Summary This paper investigates the extent of overseas migration by British chemists over the period 1887–1971. Notwithstanding the ‘brain drain’ alarms of the 1960s, overseas employment was characteristic of some 19% of British chemists’ careers throughout our period, though its nature changed considerably. Our study examines the overseas employment histories of four cohorts of members of the [Royal] Institute of Chemistry in the ‘Chemists’ Database’ at the Open University. Those employed abroad were not only highly qualified but also both geographically (...) mobile and occupationally versatile. Over the period, the pattern of chemists’ migration was broadly similar to that of British migration trends more generally. Except in the interwar years, chemists’ rate of migration was relatively constant. However, the length of time they spent abroad declined markedly over the period: long-term migration became less characteristic than short-term overseas employment for purposes of career development. From the late nineteenth century, British chemists staffed the Empire, but also found employment in the expanding US economy. After 1945, chemists’ destinations shifted more markedly towards North America, including Canada, and later also to Europe. Our work thus provides a new perspective on the dynamics of scientists’ migration and contributes to studies on the brain drain. (shrink)

Humanity and water represent an intersection of two natural cycles: the human economy and the earth's hydrological system. Although water is vital for human survival and growth, the point where human endeavor intersects is the most variable and uncertain in the hydrological system. Significant spatial and temporal variation of evaporation and rainfall has led to a number of responses aimed at increasing certainty of access to water. However, many of the world's civilizations can attest that the very act of reducing (...) water uncertainty by technical means (capture, storage, and irrigation) has ultimately led to greater uncertainty and civilization failure. This article explores the concept of living with water as a complex entity, inseparably connected with all three levels of existential complexity - individual, social, and ecological - rather than as a commodity, which has led to our current uncertain status. This paper argues that libertarian political philosophers, including Robert Nozick, have erred in neglecting the problem of political obligation and that they ought to embrace an actual consent theory of political obligation and state legitimacy. It argues as well that if they followed this recommendation, their position on the subject would be correct. I identify the tension in libertarian (and especially Nozick's) thought between its minimalist and its consensualist strains and argue that, on libertarianism's own terms, the consensualist strain (...) ought to prevail. I then describe the form of the consent theory that I recommend to libertarians. The paper concludes with an extended defense of this form of consent theory against contemporary liberal-egalitarian criticisms of it (both explicit and implicit), including those of Dworkin, Rawls, and their followers. My aim in this essay is to explore the nature and force of “original-acquisition” justifications of private property. By “original-acquisition” justifications, I mean those arguments which purport to establish or importantly contribute to the moral defense of private property by: offering a moral/historical account of how legitimate private property rights for persons first arose ; offering a hypothetical or conjectural account of how justified private property could arise from a propertyless condition; or simply defending an account of how an individual (...) can make private property in some previously unowned thing . The “original acquisition” to which such justifications centrally refer, then, may be either the first instance of legitimate private property in human history , or only the first legitimate acquisition of some particular thing . But in either case, the justification will involve or entail the defense of one or more moral principles specifying how unowned things can become privately owned — that is, the defense of the kind of principles Robert Nozick has called “principles of justice in acquisition.”. On July 2, 2001, a medical milestone was reached when Robert Tools received a total artificial heart implant at Jewish Hospital in Louisville, Kentucky. Tools was implanted with an AbioCor artificial heart, one of several brands of new-generation artificial hearts that has been approved by the U.S. Food and Drug Administration for clinical trial. The AbioCor heart was developed by Abiomed of Danvers, Massachusetts.Following the surgery, physicians were guardedly enthusiastic about the device and optimistic about the patient’s future. Tools, (...) 59, has had a history of numerous heart attacks and by-pass surgery, as well as diabetes and kidney problems. He met the requirements of the AbioCor protocol because he was not a candidate for transplant, death was otherwise probable within thirty days, and other interventions were deemed ineffective. Researchers hope that strengthening his heart function will result in increased function of his other vital organs, thus prolonging the patient's life and increasing his energy. But because the device is experimental, nothing can be promised. (shrink)

The article of Finlay et al. is an excellent example of identifying constraints in the development of the brain, and their implications on brain architecture in evolution. Here we further illustrate the importance of constraints by presenting a few examples of how a small number of biophysical mechanisms or even a single life history parameter can have an enormous impact on brain evolution.

The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. Stakeholder theory has become a central issue in the literature on business ethics / business and society. There are, however, a number of problems with stakeholder theory as currently understood. Among these are: 1) the lack of a coherent justificatory framework, 2) the problem of adjudicating between stakeholders, and 3) the problem of stakeholder identification. In this essay, I propose that a possible source of obligations to stakeholders is the principle of fairness (or fair play) as discussed in the political (...) philosophic literature of Rawls, Simmons, and Cullity among others. The principle of fairness states that, “Whenever persons or groups of persons voluntarily accept the benefits of a mutually beneficial scheme of co-operation requiring sacrifice or contribution on the parts of the participants and there exists the possibility of free-riding, there exist obligations of fairness on the part of these persons or groups to co-operate in proportion to the benefits accepted.” In this essay I discuss the gaps in the current stakeholder literature, elucidate and defend a principle of fairness that fills the gap, compare the fairness model to other similar models of business ethics, and draw some conclusions for the future of stakeholder theory. Among the most popular strategies for justifying political obligations are those that appeal to the principle of fairness. These theories face the challenge, canonically articulated by Robert Nozick, of explaining how it is that persons are obligated to schemes when they receive goods that they do not ask for but cannot reject. John Simmons offers one defense of the principle of fairness, arguing that people could be bound by obligations of fairness if they voluntarily accept goods produced by (...) a cooperative scheme. Simmons, however, thinks that such a theory will do little work in justifying political obligations, since virtually no one voluntarily accepts state goods. This paper attempts to advance just such a theory by arguing that states are in fact genuine cooperative schemes and that Simmons is overly pessimistic in his appraisal of whether the majority of citizens accept the goods provided by their states. Government action has advantages, which explains the central role of states in political theory. However, taking states for granted limits the ability to critique the status quo and consider alternatives. The rejection of domination by anarchists and their vision of a society free of domination can be a productive starting point for critical reflection on statehood. Drawing on works by the philosophical anarchists Robert Paul Wolff and A. John Simmons, as well as Joseph Raz, this study presents a (...) compelling anarchist challenge to the state. This demonstrates that state action can only be legitimised if it enables us to lead a self-determined and emancipated life. (shrink)

John Locke's political theory has been the subject of many detailed treatments by philosophers and political scientists. But The Lockean Theory of Rights is the first systematic, full-length study of Locke's theory of rights and of its potential for making genuine contributions to contemporary debates about rights and their place in political philosophy. Given that the rights of persons are the central moral concept at work in Locke's and Lockean political philosophy, such a study is long overdue.

Ontological pluralism is the view that there are different fundamental ways of being. Trenton Merricks has recently raised three objections to combining pluralism with a generic way of being enjoyed by absolutely everything there is: first, that the resulting view contradicts the pluralist’s core intuition; second, that it is especially vulnerable to the charge—due to Peter van Inwagen—that it posits a difference in being where there is simply a difference in kind; and, third, that it is in tension with various (...) historically influential motivations for pluralism. I reply to each of these objections in turn. My replies will help to bring out the true nature of the pluralist’s basic commitments. (shrink)

This has lent a sense of urgency to recent disagreements about whether a state’s legitimacy depends upon its ‘subjects” having a duty to obey the law. This book aims to provide a solution to the semantic paradoxes. It argues for a unified solution to the paradoxes generated by our concepts of denotation, predicate extension, and truth. The solution makes two main claims. The first is that our semantic expressions 'denotes', 'extension' and 'true' are context-sensitive. The second, inspired by a brief, tantalizing remark of Godel's, is that these expressions are significant everywhere except for certain singularities, in analogy with division by zero. A formal theory of singularities (...) is presented and applied to a wide variety of versions of the definability paradoxes, Russell's paradox, and the Liar paradox. Keith Simmons argues that the singularity theory satisfies the following desiderata: it recognizes that the proper setting of the semantic paradoxes is natural language, not regimented formal languages; it minimizes any revision to our semantic concepts; it respects as far as possible Tarski's intuition that natural languages are universal; it responds adequately to the threat of revenge paradoxes; and it preserves classical logic and semantics. Simmons draws out the consequences of the singularity theory for deflationary views of our semantic concepts, and concludes that if we accept the singularity theory, we must reject deflationism. The distinction between qualitative and non-qualitative properties should be familiar from discussions of the principle of the identity of indiscernibles: two otherwise exactly similar individuals, Castor and Pollux, might share all their qualitative properties yet differ with respect to their non-qualitative properties—for while Castor has the property being identical to Castor, Pollux does not. But while this distinction is familiar, there has not been much critical attention devoted to spelling out its precise nature. I argue that the class of non-qualitative (...) properties is broader than it is often taken to be. When properly construed, it will not only include properties such as being identical to Castor, which somehow make reference to particular individuals, it will also include more general properties such as identity, composition, set membership, as well as various peculiarly ontological properties. Given that some of these more general properties help to explain objective similarity, we have reason to believe that there are fundamental non-qualitative properties. (shrink)

‘Rights and Territories: A Reply to Nine, Miller, and Stilz’ defends the Lockean theory of states’ territorial rights (as this theory was presented in Boundaries of Authority) against the critiques of Nine, Miller, and Stilz. In response to Nine’s concern that such a Lockean theory cannot justify the right of legitimate states to exclude aliens, it is argued that a consent-based theory like the Lockean one is flexible enough to justify a wide range of possible incidents of territorial rights – (...) importantly including, though not necessarily including, the sort of right to exclude aliens that is familiar from actual political practice. Miller’s criticisms are more wide-ranging. In response, the article argues that Lockean labor-based property rights are both stronger and more enduring than Miller suggests and that nationalism’s resources for dealing with concerns about rights-supersession and trapped minorities are importantly overstated by Miller. Against Stilz’s Kantian, ‘presentist’ account of states’ authority over persons and territories, it is argued that the rectification of past (historical) wrongs remains morally crucial even in the context of otherwise-just societies and that Stilz’s Kantian/rawlsian position unconvincingly privileges the rights to autonomy of territorially concentrated groups over those of dissenting individuals or wrongfully dispersed groups. This book is about one of the most baffling of all paradoxes – the famous Liar paradox. Suppose we say: 'We are lying now'. Then if we are lying, we are telling the truth; and if we are telling the truth we are lying. This paradox is more than an intriguing puzzle, since it involves the concept of truth. Thus any coherent theory of truth must deal with the Liar. Keith Simmons discusses the solutions proposed by medieval philosophers and (...) offers his own solutions and in the process assesses other attempts to solve the paradox. Unlike such attempts, Simmons' 'singularity' solution does not abandon classical semantics and does not appeal to the kind of hierarchical view found in Barwise's and Etchemendy's The Liar. Moreover, Simmons' solution resolves the vexing problem of semantic universality – the problem of whether there are semantic concepts beyond the expressive reach of a natural language such as English. It has been nearly seventy years since the creation of the Universal Declaration of Human Rights, and some of the oldest and most active human rights organizations have been operating around the world for about forty years. More than twenty years have passed since the end of the cold war, and the time when people spoke in triumphal terms of the global success of Western values is now (...) a fading memory. International human rights are ensconced as firmly as ever in international law and institutions, but what about the future of the “human rights movement”? (shrink)

In this essay I will discuss the relationship between two of the most basic ideas in political and legal philosophy: the justification of the state and state legitimacy. I plainly cannot aspire here to a complete account of these matters; but I hope to be able to say enough to motivate a way of thinking about the relation between these notions that is, I believe, superior to the approach which seems to be dominant in contemporary political philosophy. Today showing that (...) a state is justified and showing that it is legitimate are typically taken to require the very same arguments. I will argue that this contemporary stance obscures the difference between two central ways in which we should morally evaluate states, and it generates confusions about other serious practical issues, such as those surrounding our moral obligations to comply with law. I begin with brief discussions of the ideas of justification and legitimacy and with an attempt to capture what ought to be most central in our concerns about these ideas. I turn then to two basic ways of thinking about the relation between justification and legitimacy that I want to distinguish: what I will call the Lockean and the Kantian approaches. Next, I argue that the minority Lockean approach to this issue captures essential features of institutional evaluation that the majority Kantian approach does not; and I add brief mention of one further complication facing any adequate account of political evaluation. Optimism and pessimism are two diametrically opposed views about the value of existence. Optimists maintain that existence is better than non-existence, while pessimists hold that it is worse. Arthur Schopenhauer put forward a variety of arguments against optimism and for pessimism. I will offer a synoptic reading of these arguments, which aims to show that while Schopenhauer’s case against optimism primarily focuses on the value or disvalue of life’s contents, his case for pessimism focuses on the ways in which life (...) as a whole is structurally defective. Modern states claim rights of jurisdiction and control over particular geographical areas and their associated natural resources. Boundaries of Authority explores the possible moral bases for such territorial claims by states, in the process arguing that many of these territorial claims in fact lack any moral justification. The book maintains throughout that the requirement of states' justified authority over persons has normative priority over, and as a result severely restricts, the kinds of territorial rights that states can justifiably claim, and (...) it argues that the mere effective administration of justice within a geographical area is insufficient to ground moral authority over residents of that area. The book argues that only a theory of territorial rights that takes seriously the morality of the actual history of states' acquisitions of power over land and the land's residents can adequately explain the nature and extent of states' moral rights over particular territories. Part I of the book examines the interconnections between states' claimed rights of authority over particular sets of subject persons and states' claimed authority to control particular territories.
