natural refinement of Green’s original conceptual (...) framework. Finally, the author uses the refined framework to develop an alternative account of expressing thoughts with words. In particular, he argues that in theorising about expressing thoughts with words – as well as about using language to change context – we should adopt a Millikanian view on what can be called, following Green, acts of communication and an Austinian approach to speech or illocutionary acts. I distinguish its two basic meanings: copying (imitation) and expression. Analysis of Plato’s dialogues step by step reveals ambivalence of the notion, and, what is most important, points out how useful it can be in epistemology, philosophy of language, psychology and aesthetics. chapter aims at tracing the connections between global citizenship and global environmentalism at both, the theoretical and the practical level. At the theoretical level I define the notion of global citizenship referring to Nigel Dower's definition described in his book titled World Ethics - The New Agenda. Subsequently, I show that the idea of global citizenship is a part of global justice concept. At the first glance it seems to be a political concept, while it is primarily an ethical one. (...) Therefore, not only does global justice concern war and peace but also environmental responsibility. Taking this into consideration I trace the relation between global citizenship and environmental responsibility on three levels, individual, social and political, all three being part of CSR. This is the first book on the role of cognition in the aesthetic theory of Li Zehou (1930–2021), one of China's most important and influential contemporary philosophers. The cognitive dimension and its integration with practice is discussed by examining one of Li's pivotal concepts: "subjectality," a human subject shaped by the world in which they live, including beauty and aesthetic experience. Li's theory is also contextualized in the threefold inspiration coming from Confucian, Kantian, and Marxist philosophies, which differently conceptualize the (...) aesthetic and cognitive dimensions in humans. By referring to different aesthetic theories and interdisciplinary approaches to cognition, the book aims to show how Li's cognitively oriented project can contribute to contemporary research into aesthetics.
