In 1805 Susannah Middleton travelled with her husband, Captain Robert Middleton, to Gibraltar where he was to run the naval dockyard. Abroad for the first time, Susannah maintained a regular correspondence with her sister in England. Casting light on a collection of letters yet to be fully published, the paper gives an account of Susannah‘s experiences as described to her sister. Consideration is given to Susannah‘s position as the wife of a naval officer and her own view of the role (...) she had to play in her husband‘s success. Written at a time when an officers wife could greatly improve his hopes for advancement through the judicious use of social skills, the Middleton letters provide evidence of an often overlooked aspect of the workings of the Royal Navy. In this essay, I examine Robert Boyle's strategies for making imperceptible entities accessible to the senses. It is well known that, in his natural philosophy, Boyle confronted the challenge of making imperceptible particles of matter into objects of sensory experience. It has never been noted, however, that Boyle confronted a strikingly similar challenge in his natural theology – he needed to make an equally imperceptible God accessible to the senses. Taking this symmetrical difficulty as my starting point, I propose a (...) new approach to thinking about the interconnections between Boyle's natural philosophy and natural theology. For the most part, studies of science and religion in the early modern period work by seeking out the influence of explicitly stated religious beliefs on scientific ideas. I argue, by contrast, that we need to focus on Boyle's representational practices, using his attempts to represent imperceptible entities as a means of uncovering metaphysical and theological presuppositions that he did not always articulate when stating his religious beliefs. With new interpretations of bothA Discourse of Things Above Reason(1681) andSome Physico-Theological Considerations about the Possibility of the Resurrection(1675), I show that there were crucial similarities between Boyle's practices for representing both God and atoms. I go on to show, moreover, that Boyle used these practices to enact an ontological stance at odds with one of his most important professed beliefs. (shrink)

By far the largest part of Nehemiah Grew?s account of a seventeenth?century collection of rarities, his Musæum Regalis Societatis (1685) is taken up with ?thick?, verbal descriptions of things in the Royal Society?s repository. Not only, Grew suggests, do his descriptions serve to signify the contents of his collection, but they enable us to discern among species and to think about the collection?s pieces in new ways. Verbal descriptions did not just signify things in the Royal Society?s collection, but had (...) the capacity to alter their meanings. The essay discusses the ?picturing? of natural things in Early Modern Europe with little direct reference to the contemporary media of graphic representation ? drawings, engravings, paintings etc. ? in order to highlight the role of the then most widely used, but now least discussed of these media, verbal descriptions. This thought-provoking monograph provides a systematic, philosophically-grounded reconceptualisation of press freedom and press regulation. In a major departure from orthodox norms, the book argues that press freedom and coercive independent press regulation are not mutually exclusive; that newspapers could be made to compensate their victims, through regulation, without jeopardising their free speech rights; that their perceived public watchdog status does not exempt them; and, ultimately, that mandatory press regulation is not unconstitutional. In doing so, the book questions our most deeply-held, (...) intuitive beliefs about the press and its role in society. Why do we say the printed press has a duty to act as a public watchdog when there is no legally enforceable apparatus by which to ensure it does? Why does government constantly recommend that the press regulate itself when history shows this model always fails? Why do victims of press malfeasance continue to suffer needlessly? By deconstructing the accepted view of press freedom and mandatory regulation, this book shows that both are deeply misunderstood. The prevailing notion that the press must serve the public is an empty relic of Victorian ideology that is both philosophically incoherent and legally unjustifiable. ACAS reports increasing disciplinary action against employees over expression that employers dislike. Given the prominence of social media in contemporary life, this is a significant current legal issue yet one which has attracted relatively little academic comment. This article examines the compatibility of unfair dismissal doctrine in this context with traditional liberal principle. Arguably, doctrine provides only flimsy protection. Although the common law recognises the importance of individual autonomy generally when determining rights claims, this well-established liberal value appears to have (...) little influence on unfair dismissal doctrine. The dominant academic view on realising greater workplace human rights protection through greater application of the proportionality principle is unlikely to address this problem; reconceptualisation of the substantive free speech right at stake is required. This article offers a strategy on how this might be achieved--and so how differences between practice and principle might be reconciled--through a sympathetic reading of the Strasbourg and UK jurisprudence and potential policy-maker intervention. This essay reconsiders the links between medicine, connoisseurship, and aesthetic theory in early eighteenth-century Britain. Taking a satire on the body of the physician and collector John Woodward as its starting point, I show that medicine and connoisseurship shared a deep preoccupation with the possibility that the animal body could excessively influence the workings of the mind. Pursuing this line of argument, moreover, I will reconsider the place of mind–body dualism in eighteenth-century British medicine and aesthetics. With the exception of (...) materialists such as the philosopher-physician Bernard Mandeville, medics and aesthetic theorists tended to identify the exercise of judgment with the operations of a disembodied mind, unsullied by the embodied mechanisms of the lower body. In practice, however, the insistence that the most refined forms of judgment depended on the presence and activity of a disembodied, immaterial soul was less meaningful than it seems. When confronted by failures of judgment, medics and connoisseurs alike sought explanations in the mechanisms of the animal body. Whether or not they believed in the immateriality of the soul, they pictured the mind as a malfunctioning animal machine, to be cured through the material agency of medical therapeutics. (shrink)

According to the House of Lords decision in Campbell v MGN Ltd, a misuse of private information claim may succeed even though public interest expression is at stake. The post-Campbell jurisprudence, however, does not reflect this central tenet. Cases are not determined by balancing the weight of each claim but by a binary approach in which claims succeed or fail depending on whether public interest expression is present or not. By charting this development, this article argues that a greater sense (...) of proportionality would be achieved if cases were decided not by the quality of expression but by the harm caused by it. By re-imagining Campbell as a four-part test, it will show how the current paternalistic and idiosyncratic influences on decision-making may be reduced significantly. (shrink)

This article presents the novel view that ‘inclusion into seclusion’ and ‘public disclosure of embarrassing facts’ (‘misuse of private information’ (“MOPI”) in the UK), which both the academic commentary and US case law treat as two separate legal actions, occupy the same conceptual space. This claim has important practical ramifications. No further development of the law is required to realise an actionable intrusion tort as part of the UK’s MOPI tort. The argument is defended in doctrinal and theoretical terms, and (...) by reference to both UK and US law. It is presented in three forms: first, in negative terms, that the orthodox distinction between the two claims (informational privacy and intrusion) is unsustainable; secondly, in positive terms, that both guard against the same wrong (unwarranted privacy-invasion) and the same harm (mental distress), in a way that is distinctive from other privacy actions and legal claims based upon the autonomy value; finally, in pragmatic terms, that MOPI’s mature jurisprudence is sufficiently flexible and dynamic to recognise intrusion-only claims using its existing legal framework. When making decisions, people naturally face uncertainty about the potential consequences of their actions due in part to limits in their capacity to represent, evaluate or deliberate. Nonetheless, they aim to make the best decisions possible. This book argues that a plausible account of emergence requires replacing the traditional assumption that what primarily exists are particular entities with generic processes. Traversing contemporary physics and issues of identity over time, it then proceeds to develop a metaphysical taxonomy of emergent entities and of the character of human life.

Some theorists who accept the existence of global justice duties to alleviate the condition of distant needy strangers hold that these duties are significantly constrained by special ties to fellow countrymen. The patriotic priority thesis holds that morality requires the members of each nation-state to give priority to helping needy fellow compatriots over more needy distant strangers. Three arguments for constraint and patriotic priority are examined in this essay: an argument from fair play, one from coercion, another from coercion and (...) autonomy. Under scrutiny, none of these arguments qualifies as successful. (shrink)

Abstract: I argue that for psychological and social reasons, the traditional “Conflict Model” of science and religion interactions has such a strong hold on the nonexpert imagination that counterexamples and claims that interactions are simply more complex than the model allows are inadequate to undermine its power. Taxonomies, such as those of Ian Barbour and John Haught, which characterize conflict as only one among several possible relationships, help. But these taxonomies, by themselves, fail to offer an account of why different (...) relationships prevail among different communities and how they succeed one another within particular communities—that is, they contain no dynamic elements. To undermine the power of the “Conflict Model,” we should be seeking to offer alternative models for science and religion interactions that can both incorporate the range of stances articulated by scholars like Barbour and which can offer an account of the process by which differing attitudes succeed one another. As a step toward this goal, I propose a general “interacting subcultures model” and illustrate its applicability in a small number of mini-case studies from Early Modern Britain and France and with glances toward contemporary America. If we make the basic assumption that the components of a proposition have reference on the model of proper name and bearer, we face the problem of distinguishing the proposition from a mere list' of names. We neutralize the problem posed by that assumption of we first of all follow Wiggins and distinguish, in every predicate, a strictly predicative element (the copula), and a strictly non-predicative conceptual component (available to be quantified over). If we further allow the copula itself to (...) conform to the basic assumption, a regress ( Bradley's regress') arises: the referent of the copula will be instantiation, the instantiation of instantiation etc. To avert the regress, Wiggins simply legislates that the basic assumption is to fail for the copula. But we are entitled to regard the regress as constitution not a difficulty, but the solution: the infinitism it imports (capturable in a finitistic theory of meaning) is just what the unity of the proposition "is". There are many reasons we might want to take the opinions of various individuals and pool them to give the opinions of the group they constitute. If all the individuals in the group have probabilistic opinions about the same propositions, there is a host of pooling functions we might deploy, such as linear or geometric pooling. However, there are also cases where different members of the group assign probabilities to different sets of propositions, which might overlap a lot, a little, (...) or not at all. There are far fewer proposals for how to proceed in these cases, and those there are have undesirable features. I begin by considering four proposals and arguing that they don't work. Then I'll describe my own proposal, which is intended to cover the situation in which we want to pool the individual opinions in order to ascribe an opinion to the group considered as an agent in its own right. This essay describes modern American legal pragmatism. Its origins in pragmatist philosophy are traced, and it is compared with the law and economics movement in American law and the formalist style of Continental legal theory. The essay argues that the inevitability of legal pragmatism in America, and its dispensability in Europe, reflect fundamental institutional and cultural differences rather than mere accidents of history or legal thought.

"One might say that where Religion becomes artificial, it is reserved for Art to save the spirit of religion." With these words Richard Wagner began "Religion and Art" (1880), one of his most passionate essays. That passion made Wagner himself a central icon in the growing cult of art. Wagner felt that he lived in an age of spiritual crisis. "It can but rouse our apprehension, to see the progress of the art-of-war departing from the springs of moral force, (...) and turning more and more to the mechanical," he wrote. In response to the frightening progress of dynamite and steel, Wagner adopted the role of the Tone Poet Seer, who reveals the inexpressible in concert halls and cleanses souls in waves of symhonic revelation. "Religion and Art" is the pivot of the works collected here. Also included are his defining essays "Public and Popularity" and "The Public in Time and Space"; his papers relating to the creation of the Bayreuth School; his complaint against publishers, "On Poetry and Composition" (1879); his article on the first production of Parsifal (1882); and other works that speak his mind about strengthening the spirit through music. These works participated in the duel between Wagner and Nietzsche that ensued after the breakup of their friendship in 1878. Nietzsche publicly called Wagner an incurable romantic, emphasizing how sick he thought both Wagner and his art were. Here Wagner counterattacks with arch innuendo and sarcasm. This edition includes the complete volume 6 of the 1897 translation of Wagner's works commissioned by the London Wagner Society. William Ashton Ellis is one of the most important translators of nineteenth-century musicology. In addition to his monumental translation of Wagner's prose works, he translated Wagner's correspondence with Franz Lizst, Mathilde Wesendonck, and Wagner's own family. Ellis died in 1919. (shrink)

Progress may be made in resolving the tension between free will and determinism by analysis of the necessary conditions of freedom. It is of the essence that these conditions include causal and deterministic regularities. Furthermore, the human expression of free will is informed by understanding some of those regularities, and increments in that understanding have served to enhance freedom. When the possible character of a deterministic system based on physical theory is considered, it is judged that, far from implying the (...) elimination of human freedom, such a theory might simply set parameters for it; indeed knowledge of that system could again prove to be in some respects liberating. On the other hand, it is of the essence that the overarching biological framework is not a deterministic system and it foregrounds the behavioural flexibility of humans in being able to choose within a range of options and react to chance occurrences. Furthermore, an issue for determinism flows from the way in which randomness (e.g. using a true random number generator) and chance events could and do enter human life. Once the implications of that issue are fully understood, other elements fit comfortably together in our understanding of freely undertaken action: the contribution of reasons and causes; the fact that reasons are never sufficient to account for outcomes; the rationale for the attribution of praise and blame. Adorno unquestionably loved opera music as much as he hated opera as a cultural institution. His take on opera in the twentieth century led him to write its socio‐political obituary, while recognizing at the same time that opera continued to attract a steady stream of would‐be onlooker‐auditors. Paradoxically for Adorno, opera continued to appeal to audiences, and – from his dialectical reckoning – characteristically for precisely the wrong reasons. His opera analyses address the sociology of musical theater, performance hermeneutics, and (...) the direct consideration of music itself (though given his typical writing mode this writing is perhaps best characterized as criticism rather than analysis, as the latter term is commonly employed within musicology). Adorno's interests principally revolve around modern opera (Schoenberg, Berg, Strauss, Weill, especially) but also, if to a lesser extent, canonic works from Mozart to Verdi. Wagner, Wagnerian music drama, and cultural Wagnerism more generally were special cases for Adorno, and subjects he returned to repeatedly throughout his adult life, coinciding with the rise and fall of National Socialism and the Wagner cult, which in the 1930s and 1940s war years comfortably accommodated fascist proclivities. Adorno recognized the socio‐cultural agency of opera as a still‐prestigious cultural leftover of nineteenth‐century bourgeois triumphalism, which he vigorously opposed. In its place, he labored to promote what he regarded as a more socially responsible musico‐operatic practice to supplant the aesthetic and social complacency of the established order, ideas that after his death have found considerable currency, nowhere more evident than in late‐modern opera productions throughout the world. In this paper we compare Kierkegaard’s and Marx’s views on social reform. Then we argue that Kierkegaard’s own reasoning is consistent with the expression of neighbor-love through collective action, i.e. social reform. However, Kierkegaard’s approach to social reform would be vastly different than Marx’s. We end by reviewing several questions that Kierkegaardian social reformers would ask themselves. Our hope is that this exploration will provide helpful insights into how those who genuinely love their neighbors ought to seek the common good (...) through collective action. (shrink)

A brief reflection on the mind-body problem and its implications for the way we conceive of ourselves and live our lives.

This book grew out of my confusion. If logic is objective how can there be so many logics? Is there one right logic, or many right ones? Is there some underlying unity that connects them? What is the significance of the mathematical theorems about logic which I've learned if they have no connection to our everyday reasoning? The answers I propose revolve around the perception that what one pays attention to in reasoning determines which logic is appropriate. The act of (...) abstracting from our reasoning in our usual language is the stepping stone from reasoned argument to logic. We cannot take this step alone, for we reason together: logic is reasoning which has some objective value. For you to understand my answers, or perhaps better, conjectures, I have retraced my steps: from the concrete to the abstract, from examples, to general theory, to further confirming examples, to reflections on the significance of the work. I discuss groove as grounded in structure and performance, and relate musical performance to play in nonhuman animals and humans. The interplay of individuals' contributions with group action is proposed as the common link between music and play as contributors to social bonding.
