Badiou’s contemporary claim that truth processes can no longer be considered as indifferent to sexual difference is set here in the context of the French philosophical moment of the second half of the twentieth century—a sequence in which the deployment of the category of “the feminine” by Badiou’s philosophical peers precisely entailed a formalization of women’s different relation to “the symbolic.” When compared, in particular, with the philosophy of sexual difference elaborated by Luce Irigaray, Badiou’s intertwining of “woman,” love, and (...) the universal—both before and after his inflexion on the sexuation of truths—is confronted with the systematic counterproposition of alternative conceptual constellations. Might it not, then, be possible that the comparison of Badiou and Irigaray ultimately brings into play something of the order of a demonstration of thought’s sexuation? (shrink)

Cinema is, for Jacques Derrida, at once the “medium,” the “apparatus,” and the “experience” that proffers a historically unprecedented instantiation of the logic of spectrality. Of cinema, Derrida would almost exclusively have spoken, his remarks dispersed in a smattering of (nonetheless significant) interviews or, indeed, films, as though the written word was to withdraw into a rare resistance when it came to matters cinemato‐graphic. As Derrida's reference to two types of writing machine, indicates contemporary “teletechnologies” consisting of machines like the (...) cinema, the camera, TV, and photography, but also the internet, digital imaging, and so on. Derrida's reflections on the photographic image are of particular interest in the present context inasmuch as they persistently come up against the “objections” addressed to deconstruction, as it were, by Roland Barthes's highly influential Camera Lucida. The importance that Deleuze attributes to syntax, as that which tends towards the movement of the concept, along with his analyses of the different ways in which English and French relate to « becoming », form the basis on which this article investigates the question of whether a « theory of translation » can be found in Deleuze’s thought. In this perspective, we examine the intersection between several key concepts in Deleuze’s philosophy and theories of translation dealing with the comparative (...) syntax of English and French. Analysis of the concepts of actualisation, virtual and actual, as used by both Deleuze and comparative syntax theorists, indicates that the internal temporality Deleuze attributes to language would play a critical role in translation. Dynamic Consent is both a model and a specific web-based tool that enables clear, granular communication and recording of participant consent choices over time. The DC model enables individuals to know and to decide how personal research information is being used and provides a way in which to exercise legal rights provided in privacy and data protection law. The DC tool is flexible and responsive, enabling legal and ethical requirements in research data sharing to be met and for online health (...) information to be maintained. DC has been used in rare diseases and genomics, to enable people to control and express their preferences regarding their own data. However, DC has never been explored in relationship to historical collections of bioscientific and genetic heritage or to contexts involving Aboriginal and Torres Strait Islander people.In response to the growing interest by First Peoples throughout Australia in genetic and genomic research, and the increasing number of invitations from researchers to participate in community health and wellbeing projects, this article examines the legal and ethical attributes and challenges of DC in these contexts. It also explores opportunities for including First Peoples' cultural perspectives, governance, and leadership as a method for defining DC on cultural terms that engage best practice research and data analysis as well as respect for meaningful and longitudinal individual and family participation. Some theorists who accept the existence of global justice duties to alleviate the condition of distant needy strangers hold that these duties are significantly constrained by special ties to fellow countrymen. The patriotic priority thesis holds that morality requires the members of each nation-state to give priority to helping needy fellow compatriots over more needy distant strangers. Three arguments for constraint and patriotic priority are examined in this essay: an argument from fair play, one from coercion, another from coercion and (...) autonomy. Under scrutiny, none of these arguments qualifies as successful. (shrink)

Abstract: I argue that for psychological and social reasons, the traditional “Conflict Model” of science and religion interactions has such a strong hold on the nonexpert imagination that counterexamples and claims that interactions are simply more complex than the model allows are inadequate to undermine its power. Taxonomies, such as those of Ian Barbour and John Haught, which characterize conflict as only one among several possible relationships, help. But these taxonomies, by themselves, fail to offer an account of why different (...) relationships prevail among different communities and how they succeed one another within particular communities—that is, they contain no dynamic elements. To undermine the power of the “Conflict Model,” we should be seeking to offer alternative models for science and religion interactions that can both incorporate the range of stances articulated by scholars like Barbour and which can offer an account of the process by which differing attitudes succeed one another. As a step toward this goal, I propose a general “interacting subcultures model” and illustrate its applicability in a small number of mini-case studies from Early Modern Britain and France and with glances toward contemporary America. If we make the basic assumption that the components of a proposition have reference on the model of proper name and bearer, we face the problem of distinguishing the proposition from a mere list' of names. We neutralize the problem posed by that assumption of we first of all follow Wiggins and distinguish, in every predicate, a strictly predicative element (the copula), and a strictly non-predicative conceptual component (available to be quantified over). If we further allow the copula itself to (...) conform to the basic assumption, a regress ( Bradley's regress') arises: the referent of the copula will be instantiation, the instantiation of instantiation etc. To avert the regress, Wiggins simply legislates that the basic assumption is to fail for the copula. But we are entitled to regard the regress as constitution not a difficulty, but the solution: the infinitism it imports (capturable in a finitistic theory of meaning) is just what the unity of the proposition "is". Does it make sense to hold that, if it is bad that some people are worse off than others, it is worse if those who are worse off come to be so through sheer bad luck that it is beyond their power to control? In her contribution to this symposium, Susan Hurley cautions against a closely related fallacy: from the fact that people have come to an unequal condition through unchosen bad luck, it does not follow that, if we aim (...) to undo the influence of unchosen luck, we ought to institute equality of condition. Forswearing the fallacy that Hurley analyses is compatible with answering the question affirmatively, and more generally with holding that principles of distributive justice should be sensitive to the distinction between chosen and unchosen bad luck. Its origins in pragmatist philosophy are traced, and it is compared with the law and economics movement in American law and the formalist style of Continental legal theory. The essay argues that the inevitability of legal pragmatism in America, and its dispensability in Europe, reflect fundamental institutional and cultural differences rather than mere accidents of history or legal thought.

"One might say that where Religion becomes artificial, it is reserved for Art to save the spirit of religion." With these words Richard Wagner began "Religion and Art" (1880), one of his most passionate essays. That passion made Wagner himself a central icon in the growing cult of art. Wagner felt that he lived in an age of spiritual crisis. "It can but rouse our apprehension, to see the progress of the art-of-war departing from the springs of moral force, (...) and turning more and more to the mechanical," he wrote. In response to the frightening progress of dynamite and steel, Wagner adopted the role of the Tone Poet Seer, who reveals the inexpressible in concert halls and cleanses souls in waves of symhonic revelation. "Religion and Art" is the pivot of the works collected here. Also included are his defining essays "Public and Popularity" and "The Public in Time and Space"; his papers relating to the creation of the Bayreuth School; his complaint against publishers, "On Poetry and Composition" (1879); his article on the first production of Parsifal (1882); and other works that speak his mind about strengthening the spirit through music. These works participated in the duel between Wagner and Nietzsche that ensued after the breakup of their friendship in 1878. Nietzsche publicly called Wagner an incurable romantic, emphasizing how sick he thought both Wagner and his art were. Here Wagner counterattacks with arch innuendo and sarcasm. This edition includes the complete volume 6 of the 1897 translation of Wagner's works commissioned by the London Wagner Society. William Ashton Ellis is one of the most important translators of nineteenth-century musicology. In addition to his monumental translation of Wagner's prose works, he translated Wagner's correspondence with Franz Lizst, Mathilde Wesendonck, and Wagner's own family. Ellis died in 1919. (shrink)

Adorno unquestionably loved opera music as much as he hated opera as a cultural institution. His take on opera in the twentieth century led him to write its socio‐political obituary, while recognizing at the same time that opera continued to attract a steady stream of would‐be onlooker‐auditors. Paradoxically for Adorno, opera continued to appeal to audiences, and – from his dialectical reckoning – characteristically for precisely the wrong reasons. His opera analyses address the sociology of musical theater, performance hermeneutics, and (...) the direct consideration of music itself (though given his typical writing mode this writing is perhaps best characterized as criticism rather than analysis, as the latter term is commonly employed within musicology). Adorno's interests principally revolve around modern opera (Schoenberg, Berg, Strauss, Weill, especially) but also, if to a lesser extent, canonic works from Mozart to Verdi. Wagner, Wagnerian music drama, and cultural Wagnerism more generally were special cases for Adorno, and subjects he returned to repeatedly throughout his adult life, coinciding with the rise and fall of National Socialism and the Wagner cult, which in the 1930s and 1940s war years comfortably accommodated fascist proclivities. Adorno recognized the socio‐cultural agency of opera as a still‐prestigious cultural leftover of nineteenth‐century bourgeois triumphalism, which he vigorously opposed. In its place, he labored to promote what he regarded as a more socially responsible musico‐operatic practice to supplant the aesthetic and social complacency of the established order, ideas that after his death have found considerable currency, nowhere more evident than in late‐modern opera productions throughout the world. This chapter argues that Hobbes believed that we have to assent inwardly as well as outwardly to the determinations of the sovereign, unless—surprisingly—we adhere to the Jewish or Christian religions. In those cases, we have made a civil covenant with God which in some respects trumps the covenant we have made to erect our normal commonwealth. The significance of this, the author claims, is that it brings out clearly the fact that our civil sovereign is internally authoritative because otherwise there (...) would have been no need for Hobbes to argue that God’s internal authority over the Jew or Christian itself rests on a civil covenant. ABSTRACTCommercial lawyers often signal that ‘client first’ is an essential element of their professional DNA, and some scholarly proponents have laid claim to a moral justification for zeal. That moral justification is found, in particular, in the notion of lawyers as friends. One critique of zeal is that this moral claim is bogus: that ‘client first’ is a convenient trope for disguised self-interest. This paper explores the empirical validity of this ‘client first’ ideal through a value-based analysis of zeal in (...) lawyering. Our data suggest plausible differences in ethical decision-making related to those values. The data are consistent with more zealous lawyers having stronger self-interested rather than client-interested motivations. More zealous lawyers are also less constrained by valuing conformity to rules. If our results are valid, they suggest that the claim that zeal is motivated by placing a high value on the interests of the client is false. (shrink)
