This article is concerned with one of the notable but forgotten research strands that developed out of French nineteenth-century positivism, a strand that turned attention to the study of scientific discovery and was actively pursued by French epistemologists around the turn of the nineteenth century. I first sketch the context in which this research program emerged. I show that the program was a natural offshoot of French neopositivism; the latter was a current of twentieth-century thought that, even if implicitly, challenged (...) the positivism of first-generation positivists such as Comte. I then survey what French epistemologists—including Ernest Naville, Élie Rabier, Pierre Duhem, Édouard Le Roy, Abel Rey, André Lalande, Théodule-Armand Ribot, Edmond Goblot, and Jacques Picard, among others—had to say about the logic, psychology, and sociology of discovery. My story demonstrates the inaccuracy of existing historical accounts of the philosophical study of scientific discovery. (shrink)

We analyzed the patients’ perception of prenatal diagnosis of fetal cardiac pathology, and the reasons for choosing to continue with pregnancy despite being eligible to receive a medical termination of pregnancy. We also identified the challenges, the motives interfering in decision-making, and the consequences of the decisions on pregnancy, child and mother. This descriptive, prospective and longitudinal study was conducted in France, amongst pregnant women who wished to continue their pregnancy despite an unfavorable medical advice. Socio-demographic data were collected through (...) a questionnaire. Such questionnaire covered information assessing the parents/mother’s perception of prenatal diagnosis, and medical termination of pregnancy, their interpretation of the established diagnosis and their motives for not considering pregnancy termination. 72 eligible patients were analyzed over one year: mean age 33 ± 6.89 years, 47 patients had already given birth to ≥1 healthy child. Mean gestational age at the detection of fetal cardiac pathologies was 30 ± 4.37 weeks of amenorrhea. Patients decided to keep the child after 3 ± 1.25 consultations. 56 patients made their decision with their husbands and 16 made their decision alone. Reasons for declining the medical termination were culpability and responsibility, ideologies and convictions, mistrust and hope. Newborns of 67 patients died with a mean survival duration of 38 days. Patient informed consent should be sought before any decision in neonatology, even if conflicting with the medical team’s knowledge and the pregnant mother’s benefits. Decisions to accept or decline pregnancy termination depend on the patients’ psychological character, ideologies, convictions, and mistrust in the diagnosis/prognosis, or hope in the fetus survival. Eli Alshanetsky considers how we make our thoughts clear to ourselves in the process of putting them into words and examines the paradox of those difficult cases where we do not already know what we are struggling to articulate.

The central question in this book is why it seems reasonable for the words of our language to divide up the world in ordinary ways rather than other imaginable ways. Hirsch calls this the division problem. His book aims to bring this problem into sharp focus, to distinguish it from various related problems, and to consider the best prospects for solving it. In exploring various possible responses to the division problem, Hirsch examines series of "division principles" which purport to express (...) rational constraints on how our words ought to classify and individuate. The ensuing discussion deals with a wide range of metaphysical and epistemological topics, including projectibility and similarity, alternative analyses of natural properties and things, the inscrutability of reference, and the relevance of such pragmatic notions as salience and economy. The final chapters of the book develop what Hirsch contends is the most promising response to the division problem: a theory in which constraints on classification and individuation are seen to derive from the necessary structure of "fine-grained" propositions and the necessary dependence of some concepts on others. According to strong emergentism, it is a brute fact that higher-level properties (e.g., consciousness, values, etc.) emerge given certain complex structures. In this paper, I will argue that since it is allegedly a brute fact that emergent properties emerge in certain complex systems, they should emerge in anything. Since they do not emerge in anything, they also do not emerge only in certain complex systems. I will apply this argument to consciousness as the primary target, to refute certain views within (...) the philosophy of mind, according to which consciousness is an emergent property that arises only in certain complex aggregates, i.e., brains. In this paper I want to argue that a unified set of concerns constituting a new dimension—a realignment of our sense of language, self, and world—emerges in the progress of the Tractatus as we turn to inquire into the inner connection between language and such notions as world, limits, life, and ipseity. The most elusive step in that progress, and the one most necessary to recognize as part of the argument of the Tractatus, is the transition from an understanding of (...) language in terms of logic, sense, and meaning to a perspective in which language becomes the primary locus of significance or meaningfulness. It is also the pivot from the logical to the ethical concerns of the book. An ethics that appeals to the notion of meaningfulness is elaborated in terms of the dimension of existence, namely in terms of the very possibility of agreement of disagreement with what has ultimate reality. It is widely assumed that if ontological disputes turn out to be verbal they ought to be dismissed. I dissociate the semantic question concerning the verbalness of ontological disputes from the pragmatic question on whether they ought to be dismissed. I argue that in the context of ontological disputes ontologists ought to be taken to communicate views with conflicting ontological commitments even if it turns out that on the correct view of semantics they fail to literally-express their disagreement. I argue, (...) that is, against dismissing ontological disputes on grounds of verbalness. This serves to discharge the ongoing debate on the verbalness of ontological disputes from the metaontological consequences typically associated with it. (shrink)

The study presented in this article is based on field observations over one year on a critical care unit in Norway. Data were analysed according to Glaser’s grounded theory and generated a theory of hidden and emerging drama in the context of ambiguity while the nurses routinized the handling of complex technology. To the untrained eye the unit presented a picture of calm competence, while under the surface one finds hidden drama full of difficult interacting clinical and ethical problems. The (...) nurses identified six ethical dilemmas: (1) end of life issues; (2) whether there should be an age limit for coronary surgery; (3) distributing limited resources; (4) resource allocation in terms of better staffing; (5) situations in which is it more harmful than beneficial to continue treatment; and (6) transferring patients to other facilities. The six problems overlap and have clinical as well as ethical components, but it was the ethical dimensions that the nurses identified and discussed. The significance for nursing is the importance of well-educated and well-qualified nurses and how they find viable solutions to complex ethical and clinical problems. (shrink)

Can politics be thought?, asks Alain Badiou in the title of a recent book. The question itself reveals an experienced lack: that of politics. A lack which the so-called “return of the subject,” far from resolving, would stigmatize. The “return of the subject,” as he asserts, is merely the counterface of the break of politics, its reduction to an “ethics of tolerance” from which all its properly political traces have previously been erased. If politics cannot be associated with the “return (...) of the subject,” this is because politics does not relate to any subject but rather to the very impossibility of conceiving of it. Thus, the attempt to reactivate politics becomes inextricably linked to the endeavor of rethinking, or better said, unthinking the subject. As this article shows, this project articulates a specially dynamic current of thought in the last years, which we may call, generically, “poststructuralist Marxist.” That project not only gave a new impulse to Marxist thinking, articulating a space of reflection which delimitates this current from that one with which it borders—deconstructionism—and from which it can interpellate the entire philosophical tradition. Ultimately, it comes to condense an issue whose relevance far exceeds the ambit of Marxist thinking: how politics is possible in a post-metaphysical and post-subjective context. Being and Event, by Alain Badiou, is, no doubt, the most systematical attempt to answer that question. It allows us to observe the main contributions of these current to contemporary philosophical thinkings, revealing, at the same time, the kind of aporias that that issue poses to it. (shrink)

Einstein Versus Bohr is unlike other books on science written by experts for non-experts, because it presents the history of science in terms of problems, conflicts, contradictions, and arguments. Science normally "keeps a tidy workshop." Professor Sachs breaks with convention by taking us into the theoretical workshop, giving us a problem-oriented account of modern physics, an account that concentrates on underlying concepts and debate. The book contains mathematical explanations, but it is so-designed that the whole argument can be followed with (...) the math omitted. Professor Sachs' story begins with classical and nineteenth century physics, describes the early discoveries in particle theory, and introduces the "old" quantum theory, which evolved into the quantum mechanics of the Copenhagen School. Such important ideas as the Einstein Photon Box experiment and the Einstein-Podolsky-Rosen Paradox, and Schrodinger's Cat Paradox are clearly expounded, followed by a completely fresh explanation of relativity in conceptual terms, showing how apparent paradoxes can be removed by Einstein's own interpretation, especially that of his later years. Professor Sachs gives a detailed comparison of the fundamentals of the quantum and relativity theories, suggesting how the contradictions might be resolved. In an epilogue, he makes suggestions, with reference to religious notions, Taoism, and Buber's theory of I-Thou, for generalizing Einstein's approach beyond physics. (shrink)

This article concerns the ways in which authors from various fields conceptualise the ethical issues arising in the conduct of research. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) we (...) critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

What determines the degree to which some event harms a subject? According to the counterfactual comparative account, an event is harmful for a subject to the extent that she would have been overall better off if it had not occurred. Unlike the causation based account, this view nicely accounts for deprivational harms, including the harm of death, and for cases in which events constitute a harm rather than causing it. However, I argue, it ultimately fails, since not every intrinsically bad (...) state that is counterfactually dependent on an event contributes to its degree of harm. So while the causation based account is too restrictive, the counterfactual comparative view is not restrictive enough. In light of this, I suggest an alternative, explanation based account of overall harm, according to which the degree to which some event is harmful for a subject is determined by the degree to which (crudely) the states explained by it are overall more intrinsically bad than intrinsically good for her. Foucault's governmentality lectures at the Collège de France analyze the history of the state through the lens of governmental reason. However, these lectures largely omit consideration of the relationship between discipline and the state, prioritizing instead raison d'État and liberalism as dominant state technologies. To remedy this omission, I turn to Foucault's early studies of discipline and argue that they provide materials for the reconstruction of a genealogy of the "disciplinary state." In reconstructing this genealogy, I demonstrate that the disciplinary (...) state marks the "dark side" of the liberal state, a dark side which is, moreover, largely obscured in the governmentality lectures. I further construe the difference between this early genealogy of the state and the later governmental studies in methodological terms. At stake in this difference is the historiographic status of capitalism and social conflict. Foucault's governmentality lectures employ what I term an "idealist disavowal," thereby treating capitalism and social conflict as irrelevant to the history of the state. The early disciplinary studies, on the other hand, enact a "materialist avowal," by which these objects are avowed as central to the explanation of how and why the state develops. Finally, I argue that Foucault's governmental genealogy of the liberal state is explanatorily and analytically incomplete, while the genealogy of the disciplinary state contributes to its completion on both fronts. English summary: The Spitzer Manuscript is one of the oldest Sanskrit manuscripts found on the Silk Road. The work preserved in it is unique; no further manuscripts of it have been discovered so far, nor is it transmitted in Tibetan or Chinese translations. The present volume contains an introduction which summarizes previous research and discusses grammatical, lexical and palaeographical aspects of the work, together with an outline of its content. It is followed by a complete facsimile edition of the fragments (...) accompanied by transliterations. These are supplemented by transcriptions of some fragments which are no longer available, recovered from the estate of the Indologist Dr. Moritz Spitzer. A concordance juxtaposes the earlier and present-day arrangements of the fragments, and an extensive character table documents the peculiarities of the Ku'a'a-Brahma script used in the manuscript. A complete word index and a study which aims at reconstructing the last part of the manuscript conclude the volume. As well as Buddhist scholastics the work also deals with a number of non-Buddhist topics, such as a theory of Vaise'ika qualities completely unknown from other sources it contains, inter alia, the oldest list of books of the Mahabharata and an enumeration of the sixty-four arts and sciences. The last part of the work is devoted to dialectics. German description: Das Spitzer-Manuskript ist eine der altesten Sanskrithandschriften, die an der Seidenstrasse gefunden wurde. Das in ihm erhaltene Werk ist ein Unikum; bis jetzt wurden keine weiteren Manuskripte dieses Werkes entdeckt und es ist auch nicht in tibetischer oder chinesischer Ubersetzung uberliefert. In the first section of this paper I present the measurement-theoretic fallacy of 'over-assignment of structure': the unwarranted assumption that every numeric relation holding among two (or more) numbers represents some empirical, physical relation among the objects to which these numbers are assigned as measures (e.g., of temperature). In the second section I argue that a generalized form of this fallacy arises in various philosophical contexts, in the form of a misguided, over-extended application of one conceptual domain to another. Three (...) examples are given: (i) the reduction of arithmetic into set theory, (ii) the ascription of full-blown intentional states to (at least some) non-overtly intentional creatures, such as Wittgenstein's builders, and (iii) the analysis of some modal notions as involving quantification over possible worlds (or their substitutes). The discussion of the third example gives rise to a novel account of possible-worlds talk. (shrink)

In this essay, I defend philosophical wandering not only as an approach to doing philosophy, but also as an important force to incite critical reflection in cultural life. I argue that philosophical wanderers have an embodied, errant praxis, supporting wisdom whenever they engage with others. For these philosophers reflection is not given in a series of systematic assertions, nor through phenomenological description, nor analytic dissection. Rather, reflective life is the force that enhances the performative element of philosophy as an exercise (...) in being obnoxious to bring people within a culture to particular kinds of critical awareness and action. I conclude by suggesting that this mode of philosophy has a correlate mode of truth, “incited reflectivism,” different from coherentism, foundationalism, warranted assertibility, and other theories that have been previously defended as the standard for “truth.”. The causal compatibility question asks whether a given causal structure graph — possibly involving latent variables — constitutes a genuinely plausible causal explanation for a given probability distribution over the graph’s observed categorical variables. Algorithms predicated on merely necessary constraints for causal compatibility typically suffer from false negatives, i.e. they admit incompatible distributions as apparently compatible with the given graph. In 10.1515/jci-2017-0020, one of us introduced the inflation technique for formulating useful relaxations of the causal compatibility problem in terms of (...) linear programming. In this work, we develop a formal hierarchy of such causal compatibility relaxations. We prove that inflation is asymptotically tight, i.e., that the hierarchy converges to a zero-error test for causal compatibility. In this sense, the inflation technique fulfills a longstanding desideratum in the field of causal inference. We quantify the rate of convergence by showing that any distribution which passes the nth-order inflation test must be On−1/2$\begin{array}{} \displaystyle {O}{\left(n^{{{-}{1}}/{2}}\right)} \end{array}$-close in Euclidean norm to some distribution genuinely compatible with the given causal structure. Furthermore, we show that for many causal structures, the (unrelaxed) causal compatibility problem is faithfully formulated already by either the first or second order inflation test. (shrink)

While a number of jurisdictions internationally prohibit insuring companies to be able to use genetic information in their risk classification, a voluntary code of practice permits insurers the limited use of predictive genetic test results in the UK. Jonathan Pugh1 offers a pluralist justice-based argument in support of the UK practice. Pugh’s position is developed to avoid what he sees as flaws with the current debate on insurers’ access to genetic information, including an alleged reliance on idealised assumptions about the (...) predictive power of genetic test results, revisionary implications for the provision of insurance suggested in the debate and failings of commentators to engage adequately with a conception of justice that undergirds the status quo approach in the UK. Pugh suggests that a quasi-libertarian approach to justice is implicit within the terms of the present Code and should be phrased as a principle of equity. Further, he argues that basic egalitarian and non-comparative concerns should be captured in broad principles: equal access and need. In the first two sections I present and motivate a formal semantics program that is modeled after the application of numbers in measurement (e.g., of length). Then, in the main part of the paper, I use the suggested framework to give an account of the semantics of necessity and possibility: (i) I show thatthe measurement theoretic framework is consistent with a robust (non-Quinean) view of modal logic, (ii) I give an account of the semantics of the modal notions within this (...) framework, and (iii) I defend the suggested account against various objections.
