Television pictures of starvation and depredation are not the only way that famine and political instability in the horn of Africa have affected the United States. Many people from that region of the world are seeking political or economic refuge here, and they are exposing us to a culture that is in some ways — most notably, in the practice of female circumcision – so radically different from the prevailing American cultures that we have been stunned. They are also forcing (...) hospital ethics committees to face issues that cannot be resolved by the facile application of the settled principles that have guided those institutions for the past several years. Autonomy and multiculturalism, long the foundations of most ethics committee decision making, have started to give way to a list of formally articulated rights and wrongs – perhaps to a restatement and adoption of rules said to be based in natural law. Female circumcision, argues one newspaper letter writer, “is just a sickening display of male power disguised as legitimate dogma. (shrink)

The American public has increasingly identified health care as a key issue of concern. In order to address the multiple problems relating to the access and affordability of health care, President Obama and federal lawmakers across the political spectrum continue to call for major health reform. In any debate on health reform, a predictable set of complex policy, management, economic, and legal issues is likely to be raised. Due to the diverse interests involved, these issues could lead to a series (...) of high-stakes policy debates. Therefore, it is critical that advocates of reform strategies anticipate such issues in order to decrease the likelihood that legally resolvable questions become barriers to substantive health reform. In an effort to frame and study legal challenges and solutions in advance of the heat of political debate, the O’Neill Institute for National and Global Health Law at Georgetown University and the Robert Wood Johnson Foundation have crafted the “Legal Solutions in Health Reform” project. The Institute of Medicine's report, the American Medical Association's project, the Open Society Institute's and the initiative sponsored by the Robert Wood Johnson Foundation have focused attention on improving the care of dying patients. These efforts include advance care planning and the use of written advance directives. Although previous studies have provided quantitative descriptions of patient preferences for life-sustaining treatment, including those documented in written ADs, to our knowledge open-ended written preferences have not been studied. Studies (...) of these open-ended preferences could highlight issues with respect to quality end-of-life care. The purpose of this study was to explore the open-ended proxy, health, and personal care preferences of people with HIV as expressed in a written AD form. (shrink)

This paper is one of four interrelated papers resulting from the National Summit on Legal Preparedness for Obesity Prevention and Control convened in June 2008 by the Centers for Disease Control and Prevention, the Robert Wood Johnson Foundation, and the American Society of Law, Medicine, Ethics. Each of the papers deals with one of the four core elements of legal preparedness: laws and legal authorities for public health practitioners; legal competencies public health practitioners and legal and (...) policy decision makers need for use of these laws and authorities; crossdisciplinary and cross-jurisdiction coordination of law-based public health actions; and information on public health law best practices. Collectively, they are referenced as the “white papers.”Our purpose is to offer action options that will help to improve the legal competencies of public health practitioners and policy decision makers with respect to drafting, interpreting. No one who attended the 2010 national public health law conference hosted by the Public Health Law Association and the American Society of Law, Medicine & Ethics could miss the sense of excitement and momentum. The revival of this annual public health law meeting, with the support of the Robert Wood Johnson Foundation, the energetic leadership of the PHLA president and board, ASLME’s expert guidance, and a rousing address by Dr. Tom Frieden, Director of the Centers (...) for Disease Control and Prevention, symbolize the continued commitment of a wide range of important individuals and institutions to the proposition that law is of substantial importance to public health. But there is more than just symbolism to be excited about. CDC’s public health law program continues to champion efforts to promote the use and understanding of law as a public health tool. (shrink)

Georgia State University College of Law, through the Center for Law, Health & Society, developed a pair of online libraries for faculty teaching public health law in schools of law or public health. Development of these libraries was funded by a grant from the Robert Wood Johnson Foundation as part of The Future of Public Health Law Education: Faculty Fellowship Program. Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas (...) and strategies toward building a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. Kantian ethics can at times appear to defend the position that there is a unique sort of value that plays a foundational role in morality. For instance, Kant's most well known work in ethics, the Groundwork of the Metaphysic of Morals, begins by trying to establish that a good will is good without qualification' and then ends with a first statement of the fundamental principle that divides right from wrong, the Categorical Imperative.1 This presentation can make it seems as if (...) Kant believes the authority carried by the Categorical Imperative is somehow supposed to be grounded in the value of a good will. Again, the humanity formulation of the Categorical Imperative, the formulation that tell us we must respect the humanity in ourselves and others by treating it as an end in itself, appears to allude to a special value possessed by some feature of persons, their humanity, and then explain the authority of moral obligation by way of that value.2 This extolling of the value of humanity and the dramatic refrain about the unique value of a good will both appear to portray Kant as telling us to notice the peculiar value that they possess and see that this value demands that we adjust our deliberation and actions. I consider the direct product algebra formed from two isomorphic Clifford algebras. More specifically, for an element x in each of the two component algebras I consider elements in the direct product space with the form x ⊗ x. I show how this construction can be used to model the algebraic structure of particular vector spaces with metric, to describe the relationship between wavefunction and observable in examples from quantum mechanics, and to express the relationship between the electromagnetic field tensor (...) and the stress-energy tensor in electromagnetism. This study investigates the connection of moral reasoning to demographic and performance variables in business education, especially business and technical writing. The moral reasoning construct serves as the foundation for one''s decision making when confronted with moral dilemmas. Significant relationships are reported between subjects'' writing skill and their moral reasoning scores. This research serves as a foundation for questions about writers'' moral reasoning and the ethical decisions each writer makes in written communication. In addition, this study supports further (...) research into the connection between moral reasoning and written communication, given the significant relationships reported and the noticeable shortage of related, data-based research. So Michael Slote argues. There is and can be no obligation to foster one's own wellbeing for Kantians, only an obligation to foster the wellbeing of others. And any distinctively Kantian position both denies that our own wellbeing is the source of our moral duties and denies that a concern for wellbeing can be a morally worthy motive. So not only is the agent's own good not foundational to morality; it is of no moral importance. Hence, Slote concludes, the devaluation (...) of the moral agent. (shrink)

The Turning Point Initiative is an initiative for which the Robert Wood Johnson and W.K. Kellogg foundations partnered in order to fund a group of states and a number of communities within each of those states to work through a planning process to look at ways to strengthen their public health systems at the state and local levels. Out of that process, the states and communities would come together at the national level to talk about what they (...) had been learning and what the issues were. There is a growing recognition of Levinas's importance. It can in part be attributed to an increasing concern that twentieth-century continental philosophy seems to have no place for ethics. In making ethics fundamental to philosophy, rather than a problem to which we might one day return, Levinas transforms continental thought. The book brings together some of the most interesting and far-reaching responses to the work of Levinas, in three different areas: contemporary feminism, psychotherapy, and Levinas's relation to other philosophers. Completed shortly before her death in 2019, _Tragedy and Philosophy. A Parallel History_ is the sum of Agnes Heller’s reflections on European history and culture, seen through the prism of Europe’s two unique literary creations: tragedy and philosophy.

Social contract theory offers a powerful method and metaphor for the study of organizational ethics. This paper considers the variant of the social contract that has arguably gained the most attention among business ethicists: integrative social contracts theory or ISCT [Donaldson and Dunfee: 1999, Ties That Bind (Harvard Business School Press, Boston)]. A core precept of ISCT - that consent to membership in an organization entails obligations to follow the norms of that organization, subject to the moral minimums of basic (...) human rights - is a reasonable and appealing notion. One potential challenge for those attempting to apply this idea, however, lies in the dynamic nature of social norms. Organizational norms evolve, often through the conscious efforts of community members and leaders. As currently formulated, ISCT offers a framework that under-appreciates the evolving nature of moral norms. In this paper, we extend ISCT by considering the circumstances under which the terms of and parties to social contracts change. We also consider a number of principles that should be considered as the terms and parties to organizational social contracts change. (shrink)

Will stakeholder theory continue to transform how we think about business and society? On the occasion of this journal’s 60th anniversary, this review article examines the journal’s role in shaping stakeholder theory to date and suggests that it still has transformative potential. We conducted a bibliometric analysis of co-citations in the literature from 1984 to 2020. Reporting these results, we examine the field’s evolving structure. Contextualized theoretically as an accomplishment of institutional work—the creation of a meaningful and innovative field ideology—this (...) structure is remarkable for how it integrates ethical and behavioral arguments, invites engagement from adjacent domains, and arrives at important insights for business and society. Since the publication of Edmund Gettier's challenge to the traditional epistemological doctrine of knowledge as justified true belief, Roberts and Wood claim that epistemologists lapsed into despondency and are currently open to novel approaches. One such approach is virtue epistemology, which can be divided into virtues as proper functions or epistemic character traits. The authors propose a notion of regulative epistemology, as opposed to a strict analytic epistemology, based on intellectual virtues that function not as rules or even as (...) skills but as habits of the heart. To that end, they divide the task of clarifying and expounding their notion in the book's two parts.In the first part, Roberts and Wood examine various components that constitute their notion of regulative epistemology. The first are the epistemic goods or goals that drive the epistemic process. What is needed, claim Roberts and Wood, is an enriched notion of these goods rather than the restricted notion of justified true belief. Epistemic agents are more than calculating devices in that …. The non-financial effects (NFE) antitakeover amendment addresses the duties of company directors and management when faced with a possible takeover bid. The NFE amendment either permits or requires managers to consider the interests of the company's stakeholders during takeover bids. Other types of antitakeover devices have been viewed as protecting either stockholder or management interests. The NFE amendment would appear to protect a broad spectrum of interests including those of company employees, creditors, and the community in which the company operates. (...) Positive market returns to the adoption of NFE amendments provide some evidence that investors approve. The percent of both management and institutional ownership are positively related to the market reaction to the NFE amendment adoption. To the extent that institutional ownership proxies for the broad spectrum of stakeholder interest, NFE devices, unlike some other amendments that have been studied, appear to be in the interests of more than a single interest group. From the ferment of recent debates about the intellectual virtues, Roberts and Wood develop an approach they call 'regulative epistemology', exploring the connection between knowledge and intellectual virtue. In the course of their argument they analyse particular virtues of intellectual life - such as courage, generosity, and humility - in detail.

The health policy community has a growing interest in the impact of nonmedical determinants of health, such as housing, nutrition, and social supports, on both health outcomes and costs. This interest has been spurred by the Affordable Care Act’s emphasis on prevention, Robert Wood Johnson’s grant‐making focus on a Culture of Health, and an uptick of research demonstrating the potential returns to health care from investments in social services. Much of this policy‐making, grant making, and research has (...) focused on older Americans.The direct policy implications of this strategy can be elusive. It has become clear that more than medicine will be necessary to improve older Americans’ health status. Real improvement likely requires the development of additional social service offerings, including housing that is accessible to people with disabilities, Meals on Wheels‐type nutrition supports, and transportation. But who should bear the costs and control the finances associated with these programs? In this essay, I explore the question of how policy‐makers should consider financing nonmedical investments in older Americans’ health. As the reader will recognize, I stop short of arguing for what will work. Rather, I identify the strands of an emerging strategy—namely, for health care dollars to be diverted into social service programming—and offer several cautions. It may be that policy‐makers still wish to continue down this path, but my hope is that this essay will allow them to so with greater attention to the risks and unintended consequences of that strategy. This paper defends a model of the internalism requirement against Michael Smith's recent criticisms of it. On this "example model", what we have reason to do is what we would be motivated to do were we rational. After criticizing the example model, Smith argues that his "advice model", that what we have reason to do is what we would advise ourselves to do were we rational, is obviously preferable. The author argues that Smith's criticisms can quite easily be accommodated by (...) the example model. Moreover, to the extent that his model connects reasons to advice, it is not a model of the internalism requirement at all. Yet, to the extent that it connects reasons to motivation, his model collapses into the example model. The author ends by arguing that Smith's view simply proposes an unambitious conception of practical rationality, not an alternative construal of the internalism requirement. (shrink)

Examining select high points in the speculative tradition from Plato and Aristotle through the Middle Ages and German tradition to Dewey and Heidegger, _Placing Aesthetics_ seeks to locate the aesthetic concern within the larger framework of each thinker's philosophy. In Professor Robert Wood's study, aesthetics is not peripheral but rather central to the speculative tradition and to human existence as such. In Dewey's terms, aesthetics is “experience in its integrity.” Its personal ground is in “the heart,” which is (...) the dispositional ground formed by genetic, cultural, and personal historical factors by which we are spontaneously moved and, in turn, are inclined to move, both practically and theoretically, in certain directions. Kant was one of the inventors of anthropology, and his lectures on anthropology were the most popular and among the most frequently given of his lecture courses. This volume contains the first translation of selections from student transcriptions of the lectures between 1772 and 1789, prior to the published version, Anthropology from a Pragmatic Point of View, which Kant edited himself at the end of his teaching career. The two most extensive texts, Anthropology Friedländer and Anthropology Mrongovius, are presented here (...) in their entirety, along with selections from all the other lecture transcriptions published in the Academy edition, together with sizeable portions of the Menschenkunde, first published in 1831. These lectures show that Kant had a coherent and well-developed empirical theory of human nature bearing on many other aspects of his philosophy, including cognition, moral psychology, politics and philosophy of history. Much recent work on Kant's argument that the Categorical Imperative is the fundamental principle of morality has focused on the gap in that argument between the conclusion that rational agents conform to laws that apply to every rational agent, and the requirement contained in the Universal Law of Nature formula.1 While it seems plausible – even trivial– that a rational agent, insofar as she is a rational agent, conforms to whatever laws there are that are valid for all rational agents, (...) there does not appear to be any obvious route from this seemingly trivial claim to the controversial and substantive principle of acting only on maxims that one can at the same time rationally will every rational agent to act on.2 In what follows, I argue that the connection between rational agency and mere conformity to universally valid laws is not as trivial as it may seem. Many readers, I suspect, assume that Kant makes the trivial claim about rational agency because rational agency is rational, and being rational requires conforming to those laws that apply to all rational beings. For instance, this assumption is implicit in Onora O'Neill claim that "the interest of a Kantian universality test is that it aims to ground an ethical theory on notions of consistency and rationality rather than upon considerations of desire and preference."3 But, as I contend in what follows, the requirement to conform to laws valid for all rational agents is based on the fact that rational agency is, not rational, but agency. Indeed, the arguments leading to the first formulation of the Categorical Imperative rely on the idea of rational willing as a kind of causation in order to show this. And, as it turns out, the claim that the concept of causation contains the idea of conformity to universally valid laws is not a trivial claim. (shrink)

Community-based participatory research (CBPR) focuses on specific community needs, and produces results that directly address those needs. Although conducting ethical CBPR is critical to its success, few academic programs include this training in their curricula. This article describes the development and evaluation of an online training course designed to increase the use of CBPR in mental health disciplines. Developed using a participatory approach involving a community of experts, this course challenges traditional research by introducing a collaborative process meant to encourage (...) increased participation by special populations and narrow the parity gap in effective mental health treatment and services delivery. Is there any moral obligation to improve oneself, to foster and develop various capacities in oneself? From a broadly Kantian point of view, Self-Improvement defends the view that there is such an obligation and that it is an obligation that each person owes to him or herself. The defence addresses a range of arguments philosophers have mobilized against this idea, including the argument that it is impossible to owe anything to yourself, and the view that an obligation to improve onself (...) is overly 'moralistic'. Robert N. Johnson argues against Kantian universalization arguments for the duty of self-improvement, as well as arguments that bottom out in a supposed value humanity has. At the same time, he defends a position based on the notion that self- and other-respecting agents would, under the right circumstances, accept the principle of self-improvement and would leave it up to each to be the person to whom this duty is owed.
