David Hollenbach’s introduction explains how the book brings together Christian (mostly Catholic) theologians, human rights activists, humanitarian practitioners, and legal scholars to help us focus on a class of persons referred to as “forced migrants” or “persons needing protection.” These individuals are neither classical “convention refugees” (according to international law definitions) nor are they simply “migrant workers” (in the classical sense) since their basic human rights to security and subsistence cannot [End Page 230] be adequately guaranteed in their home country or region. They do not emigrate merely in search of a higher standard of living; rather, forced migrants enter and settle in foreign lands seeking some sort of “protection” similar to that afforded to “conventional” refugees. More concretely, the book focuses on persons on the move—individuals fleeing violence and the extreme poverty rampant in regions devastated by ecological degradation and natural disasters.Extending the logic of the 1952 Refugee Convention and adapting it to the realities of today, one can argue convincingly that the international community has a duty to protect such persons when their states of origin are structurally unable or unwilling to afford protection (as argued in Susan Martin’s essay). However, paternalistic approaches that diminish rather than augment the agency of local governments and migrants are to be avoided (as maintained in M. Brinton Lykes’ essay). The book helps us reflect on what can be done to guarantee the basic rights of forced migrants not only at the level of international law and institutions but also through domestic and regional policymaking spurred and inspired by both Christian and secular global-humanitarian values. Such values are eminently compatible when applied to this particular issue (see Silvano Tomasi’s contribution). Agbonkhianmeghe Orobator’s essay—which offers insightful reflections (albeit rather general ones) from Christian ethics, ecclesiology, and biblical theology—likewise points to the need for a truly interdisciplinary approach to the issue. The other authors help the book achieve precisely this. Theological ethics finds its own distinctive place and voice in dialogue with a range of perspectives: legal and political sciences and case studies (Frank Brennan, Daniel Kanstroom); philosophical approaches (Arash Abizadeh); and sociological research on particular migrant populations (M. Brinton Lykes, Maryanne Loughry). The book includes essays that integrate case studies, technical reflections, useful summaries of theological principles and doctrines (J. Bryan Hehir, Mary M. DeLorey, and Tomasi), and philosophical stances (Abizadeh, Thomas G. Weiss), and present practical and legal proposals (see Martin’s essay). A stimulating read for scholars and for the general public, the volume provides good training material for faith-based activists and practitioners.The argumentation strategy in many of the essays in Driven from Home is to appeal to the reader’s sense of solidarity with the needy or suffering neighbor. It promotes the virtues of hospitable citizenship and hospitable disciple-ship while carefully trying to convince national and international policymakers to reinforce and expand the international protection regime. Emboldened by the 2005 “Responsibility to Protect” breakthrough at the United Nations, the authors seek to remain acceptable to a wide audience in an atmosphere of resurgent nationalism, nativism, and protectionism. The authors generally avoid harsh critiques of Westphalian models of sovereignty and do not dwell [End Page 231] on the Catholic doctrines of the universal destination of created goods and the (circumscribed) right to immigrate (and not only to emigrate). These two volumes provide a completely new translation of the philosophical works of Descartes, based on the best available Latin and French texts. They are intended to replace the only reasonably comprehensive selection of his works in English, by Haldane and Ross, first published in 1911. All the works included in that edition are translated here, together with a number of additional texts crucial for an understanding of Cartesian philosophy, including important material from Descartes? scientific writings. The result should meet (...) the widespread demand for an accurate and authoritative edition of Descartes? philosophical writings in clear and readable modern English. (shrink)

While National Human Rights Institutions are widely regarded as particularly promising tools in the emerging transnational regime for the regulation of business and human rights, we still know little about their potential and actual contribution to this field. This article bridges the gap between business and human rights research and NHRI scholarship, proceeding in three steps: Firstly, I analyze the structural conditions for NHRIs to tackle business-related human rights abuses effectively, focusing on the key conditions of legitimacy and competences. Secondly, (...) I examine the envisaged role and functions of NHRIs in business and human rights regulation according to the Paris Principles and the UN Guiding Principles. Thirdly, I reconstruct and critically assess NHRIs’ mandates and powers to address corporate human rights abuse, based on the analysis of surveys and reports. I argue that there is a significant mismatch between the essential structural conditions for effective NHRI engagement with business and human rights, the expected contribution of NHRIs to the prevention and remedy of corporate human rights abuses, and the limitations of their mandates and powers in practice. To overcome that misalignment and unlock NHRIs’ full potential, this article proposes a reform of the Paris Principles which would provide these institutions with a robust source of international legitimacy and increase the pressure on state governments to extend their powers. Degree-sentences, i.e. sentences that seem to refer to things that allow of degrees, are widely used both inside and outside of philosophy, even though the metaphysics of degrees is much of an untrodden field. This paper aims to fill this lacuna by addressing the following four questions: [A] Is there some one thing, such that it is degree sensitive? [B] Are there things x, y, and z that stand in a certain relation to each other, viz. the relation that x (...) has more y than z? [C] In those cases in which degree sentences do not refer to phenomena that are degree sensitive, what is responsible for their prima facie seeming to do so? [D] If there are degree sensitive things, to which ontological categories do they belong? We answer each of these questions by arguing that there are, metaphysically speaking, different phenomena that degree sentences refer to: some refer to determinates that emanate from a certain determinable, others to tokens that are instantiations of a certain type, and yet others to what we call ‘complex, resultant properties that are constituted by stereotypical properties’. Finally, we show the relevance of our answers by applying them to the notions of freedom and belief. (shrink)

J’ai adressé de vives critiques à la pédagogie, en me démarquant de celle-ci, pour lui opposer une notion plus neutre « d’éducation ». En bref : s’il est hors de doute que l’enfance doive être éduquée, il n’est pas nécessaire ni universalisable qu’elle doive être soumise à une pédagogie, à un « dispositif pédagogique ». Je donnais une définition précise et restrictive de la pédagogie : une éducation sous la conduite d’un adulte conduisant l’enfant . Il faut remarquer, d’ailleurs, que (...) ce mot, dans son usage classique et contemporain n’a plus le même sens que dans l’antiquité grecque. De la notion de pédagogie, je retenais la notion de surveillance ; associée, ensuite, à celle de fonctions spécifiquement éducatives, et de méthodes propres à entraîner l’élève à apprendre de bon gré, à le « capturer » ou à le « capter », à le séduire. Mais, dans l’un et l’autre cas, c’est le même genre de dispositif. Seulement, inversé. Il faut concevoir – c’est ce que dit Deleuze à propos de Foucault—les dispositifs comme des lignes, des vecteurs qui vont susciter et mettre en place, à chaque fois, selon chaque problème, des institutions particulières. Ces lignes ne tracent pas de contours bien définis; elles ne cernent ni n’encerclent, mais elles parcourent, traversent et rassemblent ce qui était autrement organisé ou subsistait à l’état dispersé. Elles font ainsi apparaître une nouvelle configuration. Parmi les contemporains, il me paraît que Pasolini est le seul à avoir vu et exprimé ce qu’est le véritable processus de pédagogisation de l’enfance, qui est, en même temps, processus de subjectivation et indication d’une éventuelle possibilité de retournement de pouvoir; ou, autrement dit, d’une révolution pédagogique permettant à l’ enfant de conquérir cette autonomie qui, sans cesse, lui est promise et toujours refusée. This article argues that Matthew Lipman’s Philosophy for Children Program is based on a liberal conception of the relationship between education and society--a conception from which the idealist and non-critical character of his pedagogy derives. In order to demonstrate this, a short characterization of this conception is initially presented, emphasizing the equalizing and “redeeming” social mission that it entrusts to the schools. Afterwards, it briefly describes some of the main aspects of Lipman’s program, then explains the way in which it (...) incorporates the liberal doctrine of the “redeeming” school. Finally, it discusses some of the political and ideological implications that follow from this incorporation. It is important to clarify that the reflection here presented does not refer to any of the actual practices of philosophy with children, but to Lipman’s own position, which is developed in two of his most important works, Philosophy Goes to School and Thinking in Education. This article is a discussion of Hume's maxim Nothing we imagine is absolutely impossible. First I explain this maxim and distinguish it from the principle Whatever cannot be imagined (conceived), is impossible. Next I argue that Thomas Reid's criticism of the maxim fails and that the arguments by Tamar Szábo Gendler and John Hawthorne for the claim that “it is uncontroversial that there are cases where we are misled” by the maxim are unconvincing. Finally I state the limited but real (...) value of the maxim: it does help us, in certain cases, reliably to make up our minds. Along the way I show that Reid, his criticism of the maxim notwithstanding, actually employs it, and I furthermore argue that the principle What is inconceivable, is impossible is spurious. (shrink)
