Reclamation is the phenomenon of an oppressed group repurposing language to its own ends. A case study is reclamation of slur words. Popa-Wyatt and Wyatt (2018) argued that a slurring utterance is a speech act which performs a discourse role assignment. It assigns a subordinate role to the target, while the speaker assumes a dominant role. This pair of role assignments is used to oppress the target. Here I focus on how reclamation works and under what conditions (...) its benefits can stabilise. I start by reviewing the data and describing preconditions and motivations for reclamation. Can reclamation be explained in the same basic framework as regular slurring utterances? I argue that it can. I also identify some features that must be a prediction of any theory of reclamation. I conclude that reclamation is an instance of a much broader class of acts we do with words to change the distribution of power: it begets power, but it also requires it. (shrink)

Derogatory terms can be powerful mechanisms of subordination, while re-appropriating these terms can be a strategy to fight back against social injustice. I argue that projects seeking to reclaim slurs have a performative structure that raises particular hazards. Whereas more familiar forms of protest may fail to bring about their intended result, attempts to re-appropriate slurs can fail to be understood as transgressive acts at all. When attempts at reclamation fail, their force is distorted; context and convention lead the (...) hearer to give uptake to the speech act as a traditional deployment of the slur. The force of this traditional use is to validate and re-entrench the very norms the act was intended to subvert. This is the precarious structure of reclamation projects: when successful, reclamation is the subversion of powerful mechanisms of oppression, but when unsuccessful, the act has the ironic force of constituting mechanisms of oppression. Since 2014, two legislative actions, the Transgender Persons (Protection of Rights)Act 2019, and the Draft Trafficking in Persons (Prevention, Care and Rehabilitation) Bill 2021, have been pivotal in re-inscribing the Indian state’s colonial policing of queer kinship networks. By criminalising relationalities outside the heteropatriarchal conjugal home, the sexual subaltern is exposed to the state’s mechanisms of rescue and rehabilitation. These developments have occurred alongside the constitutional recognition of privacy in K.S. Puttaswamy v. Union of India (2017) 10 SCC 1 and (...) the decriminalisation of the anti-sodomy law in Navtej Johar v. Union of India 2018 (10) SCALE 386 which have been celebrated as victories of self-determination and dignity for queer kinship. These judicial pronouncements, although symbolically pertinent, fail to materially protect queer kinship, and with the contemporary advocacy around queer marriage, the need for legal and cultural recognition has obfuscated the substantive needs of pre-existing queer alliances. Queer communities continue to organise for their own emancipation and despite their vulnerability, queer visibility offers a public counter-narrative of resistance and survival against the brutalities of society and the state. For critical legal scholars, the ongoing far-right assault upon the liberal status quo poses a distinct dilemma. On the one hand, the desire to condemn the far-right is overwhelming. On the other hand, such condemnations are susceptible to being appropriated as a validation of the very liberalism that critical theorists have long questioned. In seeking to transcend this dilemma, my focus is on the discourse of ‘white genocide’ — a commonplace belief amongst the far-right/white nationalists that ‘whites’, as a discrete (...) group, are facing demographic destruction as a result of deliberate policy choices. Such a belief has motivated acts of extreme violence. While libel to dismissal by experts on mainstream understandings of genocide, namely international criminal lawyers, I argue that this ‘white genocide’ discourse deserves careful scrutiny as a jurisprudential and socio-legal phenomenon that reveals key weaknesses in present modalities of liberal justification. Drawing upon an array of recent critical theories, I show how a liberalism unable to face its own decline enables the very far-right assertions it purports to oppose. Thus, given liberalism’s failure to act as a neutral arbiter, an alternative approach for those opposing the far-right is to develop a vision of politics and society that confront believers in ‘white genocide’ on a more substantive level. This, I argue, forces the far-right’s opponents to disavow liberal scepticism towards utopian transformation as well as the juridical understandings and institutions that allow this scepticism to durably persist. A far-reaching account of what is meant by the human spirit, and its relevance to the worldwide efforts being made to meet the challenges that define this historical moment. Notions of identity, grounded in socially constructed conceptualizations of race, gender, class, and nationality continue to pose serious threats to our collective future. At the same time, everything that had once been associated with the human spirit is often understood today only in terms of neurobiology and cognitive science. Yet if the (...) twenty-first century is to be any different from the century just ended, the protection and development of the human spirit will have to emerge as an appropriate focus for judging the moral legitimacy of human acts, social policy, or cultural or religious practices. In a Bahá'í-inspired approach to these issues, the unique perspectives contained in the Bahá'í writings are explored alongside the rich diversity of other philosophical, epistemic, and moral traditions that have contributed to our understanding of the nature and needs of the human spirit over the ages. The reclamation of slurs raises a host of important questions. Some are linguistic: What are the linguistic conventions governing the slur post-reclamation and how are they related to the conventions governing it pre-reclamation? What mechanisms engender the shift? Others bend toward the social: Why do a slur’s targets have a special privilege in initiating its reclamation? Is there a systematic explanation why prohibitions on out-group use of reclaimed slurs vary from slur to slur? And how does (...) reclamation contribute to shaping social identities and reversing oppressive social norms and stigma? Most analyses of slur reclamation advance a single model to answer these questions. The author argues that there are different varieties of reclamation. Two predominate, what she calls pride reclamation and insular reclamation. While many features unite pride and insular reclamation, they differ with respect to the purpose of the reclamatory act, the linguistic mechanisms reclaimers employ to execute the linguistic change, and the social and grammatical roles of the reclaimed slur. By distinguishing these two types of reclamation and offering a fine-grained characterization of their properties, the author argues that we gain deeper insight into the reasons why slurs may in principle only be ignited by the target group and why pride- but not insular-reclaimed slurs become available for use by out-group members. Dispersal of biota by humans is a hallmark of civilization, but the results are often unforeseen and sometimes costly. Like kudzu vine in the American South, some examples become the stuff of regional folklore. In recent decades, "invasion biology," conservation-motivated scientists and their allies have focused largely on the most negative outcomes and often promoted the perception that introduced species are monsters. However, cases of monstering by scientists preceded the rise of popular environmentalism. The story of tamarisk (Tamarix spp.), flowering (...) trees and shrubs imported to New England sometime before 1818, provides an example of scientific "monstering" and shows how slaying the monster, rather than allaying its impacts, became a goal in itself. Tamarisks' drought and salt tolerance suggested usefulness for both coastal and inland erosion control, and politicians as well as academic and agency scientists promoted planting them in the southern Great Plains and Southwest. But when erosion control efforts in Arizona, New Mexico and Texas became entangled with water shortages, economic development during the Depression and copper mining for national defense during World War Two, federal hydrologists moved quickly to recast tamarisks as water-wasting foreign monsters. Demonstrating significant water salvage was difficult and became subsidiary to focusing on ways to eradicate the plants, and a federal interagency effort devoted specifically to the latter purpose was organized and continued until it, in turn, conflicted with regional environmental concerns in the late 1960s. L’interprétation d’un acte de violence de masse est toujours délicate puisqu’elle confère un certain statut au groupe visé. Ce statut peut devenir un facteur important dans la décision de la communauté internationale de reconnaître ou non l’indépendance d’un groupe et de son territoire. Cet article examine le cas de la reconnaissance du Kosovo par la communauté internationale, en février 2008, et soutient que cette reconnaissance a été rendue possible par l’utilisation d’arguments basés sur le statut collectif de victime de nettoyage (...) ethnique détenu par la population albanaise du Kosovo. L’article comble le fossé entre, d’un côté, la théorie de la sécession comme réparation, et de l’autre, les travaux sur la violence de masse contre les groupes ethnonationaux. L’analyse montre que la pratique de la reconnaissance étatique a été réorientée vers un critère restrictif lié au type de violence subie par le groupe réclamant l’indépendance. Dans cette optique, le territoire devient une forme tangible de compensation pour les injustices subies, ce qui tranche par rapport à la pratique antérieure de la reconnaissance étatique dans l’ex-Yougoslavie et ailleurs.The interpretation of an act of mass violence is always a contentious issue since it confers a certain status to the targeted group. This status may become an important factor in the international community’s decision to recognize or not the independence of a group and its territory. This article examines the case of Kosovo’s February 2008 recognition by the international community and argues that this recognition was made possible by the summoning of arguments based on Kosovo Albanians’ collective status as victims of ethnic cleansing. The article bridges the gap between on the one hand the Remedial Right theory of secession, and on the other hand, works on mass violence against ethnonational groups. The article shows that the practice of state recognition was reoriented towards a restrictive criterion linked to the type of violence sustained by the group claiming independence. Under this interpretation, territory becomes a tangible form of compensation for suffered injustices, which contrasts with earlier practice of state recognition in the former Yugoslavia and elsewhere. There is now an awakening to and recognition of the emotionally complex lives of some non-human animals. While their forms of consciousness may vary, some are indeed conscious and deserve political consideration. What that political consideration ought to be is the central topic of this article. First, I argue that interspecies justice must be understood in terms of the relationships that foster individual flourishing of all concerned. The obstacles to such flourishing are the five faces of oppression famously identified by (...) Iris Marion Young: exploitation, marginalization, powerlessness, cultural imperialism, and violence. By extending Young’s concept of the social group to intra- and interspecies groups, we become more attuned to differences between and among species. Theorizing the existence of interspecies groups brings forward new avenues to explore oppression and simultaneously theorize its opposite – interspecies justice. Second, I argue that a positive theory of interspecies flourishing can be developed on the basis of Marx’s materialist philosophy and reclamation of species-being. Though Marx uses humanist language throughout the Economic and Philosophic Manuscripts of 1844, attention to his methodological commitments reveals that some non-human animals can no longer be excluded from the capability of flourishing and species-being. Some non-human animals are conscious, act purposefully, and labor creatively and must be included in our circle of moral and political concern. (shrink)

Introduction Je souhaite défendre la pertinence de la phénoménologie dans le débat contemporain quant à la possibilité d?une clarification et d?une explication naturaliste de la conscience phénoménale. La première partie explique comment une théorie des actes mentaux intentionnels en termes d?acte conscient, de contenu représentationnel et d?objet intentionnel, qui est in­spirée par la phénoménologie husserlienne, conduit à concevoir la conscience phénoménale comme une propriété non intentionnelle et non représen­tationaliste d?événements mentaux. Cette conception soutient une distinction entre la qualité phénoménale de (...) la conscience et les qualia . Les qualia doivent être compris comme des propriétés phénoménales de l?objet perçu, et peuvent dans ce sens être expliqués comme éléments du contenu intentionnel ou représentationnel, en ligne avec le représentationalisme récent. La se­conde partie clarifie la conscience phénoménale, ou le caractère subjectif spécifique des processus mentaux conscients, comme une expérience de soi préréflexive ( self-awareness ). In Stieglerian fashion, this paper is concerned with both the loss and the re-creation of knowledge in the field of architecture. The student of architecture must be the one who learns new tools and new forms of knowledge and this has profound implications and applicability for the philosophy of education as it is a question of the recuperation of architecture with negentropic tools. Why? In the realm of the digital, it is the case that architectural student is at risk of (...) dis-individuation, the loss of knowledge of such. Therefore, the paper concerns itself with questions of maturity, critical intelligence, trans-individuation, the crisis of noetic being, the artisanal mode of learning and finally the proletarianization of the faculties. It is concerned with the reclamation of noetic space and the search for negentropic tools. This paper is thus pertinent to the philosophy of education because it pertains to the act of creation, the question of imagination and to the loss of thinking as such. Focusing on the history of architecture it demonstrates the loss of knowledge in the history of architecture and shows this has clear implications for the philosophy of education, which is precisely concerned with the nurturing and maturing of the thinking subject. The crisis in the proletarianization of the faculties in architecture pinpoints the role of the artisan’s mode of learning and its crisis brought by the digitisation of architecture. The conclusion shows that Stiegler’s philosophy of the pharmakon is appropriate to understand this movement as it points to new and embraces new modes of learning in the present. (shrink)

There has recently been a flurry of activity in the philosophy of language on how to best account for the unique features of epithets. One of these features is that epithets can be appropriated (that is, the offense-grounding potential of a term can be removed). We argue that attempts to appropriate an epithet fundamentally involve a violation of language-governing rules. We suggest that the other conditions that make something an attempt at appropriation are the same conditions that characterize acts of (...) civil disobedience. Accounting for attempts at appropriation is thus both a linguistic and socio-political endeavor. We demonstrate how these two facets of attempts at appropriation also help us understand the communicative features of civil disobedience. (shrink)

CAMOSY Cambridge: Cambridge University Press, 2012. 278 pp. $29.99Peter Singer’s “Copernican revolution” against a sanctity of life ethic may be regarded, from a Roman Catholic viewpoint, as an expression of the “culture of death” denounced by John Paul II. One must keep in mind, however, that “we know (...) that historically there have been times where those participating in discussions about ethics disagree deeply about theory, but nevertheless come to important and even broad agreement about applied or practical ethics” (179). The aim of Camosy’s book is to sketch the various areas of agreement and disagreement between Peter Singer and Catholic moral theology as well as the possibilities of working together.There are issues even about the subject of abortion on which Singer and the Church agree: that moral relativism is wrong; that it is seriously wrong to kill a person; that the right to privacy (see Roe vs. Wade) does not apply to acts harming others; and that the right to abortion is not a constitutional matter (chapter 1). Both positions see a connection between abortion and infanticide, but both draw different conclusions. The disagreements between them are about who is to count as a person, which Camosy comments on in the rest of chapter 1 (27–37). In the area of euthanasia, the Church and Singer share some skepticism about brain death (chapter 2). Camosy discusses the church’s position on one’s moral status at the end of life and the Roman Catholic understandings of ordinary and extraordinary means, acts, and omissions. Commenting on public policy in that field, Camosy gives some useful and convincing illustrations of the slippery slope effect in different countries that have legalized active euthanasia or assisted suicide (68–81).With regard to problems of killing, however, Helga Kuhse’s The Sanctity of Life Doctrine in Medicine (Oxford University Press, 1987) should perhaps have been considered. On the subject of acting and refraining, I would recommend Dieter Birnbacher’s Tun und unterlassen (Reclam 1995).Commenting on Singer’s championing of the moral status of nonhuman animals, Camosy points to elements in the Christian tradition that may support Singer’s issue of animal liberation (chapter 3). I wonder why the discussion concentrates on domestic animals and the problems of eating meat or [End Page 225] vegetarianism but omits problems of environmental ethics (e.g., ecological balance). Would the aim of avoiding animal harm include saving animals from predators? And if some animals are to be regarded as persons, we may get in trouble with our basic conviction of the equality (of the dignity) of human beings—as the debate on the margins of human life shows.Duties to the poor are not in dispute except for “partial preferences” (166) for members of our family, kinship, or country (chapter 4). Speaking of “partiality” in this context is, however, a bit misleading. Since no one can care for all people, preferences of an ordo caritatis (order of love) are a necessary part of a system of coordination from which—ideally—all humans can benefit. (Recall Augustine in De doctrina Christiana, 1.28–29: “The interests of society, however, and its common bonds will be best conserved if kindness be shown to each individual in proportion to the closeness of his relationship.”) Chapter 5, which compares Singer’s ethical theory with Catholic moral theology, would need more discussion (e.g., on double effect, object, and act), which I cannot cover within the limits of this review. Slurs possess interesting linguistic properties and so have recently attracted the attention of linguists and philosophers of language. For instance the racial slur "nigger" is explosively derogatory, enough so that just hearing it mentioned can leave one feeling as if they have been made complicit in a morally atrocious act.. Indeed, the very taboo nature of these words makes discussion of them typically prohibited or frowned upon. Although it is true that the utterance of slurs is illegitimate and derogatory in (...) most contexts, sufficient evidence suggests that slurs are not always or exclusively used to derogate. In fact, slurs are frequently picked up and appropriated by the very in-group members that the slur was originally intended to target. This might be done, for instance, as a means for like speakers to strengthen in-group solidarity. So an investigation into the meaning and use of slurs can give us crucial insight into how words can be used with such derogatory impact, and how they can be turned around and appropriated as vehicles of rapport in certain contexts among in-group speakers. In this essay I will argue that slurs are best characterized as being of a mixed descriptive/expressive type. Next, I will review the most influential accounts of slurs offered thus far, explain their shortcomings, then provide a new analysis of slurs and explain in what ways it is superior to others. Finally, I suggest that a family-resemblance conception of category membership can help us achieve a clearer understanding of the various ways in which slurs, for better or worse, are actually put to use in natural language discourse. Epistemologies have power. They have the power not only to transform worlds, but to create them. And the worlds that they create can be better or worse. For many people, the worlds they create are predictably and reliably deadly. Epistemologies can turn sacred land into ‘resources’ to be bought, sold, exploited, and exhausted. They can turn people into ‘labor’ in much the same way. They can not only disappear acts of violence but render them unnamable and unrecognizable within their conceptual (...) architectures. Settler systems of epistemic and conceptual resources and the relations among them are constructed to preclude certain forms of knowledge. This is not an accident; it is a central goal of colonial violence. Colonization and land dispossession would not be possible without the violent disruption of Indigenous knowledge systems and ongoing organized attempts to disrupt their survival. Violently disrupting the relationships of people to land is as much an epistemic project as it is a material one, and these two projects are inherently linked. The task of theorizing epistemic oppression is not only about epistemic oppression. Epistemic oppression is a story that gives language to a phenomenon in order to get past it, to carry on with the maintaining and reviving the forms of Indigenous and diasporic knowledge that colonialism has worked tirelessly to corrupt and silence. La communication politique peut être entendue comme action sémiologique collective qui se réalise dans le contexte de l’acte de gouverner une société et aussi bien comme acte d’exercice du pouvoir politique en ne faisant recours qu’aux signes. Actuellement la communication politique apparaît surtout sous la forme spécialisée du marketing politique et elle est centrée sur le but de gagner les élections. La “nouvelle” communication politique soulève quelques questions épineuses: (a) la carrière de l’homme politique dépend dans une trop grande mesure (...) de son équipe de consultants; (b) les médias exercent une influence déterminante sur la vie politique; (c) l’activité politique este devenue extrêmement coûteuse; (d) l’image politique est plus importante que l’homme politique réel; (e) les électeurs sont devenus versatiles et sujets à des goûts changeants; (f) presque tous les hommes politiques pratiquent la démagogie. Quelle que soit l’idéologie professé, les politiciens composent et transmettent des messages qui laissent voir une pensée partisane, collective, dissimulée, rationnelle et mise en service du pouvoir. Ces cinq traits dominants peuvent être reconnus aussi dans le cas des messages d’auto-présentation (nom, logo, statut et programme politique), que dans le cas des messages persuasifs (audience accordée à la population, discours prononcé aux réunions du parti, discours électoral, slogan, affiche politique, réclame politique, communiqué politique, interview, conférence de presse et débat télévisé). En faisant usage des messages politiques en tant qu’instruments pour gagner et gérer le pouvoir, les participants à la communication politique accomplissent, dans une mesure plus ou moins large, les actions suivantes: (a) la connaissance du contexte politique (qui contient les règles du jeu politique, les adversaires et les alliés actuels et potentiels, l’état de l’électorat ‒ surtout l’électorat-cible ‒ et les canaux de transmission virtuelle des propres messages politiques), (b) l’octroi d’une image politique convenable (qui réunisse au moins trois qualités majeures: la crédibilité, l’attractivité et la puissance), (c) la sélection des thèmes et des catégories de messages capables de les incarner), (d) la “modalisation” de la campagne de communication (“de notoriété” versus “persuasive”), (e) la transmission des messages politiques (visant le niveau le plus haut des standards d’adéquation et d’efficience) et (f) le monitorage des résultats de la communication politique. Dans la mesure où toutes ces actions sémiologiques sont accomplies à un niveau satisfaisant, la communication politique (qui les englobe) mène à une compétition au pouvoir bienfaisante pour la société toute entière. Une telle compétition ne divise pas la classe politique en vainqueurs et vaincus, mais en rivaux, chacun apportant sa pierre à la construction et la sauvegarde du bien commun. (shrink)

Historians of rhetoric refer to two Sophistics, one in the 5th century B.C. and another c. 2nd century A.D. Besides these two, there is a 3rd Sophistic, but it is not necessarily sequential. (The 3rd is “counter” to counting sequentially.) Whereas the representative Sophists of the 1st Sophistic is Protagoras, and the second, Aeschines, the representative sophists of the 3rd are Gorgias (as proto-Third) and Friedrich Nietzsche, Jean-François Lyotard, Michel Foucault, Jacques Lacan, and Paul de Man.To distinguish between and among (...) Socrates, Plato, and Aristotle, and then Protagoras, Gorgias, and Lacan, the author determines how far each of these personages can “count.” The model of counting, used semiotically across the topoi of “possible/impossible,” is that of the people of New Guinea: “one thing, two things, many things.” It is determined (generally) that the philosophers, including Aristotle, count to “one”; the Sophists to “two”; and Gorgias, Lacan, and Lyotard, et al. count to “many things,” thereby breaking up a monism or binarism. The ancient philosophers employ a substratum of probability to hold together the contraries of “possible/impossible”; the Sophists employ anti/logic, which keeps the contraries/antitheses separate and therefore without synthesis, but which eventually threatens the integrity of the substratum, or the law of non-contradiction; and Gorgias, Lacan, Lyotard et al. theorize about the “impossibility”/“Resistance” of the Logos (reason, logic, law, argumentation, history) to Theory/Totalization, because of the Gorgian Kairos and the Lacanian Real — both of which enter the Logos and break up the cycle of the antitheses and create “something new, irrational” (Untersteiner).This “breaking up” has a negative/positive influence on Protagoras's “man-measure doctrine,” which in turn has a similar influence on “the problem of the ethical subject.” The subject/agent not only no longer “knows” (by way of Logos) but also no longer “acts” (as independent agent); the subject becomes a function of Logos as determined by Kairos/Real; it moves from a hypotaxis/syntaxis of “one” and “two” to a radical parataxis/paralogy of “some more.”From the “Impossibility”/“tragedy” of knowledge, however, comes the “Possible,” or “Possibilisms,” which allows for the new (though divided) ethical subject to reclaim its position as “individual.” Such a reclamation of the subject, however, has a profound effect on argumentation, and especially the notion of “consensus.” What is wanted, then, in a Third Sophistic “ethical” — as opposed to a “political” — rhetoric is “dissensus” through radical parataxes and paralogies. The Caribbean is an undertheorized region within canonical political theory. This paper critically uncovers the West Indies as the inaugural site of modernity within the Americas. If it is European modernity that introduces into human existence fundamental markers of social identity, such as the historical nexus between race and class with devastating effects, then contemporary racial problems, including anti-black racism in the postcolonial world, can only be remedied by taking seriously the postcolonial Caribbean. In doing so, this paper argues that (...) while early modernity within the Caribbean inaugurated racialization in the Americas, its revolutionary movements throughout its vast histories of resistance do the work of decolonizing modernity as an act of hemispheric seizure by its poor, Black laboring class. The paper contends the transformative work of decolonizing Caribbean modernity begins by enacting universal emancipation from below through revolutionary movements during its mostly colonial era, and then shifts toward democratic revolution by struggling for self-determination in its postcolonial epoch. In the end, the recovery of Caribbean modernization amounts to a reclamation of the Caribbean subject, along with its vast political possibilities for democratic transformation. (shrink)

This work positions queer youth suicide as deviant aperture into scandal within divine life through an ‘indecenting’ of kenotic agency located in the Incarnation itself. Refuting a heteronormative gaze that defines queer youth suicide as an expression of pathology, I present a disruptive coming out of God who redeems through scandal by posing these suicides as deaths for others. Drawing from two liberation theologians, I offer a construct of martyrdom within historical contexts of an excess of death that is capable (...) of carrying the weight of their agency within a destructive heteronormative reality. Applying Althaus-Reid’s method of ‘indecenting’ within their last deviant act, both vitiated and vindicated in this kenotic agency of God, queer youth suicide becomes a preferred vehicle of divine delight and reclamation. Although disruptive, this divine eloquence spills out everywhere, cracking open a theological praxis where no one ever falls outside of God, especially in death. (shrink)

Non-human animals (henceforth, “animals”) are typically regarded as moral patients rather than moral agents. Let us define these terms as follows: 1) X is a moral patient if and only if X is a legitimate object of moral concern: that is, roughly, X is something whose interests should be taken into account when decisions are made concerning it or which otherwise impact on it. 2) X is a moral agent if and only if X can be morally evaluated–praised or blamed (...) (broadly understood)–for its motives and actions. Nothing in (1) and (2), of course, rules out one and the same individual being both a moral agent and a patient. Most humans are both. The notion of a moral agent is typically run together with that of a moral subject: 3) X is a moral subject if and only if X is, at least sometimes, motivated to act by moral considerations. However, (2) and (3) are not equivalent: the motivation for an action is one thing, the evaluation of the action quite another; indeed evaluation is often of motivation. As a matter of practice these are, for obvious reasons, run together. But motivation and evaluation are conceptually distinct. This is a claim that many will regard with surprise. In effect, the bulk of this paper can be regarded as an attempt to defend this claim as it applies to the case of animals. In this section, I merely offer some preliminary remarks in its defense. Suppose that my wife, worn down by the domestic squalor that goes with two young boys, a very large dog, and a slovenly husband, has me (unknowingly) hypnotized. Now, whenever she utters the word ‘Rosebud’, I experience an uncontrollable desire to mop the floor. This desire is, it seems, a motivational state, one that when combined with relevant cognitive states (the belief that this is a mop, the belief that this is a floor, and so on) will, ceteris paribus, result in a certain sort of behavior on my part. This floor-mopping, however, is not something for which I can be praised or blamed. Ex hypothesi, it is the result of a motivational state that is outside my control.. (shrink)

On the whole, the US Algorithmic Accountability Act of 2022 (US AAA) is a pragmatic approach to balancing the benefits and risks of automated decision systems. Yet there is still room for improvement. This commentary highlights how the US AAA can both inform and learn from the European Artificial Intelligence Act (EU AIA).

This paper attempts to explain what a protest is by using the resources of speech-act theory. First, we distinguish the object, redress, and means of a protest. This provided a way to think of atomic acts of protest as having dual communicative aspects, viz., a negative evaluation of the object and a connected prescription of redress. Second, we use Austin’s notion of a felicity condition to further characterize the dual communicative aspects of protest. This allows us to distinguish protest from (...) some other speech acts which also involve a negative evaluation of some object and a connected prescription of redress. Finally, we turn to Kukla and Lance’s idea of a normative functionalist analysis of speech acts to advance the view that protests are a complex speech act constituted by dual input normative statuses and dual output normative statuses. Kathryn Morgan has introduced us to a typology of ‘the ways in which women’s moral voice and her sense of moral integrity are twisted and destroyed by patriarchal ideology and lived experience.’ She claims that this experience can induce in women ‘a sense of confusion and genuine moral madness.’I am in agreement with much of what Morgan says. However, I suspect that some others might find her case less convincing than I for the reason that she supports her claims by (...) an appeal to classical philosophical literature and what we might loosely call ‘sociological observations.’ One can imagine the easy retort—‘Yes, well, it’s true that Aristotle, Aquinas, Rousseau and Kant did say those silly things about women, but their remarks were mere asides and no one takes them seriously in this matter any more anyway. Kant considers eudaimonism as his main opponent and he assumes that his ethics is the only viable alternative to eudaimonism. He does not explicitly address theories differing from both eudaimonism and from his own. I argue that whilst Kant and Act-Consequentialists advocate different normative principles, their positions share the important abstract feature that they establish what is to be done from a rational principle and not based on what is in the self-interest of the respective agent, as Kant thinks eudaimonism (...) does. Act-Consequentialism is thus closer to Kant’s ethics than is often assumed. I will demonstrate and vindicate this point with a new interpretation of the Fact of Reason. This reading also establishes that the notion of a Fact of Reason is less contentious than many of Kant’s critics believe. We should not expect that the Fact establishes Kantianism. Instead, the Fact is only supposed to count against a specific competing view of morality, namely, eudaimonism. Act-Consequentialists can accept the Fact as well. (shrink)

The theory that structured propositions are complex act-types has been independently articulated by Peter Hanks and Scott Soames. The present paper argues that the role of the act in such theories is supererogatory, for the individuation conditions of the act-based propositions remain wholly at the level of concepts and their formal combination, features which the traditional structured proposition theorist endorses. Thus, it is shown that the traditional problems for structured propositions are only ameliorable on the act conception by appeal to (...) the very resources of the traditional conception. It is also shown that the act theories have no act-based account of quantification and other operator-involving relations. An elementary account of propositions is sketched, after Fodor, which retains the virtues of the traditional structural conception without falling into ’Platonism’. (shrink)
