Sometimes, the availability of more evidence for a conclusion provides a reason to believe in its falsity. This counter-intuitive phenomenon is related to the idea of higher-order evidence, which has attracted broad interest in recent epistemological literature. Occasionally, providing more evidence for something weakens the case in its favor, by casting doubt on the probative value of other evidence of the same sort or on the fact-finder’s cognitive performance. We analyze this phenomenon, discuss its rationality, and outline possible application to (...) evidence law and to the law in general. It is suggested, inter alia, that such higher-order evidence may explain how judicial experience-based expertise in fact-finding is possible despite the absence of a feedback mechanism; and that fact-finders’ self-doubt regarding their own competence in making ‘beyond-reasonable doubt’ judgments might be reasonable and should not be ignored. Sometimes, there are reasons for which we believe, intend, resent, decide, and so on: these reasons are the “bases” of the latter, and the explanatory relation between these bases and the latter is what I will call “the basing relation.” What kind of explanatory relation is this? Dispositionalists claim that the basing relation consists in the agent’s manifesting a disposition to respond to those bases by having the belief, intention, resentment, and so on, in question. Representationalists claim that the basing (...) relation consists in the agent’s representing the bases as justifying the belief, intention, resentment, and so on, in question. This article shows that an adequate account of the basing relation requires a particular refinement and combination of these two views. On the hybrid account defended here, the basing relation involves a disposition exercise that is individuated by the agent’s object-involving de se representation of that very exercise as justifying. In his recent Knowledge and its Limits, Timothy Williamson argues that no non-trivial mental state is such that being in that state suffices for one to be in a position to know that one is in it. In short, there are no “luminous” mental states. His argument depends on a “safety” requirement on knowledge, that one’s confident belief could not easily have been wrong if it is to count as knowledge. We argue that the safety requirement is ambiguous; on one (...) interpretation it is obviously true but useless to his argument, and on the other interpretation it is false. (shrink)

The fair innings argument (FIA) is frequently put forward as a justification for denying elderly patients treatment when they are in competition with younger patients and resources are scarce. In this paper I will examine some arguments that are used to support the FIA. My conclusion will be that they do not stand up to scrutiny and therefore, the FIA should not be used to justify the denial of treatment to elderly patients, or to support rationing of health care by (...) age.There are six issues arising out of the FIA which are to be addressed. First, the implication that there is such a thing as a fair share of life. Second, whether it makes sense to talk of a fair share of resources in the context of health care and the FIA. Third, that 'fairness' is usually only mentioned with regard to the length of a person's life, and not to any other aspect of it. Fourth, if it is sensible to discuss the merits of the FIA without taking account of the 'all other things being equal' argument. Fifth, the difference between what is unfair and what is unfortunate. Finally, that it is tragic if a young person dies, but only unfortunate if an elderly person does. (shrink)

I have argued that orthographic processing cannot be understood and modeled without considering the manner in which orthographic structure represents phonological, semantic, and morphological information in a given writing system. A reading theory, therefore, must be a theory of the interaction of the reader with his/her linguistic environment. This outlines a novel approach to studying and modeling visual word recognition, an approach that focuses on the common cognitive principles involved in processing printed words across different writing systems. These claims were (...) challenged by several commentaries that contested the merits of my general theoretical agenda, the relevance of the evolution of writing systems, and the plausibility of finding commonalities in reading across orthographies. Other commentaries extended the scope of the debate by bringing into the discussion additional perspectives. My response addresses all these issues. By considering the constraints of neurobiology on modeling reading, developmental data, and a large scope of cross-linguistic evidence, I argue that front-end implementations of orthographic processing that do not stem from a comprehensive theory of the complex information conveyed by writing systems do not present a viable approach for understanding reading. The common principles by which writing systems have evolved to represent orthographic, phonological, and semantic information in a language reveal the critical distributional characteristics of orthographic structure that govern reading behavior. Models of reading should thus be learning models, primarily constrained by cross-linguistic developmental evidence that describes how the statistical properties of writing systems shape the characteristics of orthographic processing. Question: Do clinicians providing abortion practicing in states that restrict abortion experience more moral distress than those practicing in states that protect abortion? -/- Findings: In this national, purposive survey study of 310 clinicians providing abortion, moral distress was elevated among all clinicians, with those practicing in restrictive states reporting higher levels of moral distress compared with those practicing in protective states. -/- Meaning: The findings suggest that structural changes addressing bans on necessary health care, such as federal protection for (...) abortion, are needed at institutional, state, and federal policy levels to address clinician moral distress. Rieber 1998 proposes an account of "S knows that p" that generates a contextualist solution to Closure. In this paper, I’ll argue that Rieber’s account of "S knows that p" is subject to fatal objections, but we can modify it to achieve an adequate account of "S knows that p" that generates a unified contextualist solution to all four puzzles. This is a feat that should matter to those philosophers who have proposed contextualist solutions to Closure: all of them have (...) motivated their contextualism by appeal to the fact that they can explain the plausibility of each of the statements in Closure taken individually, and they can do this without having to deny that each of those statements is true, at least in the context in which it is plausible. But notice that this consideration would equally well motivate a contextualist approach to the other puzzles. Nonetheless, no contextualist has yet suggested how a contextualist solution to the other puzzles might go. (shrink)

In the last decade, reading research has seen a paradigmatic shift. A new wave of computational models of orthographic processing that offer various forms of noisy position or context-sensitive coding have revolutionized the field of visual word recognition. The influx of such models stems mainly from consistent findings, coming mostly from European languages, regarding an apparent insensitivity of skilled readers to letter order. Underlying the current revolution is the theoretical assumption that the insensitivity of readers to letter order reflects the (...) special way in which the human brain encodes the position of letters in printed words. The present article discusses the theoretical shortcomings and misconceptions of this approach to visual word recognition. A systematic review of data obtained from a variety of languages demonstrates that letter-order insensitivity is neither a general property of the cognitive system nor a property of the brain in encoding letters. Rather, it is a variant and idiosyncratic characteristic of some languages, mostly European, reflecting a strategy of optimizing encoding resources, given the specific structure of words. Since the main goal of reading research is to develop theories that describe the fundamental and invariant phenomena of reading across orthographies, an alternative approach to model visual word recognition is offered. The dimensions of a possible universal model of reading, which outlines the common cognitive operations involved in orthographic processing in all writing systems, are discussed. (shrink)

(NEG) is widely accepted both by internalist and by externalists. In fact, there have been very few opponents of (NEG). Timothy Williamson (e.g., 2000) rejects (NEG), for reasons that have by now received a great deal of scrutiny.2 John McDowell also rejects (NEG), but his reasons have not received the scrutiny they deserve. This is in large part because those reasons have not been well understood. We believe that McDowell’s challenge to (NEG) is important, worthy of fair assessment, and maybe (...) even correct. Wittgenstein’s On Certainty is sometimes read as providing a response to the skeptical puzzle from closure, according to which our commitment to the trustworthiness of our evidence is not itself evidentially grounded. In this paper, I argue both that this standard reading of Wittgenstein is incorrect, and that a more accurate reading of Wittgenstein provides us with a more plausible solution to the Closure Puzzle.

Subliminal perception (SP) is today considered a well-supported theory stating that perception can occur without conscious awareness and have a significant impact on later behaviour and thought. In this article, we first present and discuss different approaches to the study of SP. In doing this, we claim that most approaches are based on a dichotomic measure of awareness. Drawing upon recent advances and discussions in the study of introspection and phenomenological psychology, we argue for both the possibility and necessity of (...) using an elaborated measure of subjective states. In the second part of the article, we present findings where these considerations are implemented in an empirical study. The results and implications are discussed in detail, both with reference to SP, and in relation to the more general problem of using elaborate introspective reports as data in relation to studies of cognition. According to a doctrine that I call “Cartesianism”, knowledge – at least the sort of knowledge that inquirers possess – requires having a reason for belief that is reflectively accessible as such. I show that Cartesianism, in conjunction with some plausible and widely accepted principles, entails the negation of a popular version of Fallibilism. I then defend the resulting Cartesian Infallibilist position against popular objections. My conclusion is that if Cartesianism is true, then Descartes was right about this much: for (...) S to know that p, S must have reasons for believing that p which are such that S can know, by reflection alone, that she has those reasons, and that she could not possibly have those reasons if p is not true. Where Descartes went wrong was in thinking that our ordinary, fallible, non-theologically grounded sources of belief (e.g., perception, memory, testimony), cannot provide us with such reasons. Your evidence constrains your rational degrees of confidence both locally and globally. On the one hand, particular bits of evidence can boost or diminish your rational degree of confidence in various hypotheses, relative to your background information. On the other hand, epistemic rationality requires that, for any hypothesis h, your confidence in h is proportional to the support that h receives from your total evidence. Why is it that your evidence has these two epistemic powers? A number of philosophers have recently defended “contrastivist” theories of knowledge, according to which knowledge is a relation between at least the following three relata: a knower, a proposition, and a contrast set. I examine six arguments that Jonathan Schaffer has given for this thesis, and show that those arguments do not favour contrastivism over a rival view that I call “evidentiary relativism”. I then argue that evidentiary relativism accounts for more data than does contrastivism.

Stephen Schiffer has argued that contextualist solutions to skepticism rest on an implausible "error theory" concerning our own semantic intentions. Similar arguments have recently been offered also by Thomas Hofweber and Patrick Rysiew. I attempt to show how contextualists can rebut these arguments. The kind of self-knowledge that contextualists are committed to denying us is not a kind of self-knowledge that we need, nor is it a kind of self-knowledge that we can plausibly be thought to possess.

Contemporary consciousness studies, where it is not explicitly religious, is mostly physicalist. Theories of self and consciousness in classical Hindu thought can easily be seen to contribute to religious issues in consciousness studies. But it is also the case that there is much in that that can be useful within broadly physicalist parameters of study as well. The Mīmāṃsā and Nyāya schools, while having (nonphysicalist) soteriological goals for the metaphysical self, nonetheless provide theories of its relationship with consciousness that allow (...) for interpretative strategies that can make their theories relevant to a broadly physicalist study of consciousness. Advaita Vedānta cannot be so interpreted, but its inquiry into the nature of consciousness can provide material for a fundamental critique of the project of objectifying consciousness. (shrink)
