A vast literature has developed probing the law's aversion to statistical/probability evidence in general and its rejection of naked statistical evidence in particular. This literature rests on false premises. At least so far as US law is concerned, there is no general aversion to statistical forms of proof and even naked statistics are admissible and sufficient for a verdict when the evidentiary proffer meets the normal standards of admissibility, the most important of which is reliability. The belief to the contrary (...) rests upon a series of mistakes: most importantly, mismodeling of the structure of legal systems and the nature of common law decision making. Contributing to these mistakes is the common methodology in this literature of relying on weird hypotheticals that mismodel the underlying legal relations and contain impossible epistemological demands. Collectively, these phenomena have distracted attention from issues that actually affect real legal systems. (shrink)

In The Ultimate Betrayal: Is There Happy Meat?, Bohanec (2013) proposed that farmed animals raised humanely may experience betrayal when slaughtered. I argue based on personal experience that humans often betray trust relationships with farmed animals. Using published scientific literature, I find that typical farmed animals (mammals) and farmed fishes are both cognitively capable of a rudimentary experience of betrayal. However, the manner in which fishes are typically maintained does not present opportunities for human-fish trust relationships to develop. Husserl has finally begun to be recognized as the precursor of current interest in intentionality — the first to have a general theory of the role of mental representations in the philosophy of language and mind. As the first thinker to put directedness of mental representations at the center of his philosophy, he is also beginning to emerge as the father of current research in cognitive psychology and artificial intelligence.

In this paper we examine the meaning of the idea of human rights in the works of Kant and Habermas. As a starting point of this examination we take Rorty's Oxford Amnesty Lecture of 1993. In this lecture Rorty claims, among other things, that a Kantian foundationalist approach to human rights is outmoded. It is better to neglect the question concerning our nature as human beings and substitute it for the question what we can make of ourselves. Kant's account of (...) the equal respect that is due to every person, tends to forget that outside our circle of post-Enlightenment European culture most people do not understand why rational agency is a sufficient condition for membership in a moral community. The borders of our moral community are often enough the borders of our family, group or society and do not include every human being. This restriction of the moral community poses a serious challenge to Kantian moral and political theory. On the basis of an analysis of the idea of human rights and the principle of popular sovereignty in the works of Kant and Habermas we try to show that the main claim of both authors is not so much a claim to knowledge about the nature of human beings, but a claim to the counterfactual conditions of a system of rights. As legal subjects we cannot claim a right to equal liberty for ourselves and people like us and deny it to everyone outside the borders of our moral community. As legal subjects we may no longer choose the medium or the language in which we can actualize our autonomy. Every system of rights presupposes certain counterfactual conditions, among which a right to equal liberties, and a certain performative meaning. (shrink)

This paper critically appraises the applied action-guide approach to bioethics and finds it wanting in two ways: it is tethered to a social contract view of the doctor-patient relationship that is largely incompatible with experiences of illness and care; and, as a formalist doctrine, it lacks critical edge and tends toward accommodationism. An alternative approach is recommended that involves interpreting moral experience by means once associated with the rhetorical arts — practical reasoning, hermeneutics, casuistry, and thick description.

Consider a physical system for which a mathematically rigorous geometric quantization procedure exists. Now subject the system to a finite set of irreducible first class (bosonic) constraints. It is shown that there is a mathematically rigorous BRST quantization of the constrained system whose cohomology at ghost number zero recovers the constrained quantum states. Moreover this space of constrained states has a well-defined Hilbert space structure inherited from that of the original system. Treatments of these ideas in the physics literature are (...) more general but suffer from having states with infinite or zero "norms" and thus are not admissible as states. Also BRST operators for many systems require regularization to be well-defined. In our more restricted context, we show that our treatment does not suffer from any of these difficulties. (shrink)

Alfred Betschart has claimed that the project of existential Marxism is a contradiction in terms, but this argument, even when supported by many experts and quotes from Sartre’s 1975 interview, misses the point of my Boston Review article, “The Philosophy of Our Time.” I believe the important argument today is not about whether we can prove that Sartre ever became a full-fledged Marxist, but rather about the political and philosophical possibility, and importance today, of existentialist Marxism.

Physical objects are located in "one public all-embracing physical space", while "our sense-data are situated in our private spaces, either the space of sight or the space of touch or such vaguer spaces as other senses may give us".6 Through experience, we are able to correlate these various private sense-data spaces (i.e., in so far as we can correlate experiences in one with experiences in another). What Russell does not go on to do here is define physical space in terms of private spaces. Given that (a) Space is relational rather than absolute, and (b) All that we can know about physical objects is that both they and their relations "correspond" to our sense-data and their relations, then (c) "we may assume that there is a physical space in which physical objects have spatial relations corresponding to those which the corresponding sense-data have in our private spaces".7 Our knowledge of physical space is then merely knowledge of relative position, and other features, e.g., shape, are "only supposed to correspond to the physical space so far as is required for the preservation of the order".8 On this view, the existence ofa physical space is necessitated solely by, and so is no more plausible than, the need for physcial objects. Russell's argument for accepting our "instinctive" belief that physical objects exist is less than compelling. Since this belief does not lead to any difficulties, but on the contrary tends to simplify and systemize our account of our experiences, there seems no good reason for rejecting it.9 In what follows, ~e shall see that Russell's phenomenalism is not explainable as differing from the realism found in The Problems of Philosophy merely in the rejection of this "instinctive" belief. Bornstein has proposed a manuscript submission process based on an adversary legal model, with the manuscript, like a criminal defendant, being presumed innocent unless and until proven guilty by the referees, who act as "prosecutors." The author would be provided with an opportunity for rebuttal, and the associate editor would serve as the trial judge, deciding whether the piece should ultimately be published. The editor-in-chief would hear appeals from decisions made by the associate editor. While there is much to be (...) said about this adversary approach, this paper points out certain problems in using the criminal case as a model. The most significant problem is that the burden of proof is not properly allocated. A better model would be that of the civil law suit, where the plaintiff carries the burden of proof to establish the strength of the claim . This paper also suggests certain modifications to Bornstein's proposal, such as publication of the referees' comments and the author's rebuttal. Although Bornstein's proposal, as modified herein, would not solve all of the problems Bornstein has identified with the current submission process, this paper concludes that the new procedure would do much to advance the science.
