Reporters' use of government data bases can create problems with serving justice and maintaining privacy. Although there are many advantages to the new reporting tool, problems can arise when the information is inaccurate or is misused for purposes other than originally intended. The ethical question of maintaining privacy while ful-filling the political function of the media is discussed. Suggested guidelines are given.

Fish stocks, as common pool resources, are more and more managed by giving fishermen exclusive access rights as Individual Transferable Quotas (ITQ). These have been widely discussed, with focus on social, economic and ecological issues. While equity aspects have been of great concern, there is very limited analysis about how to assess issues of equity and fair distribution when introducing ITQs. This paper applies an existing framework for assessing equity in resource use systems to tradable quota systems in fisheries. The (...) framework defines the perspectives of distributive fairness, the stakeholders who are bound by fair practice rules, and instruments of fairness, and identifies metrics to assess equity in practice. The following paper is devoted to the discussion of three important and closely interlocked topics in the philosophy of Donald Davidson, the questions: What are reasons? — What are actions? — And: What is the relation between a reason and an action, when the reason explains the action by giving the agent's reason for doing what he did? The last question is actually a quotation; it is the first sentence of Davidson's famous article Actions, Reasons, and Carnes. Although subse-quently modified (...) in various important respects, it still provides the meta-physical groundwork for Davidson's later views on action theory and the philosophy of mind. It is this metaphysical basis that I want to concentrate on. Offhand, Davidson's answers to all the three questions are common in philosophical action theory: Actions are events, reasons are causes of those events, and giving the agent's reason explains an action because it explains the action causally. In what follows, I shall first recapitulate Davidson's reasoning toward the third claim, which I take to be true and to be what Davidson thinks. In discussing a possible objection against this claim I shall then try to show that the second thesis, the thesis that reasons are causes, is neither true nor is it Davidson's opinion. And finally, I want to argue with regard to the first thesis that although Davidson actually holds that actions are events, he should better abandon this position. (shrink)

According to D. Lewis, fundamental physical quantities such as mass are families of perfectly natural properties. The best theory of naturalness, however, is nominalistic. But the nominalistic Lewisian has to account for the unity of the particular masses in terms of fundamental ordering and congruence relations among individuals. Such a first-order relational theory can do without perfectly natural mass qualities, without making the having of a particular mass extrinsic. This strictly relational account can be applied to fundamental vectorial quantities such (...) as the field strengths, too. So conceived, vector fields are compatible with Lewis ' hypothesis of Humean Supervenience. Even the denier of real possible worlds should seek to retain the advantages of this first-order, strictly relational theory. German D. Lewis zufolge sind physikalische Grundgrößen wie die Masse Familien von perfekt natürlichen Eigenschaften. Die beste Theorie der Natürlichkeit ist jedoch die nominalistische. Der nominalistische Lewisianer muss aber den Familienzusammenhalt der einzelnen Massequalitäten durch fundamentale Ordnungs- und Kongruenzbeziehungen zwischen den Masseträgern erklären. Eine solche erststufig-relationale Theorie kann auf perfekt natürliche Massequalitäten verzichten, ohne das Haben einer Masse zu einer extrinsischen Eigenschaft zu machen. Diese strikt relationale Theorie ist auch auf fundamentale Vektorgrößen wie die Feldstärken anwendbar. Derart konzipierte Vektorfelder sind mit Lewis ' Hypothese der Hume'schen Supervenienz vereinbar. ZusammenfassungDie traditionsreiche Deutsche Gesellschaft für Innere Medizin war durch ihr Agieren in der NS-Zeit belastet. Vor ihrem ersten Nachkriegskongress 1948 in Karlsruhe fiel dem Bonner Klinikdirektor Paul Martini die Rolle eines Reorganisators zu. Martini, der während der NS-Zeit in Opposition zum Regime gestanden hatte, wählte einen Kurs umfassender Integration. Verfolgte des NS-Staats versuchte er ebenso in die DGIM einzubinden wie einstige gemäßigte Nationalsozialisten. Zugleich bemühte er sich um die Bewahrung des gesamtdeutschen Charakters der Kongresse sowie um einen zügigen Anschluss an (...) die internationale Forschung. Dennoch führte der eingeschlagene Weg die DGIM in nur scheinbar unpolitische Wissenschaftlichkeit und Jahrzehnte weitgehender Kritiklosigkeit gegenüber ihrer NS-Geschichte. (shrink)

Ist es sinnvoll, krank zu sein? – Diese seltsam anmutende Frage bietet den Auftakt für eine philosophische Untersuchung, was unter dem Sinn einer Krankheit verstanden werden kann und was das Interessante an diesen Konzeptionen ist. Ausgangspunkt ist die Feststellung, dass der Ausdruck „Sinn“ offenkundig mehrdeutig ist. Man kann damit sprachliche Bedeutung, Zwecke oder Motive meinen. Es kann aber auch um den narrativen Sinn im biographischen Leben oder um das Verhältnis der Krankheit zum Lebenssinn eines Menschen gehen. Gerade die letzten beiden (...) Lesarten erweisen sich als aufschlussreich: die Einbindung der Krankheiten in den Lebenslauf und Krankheiten als Anstoß, sich über das eigene Leben Gedanken zu machen. Krankheiten könnten so den Effekt haben, ein sinnvolleres Leben zu führen, sie könnten uns aber auch die ultimative Sinnlosigkeit unseres Daseins vor Augen führen. (shrink)

Inductive Metaphysics combines an anti-aprioristic emphasis on an empirical and scientific basis for metaphysics with an insistence on a specifically philosophical abductive theory-building. Since the latter specifically philosophical work is not empirical itself, it may in a liberal sense be called apriori. This paper highlights this apriori dimension within IM by a case study on Structuralism, the view that fundamental reality consists of a network of relations, which a number of philosophers consider to be suggested by modern physics. Focussing on (...) Dasgupta’s algebraic Generalism, the author argues that Structuralism suffers from a severe entailment problem, because the relations-spanning apparatus must stand for metaphysically fundamental forms. Schaffer’s contention that there are no entailment problems is rejected. Advocates of IM are well advised to take seriously their own insistence on metaphysical abduction and not to one-sidedly emphasise the empirical input: the elaboration of exact metaphysical theories and the apriori evaluation of their inherent tenability is a constituent of IM no less important than the consideration of scientific input. More traditional ways of metaphysical reasoning inevitably survive as an essential dimension within IM. (shrink)

Resemblance Nominalism About Perfect Naturalness is the view that perfect naturalness of classes is best defined by a conceptual primitive of resemblance between particulars. The adequacy of RNPN is defended by outlining nominalism as the strictly anti-constitutive view that the particulars’ being the fundamental ways they are is not constituted by anything further, supplying a doubly plural contrastive and graded resemblance predicate that allows for a definition of perfect naturalness on an actualist basis, and proving a representation and a uniqueness (...) theorem on the basis of a formal constraint on resemblance called “the Principle”, thereby revealing that bodies of nominalist resemblance facts are guaranteed to behave as if they were grounded in patterns of universals distributed over particulars. In his new book, Fred Schauer adopts a prototypical approach to the law in order to reestablish the importance of “The Force of Law”, and I strongly support his claim that there are interesting things to be said about the relationship between law and force. One aspect concerns the special kind of force to which the law is related. In the tradition of political philosophy, this kind of force has often been characterized with the state's monopoly on legitimate force. Whereas (...) the essay will support the idea that the law has a monopoly of force, it will challenge the idea that it is its legitimacy that makes it characteristic. It is a monopoly not so much on legitimate, but on ultimate force. The robustness of the force the law is—prototypically—related to, however, should not obscure the fact that the relation between law and force is quite delicate and precarious. Three strategies of the law to manage this fundamental precariousness are pointed out. (shrink)

A “multifactorial” model should accommodate a psychological perspective, aiming to relate the phenomenology of complex visual hallucinations not only to neurobiological findings but also an understanding of the patient's psychological problems and situation in life. Greater attention needs to be paid to the role of the “lack of insight” patients may have into their hallucinations and its relationship to cognitive impairment.

We show that the statement “every universally Baire set of reals has the perfect set property” is equiconsistent modulo ZFC with the existence of a cardinal that we call virtually Shelah for supercompactness. These cardinals resemble Shelah cardinals and Shelah-for-supercompactness cardinals but are much weaker: if $0^\sharp $ exists then every Silver indiscernible is VSS in L. We also show that the statement $\operatorname {\mathrm {uB}} = {\boldsymbol {\Delta }}^1_2$, where $\operatorname {\mathrm {uB}}$ is the pointclass of all universally Baire (...) sets of reals, is equiconsistent modulo ZFC with the existence of a $\Sigma _2$ -reflecting VSS cardinal. The mechanics of claims focusses predominantly on the claim to life. The claim to life is rooted in the autonomy principle, just like other specific claims. Still, the mechanics of claims does not have a systematic place for the fundamental negation of the status as an autonomous being as such. It is, however, the proctiction of the status as such, which is at the center of the protection of human dignity in German constitutional law. Looked at it from this perspective, (...) the protection of human dignity as the protection of the status of an autonomous human being, appears to be a blind spot of the mechanics of claims. The comment attempts to show, how this blindspot leads to inconsistencies in the mechanics of claims, and how they might be ameliorated if human dignity is considered as an absolute right independent of the claims to life. One hundred and fifty years ago, a hopeful young researcher reported a recent discovery he had made. Working in the bowels of a medieval castle in the German city of Tübingen, he had isolated a then entirely new type of molecule. This was the birth of a field that would fundamentally change the course of biology, medicine, and beyond. His discovery: DNA. His name: Friedrich Miescher. In this article, the authors try to find answers to the question why—despite the fact (...) that virtually everyone nowadays knows DNA—hardly anyone remembers the man who discovered it. In the history of science, the discovery of DNA was a seminal moment. Why then did it not enter into public memory? Ground‐breaking discoveries can occur in a historical context that is not ready to appreciate them. But that's not all that decides who is remembered and who is forgotten. Scientific pioneers sometimes fail to publicize their findings in a way that ensures that they receive the attention they merit. As discussed here, their personalities and habits may cause discoveries to be “overwritten” by more recent researchers, resulting in distorted cultural memories no longer reflecting the initial event. This paper provides an account of the closure conditions that apply to sets of subvening and supervening properties, showing that the criterion that determines under which property-forming operations a particular family of properties is closed is applicable both to the finitary and to the infinitary case. In particular, it will be established that, contra Glanzberg, infinitary operations do not give rise to any additional difficulties beyond those that arise in the finitary case.

Based on recent insight into the thalamocortical system and its role in perception and conscious experience, a unified pathophysiological framework for hallucinations in neurological and psychiatric conditions is proposed, which integrates previously unrelated neurobiological and psychological findings. Gamma-frequency rhythms of discharge activity from thalamic and cortical neurons are facilitated by cholinergic arousal and resonate in networks of thalamocortical circuits, thereby transiently forming assemblies of coherent gamma oscillations under constraints of afferent sensory input and prefrontal attentional mechanisms. If perception is based (...) on synchronisation of intrinsic gamma activity in the thalamocortical system, then sensory input to specific thalamic nuclei may merely play a constraining role. Hallucinations can be regarded as underconstrained perceptions that arise when the impact of sensory input on activation of thalamocortical circuits and synchronisation of thalamocortical gamma activity is reduced. In conditions that are accompanied by hallucinations, factors such as cortical hyperexcitability, cortical attentional mechanisms, hyperarousal, increased noise in specific thalamic nuclei, and random sensory input to specific thalamic nuclei may, to a varying degree, contribute to underconstrained activation of thalamocortical circuits. The reticular thalamic nucleus plays an important role in suppressing random activity of relay cells in specific thalamic nuclei, and its dysfunction may be implicated in the biological vulnerability to hallucinations in schizophrenia. Combined with general activation during cholinergic arousal, this leads to excessive disinhibition in specific thalamic nuclei, which may allow cortical attentional mechanisms to recruit thalamic relay cells into resonant assemblies of gamma oscillations, regardless of their actual sensory input, thereby producing an underconstrained perceptual experience. Es wird der Vorschlag gemacht, das Konzept des psychoanalytischen Arbeitsmodells (Sandler, Tuckett) auf die Erfahrungen der Lehranalyse zu übertragen. Der Autor vergleicht das von Hermann Beland 2020 [2004] beschriebene Modell mit dem eigenen und postuliert eine Besonderheit der Lehranalyse, die er als Dichotomie von »therapeutischer Dimension« und »didaktischer Dimension« formuliert. In der Beschreibung ihrer Verstrickungen wird auf einige ethische Aspekte hingewiesen, die das Ziel der Lehranalyse gefährden können.

ABSTRACTOne prestudy based on a corpus analysis and four experiments in which participants had to invent novel names for persons or objects investigated how the valence of a face or an object affects the phonological characteristics of the respective novel name. Based on the articulatory feedback hypothesis, we predicted that /i:/ is included more frequently in fictional names for faces or objects with a positive valence than for those with a negative valence. For /o:/, the pattern should reverse. An analysis (...) of the Berlin Affective Word List – Reloaded yielded a higher number of occurrences of /o:/ in German words with negative valence than in words with positive valence; with /i:/ the situation is less clear.
