This contribution serves as an invitation to a renewed exploration of Herbert Marcuse’s critical theory. It discloses his continued relevance for critical social theory and politics in the contemporary moment and why Marcuse should not be condemned to the dustbin of history but should be appropriated and developed in our contemporary conditions in which crises are multiplying.

ZusammenfassungDie Ökonomisierung bzw. die Kommerzialisierung des Sports ist ein langfristiger Prozess, der sich bereits seit der Wende zum 20. Jahrhundert vollzog und unterschiedliche Sportarten in unterschiedlichen Entwicklungsphasen und Geschwindigkeiten erfasste. Sportartikelunternehmen wie adidas beschleunigten diese Entwicklung nach dem Zweiten Weltkrieg, indem sie anlässlich sportlicher Großereignisse wie Olympischen Spielen oder Fußball-Weltmeisterschaften intensive Kontakte und Netzwerke zu Spitzensportlern und Funktionären aufbauten. Dabei ging es zunächst um die individuelle Ausrüstung der Sportler mit Schuhen und Kleidung, seit den 1960er Jahren dann auch um Promotionverträge (...) bei denen – in West- wie in Osteuropa – Geldzahlungen eine zunehmend wichtige Rolle spielten. Eine solche Vermarktlichung – also die Gestaltung von Prozessen, die bislang über den Staat oder bürokratische Strukturen und nun zunehmend über den Markt geregelt wurden (Ahrens et al. 2015: 395f.) Ökonomisierung, Kommerzialisierung und Vermarktlichung sind verwandte Begriffe, die z.T. auch synonym benutzt werden. Siehe dazu jüngst Graf (2019)., was im Vergleich zu anderen gesellschaftlichen Subsystemen durchaus eine Art „Normalisierung“ darstellte, erreichte spätestens in den 1980er Jahren und mit der massenmedialen Verbreitung des Sports neue Dimensionen, die wiederum mit Hilfe von adidas unter Horst Dassler in Kooperation mit dem IOC und der FIFA vorangetrieben wurden und die Grundlagen einer Kommerzialisierungsspirale legten, deren Auswirkungen bis in die Gegenwart reichen. Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. Research on a wide range of medical and non-medical conditions has demonstrated the power of the placebo effect but also calls for the necessity to better understand its psychological mechanisms. The placebo effect appears to be elicited by meaning and expectation. However, expectations have been explored by accounts based on conscious thoughts . In this paper, a functionally oriented approach is introduced which favors the functional properties of mental systems whose operations need not be conscious. It is maintained that only (...) one specific mental system, called extension memory, qualifies to produce the placebo effect since it consists of implicit, parallel-holistic networks integrating aspects and providing self-regulatory mechanisms. On the basis of this line of reasoning, experimentally testable research ideas are presented. (shrink)

_Contexts of Justice,_ highly acclaimed when it was published in Germany, provides a significant new intervention into the important debate between communitarianism and liberalism. Rainer Forst argues for a theory of "contexts of justice" that leads beyond the narrow confines of this debate as it has been understood until now and posits the possibility of a new conception of social and political justice. This book brings refreshing clarity to a complex topic as it provides a synthesis of traditions and (...) theories that leads to a truly original approach. Forst makes a four-part distinction to decipher the debate between communitarianism and liberalism. These four parts concern the constitution of the self, the neutrality of law, the ethos of democracy, and the opposition between universalism and contextualism. He shows that a comprehensive theory of justice needs to take these different contexts adequately into account. He discusses recent debates about discursive democracy and feminist critiques of liberalism, and addresses such topics as multiculturalism and civil society. (shrink)

Based on the belief that computational modeling (thinking in terms of representation and computations) can help to clarify controversial issues in emotion theory, this article examines emotional experience from the perspective of the Computational Belief–Desire Theory of Emotion (CBDTE), a computational explication of the belief–desire theory of emotion. It is argued that CBDTE provides plausible answers to central explanatory challenges posed by emotional experience, including: the phenomenal quality,intensity and object-directedness of emotional experience, the function of emotional experience and its relation (...) to cognition and motivation, and the relation between emotional experience and emotion. In addition, CBDTE avoids most objections that have been raised against cognitive theories of emotion. A remaining objection, that beliefs are not necessary for the emotions covered by CBDTE, is rejected as empirically unsupported. (shrink)

The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an (...) expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration. This article argues that alienation should be understood as a particular form of individual and social heteronomy that can only be overcome by a dialectical combination of individual and collective autonomy, recovering a deontological sense of normative authority. If we think about alienation in Kantian terms, the main source of alienation is a denial of standing or, in the extreme, losing a sense of oneself as a rational normative authority equal to all others. I call the former kind of alienation, (...) where persons deny others equal standing as a normative authority in moral or political terms, first order noumenal alienation, as there is no proper mutual cognition and recognition of each other in such a social context. I call the latter kind of alienation, where a subject does not consider themselves an equal normative authority – or an ‘end in oneself’ – second order noumenal alienation. In this sense, alienation violates the dignity of humans as moral and political lawgivers – a dignity seen by Rousseau, Kant and Marx as inalienable: It can be denied or violated, but it cannot be lost. This paper argues for a conception of transnational justice that provides an alternative to globalist and statist views. In light of an analysis of the transnational context of justice, a critical theory is suggested that addresses the multiple relations of injustice and domination to be found in this context. Based on a universal, individual right to reciprocal and general justification, this theory argues for justifiable social and political relations both within and between states. In both of these contexts, it distinguishes (...) between minimal and maximal justice and stresses the interdependence of domestic and transnational justice. On both levels, minimal justice calls for a discursive structure of justification, whereas maximal justice implies a fully justified basic social structure. (shrink)

The existence of predatory animals is a problem in animal ethics that is often not taken as seriously as it should be. We show that it reveals a weakness in Tom Regan's theory of animal rights that also becomes apparent in his treatment of innocent human threats. We show that there are cases in which Regan's justice-prevails-approach to morality implies a duty not to assist the jeopardized, contrary to his own moral beliefs. While a modified account of animal rights that (...) recognizes the moral patient as a kind of entity that can violate moral rights avoids this counterintuitive conclusion, it makes non-human predation a rights issue that morally ought to be subjected to human regulation. Jennifer Everett, Lori Gruen and other animal advocates base their treatment of predation in part on Regan's theory and run into similar problems, demonstrating the need to radically rethink the foundations of the animal rights movement. We suggest to those who, like us, find it less plausible to introduce morality to the wild than to reject the concept of rights that makes this move necessary to read our criticism either as a modus tollens argument and reject non-human animal rights altogether or as motivating a libertarian-ish theory of animal rights. Mental-threshold egalitarianism, well-known examples of which include Jeff McMahan’s two-tiered account of the wrongness of killing and Tom Regan’s theory of animal rights, divides morally considerable beings into equals and unequals on the basis of their individual mental capacities. In this paper, I argue that the line that separates equals from unequals is unavoidably arbitrary and implausibly associates an insignificant difference in empirical reality with a momentous difference in moral status. In response to these objections, McMahan has proposed the introduction (...) of an intermediate moral status. I argue that this move ultimately fails to address the problem. I conclude that, if we are not prepared to give up moral equality, our full and equal moral status must be grounded in a binary property that is not a threshold property. I tentatively suggest that the capacity for phenomenal consciousness is such a property, and a plausible candidate. (shrink)

In this collection of essays, the first translation into English of the ground-breaking 'Normativität und Macht' (Suhrkamp 2015), Rainer Forst presents a new approach to critical theory. Each essay reflects on the basic principles that guide our normative thinking. Forst's argument goes beyond 'ideal' and 'realist' theories and shows how closely the concepts of normativity and power are interrelated, and how power rests on the capacity to influence, determine, and possibly restrict the space of justifications for others. In this article, I address the various objections raised by Simone Chambers, Stephen White and Lea Ypi concerning my version of a critical theory of politics. I explain the basic assumptions that inform my account of a critique of relations of justification, its particular method and aims.

We first present a reconstruction of James’s theory of emotion (JATE) and then argue for four theses: (a) Despite constructivist elements, James’s views are overall in line with basic emotions theory. (b) JATE does not exclude an influence of emotion on intentional action even in its original formulation; nevertheless, this influence is quite limited. It seems possible, however, to repair this problem of the theory. (c) Cannon’s theory of emotion is a centralized version of JATE that inherits from the latter (...) theory a potentially fatal flaw, the insufficient physiological differentiation of emotions. (d) The core claim of JATE, that emotions are bodily feelings, is very likely false. (shrink)

Research on cognition and emotion during the past 30 years has made reasonable progress in theory, methods and empirical research. New theories of the cognition–emotion relation have been proposed, emotion research has become more interdisciplinary, and improved methods of emotion measurement have been developed. On the empirical side, the main achievement of the past 30 years is seen to consist in the reduction of the set of serious contenders for a theory of emotions. Still, several important issues are not fully (...) resolved, including the computational implementation of appraisal processes, the nature of emotions, and the link between emotions and actions. Also, quantitative theories of the cognition–emotion relation need to be refined and tested, and improved theories of the link between emotions and bodily and facial expressions need to be developed. To counter the dangers of theoretical fragmentation and knowledge loss, more efforts should be devoted to the analysis, reconstruction, comparison and integration of important theories and hypotheses in the field of emotion, as well as to the systematization of arguments in favor and against these theories and hypotheses. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Je weiter die Verwissenschaftlichung unserer Lebenswelt fortschreitet, desto dringender stellt sich die Frage nach dem Status und dem sinnvollen Umgang mit Wissenschaft. Buchstaben-Folgen rekonstruiert das Projekt abendländischer Wissenschaft vor dem Hintergrund der Differenz von Mündlichkeit und Schriftlichkeit. Die Reflexion auf das komplizierte Verhältnis zwischen gesprochener Sprache und Schrift sowie auf die entsprechenden - medial unterschiedlichen - Darstellungsformen von Wissen ermöglicht ein angemesseneres Verständnis der ambivalenten Rolle von Wissenschaft in unserer Kultur. Eine in ihrem Status und ihrer Reichweite mißverstandene Wissenschaft kann (...) leicht zur Ideologie werden. Das Buch führt zwei Debatten zusammen, die bisher noch kaum verknüpft worden sind: die interdisziplinäre Debatte der 80er und 90er Jahre um die kulturellen Auswirkungen von Schrift und Schriftlichkeit einerseits und die von Heidegger wesentlich angestoßene und bis heute anhaltende philosophische Diskussion um Status und Reichweite wissenschaftlicher Weltdarstellungen andererseits. In einer doppelten - medienhistorischen und medien-phänomenologischen - Perspektive erläutert der Autor, welche praktischen Entstehungsbedingungen und welchen Status wissenschaftliche Aussagen als >verdauerte sprachliche Handlungen haben, was bestimmte Mißverständnisse von Wissenschaft sind und wie diese Mißverständnisse gerade durch die schriftliche Form der Wissensdarstellung evoziert werden. Der erste Teil des Buches zeigt im Anschluß an Arbeiten von Jan Assmann, Christian Stetter und anderen, wie die Erfindung und Verbreitung der Alphabetschrift in Griechenland die Ausprägung eines formalen Sprachumgangs, die Entstehung von formaler Logik und logisch-enzyklopädischer Wissenschaft als episteme zugleich ermöglicht und herausgefordert hat. Im zweiten Teil des Buches werden zentrale Texte Heideggers im Kontext schriftphilosophischer Überlegungen neu gedeutet. Heideggers kritische Diagnose, daß die Geburtsstunde der okzidentalen Wissenschaft zugleich die Geburtsstunde der abendländischen Wissenschaftsmetaphysik ist, wird verständlich, wenn man sie mit der unreflektierten konstitutiven Schriftlichkeit des Wissenschaftsprojektes in Zusammenhang bringt. Seinsvergessenheit wird im Kern als Schriftvergessenheit verstehbar. Die Darstellung bewegt sich in einem spannungsreichen Verhältnis zu den schriftphilosophischen Thesen von Jacques Derrida und dessen Projekt einer Grammatologie. Die explizite Auseinandersetzung mit Derridas extrem erweitertem Schriftbegriff und mit dessen Kritik am vermeintlichen Präsentismus Heideggers bilden das abschließende Kapitel von Buchstaben-Folgen. In this paper, I focus on Kant’s doctrine of figurative synthesis. Figurative synthesis is the result of the activity of productive transcendental imagination. This is the chief problem of the so-called “second proof step” in Kant’s deduction of the categories according to the second edition of the Critique of Pure Reason. The pure original synthetic apperception forms in the inner and outer sense - i. e. in time and space - by self-affection structures of order that make it possible to (...) cognize empirical objects. The order of space and time through figurative syntheses must be distinguished on the one hand from space and time as forms of intuition and on the other hand from the order of the manifold given in space and time. This clarifies the differences and relations between the constitutive noetic faculties of our knowledge apparatus. (shrink)

This article suggests a Kantian reading of Rawls’s Political Liberalism. As much as Rawls distanced himself from a presentation of his theory in terms of a comprehensive Kantian moral doctrine, we ought to read it as a noncomprehensive Kantian moral-political theory. According to the latter approach, the liberal conception of justice is compatible with a plurality of comprehensive doctrines as long as they share the independently defined and grounded essentials of that conception of justice—that is, as long as they are (...) “reasonable,” to use the term that does most of the Kantian work. Eine Besinnung auf erneuerungsfahige und erneuerungs bedurftige Elemente ihrer Vorgeschichte kann es sich nicht leisten, die epochalen Vorzeichen der Aufklarung zu vernachlassigen, un ter denen ihre ruhmreiche Vorgangerin, die Friedrichs-Universi tat, 1694 gegrundet wurde. * Die Zeit der Aufklarung ist indessen noch langst nicht vorbei. Die Aufklarungsbedurftigkeit der Menschen ist keine Angelegen heit von Epochen oder von Episoden. Sie gehort vielmehr zur con ditio humana. (...) Seit dem revolutionaren Gestaltwandel, den die Na turwissenschaften seit dem 17. Jahrhundert durchgemacht haben, sind immer mehr Menschen von der Frage beunruhigt worden, in wiefern die Wissenschaften uberhaupt zur Aufklarung beitragen konnen. Immerhin war die staatliche Forderung der wissenschaft lichen Lehre und Forschung im organisatorischen Rahmen von Universitaten seit der Wende zum 18. Jahrhundert Teil einer op timistischen Antwort auf diese Frage. Der politisch institutionalisierte Optimismus der Erwartung, daB die Aufklarung durch Wissenschaft moglich sei, hat wahrend der vergangenen drei Jahrhunderte mancherlei Bewahrungspro ben durchgemacht. Das Zutrauen, von dem der Optimismus des Programms einer Aufklarung durch Wissenschaft getragen wird, bedarf daher schon langst einer Uberprtifung seiner Berechtigung, wenn weder die Wissenschaft noch die Aufklarung durch Uberfor derung oder durch Unterforderung lei den soIl. Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously.
