End-of-life disputes in Ontario are currently overwhelmingly assessed through the singular lens of patient autonomy. The current dispute resolution mechanism does not adequately consider evidence-based medical guidelines, standards of care, the patient’s best interests, expert opinion, or distributive justice. We discuss two cases adjudicated by the Consent and Capacity board of Ontario that demonstrate the over emphasis on patient autonomy. Current health care policy and the Health Care Consent Act also place emphasis on patient autonomy without considering other ethically defensible (...) factors. We argue that current policy and legislation require amendment, and unless there are measures undertaken to modify them, both the quality of care provided and the long-term capabilities of the health care system to remain publicly-funded, comprehensive and equitable, are at stake. PurposeWithin a larger mandate of reviewing the key global trends concerning consumer protection in the electronic commerce (e-commerce) literature, this study aims to study the legal framework concerning e-commerce and consumer protection in the Sultanate of Oman and to analyse the current regulations concerning e-commerce and consumer protection.Design/methodology/approachThis study followed the normative legal research approach and resorted to the desk research process to facilitate content analysis of literature containing consumer protection legislation and regulatory provisions in Oman in particular and the (...) rest of the world in general.FindingsThe study reveals that consumer protection initiatives in Oman are well entrenched for offline transactions, but are relatively new and limited for e-commerce. In spite of the promulgation of consumer protection laws, electronic transaction law and cybercrime law, consumer protection measures for e-commerce in Oman do not address a large number of the global concerns necessary to build consumer confidence and trust in the online environment.Research limitations/implicationsThere is a dearth of information concerning Oman on this topic in the extant literature. The research also witnessed the lack of empirical data on the issue of consumer protection and e-commerce in Oman that offer a detailed database of consumer complaints and associated outcomes.Practical implicationsThe mechanism of consumer protection in electronic transactions is not robust in many countries. Because of the lack of comprehensive and robust legislation, consumers remain vulnerable in the online contractual purchase process. Moving beyond the fragmented legislation, many countries are currently mulling an all-comprehensive e-commerce law, implications of this paper will help the policymakers in identifying the focus areas.Social implicationsConsumer protection is a burning global issue in this era of consumerism. It is important to build consumer trust, transparency and integrity of transactions to reduce the risk and uncertainties of purchase.Originality/valueConsumer protection studies conducted in the context of Oman, hitherto, deal more with data protection and dispute resolution mechanisms, and less with legal provisions, regulations and consumer confidence. In normative decision theory, the weight of an uncertain event in a decision is governed solely by the probability of the event. A large body of empirical research suggests that a single notion of probability does not accurately capture peoples' reactions to uncertainty. As early as the 1920s, Knight made the distinction between cases where probabilities are known and where probabilities are unknown. We distinguish another case –- the unknowable uncertainty –- where the missing information is unavailable to all. We (...) propose that missing information influences the attractiveness of a bet contingent upon an uncertain event, especially when the information is available to someone else. Prior research suggests that the media plays an important information intermediary role in capital markets. We investigate the role of the media in influencing firms’ engagement in corporate social responsibility activities. Using a large sample of 4396 unique firms from 42 countries over the period 2003–2012, we find strong evidence that firms engage in more CSR activities if located in countries where the media has more freedom. This relation is robust to using various proxies for media freedom, an alternative source (...) of CSR data, and to applying the instrumental variables approach to address endogeneity. In additional analyses, we find that the positive relation between media freedom and CSR engagement is stronger for better governed firms and for larger firms. Since the media have the ability to impact reputational capital, we conclude that media freedom affects firms’ incentives to engage in costly CSR activities. (shrink)

Abstract This essay discusses the paradox of the N?g?rjunian negation as presented in his Vigrahavy?vartani. In Part One it is argued that as the Naiy?yika remarks, N?g?rjuna's speech act ?No proposition has its own intrinsic thesis? seemingly contradicts his famous claim that he has no negation whatsoever. In Parts Two and Three I consider the traditional as well as modem responses to this paradox and offer my own. I argue that N?g?rjuna's speech act does not generate a paradox for two (...) reasons: (a) the equivalence thesis of the kind??P = ?P is obviously false; and (b) since N?g?rjuna's speech act is situated in the dialogical/conversational universe of discourse as opposed to the argumentative/systematic universe of discourse, the teaching of the non?intrinsic thesis of all statements that it purports, holds for all statements in its class, including itself. Lastly, it is argued that even though the N?g?rjunian speech act is not a negation situated in the argumentative universe of discourse, it serves both philosophical and soteriological purposes. While living a life based on universal principles is well accepted by many, the reality of living acts as a great detriment to those who want to centre their lives on these timeless truths. Further, institutional mechanisms and work environments do not conform in general to such principle-centred living. The agents of the state, especially those in the police, have to work under tremendous obstacles and pressures from within and without, and often get a bad reputation, sometimes undeservingly. Moreover their (...) value systems may also degrade in these environments, a direction that requires to be altered by the ‘guardians of the law’. It is important to bring about alignment of values and ethical perceptions of state administrators with some universal laws. The Buddhist practice of vipassana mediation can play a significant role in such transformations, as is evident from the responses from Delhi Police personnel who underwent vipassana in one of their training programmes. Vipassana has made significant differences in the lives and perceptions of these trainees—both at the professional and personal level. This paper introduces these concepts and cites evidences from the feedback sheets of trainees to recommend worldwide adoption of such practices for those who occupy seats of power and responsibility. The feedback shows positive and very encouraging trends in all dimensions—work related, humanitarian, family and self—in other words, in professional, personal and deep inner lives. (shrink)

Plagiarism is growing at rampant rate due to available internet and the growing tendency of wrong practices of hiding the undocumented or documented sources. In academic institutions, plagiarism poses a threat to both students and instructors that ultimately leads to common plagiarism undetected, lost grants or public resources with over all poor quality. A step-by-step approach is proposed to avoid plagiarism for students by correct paraphrasing and quoting the words, sentences and paragraphs piece by piece to give the appropriate credit (...) to the author with existing work of its original author. This approach will avoid the parallel or reproduction of material inappropriately used in any way . Several examples are cited from documented websites of leading universities and institutions to make new freshman students aware of plagiarism and methods to avoid it. (shrink)

This essay explores the notion of female embodiment and its relation to the phenomenon of religion. It explains religious beliefs, acts, and events in terms of the worship of the female body. By elucidating this standpoint, this essay hopes to reclaim the centrality of the female body and its importance in the study of philosophy of religion.

In this paper, I will be discussing, through the lens of this paradox, the experiences of a Hindu devotee of God, the 16th-century poet Mirabai. I will map out some contours of this interaction that seems to be conceptually impossible and yet animates the devotional life. I will explore how Mirabai seeks to transgress, through her poetic expressions alternating with joy and sorrow, the finite realm and somehow contain the divine non-finite reality, namely, Krishna. As we will see, her attempts (...) to engage with Krishna, her non-finite beloved, and generate a loving interaction between herself and Krishna often leads to the disappearance of Krishna which encases her in a spiral of deep suffering and lament. However, it is precisely this agony that enables her to gradually withdraw herself from the finite world and, in turn, immerse herself devotionally in Krishna. I will explore, in the final section, the nature of Mirabai’s devotional victory, and how these moments of suffering, in the experience of separation from Krishna (viraha-bhakti), are yet charged with a liberating power. This spiritual telos allows for a deep devotional connection to be established between her finite self and Krishna, a connection that cannot be articulated straightforwardly on the logical plane. BACKGROUND AND RATIONALE: Evidence based medicine is the present backbone of rational and objective, modern medical problem solving and is a meeting ground for quantitative and qualitative researchers alike as it culminates into applying the fruits of clinical research to the individual patient. A systematic enquiry into the evolving paradigms in EBM is a need of the hour. AIMS AND METHODS: A qualitative enquiry examining the impact of different methodologies in EBM and their role in generating meaning interpretable at individual (...) levels. RESULTS: Present day outcome based research deals less with patients as individuals than as populations. Evidence based medicine struggles to apply the fruits of population based research to individuals who are often not as predictable as linear quantitative research would like them to be. The present EBM literature neglects a lot of events it doesn't believe to be statistically significant and perhaps here is an area that needs to be improved on - it assumes that because associations are demonstrated between interventions and outcomes in RCTs/meta-analysis, these associations are linear and causal in the real world. While they may be demonstrated repeatedly in highly controlled environments, in the real 'uncontrolled' world of clinical practice with real people, their validity breaks down. CONCLUSIONS: One needs to make the EBM standard model patient-individual (a projection of collective patient event data) resemble the real human individual patient so that optimal EBM individual data that matches our query can be easily and quickly spotted from the dense jungle of information that has grown over the years. This hints at rethinking our entire research methodology and modifying it to suit the needs of the individual patient. (shrink)

Drawing on contrasting theoretical perspectives of self-interest and utilitarian/ethical motivations, we examine the degree to which a company's pace of departure from Russia after the Ukraine invasion is driven by its exposure to the Russian market. Moreover, we investigate whether firm-level political and non-political risks influence the propensity to delay or expedite the exit/withdrawal process. Contrary to utilitarian expectations advocating for ethical exit decisions irrespective of exposure and risks, firms with higher Russian exposure were less likely to exit sooner, indicating (...) a prioritization of business interests over ethical imperatives. This self-interest effect was further amplified by heightened political risks but attenuated by non-political risks. These findings remained consistent across various model specifications, with limited discernible variations based on firm characteristics such as ranking, COVID-19 exposure and risk, past idiosyncratic volatility, or family ownership and control. In addition, an examination of post-exit effects on profitability, risk, cost of capital, and liquidity revealed no statistically significant relationships. Our study highlights the prevalence of self-interest motivations over utilitarian principles, as firms with substantial Russian exposure prioritized safeguarding their business interests in the aftermath of the Ukraine invasion, even at the potential cost of ethical and social responsibility imperatives. A deficit in the number of organs available for transplantation persists even with an increase in donation rates. One possible choice of donor for organs that appears under-referred and/or unaccepted is patients with primary brain tumours. In spite of advances in the treatment of high-grade primary central nervous system (CNS) tumours, the prognosis remains dire. A working group on organs from donors with primary CNS tumours showed that the risk of transmission is small and outweighs the benefits of waiting for (...) a normal donor, in survival and organ life-years, with caveats. This paper explores the possibility that, if information on organ donation were made available to patients and their families with knowledge of their inevitable fate, perhaps some will choose to donate. It would be explained that to achieve this, elective ventilation would be performed in their final moments. This would obviate the consent question because of an advance statement. It is accepted that these are sensitive matters and there will be logistic issues. This will need discussion with the public and other professionals, but it could increase the number of donors and can be extrapolated to encompass other primary CNS tumours. (shrink)

Purpose This study aims to explore the potential of mobile assistive technology as a vocational tool for blind workers. Specifically, it investigates: Can MAT-enabled BW to perform better at the workplace and will insight into MAT-enabled capabilities impact employer perception regarding BW employability. Design/methodology/approach Exploratory case study which draws on theories of fit to analyze observational and interview data at an organization familiar with employing, training and referring BW. Findings MAT can increase blind worker job fit, positively impacting their performance, (...) self-reliance and managerial perceptions regarding their employability. Research limitations/implications A conceptual framework is articulated which expands current literature on fit to better account for the assistive potential of mobile technology for differently abled workers. Practical implications The positive impact of MAT on managerial perceptions of BW fit and employability can inform the regimes of employers, job skills trainers, vocational rehabilitation specialists and policy makers. Social implications Insights on the use of MAT as a vocational tool can reduce the systemic workplace disenfranchisement of blind people. The natural replacement of damaged cells by stem cells occurs actively and often in adult tissues, especially rapidly dividing cells such as blood cells. An exciting case in Boston, however, posits a kind of natural stem cell therapy provided to a mother by her fetus—long after the fetus is born. Because there is a profound lack of medical intervention, this therapy seems natural enough and is unlikely to be morally suspect. Nevertheless, we feel morally uncertain when we consider giving this (...) type of therapy to patients who would not naturally receive it. Much has been written about the ethics of stem cell research and therapy; this paper will focus on how recent advances in biotechnology and biological understandings of development narrow the debate. Here, the author briefly reviews current stem cell research practices, revisits the natural stem cell therapy case for moral evaluation, and ultimately demonstrates the importance of permissible stem cell research and therapy, even absent an agreement about the definition of when embryonic life begins.Although one promising technology, blighted ovum utilisation, uses fertilised but developmentally bankrupt eggs, it is argued that utilisation of unfertilised eggs to derive totipotent stem cells obviates the moral debate over when life begins. There are two existing technologies that fulfil this criterion: somatic cell nuclear transfer and parthenogenic stem cell derivation. Although these technologies are far from therapeutic, concerns over the morality of embryonic stem cell derivation should not hinder their advancement. (shrink)

I examine the foundations of a just society using the lens of decision theory. The conception of just society is from an individual’s viewpoint: where would I rather live if I have an equal chance of being any individual? Three alternative designs for a just society are examined. These are: laissez-faire, maximin and social minimum. Two assumptions about human nature clarify the distinction among three societies. The first assumption is that a representative individual’s utility function is concave. The second assumption (...) recognizes that redistribution to achieve equality reduces total wealth. A rational individual would prefer a society where one is free to maximize one’s expected utility. A social minimum that includes both the provision of essential human needs and equality of opportunity (education, healthcare, access to capital) for a flourishing life emerges as a candidate solution for the basic structure of society. Much has been written about how Foucault's archaeology of the modern episteme, emerging from early 19th-century Europe, was curiously divorced from its context of colonialism. Media archaeology, as Foucault's legacy, has also remained rather geopolitically insular and race agnostic in its epistemological reverse engineering of media modernity. Using screenwriting history as a case study, this article demonstrates how bringing decolonial thinking and media archaeology together can challenge linear narratives of modernity/coloniality in media history. The article connects two seemingly disparate histories (...) of archival absence and human obsolescence to reveal the construction of an elusive screenwriting modernity that has historically obscured parallel scripting practices and pre-existing scribal traditions. Mechanism design is an analytical framework for thinking clearly and carefully about what exactly a given institution can achieve when the information necessary to make decisions is dispersed and privately held. This analysis provides an account of the underlying mathematics of mechanism design based on linear programming. Three advantages characterize the approach. The first is simplicity: arguments based on linear programming are both elementary and transparent. The second is unity: the machinery of linear programming provides a way to unify results (...) from disparate areas of mechanism design. The third is reach: the technique offers the ability to solve problems that appear to be beyond solutions offered by traditional methods. No claim is made that the approach advocated should supplant traditional mathematical machinery. Purposefully situated beyond popular deconstructionist theory and anthropocentric perspectives, the book investigates the longstanding traditions of oppression, racism, and white supremacy that are systemically reseated and reinforced by learning and social interaction. There are a number of conflicting accounts of thought insertion, the delusion that the thoughts of another are inserted into one’s own mind. These accounts share the common assumption of _realism_: that the subject of thought insertion has a thought corresponding to the description of her thought insertion episode. I challenge the assumption by arguing for an anti-realist treatment of first-person reports of thought insertion. I then offer an alternative account, _simulationism_, according to which sufferers merely simulate having a thought (...) inserted into their heads. By rejecting realism, the paper undermines a widespread explanatory framework that unites otherwise competing cognitive models of thought insertion. (shrink)

The last decades have seen major advances in the study of gestures both in humans and non-human primates. In this paper, we seriously examine the idea that there may be gestural form types that are shared across great ape species, including humans, which may underlie gestural universals, both in form and meaning. We focus on one case study, the hand fling gesture common to chimpanzees and humans, and provide a semantic analysis of this gesture.

This study examines the endogenous relation between corporate social responsibility and tax avoidance by focusing on a common strategy of corporate tax avoidance, i.e., establishing entities in offshore tax havens. Using hand-collected data on a sample of U.S. firms, we find that firms’ CSR ratings increase substantially in the two years after they first open tax haven affiliates. We provide evidence by using the controlled foreign corporations look-through rule enacted by Congress in 2006 that facilitates offshore profit shifting. We find (...) that firms that are affected by the CFC legislation increase their CSR practices in response. Overall, our results are consistent with the risk management theory, which argues that firms hedge against the potential negative consequences of aggressive tax avoidance practices through an increase in positive CSR activities. Research in formal theoretical semantics has recently expanded its scope to include gestural communication, focusing in particular on gestures that contribute to the content of an accompanying utterance, e.g., size gestures (LARGE, WIDE), pointing gestures, and gestures that depict objects (TELESCOPE) or actions (SLAP). At the same time, fruitful inquiries at the intersection of primatology and linguistics have given rise to the hypothesis that human and non-human great apes share a common set of directive (=imperative) gestures. Directive gestures such as (...) STOP or COME-CLOSER, pose non-trivial issues for a semantic analysis: we inherit the challenges that pertain to the analysis of imperative utterances (Come closer!), while adding a further challenge that stems from the underspecified mapping between a directive body movement and its potential counterparts in human language. We begin by outlining the problem and surveying the nascent state-of-the-art with regards to a formal semantics of directive gestures. Particular attention is given to the multifunctionality of directive gestures, which typically have different effects in different contexts; for example, a non-human ape gesture may communicate "Stop that" in some contexts and "Move away" in others, with similar patterns found in humans. We show that this multifunctionality can be derived from a single, rich abstract lexical entry, "Not…!", a candidate for a universal building block of meaning, shared by human and non-human great apes. "Not…!", which incorporates negation/rejection, temporal reference and presuppositionality is more explanatory in comparison to a minimal alternative. This chapter lays out the hypothesis space, addressing the foundational question of how to explain attested gestural overlap between human and non-human great apes. We conclude the chapter by reviewing potential expansions of the analysis to the pragmatic gestures of humans, which are thus placed on the primate gestural meaning continuum and connected to the directive gestures we share with our non-human relatives in the great ape family. This paper examines the role of mutual funds in corporate social responsibility. Using a fund-level, holdings-based CSR score, we find that CSR-friendly mutual funds improve firms’ CSR standings. This effect is more pronounced for firms with higher mutual fund ownership and stronger corporate governance. We further show that while CSR-friendly mutual funds have influence on almost all CSR categories, they focus on increasing CSR strengths rather than reducing CSR concerns. We also discover that CSR-friendly funds are more likely to vote (...) in favor of CSR proposals, and that firms owned by CSR-friendly funds are more likely to link their CEO compensation to CSR outcomes. These results suggest that actively managed mutual funds, which were previously thought to be indifferent to social and ethical issues, play a significant role in corporate social outcomes of the firms they invest in. This article describes a representation-based framework of distributed cognition. This framework considers distributed cognition as a cognitive system whose structures and processes are distributed between internal and external representations, across a group of individuals, and across space and time. The major issue for distributed research, under this framework, are the distribution, transformation, and propagation of information across the components of the distributed cognitive system and how they affect the performance of the system as a whole. To demonstrate the value of (...) this representation-based approach, the framework was used to describe and explain an important, challenging, and controversial issue — the concept of affordance.
