Many see the mithnagdim as total rationalists. Therefore it has been assumed that R. Hayyim of Volozhin’s approach to Torah study was the same. Although rationalism may be a correct characterization of the method he used in talmudic study, it does not capture how R. Hayyim understood the essence of Torah study. Some have described Nefesh ha-Hayyim as demystifying Kabbalah. I agree that R. Hayyim opposes ecstatic Kabbalah. However, already in 1972 Norman Lamm noticed that R. Hayyim saw Torah study (...) as a form of clinging to God. In my article, I go further and demonstrate how torah lishmah for R. Hayyim is a radical idea that includes a legitimate path to unio mystica, and even a way to divine inspiration. (shrink)

Nagel’s official model of theory-reduction and the way it is represented in the literature are shown to be incompatible with the careful remarks on the notion of reduction Nagel gave while developing his model. Based on these remarks, an alternative model is outlined which does not face some of the problems the official model faces. Taking the context in which Nagel developed his model into account, it is shown that the way Nagel shaped his model and, thus, its well-known deficiencies, (...) are best conceived of as a mere by-product of his philosophical background. Aristotle's Eudemian Ethics has been unjustly neglected in comparison with its more famous counterpart the Nicomachean Ethics. This is in large part due to the fact that until recently no complete translation of the work has been available. But the Eudemian Ethics is a masterpiece in its own right, offering valuable insights into Aristotle's ideas on virtue, happiness and the good life. This volume offers a translation by Brad Inwood and Raphael Woolf that is both fluent and exact, and (...) an introduction in which they help the reader to gain a deeper understanding both of the Eudemian Ethics and of its relation to the Nicomachean Ethics and to Aristotle's ethical thought as a whole. This paper contains a novel and coherent reading of Weberian ideal type construction, based on recent philosophical approaches to conceptual engineering. This reading makes transparent the dialectics of Weber's approach, resulting in a more nuanced interpretation of his methodological work. It will become apparent that Weber, when introducing his notion of an ideal type, did not merely summarize his views on methodology in the social sciences, but, rather, presented a two-step argument in favor of these views. The reconstruction will directly (...) bear on issues in the methodology of the social sciences. Weber not only presented a methodology that is, at some level of abstraction, strikingly similar to Carnapian explication (the canonical point of reference in the contemporary debate on conceptual engineering). He also diagnosed, in a systematic fashion, types of problems we face when dealing with ordinary and scientific concepts that play a key role in the description of social reality, and he foreshadowed what is today sometimes described as “debunking” projects. From a philosophy of science perspective, I propose Weber's view (on the reconstruction proposed here) as a serious candidate for an adequate theory of concept replacement in the social sciences. The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

This chapter considers eternity, duration, time, and their interrelations, and aims to resolve a paradox in Spinoza's theory of the mind's eternity. Spinoza's metaphysics of time includes an endless series of virtuous regresses. Spinoza characterizes duratio as a “magnitude. Spinoza says that duratio is “conceived as being greater or lesser, and as composed of parts”. Spinoza addresses time and its relation to duratio in the Metaphysical Thoughts. Spinoza accepts Suarez's view that “duratio and existence are only rationally distinct”. Spinoza holds, (...) with some of the Scholastic philosophers, that extrinsic denominations are mind‐made. Spinoza also uses geometrical construction as a model for thinking about the relationship between eternity and time. This is an extensive critical review of Euthanasia in International and Comparative Perspective. My Review is divided into five parts. First, I outline the book's strengths. I proceed by speaking of the need for clear and cohesive terminology. I then discuss end-of-life decision-making in some of the countries: Belgium, The Netherlands, and the State of Oregon in the United States, all allow PAS. Belgium and The Netherlands also allow euthanasia. I also discuss Israel's Dying Patient Law,13 enacted by the Knesset (...) on December 5, 2005. Finally, I make some suggestions for improvement, including a detailed proposal for PAS which I conceive to be the best policy when balancing one against the other the autonomy of the patient, on the one hand, and the safeguards against abuse when life might be considered too lightly, on the other. Indeed, the main difference between euthanasia and PAS is that in euthanasia, it is the physician who makes the final act of taking patient's life, whereas in PAS it is the patient who takes his or her life. In euthanasia, the physician has control over the process. In PAS, the physician controls the procedure up until the last act. The patient has control over the very act of suicide. (shrink)

This article reviews the history of press self-regulation in Britain, from the 1947 Ross Commission to the 2012 Leveson Inquiry Commission. It considers the history of the Press Council and the Press Complaints Commission, analysing the ways they developed, their work, and how they have reached their current non-status. It is argued that the existing situation in Britain is far from satisfactory, and that the press should advance more elaborate mechanisms of self-control, establishing a new regulatory body called the Public (...) and Press Council that will be anchored in law, empowering the new regulator with greater and unprecedented authority, and equipping it with substantive sanctioning abilities. The Public and Press Council should be independent and effective, with transparent policies, processes and responsibilities. Its adjudication should be made in accordance with a written, detailed Code of Practice. (shrink)

The discourse on economic integration with authoritarian regimes has evolved as a key topic throughout the different disciplines of social sciences. Are sanctions and boycotts effective methods to incentivize human rights improvements? To analyze this question, we focus on the situation in China’s Xinjiang province from 2010 to 2019. In this paper, we discuss the relevance of human rights as an ethical norm within business ethics and international law. We evaluate the ongoing processes in Xinjiang from this perspective and scrutinize (...) the interests of major players in the region, including the Central Government of the People’s Republic of China, Xinjiang’s local government, and enterprises involved in the region. In this paper, a cognate of the problem of divine foreknowledge is introduced: the problem of the prophet’s foreknowledge. The latter cannot be solved referring to Ockhamism—the doctrine that divine foreknowledge could, at least in principle, be compatible with human freedom because God’s beliefs about future actions are merely soft facts, rather than hard facts about the past. Under the assumption that if Ockhamism can solve the problem of divine foreknowledge then it should also yield a solution to the problem (...) of the prophet’s foreknowledge, it is concluded that Ockhamism fails. In this book, Erick Raphael Jiménez examines Aristotle's concept of mind, a key concept in Aristotelian psychology, metaphysics, and epistemology. Drawing on a close analysis of De Anima, Jiménez argues that mind is neither disembodied nor innate, as has commonly been held, but an embodied ability that emerges from learning and discovery. Looking to Aristotle's metaphysics and epistemology, Jiménez argues that just as Aristotelian mind is not innate, intelligibility is not an innate feature of the objects of Aristotelian mind, (...) but an outcome of certain mental constructions that make those objects intelligible. Conversely, it is through these same mental constructions that thinkers become intelligent, or come to possess minds. Connecting this account to Aristotle's metaphysics and epistemology, Jiménez shows how this concept of mind fits within Aristotle's wider philosophy. ObjectiveTo provide insights on emergent ethical tensions experienced by mental health practitioners during system re-organisation, which is sufficiently grounded in empirical data at the local level to inform policy on recovery at institutional and provincial levels.MethodEthnographic methods using narrative and critical phenomenological resources over 24 months.FindingsEveryday ethical tensions emerged at the confluence of different experiences of time, for example, how a context of increasing pressure to decrease patients’ length of stay at the hospital challenged efforts to listen to and advocate (...) for what mattered to patients and maintain the integrity of interventions. In this context, practitioners drew on clinical language and that of personal recovery to strategically ‘push back’, ‘play with’ or ‘take back’ time.DiscussionExamining everyday practices through ethnographic methods can illuminate the everyday ethical tensions that arise when mental health professionals and psychiatrists grapple with, often competing, goods. Critical phenomenological resources can help expand the structural considerations in empirical ethics, excavate underground practices and raise questions about the conceptual categories undergirding normative ethics. Elle permet d’ouvrir plus largement la réflexion sur la différence fondamentale qui se trouve entre la prise de décision éthique ou politique auprès (...) du patient, et à l’échelle macroscopique. Enfin, une discussion ouvrira la réflexion sur l’autonomie des patients et la légitimité de la réanimation – pour ceux qui ne souhaitent pas continuer à vivre – sur la valeur du « sauver à tout prix » et de la place du triage dans la pratique de la médecine. The aim is to review the decisions of the Central Elections Committee and of the Supreme Court regarding disqualification of lists in Israel. Two major questions are addressed: When should tolerance have its limits?; and, What constraints on liberty should be introduced in order to safeguard democracy? The judicial analysis focuses attention on the issue of whether the justices acted in accordance with the law. Consideration is given to the written law and to existing normative considerations which allow justices an (...) exegetic latitude. It is argued that theNeiman decision of 1984 was flawed, that the Court was erroneous in ignoring the licensing effect of its decision, and that democracy does not have to allow a violent list propounding the destruction of democracy to act in order to fulfil its aim. It is neither morally obligatory, nor morally coherent, to expect democracy to place the means for its own destruction in the hands of those who either wish to bring about the physical annihilation of the state, or to undermine democracy. These two cases are the only cases in which democracy has to introduce self-defensive measures and to deny representation in parliament to violent lists that convey such ideas, and that act to realize them. Even though anthropogenic climate change is largely caused by industrialized nations, its burden is distributed unevenly with poor developing countries suffering the most. A common response to livelihood insecurities and destruction is migration. Using Peter Singer's ‘historical principle’, this paper argues that a morally just evaluation requires taking causality between climate change and migration under consideration. The historical principle is employed to emphasize shortcomings in commonly made philosophical arguments to oppose immigration. The article concludes that none of these arguments is (...) able to override the moral responsibility of industrialized countries to compensate for harms that their actions have caused. (shrink)
